Apirak faces probe before endorsement

Electoral Commission to look at 'complaint'

MONGKOL BANGPRAPA

The Election Commission will investigate a complaint against election winner Apirak Kosayodhin before endorsing him as Bangkok governor.

Commission chairman Pol Gen Wassana Permlarp said Mr Apirak's victory cannot be confirmed until the complaint is cleared up.

"There is one complaint against the winner. We have to investigate it and come to a conclusion.We cannot disclose what the complaint is about as it is still under investigation," he said.

"We will conduct an inquiry, not make an advertisement of it. The probe will kept confidential and the result made public after the investigation is complete."

A source at the commission said it had been alleged Mr Apirak had put on a feast for his supporters.

However, an initial investigation found the Democrat candidate simply had meals with leading party members and he paid the bill. It was unlikely that he had violated the election law, the source said.

Official complaints on election fraud must be filed within three days after results are announced. If poll fraud involved the winning candidate, the commission would immediately conduct a probe.

If the allegations had grounds, the winner would be given either a red card or a yellow one and a new round of elections would be held. If the allegations against the winner were unfounded, the commission would endorse his victory.

All candidates, including red-carded Leena Jangjanya, are required to declare campaign spending within 90 days of the election results being announced, or face criminal action and lose voting rights.

A man claiming to be a graduate student at Ramkhamhaeng University yesterday lodged a complaint with the commission against five Bangkok governor candidates, including Mr Apirak, for election violations.

Singthong Buachum claimed Mr Apirak, Mana Mahasuveerachai, Pavena Hongsakula, Pol Cap Mettha Temchamnarn and Chuwit Kamolvisit had put on "boisterous" performances on candidacy registration day, July 26.

A source who monitored the campaign activities of Pol Capt Chalerm Yubamrung said the presence of Mr Singthong coincided with a plan by Pol Capt Chalerm to send someone to lodge a complaint against certain candidates for election violations. Mr Singthong denied he was sent by the veteran politician.

The EC chairman said the commission had received Mr Singthong's complaint. However, it had already given similar rulings on this case. Earlier, the commission said the behaviour of candidates' supporters on registration day was not considered a violation of election laws.

Governor candidate Chuwit Kamolvisit plans to donate six rai of land in Sukhumvit area for a public park and art complex, to show his gratitude to city people who voted for him.

The land, formerly Sukhumvit Square complex on Sukhumvit Soi 10 which was torn down early last year, had been designated for a five-star hotel.

However, Mr Chuwit, the second runner-up in Sunday's poll, said he wanted to serve city people by turning the plot into an art complex which would also include a day-care centre for orphans and a public library.

Despite being a new political face, he received more than 300,000 votes in the governor race.

Mr Chuwit plans to inject 200-300 million baht into the project, Spirit of Bangkok, that is scheduled to be completed by Sept 29 next year. The establishment will be managed by his Tontrakul Kamolvisit Foundation, he said.

"I purchased this land for 490 million baht. I would get 1.2 billion baht if I sold it, or a 700 million profit. But a man branded as a 'papa-san' wants to do something for society. I have done a lot before for public benefit," he said, referring particularly to his sponsorship of numerous police traffic control operation checkpoints which were donated by his foundation.

However, police removed signs acknowledging his sponsorship after a flare-up when Mr Chuwit revealed senior police officers took bribes from him.

Frankly speaking, I've never seen PM Thaksin gives such this large amount of his own money to the public...what a shame.

Personally, I don't like Chuwit that much and I didn't give him a vote.
But, thank you for donation that help improve our quality of life, whatever he is thinking...

well, maybe it is my foreign way of thinking, but i do not believe in this kind of "free donation". More than just a way to get more power for election next year, it must have something else. Sorry Chuwit, but i do not believe in it... Did he actually give it, or just give the right to use it? Did he made too much capital gain in selling its massage that this donation can deduct those extra-income?

yeh I hope he stick to his promise, its only words ..we can only wait and see I guess.

anyway I read in the papers that Chuwit's political party (Ton Trakul Thai aka First Thai Nation) recently merged with Chart Thai party of Banharn Silpaarcha. Apparently the FTN party members weren't too happy about the merger... since they weren't informed about it and they alredy invested lots of money to promote the party+candidates leading up to the general next election. Possible litigation coming up..so Chuwit might need some extra money!!

