BACOLOD CITY, Philippines — Ayala Land, Inc. yesterday won over SM Prime Holdings on the "negotiated bidding" for the sale and lease of the 7.7068-hectare (77,068 square meters) prime property of the Negros Occidental provincial government in this city.

Ayala Land vice president Jose Emmanuel Jalandoni said the company offered to acquire on freehold basis 36,587 square meters of land at P20,500 per square meter and on leasehold basis 40,481 square meters of land at P73 per square meter per month for 50 years.

The provincial government had placed the floor price (appraised value) of the subject property at P19,500 per square meter. SM Prime Holdings, which was the first to submit an "unsolicited intent" to purchase or lease the said property last month, did not submit its proposal yesterday.

Governor Alfredo Maranon Jr., head of the committee on awards and disposal of properties, said, "SM Prime lost in the bidding by default. Maybe, it was not interested."

SM Prime filed Wednesday a petition for a temporary restraining order (TRO) to prevent Maranon and the awards committee from entering into a negotiated lease and sale of the property. The following day, Judge Estefanio Libutan Jr, of the Regional Trial Court-Branch 50 denied SM's petition.

"The court should not intervene in the bidding process of the provincial government for so long as it follows the legal process," said Libutan in his decision.

Following the court's ruling, the committee proceeded with its scheduled acceptance of negotiated sale and lease proposals yesterday, said the governor, adding that it was done to the best interest of the people and the province of Negros Occidental.

Maranon said the committee declared the second bidding on July 7 a failure after both SM Prime and Ayala Land submitted bids below the appraised value of the 7.7068-hectare property.

Vincent Patrick Bayhon, lawyer of SM Prime, said Thursday the firm maintained its position that it won the July 7 bidding as its bid was the superior one, contending that it was higher at P18,888 per square meter against Ayala's P17,719.50 per square meter.

"If you follow the rules, the highest should be declared the winner for the auction. We are entitled to be declared the winning bidder," Bayhon said. "There was no failure of bidding and the court will have to decide for that."

Ayala Land is planning to invest P6 billion for the "Capitol Civic Center–an integrated mixed-use civic and commercial district combining the center of government with commercial and residential uses, making it the growth center of Metro Bacolod and Negros Occidental," said Joel Luna, one of its vice president.

"The project will have a lifestyle center, encompassing retail, office and hotel, a multi-use convention and events venue, and a residential commercial zone," Luna said, adding that an additional investment of P25 million will be earmarked for the development of the Capitol Park and Lagoon.

Maranon told The FREEMAN: "This will be the biggest investment in the province so far. It will definitely change the landscape (of the province). It must conform to the culture and aesthetic beauty of the Negrosanon."

The key principles to govern the planning and development of the Capitol Civic Center will revolve around five major themes: Smart and Green, Pedestrian and Transit Orientation, Diversity of Activity, Youth and Vibrancy, and Prestige and Civic Pride.

BACOLOD City — The Ayala Land Inc. is poised to get the 7.7-hectare provincial government property offered for sale and lease after SM Prime Holdings Inc. failed to submit its bid for direct negotiation yesterday.

The Bids and Awards Committee gave SM Prime only until 11:30 a.m. yesterday.

Ayala Land Vice President Joey Jalandoni presented their technical and financial plans to Gov. Alfredo Marañon Jr. and the Committee on Awards and Disposal of Real Properties, a special body that studies offers for government properties for sale or lease.

Ayala Land plans to convert the property for commercial and residential use, focusing on redeveloping the Capitol Park and the Provincial Capitol Building.

It will use P6-billion worth of investments to build a retail area; residential, hotel and convention center; and office zones in the property.

The land developing giant vowed to make the property a signature Ayala Land project like the Bonifacio Global City, Trinoma Mall and the Asia Town IT Park.

The presentation and direct negotiation almost got stalled after SM Prime filed a petition for certiorari with a prayer for temporary restraining order (TRO) to stop Marañon from negotiating the sale and lease of the property on July 13.

During the hearing, the provincial government’s legal counsel said SM Prime is employing a “bullying and blackmailing tactic” on the governor and the committee.

But SM Prime said they are just protecting their business image and that they want to avail themselves of all available remedies in filing the civil case against the provincial government.

