Lawyer: Gonzaga clan's claim a dead case

| More |

Friday, September 9, 2011

PROVINCIAL legal officer lawyer Jose Maria Valencia said the case filed by the Gonzaga heirs who claim ownership over a portion of the 7.7-hectare Capitol property is a dead case.

The case has been dismissed by the Supreme Court but was re-filed with the Regional Trial Court (RTC) here.

Valencia issued this statement after the heirs of the Gonzaga clan have surfaced yesterday to claim ownership of the 6,900-square-meter property as part of the 7.7-hectare property being sold by the Provincial Government to Ayala Land, Inc.

They were Risa Schlosser and Tranquilino Monton, great grandchildren of the original property owner. Urs Schosser, a Swiss national, husband of Rita, and their lawyers held a press conference to clarify this ownership.

However, Valencia pointed out that it is practically the same case that was filed before by supposed Gonzaga heirs as the documents as well as pieces of evidence presented are the same.

“It has been dismissed by the Supreme Court and we even have a certificate of finality,” he said.

Valencia added that with the case being resurrected over and over again by supposed heirs of the Gonzagas, the Capitol is contemplating the filing of countercharges for damages.

He said that with the refilling of the case with the RTC here, the Provincial Government has filed a motion to dismiss on the ground of res judicata because the case has already been resolved a long time ago and one cannot just re-file the same case.

However, he said the complainants filed a motion for the inhibition of Judge Pepito Gellada of Branch 47 of the RTC.

Valencia also said that interested investors for the property had been duly informed of the said cases and the decision of the Supreme Court.

He added that the irony is that when the property was occupied by the squatters, there seem to be nobody interested in it. Now that a big investor has signified interest, a lot of people are putting claim on the property.

He said that he even received letters until now coming from those who also claim ownership on Capitol properties. (Teresa Ellera-Dulla)

Guys.. good am...

Just concerned lang.. anyway I am for Province and Ayala deals, and I believe that the majority of the province speaks itself.. this SM and Gonzaga's are for their own interest.. If you are The Supreme Court, who would you listen? the betterment of the Majority as a whole? or the interest of individual? syempre... the people of the province diba?:bash::bash:

By the way The gonzaga's are inconsistent and not credible, in fact their lots being occupied by the government Center which they donate do not have Original Deed Of Sale..and many pending cases filed against the Gonzaga's.. their lots that they claimed had no Documents to prove..so the Governor has nothing to worry.. we in Bacolod and the entire Neg. Occ. is supporting the Province -Ayala Deal.. Go.go.go..:banana::banana:

I thought na dismiss na ni sang SC ang ila nga kaso dugay na...

If there's a truth to the Gonzagas Claim, that they owned the Provincial Lot, then may I ask the Gonzaga's ( Did you pay a yearly land tax on the lot area that you claimed is yours?) If they were not able to pay a yearly land tax to the City, then what is their basis for claiming the Land??:bash: May receipt kamo ipakita na nagbayad kamo land tax sa city? diin?, If no then basi ang Land Tax nyo na balayran sa gobyerno including the interest, Daku pa sa bili sang duta...he.he.... common sense lang...basi tanan nga makita nga duta sang Gonzaga ila na dayon....:bash::bash::bash::bash:

I thought na dismiss na ni sang SC ang ila nga kaso dugay na...

I think what he meant is, putting yourself on SC shoes then, how would you judge? for the foolish few, or for the welfare of the general public?

Moving forward..

I think it is not about it. The law always rule to the right. "Dura Lex Sed Lex". Considering the facts and not the Faux Pas. If SM felt fooled, well foolish is the blabber mouth fish, which bites any bait it comes across.

I would agree on One radiations post, about sustainability. However I don't believe he understand it quite clearly. His idea of sustainability is on how to sustain SM's appetite to monopolize the Local Market/s. Well it is all written in his posts. Anyone who passes kindergarten can draw his cheap art.

Lets put it this way, 6.5 Billion Pesos, is far better than 2 Billion. Developing a lot of area, is better than developing a small portion.

Given that SM Promised to build the Boutique Hotel by then of 2009 and it is already 2011 still NO HOTEL, is one way to say, "they do not have a word of honor". That way too cheap. Way cheaper than 5 centavo.

