Deyouf Al Sebtain Hotel Apartments is a five-star hotel development which is planned to be in the holy city of Karbala in the Republic of Iraq.
Q2: Where is the location of the project?
A
It is located on plot no. (12/139) on Bab Twarig road at Bab Al Khan area, in the heart of the Iraqi city Karbala.
Q3: What is the land area and built up area?
A
Land area is 10,200 square meters. The hotel will be built on 70% of the total land area while keeping the remaining areas for landscaping.
Q4: What are the descriptions of the hotel?
A
The hotel consists of two basements + ground floor + eleven typical floors + pent house floor including facilities such as parking spots, retail shops, food courts, nurseries, meeting rooms and business centre offering all required services for the pilgrims and businessmen in addition to two Hussayneya Halls for celebrating religious events and occasions.

FAM Holding is the investor of the project who is entitled to invest in the land of the project as the contract with the land lord.
Q6: Who is the developer?
A
The developer is MADA PROPERTY DEVELOPMENT and is a member of FAM HOLDING GROUP. MADA is an integrated provider of property design and development services.
Q7: Who is the land lord?
A
The land lord is the Public Foundation of Holy Attaba Hussayneya, a religious authorization under Shia Endowments in Karbala – Iraq.
Q8: When will the project be completed?
A
The project will be completed within three years.
Q9: What is the expected date of delivery?
A
The expected delivery date is on first of Muharram of the Hijri year 1434 .

A

Q12: What is the type of the irrevocable contract between the investor and the land owner? What is its duration?
A
It is an investment irrevocable contract between the land lord and the developer through (Investment Contract) which allows the investor to set up buildings and saplings on the plot owned by the land lord and getting the profits for the period of twenty eight years.
Q13: What do we mean by "Time Share" term?
A
It is a global system for selling property units for a predefined time period and for certain duration. Time Share started in Europe and United States of America since 1973 and it means Participation in the joint-use rights. The newly created legitimate identification is associated with Temporary Use Funds.
Q14: What do we mean by "Week of the contract"?
A
It is the week of the contract between two parties which will be one of the four weeks of any of Hijri months (First, Second, Third or fourth week) till the entire contract period. It is a fixed week of a fixed Month in which the second party has the right to use the unit each year till the contract period expires.
Q15: What are the prices of the weeks?
A

Q16: What is the payment schedule?
A
The full amount of the lease is paid in four equal installments; each of them is 25% of the total amount. The first installment is due at the reservation of contract and is non-refundable if the purchaser defaults in completing the payments. The second installment is due on sixth month from the date of the reservation contract. The third installment is due after one year from the date of the reservation contract. The final installment is due on handover of the unit. All installments are subject to be deposited in the account of the developer in Standard Chartered Bank - Emirate of Dubai – UAE.
Q17: What do we mean with "Maintenance Fees"?
A
It is periodically paid annual fees by the purchaser ( of the agreement) to the lessor, calculated according to the unit area. This will be the amount spent on the maintenance of the leased premises in order to ensure that they remain valid for use in highly worthy of apartments classified as five-star for the duration of the contract and accept the change increase or decrease depending on changes in rates of Maintenance Services.
Q18: Is it permissible to contract for more than a week for the same unit?
A
Yes, by the same contractual methods mentioned above and in the same manner the customer is allowed to opt contract for more than one week throughout the contract period of twenty three years for the same unit, either contracted unit or other units, whether on the same floor or in the others.

A
Standard Chartered Bank
Q20: What is the duration of the contract with the customer on "Time Share" system?
A
The contract period of any unit of the project will be twenty-three Hijri years to start from the week due considering from the following day of the achievement date in the Hijri year of 1434 and ending the end of the week due in the Hijri year of 1457.
Q21: What do we mean with "Delegated management for investment"?
A
Is the mandate given by the contractor to the tenant gives the lessor the right in renting the unit of contracting to the others according to the prices on the market (when possible) getting 70% of the unit selling amount while the rest of the percentage value of 30% for the first party.
Q22: Is it possible to waive the unit of the contract for others?
A
The customer is allowed to waive, rent or bent the unit of the contract throughout the contract duration on parole he shall pay all due installments on the date of the waive. The customer shall complete all required procedures that allow the first party to manage the unit in full commitment to pay 4% fees for the first party. The administration fees equally between both of them.
Q23: Can the client delegate any of his family or his relatives to occupy the unit?
A
Yes, the purchaser has the right to delegate any of his family or his relatives to occupy the unit for certain outstanding duration provided that notice of the details of the lessor before the deadline at least one full month.
Q24: Shall the purchaser pay for that?
A
Not without any fees as long as the authorization to occupy their family members or relatives of close alliances.
Q25: Who manage the "(Escrow Account"?
A
En Trust & Title Company
Q26: Which company shall manage the hotel to be built?
A
Andalusia Hotels & Resorts will manage the hotel and is a subsidiary of FAM Holding.

Chounz December 19th, 2011, 04:54 PM LOL so I just googled what Islamic year we're in and apparently we're in Muharram of 1433. So basically the project is supposed to be completed in exactly one year while it takes three years to complete, but they havent even started as far as we know!
Can anyone try to find anything about it? Maybe it IS actually under construction but we just dont know about it?