Regional Trial Court Branch 50 Judge Estefanio Libutan denied SM Prime’s petition. In a three-page decision, the judge said there is no valid reason for the urgent issuance of a TRO on the negotiation.

SM Prime’s legal counsel said they already won the bidding on July 7, stressing that they offered a bid to develop the property a lot better than that of Ayala Land.

However, Marañon and the special committee declared the July 7 bidding a failure because the offers of the two land developers were below the appraised value of the property.

The governor scored SM Prime for declaring that they won the bidding. He said it is the special committee that will decide which bidder wins./PN

Negros Occidental Gov. Alfredo Marañon Jr. said the Committee on Awards and Disposal of Real Properties of the province has awarded the sale and lease of 7.7 hectares of its prime properties in Bacolod City to AyalaLand, after SM Prime Holdings Inc. failed to join the announced negotiated bidding yesterday.

“This P6 billion development plan of AyalaLand for the properties adjacent to the Capitol is historic for the province and Negrenses. It will change the landscape of Bacolod City and Negros Occidental,” the governor said.

AyalaLand vice president Jose Emmanuel Jalandoni thanked the committee for its decision, saying his firm is very optimistic and excited about the project.

They will begin construction as soon as they have the final contract and aim to have some buildings up in two years, he said.

The entire development of the area is expected to be completed in five to eight, but the target is to develop the Capitol Park and build the hotel and retail areas first, Jalandoni added.

The terms and condition of the contract for lease and sale of the property will be submitted to the Commission of Audit and the Sangguniang Panlalawigan for approval, provincial government lawyer Mary Ann Manayon said.

AyalaLand entered a bid of P20,500 per square meter for 36,587 square meters up for sale for a total of P749,951,500, inclusive of P25 million for the development of the Capitol Park for the provincial government.

It also entered a lease bid of P73 per square meter a month for 40,481 square meters or P2,914,632 a month escalating by 10 percent every five years over a 50-year lease period.

Lease payment will be subject to a two-year grace period for construction from the time of turnover and acceptance of the property.

AyalaLand vice president Joel Luna, who presented his firm’s plan for the 7.7 hectares, said they are proposing the development of an integrated mixed-use civic and commercial district that will combine the center of government with commercial and residential uses, making it the growth center of Metro Bacolod and Negros Occidental.

It will be known as the Capitol Civic Center – a one-of-a-kind convergence of business, community and governance, he said, noting that they believe Negros Occidental is rapidly becoming one of the fastest growing regions in the Visayas.

AyalaLand will invest P6 billion for the development of a lifestyle center for shopping, entertainment and dining, a hotel to attract business tourism, Business Process Outsourcing offices, a multi-purpose events and convention center, residential and commercial zones with high-rise towers in the midst of private gardens, and a redeveloped Capitol Park as the focal point of the project, he said.

The centerpiece of its development plan will be the Provincial Capitol Building and Capitol Park, Luna stressed.

“We see the Capitol Park as a symbolic open space just like what Washington Mall is to Washington DC,” he added.

The development will respect the site’s heritage and history as well as its context as a seat of government and symbolic heart of the province, he added.

In order to allow a fully integrated development, AyalaLand also proposed to undertake the planning for the development of the adjacent landholdings of the provincial government.

The plan allows for the seamless connection of the Capitol Park and Parks and Wildlife area into a larger and continuous landscaped experience, Luna also said.

ON SHOEMART

SMPHI Wednesday filed a civil case for certiorari with application for temporary restraining order and or preliminary injunction against the governor and the members of the Committee on Awards and Disposal of Real Properties.

But Bacolod Regional Trial Court Judge Estefanio Libutan Jr. Thursday denied the petition of SMPHI for a temporary restraining order to prevent the governor from entering into a negotiated lease and sale of the 7.7 hectares yesterday.

SMPHI told the court it already has a vested right as winning bidder since it offered a higher bid than AyalaLand during a second public bidding on July 7.

Considering that Ayala Land and SMPHI both offered bids below the floor price the court was told that the committee was constrained to declare the July 7 bidding a failure and opt for the negotiated sale and lease that was open to both parties yesterday.