There is too much to weight and too much to brunt, especially the experience of Negros with SM. a Few Savemore cannot compensate that, they are built because SM saw an opportunity to expand and SUSTAIN their corporate propaganda.

"Building its Presence/ Establishing it Position" in any Market, is just the same as showing Monopoly, minus the negative impact of the word Monopoly itself. One would argue, when did that happen, they are totally different in "SPELLING"?! The Counter argument would be, "YEAH RIGHT, as if it is the first time you speak English..."

He said that he even received letters until now coming from those who also claim ownership on Capitol properties. (Teresa Ellera-Dulla)

By the way, malain ko nay.

Saw an AC unit of Road Star bus this morning parked at the south terminal. Route: Bacolod - Ma-ao. Big bus sya like buses of Ceres. Are they ready to go head to head with the Vallacar Transit? They also have new units actually. Jeep Star is also plying that route.

Hahaha! Thanks! I used to work sa CVG Bacolod and they were starting the construction before I transferred here sa Makati. I have seen the plan about the Sanparq 3 Tower sa likod ka Sanparq 1. It's way higher than the second tower currently being constructed. I heard it would be a mixed used, residential and office building.. Hope madayon after they finish the Sanparq 2.
The 4 buildings there (including ang 2 na existing na and 1 under construction) are set to be completed within 5 yrs.. so probably, after they're finish sa sanparq2. Ma start na sila sa higher tower sa likod tapos malapos na da ang way sa Bacolod Central Business park sa likod rob!

The GONZAGA -VILLADELGADO FAMILY ang naga claim sa part sang Capitol Property (ang Pala-Pala area) is not the GONZAGA FAMILY that owns Villa Angela and the Government Center property but yes, they are both related.

Sa pagkabalo ko mga GONZAGA-VILLADELGADO man gid na da ang property as to its ancestry but why have they waited this long to claim?...tani sang pagpanghawan pa lang da sang Capitol sa punta kapre in 2006-2007 gin claim na ina nila.

Mga migs.....may ara nagligad nag PM sa akon and the forumer said nga he/she is a member of the GONZAGA Family that is claiming that lot nga gin pa lease sang Capitol sa Ayala.

The GONZAGA -VILLADELGADO FAMILY ang naga claim sa part sang Capitol Property (ang Pala-Pala area) is not the GONZAGA FAMILY that owns Villa Angela and the Government Center property but yes, they are both related.

Sa pagkabalo ko mga GONZAGA-VILLADELGADO man gid na da ang property as to its ancestry but why have they waited this long to claim?...tani sang pagpanghawan pa lang da sang Capitol sa punta kapre in 2006-2007 gin claim na ina nila.

malay nyo...basi may isa sa miyembro sang pamilya nila ang nag secret deal sa Capitol or namiyerde sa casino kag binaligya ang duta sa iban... :D :D

@doc, i heard gina sa tv patrol that the issue of ownership has a long history of legal battle between the provincial gov't and the gonzaga family. it already had the finality on the case in favor of the prov'l gov't. maybe it's a last ditch effort by the gonzaga family before the transaction with ALI is consummated. in other words, basi pa lang makalusot:)

post ko lang mga migs, at last ma open na gid man ang bagsakan terminal...

Northbound terminal
set to open Sunday

The Northbound terminal is scheduled to start operations on Sunday along with the terminal of the Vallacar Transit at Bangga Pepsi in Barangay Bata, Bacolod City, Councilor Dindo Ramos said yesterday.

Ramos, chairman of the Sangguniang Panlungsod Committee on Transportation and Traffic Management, said the SP has adopted his recommendation in his committee report Wednesday on the implementation of City Ordinance 480, Series of 2009, establishing the new northbound terminal.

He said the operation of the terminal will go through an experimental period of 45 days, after it will be evaluated by the Bacolod Traffic Authority Council to see if there is a need to amend the ordinance to accommodate the requests of some sectors for exemption.

Ramos said they have already informed all public utility vehicles and buses concerning the operation of the Northbound terminal.

His report states that a committee consultation was held Monday involving the different stakeholders who were asked to comment on the opening of the Northbound terminal on Sunday that was proposed by Chief Inspector Luisito Acebuche of the Bacolod Traffic Authority Office, to ensure that the terminal will open smoothly.

