Extell plans 55-story hotel condo project on West 45th Street

The Extell Development Company is planning to erect a 55-story hotel and hotel/condo tower at 135 West 45th Street utilizing air rights transfers from three nearby legitimate theaters.

It presented its massing studies, prepared by H. Thomas O'Hara, to the zoning committee of Community Board 5 last night.

Paul D. Selver of the law firm of Kramer Levin Naftalis & Frankel LLP, which represents Extell, told the committee that the new mid-block building between the Avenue of the Americas and Seventh Avenue would contain 242 hotel rooms and 171 hotel condos. He said that the hotel would be operated by the Intercontinental.

Extell has acquired the air rights for an undisclosed amount and is seeking a certificate of appropriateness from the City Planning Commission. Under the terms of the certificate, the owners of the theaters agree to deed restrictions that limit their properties' use to legitimate theater, and agree to a maintenance program for their preservation and agree to contribute $14.91 per square foot of transferred air rights to the Special Theater Subdistrict Fund.

The committee voted 8 to 2 in favor of supporting the granting of the certificate, but several members expressed outrage that the city has not yet created the Theater Subdistrict Council, which would administer the fund.

On March 12, David Karnovsky, counsel of the Department of City Planning, wrote a letter to the chairman of Community Boards 4 and 5 in which he said that his office "is working to establish the TSC consistent with the requirements of the Zoning Resolution," adding that "While the formation of the TSC has proved to be more complex than originally anticipated, we anticipate being able to convene an organizational meeting in the early spring."

The planned tower would rise from a 9,500 square foot mid-block plot. The tower would receive 8,500 square feet of air rights from the Hirschfeld Theater, 9,500 from the St. James Theater and 54,820 square feet from the Broadhurst Theater.

The transfers would essentially reduce the available transferable air rights of the Hirschfeld and St. James theaters to nothing but the Broadhurst would still have about 31,000 square feet available, Mr. Selver said.

Joyce Matz, a member of the committee, opposed the granting of a certificate because she felt that the public benefit was insufficient especially since Mr. Selver said that all three theaters are in very good condition. The developer's contribution to the fund is estimated to be about $1.1 million.

Meile Rockefeller, co-chair of the committee said she was not happy with the fact that the planned building would be as tall as buildings on avenues even though it is a mid-block property.

According to a recent article in the NY TImes, NY's hotel market is picking up a lot of steam. Therefore, the demand exists for this hotel. Presumably, funding will be available in 2011.

Extell President Gary Barnett and a rendering of the hotel from 2007Extell Development's 50-story hotel project at 131-139 West 45th Street will go ahead despite the company having sold off 11 commercial property lots in Midtown for approximately $125.16 million, including the hotel site, Extell President Gary Barnett told The Real Deal.

According to documents filed with the city on Monday, the buyer in the bulk property sale, which includes lots on 45th and 46th streets, is HHC TS REIT LLC. Barnett confirmed that the properties had been sold, but said that the transaction was primarily a strategy to get an equity partner involved with the hotel project. He would not confirm the identity of the buyer.

The 50-story condominium and hotel project will proceed, he said. The building, between Sixth and Seventh avenues, is slated to have 242 hotel rooms and 171 hotel-condos, according to the original plans presented to a community board in 2007.

Extell bought up scads of Theater District transferable air rights -- 9,500 from the St. James Theater at 222 West 45th Street and 54,820 square feet from the Broadhurst Theater at 235 West 44th Street -- for the project in the mid-2000s. All told, the site can support a building of 270,000 square feet.



50 stories? Or 54-55 stories? This one may need some detective work...

I hope it is built. It is a good building for this site, which in my opinion is small, and situated in a narrow street.

Just wish that its height is maintained at 183 meters.

"Another shining tower is on the way to its Broadway debut.

Ending years of speculation, Extell Development Co. has begun building a major new Midtown hotel that some had predicted might never rise.

The long-in-coming, 53-story project at 135 W. 45th St. will be the Hyatt Times Square, Extell President Gary Barnett said.

The midblock site between Sixth Avenue and Times Square had sat dormant after Extell assembled the land and air rights and poured a foundation. But the arrival of a tower crane this month clearly indicated things were looking up.
“We’re moving forward rapidly,” Barnett told us.

Contrary to previous reports of a condo-hotel, the project will be all hotel, with a high-end ground-floor restaurant, a luxury spa and a rooftop bar.
Barnett estimated the construction cost as above $300 million. He declined to identify a partner Extell recently took on when it “sold” a group of Midtown sites, including the one for the Hyatt.

By forging savvy alliances, Extell has become the city’s most prolific developer at a time when many others continue to seek equity partners or await anchor tenants. Barnett’s firm is also building the Park Hyatt on West 57th Street and the International Gem Tower on West 47th.

Things bogged down at several other sites, however, and the future of 135 W. 45th St. remained unclear -- especially after the note recently went on the market.

Since then, however, Extell essentially bought back its own debt, sources said. According to public records, the company last month “sold” the site, among others, to an entity called HHC TS.

Barnett wouldn’t comment on the project’s ownership structure except to say, “We’re very well capitalized.”

He said the hotel will enjoy a privileged site “near Times Square, but on the East Side of it,” unlike others along Eighth Avenue and farther west."

Took this a couple hours ago, sorry for the bad quality took it from my bike. It's moving along pretty well, and is a perfect filler. The design is pretty plain, but it'll get lost in the mass of Midtown.

Look straight up mate ! New York is Skyscraper City ! Get used to it......or go and spend some time in Oklahoma ? Not that there is anything wrong with Oklahoma, but I heard the wind sweeps down the plains there so guess it has lots of sky ? :nuts:

Boring tower from a design standpoint, but i'm sure it serves its purpose well as a decent hotel in a fun location and will prove profitable for the backers of this project. On the other hand, the blank concrete wall is disgustingly pitiful. I mean, come on! At least put an interesting sign or something on it. It is after all, Times Square, the center of the western world for illuminated ads, isn't it?

The blank walls and the glass cladding really detract from this tower. It's a nice overall shape, but looks like someone blew a good opportunity.

I have to agree with every bit of this. Hopefully they'll build large towers next to in in the near future.