Courts will not interfere with the government in its exercise of its discretion in the acceptance or rejection of bids, unless it has been shown that it gravely abuses or exceeds its jurisdiction, the judge said in his ruling.

The judge has set the hearing for SMPHI’s application for a writ of preliminary injunction on July 21.

SMPHI, as of press time, had no comment on the committee’s decision to award the sale and lease of the Capitol property of AyalaLand.

Maybe SM is not interested because it did not submit a proposal yesterday, the governor said.

“They lost by default,” he said.

If SM questions the committee’s decision in court, it is up to SM. In a democratic country, it is their right to go to court, Marañon added.*CPG

^^that's right. its a blessing in disguise that this capitol property came in late kay basi they could have incorporated the nortpoint plan with this and left northpoint purely residential. that's just a speculation lang a. btw, i hope pala-pala would be redeveloped also along with this to make it more presentable amd tourist friendly.:)

^^actually one of the forumers who has an insider that a kukun would be a possibility because its ayala's signature boutique hotel of chains similar to the ones of Robinson's Go hotel.

^^hopefully they'll start construction within 6 months after the signing of the deed, as it was mentioned the retail and hotel and even the convention center will be built first so completion might be 2 - 3 years and the high rise residential condos will follow.

I'm so glad Ayala pulled it through and I'm more glad that the Wildlife Park and the Lagoon Park was not spared sa development kon SM ang nagdaug I dont think that it was included in thier proposal.

Its time naman to focus sa ini nga area kay they badly needed sang rehabilitation..but I always dreaming na tani ang lagoon may ara version sang dancing fountain like in Luneta Park. Hay, Ayala ayala ayala!

Yup, I think the convention center would be the first to be built as what the province wants us to have like the CICC of Cebu which spurs a lot of new business developments like hotels, resorts, restaurants etc.....:cheers1:...

^^I hope that in the future there would be more hotel resorts in the city because it will really help attract more tourist, we don't have a white sand beach to show off to. so, an inland resort would be the best option just the likes of forest park, Caribbean, palmas. a hotel resort with a beach pool, wave pool, water slides, aquarium would be really nice.

it seems looks more than 25 stories...i want to see your source either articles or a larger size and a nearer views pics of the buildings rendering...:lol: hopefully there is more of changes for additional heights or floors and hopefully initial preliminary concepts palang 'to...bigger and better looks is all i want to see and to be happened...

I think SM is simply stopping the entry of ayala in bacolod so that they will have no competition.... self serving and stunting infrastructure development for bacolod city and Negros as well.....:ohno:

I think SM has a bigger land in the reclamation area compared to the 7 hectares in the capitol area. If they are really interested in investing in bacolod they should have developed the area around their mall. I also think that if they won in the bidding they will still not develop the area or worst even the Negros wildlife reserve near lagoon will be destroyed or demolished....:ohno:

‘Ayala venture to shift
economic landscape’

The infusion of P6 billion worth of investment by AyalaLand to develop the 7.7 –hectare prime property of the provincial government in Bacolod City, is expected by the Metro Bacolod Chamber of Commerce and Industry to change the economic landscape of the province, Frank Carbon, its president, said.

If the prime property is developed into a first class mixed-use facility, it will connect to the continued development of the Bacolod Real Estate Development Corporation, and will provide employment opportunities to about 1,500 Negrenses, Carbon said.

MBCCI was among the business groups in Negros Occidental that issued a statement of support to Governor Alfredo Marañon Jr. for deciding to sell and lease the 7.7-hectare property of the provincial government to AyalaLand.

The Court of Appeals earlier issued a 60-day temporary restraining order enjoining the provincial government from proceeding with the sale and lease of the 7.7-hectare property in Bacolod City.

The TRO was issued by the CA in response to a petition filed by the SM Prime Holdings Inc. that insists it won the July 7 public bidding for the property to be awarded to AyalaLand.

Carbon also lauded Marañon for seeing the long term benefit of his move to sell the property, which he said will also boost his food security programs and tourism industry of the province.* GPB

It is easier that way... they don't need to develop reclamation because there is no competition.... there is no need to invest 2.5B when you can just appeal to the supreme court and it would take at least 10 yrs for the courts to decide...delaying tactic nga...