The U-turn slot, which is presently undergoing construction, will be ready for use by PUJ’s to load and unload passengers at the terminal by that time.

During the consultation, Joseph Oyco, representing Vallacar Transit, also agreed and expressed the readiness of the company on the agreed date for opening the terminal.

Crispin Chua, operator of the Northbound terminal, indicated that it will be ready by Sunday and that he will provide a specific area within the terminal as drop-off point for all vehicles.

It was discussed during the committee hearing that all Talisay and Silay public utility vehicles and shuttle buses plying the airport route will be allowed to enter only up to the north terminal. The affected PUJ’s will then be rerouted accordingly to service all passengers dropping off at the north terminal.

The boat service vehicles of Banago routes will be allowed to drop off passengers at the terminal and Bangga Pepsi, while the Mandalagan route will be expanded to service passengers from the north terminal, if the PUJ’s servicing them will no longer be allowed to enter Lacson Street.

The BTAO has also been instructed to apprehend tricycles and trisikads on the fly-over since the law prohibits them from using national roads.

The routes that will be modified to serve passengers coming from and going to the Northbound terminal are all units of Bata-Libertad, Mandalagan-Libertad, and Bangga Pepsi-NGC, and selected units of Banago-Libertad, including 100-150 units of Shopping-Libertad.

Ramos said transport groups will be tasked to issue 100-150 stickers to Shopping-Libertad PUJ’s to service passengers up to the terminal. These selected PUJ’s will only service passengers from the terminal up to Shopping and West Negros University, he said.

He also said the terminal will operate under the standards set by the Land Transportation Franchising and Regulatory Board and within the area identified under the ordinance.

Ramos also said extension of routes, and new routes to be implemented, will be relayed to the LTFRB for its information, and, if feasible, the affected franchises will be amended to conform with the actual routes that they serve.*CGS

Hmmmm...in this adjustment period I am hoping that the Talisay Jeepneys will be granted exclusion but the route will be revised....from Talisay they will take their usual route until West Negros Univ than back but will go straight to San Juan (bangga stop) and all the way to Banago, then out to Bangga Pepsi

Iliranan ES and Julio Ledesma HS finalists for the 2011 National Search for Sustainable and Eco-Friendly Schools

MANILA, Philippines - A total of 45 public and private schools have entered the finals of the 2011 National Search for Sustainable and Eco-Friendly Schools, organized by the Department of Environment and Natural Resources – Environmental Management Bureau (DENR-EMB), Department of Education (DepEd), Commission on Higher Education (CHED) and Smart Communications, Inc. (Smart).

Fourteen elementary schools, 16 high schools and 15 colleges made it through the regional eliminations and will now compete in their respective categories at the national Level. Winners will be announced during the exhibition-cum-awarding ceremony that will be held on November 16, 2011 as part of the National Environmental Awareness Month.

Environment and Natural Resources Secretary Ramon J. P. Paje said the schools’ response to the call for entries was “overwhelming”. Now on its second run, the nationwide competition aims to recognize educational institutions from the elementary, high school and tertiary levels with the best sustainable and environment-friendly programs and activities.

“We were amazed by their creativity and their commitment in implementing eco-friendly practices,” he said.

“We need to start teaching our kids as early as we can to take responsibility in safeguarding our environment. Schools are dynamic focal points of learning and powerful vehicles of change. Parents and teachers can work together to spread the wonders of living an environmentally-smart lifestyle,” he added.

Smart joins the activity for the second year as part of its corporate social responsibility and community service program Kabalikat.

“Smart has been taking measures to practice environmental sustainability in our day-to-day operations and promote ecological awareness and preservation to our publics. We encourage the youth to do the same and we know we can do this by working through their schools,” said Ramon Isberto, Smart Public Affairs Head.

“We are hoping that this search will inspire more schools to go green and will influence participants to adopt an environmentally-friendly lifestyle from what they learned from this program,” he added.

Court of Appeals lifts TRO on Capitol property conflict
BY CARLA GOMEZ

CEBU CITY – The Twentieth Division of the Court of Appeals here has lifted the 60-day temporary restraining order it had issued against Gov. Alfredo Marañon Jr. and other Negros Occidental officials in connection with the sale and lease of its 7.7-hectare prime property in Bacolod City to Ayala Land Inc.