Just a fact for those who dont know :

This piece of land was going to have

1. Marriott Courtyard Hotel, 34 Storey
2. Holiday Inn Express, 26 Storey
3. Retail mall, 4 Storey

all contracted has been signed, and then scrapped by the developer him self to build a park of public use, Chuwit...:okay:

very good to have one park here!!! The central Bkk area does not have enough.. Emporium and Lumpini from what i know... really good also to integrate some cultural structures such as library, museum... i am sick of those shopping centers ...

It was in the paper the other day, he said it was going to open before the election in february.

Well its post election Khun Chuwit and where's the park......? And the poster has been gone for a while now as well.

I guess smashing bathtubs outside parliament helps people to forget such promises! :bash:

Where's the statue of Khun Chuwit??

The park does look a bit unexciting but then any green space is welcome and if it is to have a library even better.

I am confused by the white building? Is it a facade entrance at the front of the park?

Yes, thats the entrance to the park.

I think we should not criticize this park that much since he's ddoing this for goods, and also it's his right to do whatever he wants. Still remember, It's his private money and he also has the right not to do it., but he is doing it which should be alittle bit more appriciation he deserves.

yes WONDERFUL WONDERFUL.....we need more green in Bangkok for oxygen and beauty.....plant trees.....

I always feel bad when I see city workers cut down great trees just to make way for those ugly wires draping all over the street.....it should be the other way around---move the wires and let the trees sprout and grow!! :)

Isn't it weird how green Bangkok is from the air, but not from the ground? I figure too much of it is inaccessible to most people as it's either embassy grounds, private gardens or undeveloped land.

Absolutely, most lots of greeneries in Bangkok are in private areas such as private residences, areas and Embassies.

I also read in the papers that Governor Apirak wants to turn those privately unused land into public park. But to do that they need to raise the more taxes on undeveloped land. Otherwise people just buy up land around the city and speculate on prices like I guess what's happening now around the new airport.

Well Khun Chuwit did the right thing by donating that land.
Though the park's design is not to my liking I like the proposed fountain pool. reckon it'd be a good place to chill out :)

It is interesting that we all seem to be thinking of Khun Chuwit in such good light because he has 'donated' this land for public use. It seems that his PR strategy is working wonders even with discerning forum members.

I believe in forgiveness, redemption and that all can change but it seems strange that we all forget how Khun Chuwit amassed such huge personal wealth.

Remember that for many years he ran many large, illegal businesses (brothels). I have nothing personally against the sex industry but it is still unlawful in the Kingdom and I assume that Khun Chuwit did not ensure that all his employees had good health and pension benefits commensurate with state standards! During this time he engaged in endemic corruption by bribing public officials and more seriously police members. The amounts involved are easily said to be 10s of millions of baht.

He has not had to answer for any many offences of which he has publically admitted as he obviously has unofficial immunity from prosecution as it will implicate too many police and other public officials some of whom are undoubtedly in senior positions.

Most likely he didn't pay taxes to the public coffers on business earnings or he underdeclared. He only recently disposed of the last 4 premises only after he knew that he had been elected to parliament.

Remember he originally promised the park by Aug last year during his campaign for Governor of Bangkok. And also remember this was after 'thugs' raided establishments on the land in question and illegally destroyed private property and attacked staff/public in Feb 2003.

So like all those corrupt businessmen and politicians he has personally enriched himself by taking money away from the thai people/state. Now Khun Chuwit says he is a fighting for the poor and disadvantaged but lets see what he actually contributes first.

So perhaps his generosity and 'good heart' need to be seen in the light of the image remaking that he is trying to achieve.

Yeah the fence shares the same color (light brown + cream) of this hotel on Sukhumvit 24. I wish it complete soon. Gotta check out what's inside the park. :-D