^^ I think it would be favorable to SM but it would not be good for the city and negros as a whole... the property would be vacant for a long time and income for the province and its people would be put to a halt... imagine the jobs that could be generated by the project from construction which would benefit the laborers to the finished civic center which could mean more jobs for negrenses....:ohno:

It is better for S.M na i improve nila or i expand ang mall nila sa reclamation....sayang naman ang vacant na parking area nila if hindi nila ito i improve.

i guess, the sm plan to capitol lots is just only a monopolism to stop the entering of ayala mall in bacolod...akala nila sila lang ang nagmamay-ari ng bacolod...mas nauna nga ang ayala by their residential estates in talisay city and they are now developing the area into a masterplanned mix-used estate...

Negros gov’t insists on deal with ALI, says offer was bigger

BACOLOD CITY -- Negros Occidental provincial officials said Ayala Land, Inc. (ALI) offered a higher bid and proposed a bigger investment than rival SM Prime Holdings, Inc. for a government property here.
With this comment, the provincial officials asked the Court of Appeals to lift the 60-day temporary restraining order (TRO) issued against the sale and lease of a 7.7-hectare Capitol property to Ayala Land and deny SM’s petition for a preliminary injunction.

In their joint comment filed on Friday, the officials said the provincial government stands to receive almost P3.576 billion from Ayala Land. A deal with SM Prime, on the other hand, will generate only P3.112 billion.

“The latter’s offer is lower by more than P392.459 million which spells a big difference to the province as this could be translated into more development projects for the countryside,” they stated.

The proposed investment of Ayala Land in the property was around P6 billion while SM Prime’s was only around P2.5 billion.

“Definitely, Ayala’s proposal is more advantageous to the provincial government. Indeed, the declaration of failure of second bidding paved the way for the negotiation process, which made possible the submission of a much better offer for the province that will inure to the benefit of the public,” they added.

The provincial legal office filed the comment on behalf of Governor Alfredo G. Marañon, Jr., the members of the committee on awards and real properties, and the Provincial Board.

Ayala Land and SM Prime officials could not be immediately reached to comment.

Assistant Provincial Legal Officer Mary Ann Manayon-Lamis said they were asking the court to primarily lift the TRO, which she earlier said will take effect from Aug. 5 to Oct. 5 unless and until it is lifted sooner.

They also sought the dismissal of SM Prime’s petition for certiorari, citing lack of merit and even asked the court to award damages to the state agencies.

Mr. Marañon said he was optimistic the issue will be resolved soon.

“This wouldn’t drag because our case is very strong,” the governor added.

In their joint comment, the officials said the proceeds of the sale and lease will be utilized for the provincial government’s countryside development projects.

The TRO comes alongside SM Prime’s pending petition with the Commission on Audit (CoA) to defer the approval of the provincial government’s deal with Ayala Land until questions on its validity are resolved.

SM lawyers made this request in a letter dated Aug. 1 to CoA Chairman Ma. Gracia Pulido-Tan.

CENTRAL Negros Electric Cooperative (Ceneco) general manager Sulpicio Lagarde said that they are now preparing the required power for Ayala Land Incorporated’s (ALI) development of the 7.7-hectare property of the Provincial Government.

"We are looking for the needed power starting January 2012," Lagarde said.

He pointed out that, based on what Ayala have shown to them during the full completion of their development of the Capitol's property, they would need about 7 megawatts power.

Lagarde said that Ceneco is now on the process of preparing for the infrastructure needed for the future required capacity in their service areas, including that for ALI.

Part of this, he said, is the 1,000 square meter lot along San Juan going to Banago because the government plans to continue the construction up to Talisay City.

"We need to have it ready by July 2012, especially for BPOs and call centers," he added.

Lagarde also disclosed that Ceneco's move for such preparation is the contract for a 10-megawatt power supply with Green Core that offers the cheaper power at P4.70 per kilowatt hour.