The TRO had been granted to SM Prime Holdings Inc. that had opposed the awarding of the negotiated sale and lease of Ayala, claiming it was the winning bidder to the property.

SMPHI had refused to join the negotiated bidding saying it had entered a higher bid than Ayala in a second bidding held on July 7, and sought the TRO to halt the negotiated sale and lease.

But the Capitol had declared the second bidding a failure, saying both SMPHI and Ayala had failed to meet the floor price for the property approved by the Commission on Audit.

The 60-day TRO was expected to end on Oct. 4.

However, the CA, in an order promulgated on Sept. 6 lifted the TRO, which is believed to pave the way for the Capitol to proceed with the sale and lease of its property.

The dispositive portion of the Sept. 6 CA order denied SMPHI's prayer for preliminary injunction, and lifted the TRO it issued on July 27.

It also directed SMPHI and the provincial government officials to submit their respective memoranda within 15 days after which it will be deemed submitted for decision.

The decision was penned by Associate Justice Victoria Isabel Paredes and concurred in by Associate Justices Edgardo de Los Santos and Ramon Paul Hernando.*CPG

Koko to back redistricting of Bacolod
BY CHRYSEE SAMILLANO

Senator Aquilino “Koko” Pimentel III yesterday said he will support the bill re-apportioning Bacolod City into two districts as long as the city complies with the requirements provided by the Constitution.

Senator Ferdinand Marcos Jr., chairman of the Committee on Local Government, will schedule the first committee hearing on the proposed Bill in November.

Bacolod Rep. Anthony Golez Jr. said they have been lobbying with the senators to support the bill and that he mentioned the matter to Pimentel yesterday. Pimentel told him that if it will hasten the development of the city, he will support it, he said.

Pimentel together with Bacolod Mayor Evelio Leonardia were invited by Golez for his birthday celebration at lunchtime yesterday in Bacolod City.

Golez said that after the first committee hearing, another hearing may be conducted before the Bill will be taken up for second reading and then at the plenary.

He said he is confident that very soon the Bill will be realized since it has the support of senators from the Visayas like Senator Franklin Drilon.

Leonardia said he is also expects Pimentel to support anything that he believes is good for Bacolod City.

He said they discussed it when Pimentel paid a call on him yesterday at the Bacolod City Government Center.

A study team had recommended that Bacolod be divided into Bacolod North District and Bacolod South District.

The Bacolod North District will be composed of Barangays 1-12, 17-31, 41, Alangilan, Banago, Bata, Estefania, Granada, Mandalagan, Montevista, Villamonte and Vista Alegre which has a total population of 238,107, based on the National Statistics Office census of 2007.

The Bacolod South District will be composed of Barangays 13-16, 32-40, Alijis, Cabug, Felisa, Handumanan, Mansilingan, Pahanocoy, Punta-Taytay, Singcang, Sum-ag, Taculing and Tangub which have a total population of 261,390, as of 2007.

Meanwhile, Golez said Pimentel consulted him yesterday on the Reproductive Health Bill. “Since he is a lawyer and I am a doctor, Pimentel asked me of my standpoint on the matter and what issues I raised when I debated in Congress,” he said.

Pimentel, who was accompanied by his wife, Jewel Mae Lobaton, a Bacoleña, was in Bacolod City yesterday for the Sum-ag National High School PTA assembly and mass induction.*CGS

Pancake House finalizes purchase of Yellow Cab

RESTAURANT OPERATOR Pancake House, Inc. sealed on Friday its deal to take over pizza chain Yellow Cab Food Corp. for P800 million, a disclosure filed with the local bourse showed.
The firm behind Pancake House outlets as well as Dencio’s Bar and Grill and Teriyaki Boy, among others, closed the agreement to wholly acquire Yellow Cab using a loan from Metropolitan Bank and Trust Co. and its affiliates.

Yellow Cab’s principal officers and directors resigned in line with the takeover, the disclosure read. Pancake House Chairman Martin P. Lorenzo assumed the post of the pizza chain’s chairman and president.

Mr. Lorenzo had cited Yellow Cab’s brand strength and good fiscal discipline as top reasons for the purchase.

Yellow Cab’s simple look is easily recognizable and appeals to a broad range of consumer aspirational values, he had said, while maintaining a virtually debt-free status within a decade of operation.

Yellow Cab’s new owners plans to have 40% of its outlets located outside the capital within the next three to five years, earlier reports show.

Possible locations for new Yellow Cab stores include Baguio, La Union, Subic, Pangasinan and Cavite.

The cities of Cebu and Bacolod in Visayas are also being considered because of the locations’ strong economic growth and urban development.

Pancake House’s stock price closed at P11 apiece on Friday, unchanged from the previous day. -- CHCV

Volvo distributor aims to buck car industry downtrend

THE LOCAL distributor of Volvo cars expects to buck the downtrend in the automotive industry this year, banking on new markets outside Luzon and product launches to boost sales.
Viking Cars, Inc. is looking to hike sales by 14% this year against 2010 levels even as the rest of the industry already averaged a 4% drop as of August.

“We’re aiming to sell 260 vehicles by this year, compared to 228 sold last year,” Roselyn M. Dimalanta, first executive vice-president of Viking Cars, told BusinessWorld in an interview late on Wednesday.

So far, the firm has sold 155 units from January to August, Froilan Valencia, Viking Cars sales manager, said.

The firm has expansion plans that will see the local luxury dealer, which accounts for 10% of the Volvo market in Asia, establishing “boutique showrooms” in Bacolod City, Davao City, and Iloilo City, the officials said.

Viking Cars currently has one showroom in Makati City and another in Cebu City.

The firm is also looking to boost sales by offering its first sedan model fitted with a diesel engine, Mr. Valencia said.

“There is really a clamor for diesel engines,” said Mr. Valencia. “But our diesel engine, contrary to public perception, will be quieter thanks to evolving technology,” he said, adding that Viking Cars has been undertaking research in diesel engines since 2006, and Volvo’s background in producing diesel truck engines.

Viking Cars is also looking to lure more buyers by offering a five-year warranty program which it claims to cover a longer period than that offered by its rivals. --

MANIC MONDAY!!!! ---- my fearless forecast for tomorrow's Bacolod-bound commuters from the north :bash::bash::bash::bash::bash:

ang mahambal ko lang:

COMMUTERS: PLEASE COOPERATE. Come early para indi mag sala-sala sa North Terminal.

for those going to Shopping and BS Aquino Drive take the SHOPPING - LIBERTAD Jeepneys with sticker NORTH TERMINAL VIA BURGOS (this has taken the route of Talisay-Bacolod)

for those going downtown Bacolod, take BATA-LIBERTAD and MANDALAGAN-LIBERTAD jeepneys that were selected to have extended routes to the North Terminal

SA MGA DRIVER - abi pag disiplina. nugay hinaras-haras dira along the flyover approaches. Nugay dinalok sa pasahero.

SA BACOLOD TRAFFIC AUTHORITY - please put enough number of traffic enforcers and Barangay Tanods of Bata to help in the movement of traffic.

WE ALL KNOW THIS IS A VERY BIG ADJUSTMENT PERIOD. ANG MAHAMBAL KO LANG PLEASE COOPERATE LANG ANG TANAN PARA MAKITA TA ANG DAPAT BAG-UHON OR I-DEVELOP NGA MGA STRATEGIES TO ENSURE SMOOTH OPERATION OF THE NORTH PUBLIC AND VALLACAR TRANSPORT TERMINALS.

THIS WILL BE THE BASIS OF CHANGES OR ADJUSTMENTS OF THE TERMINAL AND RULES REGARDING THE OPERATIONS OF THESE TERMINALS. IT WOULD ALWAYS BE A ROUGH START.

CA lifts TRO on sale of prime property in Bacolod
By Carla P. Gomez
Inquirer Visayas
5:49 am | Monday, September 12th, 2011
0 shareNew 0
Bacolod City—The Court of Appeals (CA) has lifted a 60-day temporary restraining order (TRO) that may pave the way for the provincial government to proceed with the sale and lease of its 7.7-hectare of prime property here to Ayala Land Inc. (ALI).
In a decision dated Sept. 6, the CA’s 20th Division denied the petition of SM Prime Holdings Inc. (SMPHI) for a preliminary injunction and instead cut short the 60-day TRO it issued on July 27. The order was supposed to expire on Oct. 4.
The court ordered SMPHI and the provincial government officials to submit their memorandums within 15 days after which the case would be deemed submitted for decision.
SMPHI lawyer Vincent Patrick Bayhon could not be reached for comment as of press time.
SMPHI filed a petition for certiorari against the provincial government, insisting that it won the July 7 public bidding for the property. It posted a P50-million bond.
It had insisted that it “clearly submitted a bid superior to Ayala’s” and was surprised when the bidding was declared a failure.
SMPHI had proposed to purchase a portion of the province-owned property for P18,885 per square meter and to lease the remaining portion for P65 per sq. m., well within the price set by the awards committee.
Ayala, on the other hand, submitted a bid of P17,000 per sq. m. for the purchase and P50 per sq. m. for the lease.
The provincial government declared the bidding a failure after both parties’ bids came in below the floor price set by the Commission on Audit.
A negotiated bidding was held on July 15, but SMPHI representatives did not show up. The property was then awarded to ALI.
SMPHI filed petition before the regional trial court in a bid to stop the negotiated sale and lease.
Judge Estefanio S. Libutan Jr. of Bacolod RTC Branch 50 did not issue a TRO but instead asked the Capitol officials and ALI to comment on SMPHI’s petition.
But SMPHI decided to elevate its petition to the CA, which then issued a 60-day TRO on July 27. On Sept. 6, the CA ruled to lift the TRO and asked the respondents to file their memorandums.
Gov. Alfredo Marañon Jr. was happy with the court’s decision, saying the sale and lease of the province-owned property to ALI could now proceed.
“It is a vindication of our position,” he said. “We followed all legal procedures in the conduct of the bidding and SMPHI self proclaimed itself the winner.”

We'll see what comes next of this development.....Exciting week ahead:)

BACOLOD City Mayor Evelio R. Leonardia believes the implementation of City Ordinance No. 187 is the solution to the traffic congestion at Libertad Market area.

The ordinance stipulated the transfer of southbound terminal to Sambok terminal in Lopez Jaena from Daalco waiting station in Libertad.

The mayor said he will prove in court that the city is right in implementing the ordinance.

"I believe we have all the legal grounds in all the action we implemented in the terminal and waiting station. So we cannot pre-empt the courts. We will respect the proceedings and pick it up from there," he said.

THE business sector in Negros Occidental will inquire from Vice President Jejomar Binay how the province can avail itself of the public-private partnership (PPP) flagship programs of President Benigno Aquino III.

Frank Carbon, president of the Metro Bacolod Chamber of Commerce and Industry (MBCCI), said they will ask about such projects from Binay, who is set to arrive for the 20th Visayas Area Business Conference and Expo on September 15 to 17 in Bacolod City.

Carbon said they want to be clarified about the statement issued by the President during his visit in Dumaguete last week when he said that 70 percent of the infrastructure projects with allocated funds have turned out to be completed and that this made Public Works Secretary Rogelio Singson decide to review the projects to avoid double payment.

BY CARLA GOMEZ

Negros Occidental Gov. Alfredo Marañon Jr. yesterday said he is elated and very excited over the lifting of the Temporary Restraining Order on the provincial government by the Court of Appeals, saying the sale and lease of its 7.7-hectare prime property in Bacolod City to Ayala Land can now push through as planned.

"We are very happy, it is a vindication of our position," the governor said.

The Twentieth Division of the Court of Appeals in Cebu on Sept. 6 lifted the 60-day TRO it issued on Marañon and other Negros Occidental officials sought by SM Prime Holdings Inc. that had opposed the awarding of the negotiated sale and lease of Ayala, claiming to be the winning bidder to the property.

hello bacolod gud afternoon...

re: north terminal, mas maayo na lng ini ang sa bacolod, we are still lucky to have that terminal, indi mn xa world class but at least decent mn xa nga matawag, i've been to some places nga pwerti pa gid ya ka lala ang terminal nila. although if we compare it other terminals sa negros, wigit gid mn ang bacolod, bt let us set that aside for now, ang importante ma serve niya ang iya nga purpose that is to decongest bacolod,.,