Meanwhile, Negros Occidental Governor Alfredo Marañon Jr. said that ALI’s development of capitol properties will immediately start when the contract approved by the Commission on Audit will be received by his office.

kakapoy halay pila kag file sa prc... ka gasto mag kad2 pa ta nga taga bacolod sa iloilo para lang maka kwa board exam... I don't know why wala pa gd ta di prc sa bacolod.. tani maka lab-ot ini sa mga opisyales naton sa bacolod!...

damo na gd ang ga reklamo..kahapon damo nag kamog kag nag dumugay sa pavillon sang pag file ko for board exam.. damo professionals ang ga reklamo!!!! tam-an ka gutok!!! on time ang abot ang mga naga file pero late abot ang prc-iloilo.

taman ka hinay sang filing..kulang sa improvement..
negros island would cater how many cities and towns. although we have to provinces, the oriental ang occidental. damo schools and universities here compare to panay island.
ano ang rason nga-ah indi ta di kapa tindog sang prc man????

Court of Appeals lifts TRO on Capitol property conflict

CEBU CITY – The Twentieth Division of the Court of Appeals here has lifted the 60-day temporary restraining order it had issued against Gov. Alfredo Marañon Jr. and other Negros Occidental officials in connection with the sale and lease of its 7.7-hectare prime property in Bacolod City to Ayala Land Inc.

The TRO had been granted to SM Prime Holdings Inc. that had opposed the awarding of the negotiated sale and lease of Ayala, claiming it was the winning bidder to the property.

SMPHI had refused to join the negotiated bidding saying it had entered a higher bid than Ayala in a second bidding held on July 7, and sought the TRO to halt the negotiated sale and lease.

But the Capitol had declared the second bidding a failure, saying both SMPHI and Ayala had failed to meet the floor price for the property approved by the Commission on Audit.

The 60-day TRO was expected to end on Oct. 4.

However, the CA, in an order promulgated on Sept. 6 lifted the TRO, which is believed to pave the way for the Capitol to proceed with the sale and lease of its property.

The dispositive portion of the Sept. 6 CA order denied SMPHI's prayer for preliminary injunction, and lifted the TRO it issued on July 27.

It also directed SMPHI and the provincial government officials to submit their respective memoranda within 15 days after which it will be deemed submitted for decision.

The decision was penned by Associate Justice Victoria Isabel Paredes and concurred in by Associate Justices Edgardo de Los Santos and Ramon Paul Hernando.*CPG

O’k Prov’l Gov’t-Ayala Land Deal

The Commission on Audit (COA) Negros Occidental Office has recommended to its Head Office in Manila the approval of the contract between the Provincial Capitol and Ayala Land for the negotiated sale and lease of the 7.7-hectare property of the provincial government in Bacolod City.

COA Provincial Head Ernie Villa yesterday said he has submitted Wednesday his comments and recommendation to their regional office, which in turn, endorses it to their Head Office.

Villa said the COA Head Office had asked for comments and recommendation of the COA Western Visayas Office, which also asked COA Negros Occidental Office, on the said contract.

The provincial government had submitted a draft of the Deed of Conditional Sale to COA Head Office for review and approval, prior to the signing of the contract.

The Deed of Conditional Sale as approved by the Sangguniang Panlalawigan (SP) involves the sale of 36,587 square meters of Capitol lots totaling P750.033 million. The Contract of Lease, on the other hand, is for the 40,481-square meter lot at P73 per square monthly, amounting to almost P2.755 billion.

The total monthly lease amount is P2.914 million monthly, increasing by 10 percent every five years over a 50-year period. Both contracts amount to almost P3.505 billion.

Villa said, “I recommended for the approval of the contract principally because the COA review concerns two things: one is the reasonableness of the price, and second, the compliance with rules and regulation of the COA.”

He said that on the first count, the price negotiated was reasonable. “With regard to the price, there is no question,” he stressed.

Even if they subtracted the P25-million development cost of the Capitol Lagoon and Park as what was proposed by Ayala, the price is still above the minimum that was set by the provincial government’s Committee on Awards and Disposal of Real Properties, and inspected by COA technical services team, he said.

With regards to the rules and regulation being followed in the conduct of the bidding, Villa said it is also legal.

“I have declared this also in the hearing of the SP that the Committee on Awards had followed the pertinent rules and regulation with respect to the conduct of the disposal of bidding. That is provided for in COA Circular 92386 issued as Implementing Rules and Guidelines for RA 7160 with respect to property management which includes disposal (of properties),” he explained.

Villa, who had served as a resource person during the SP deliberation, said he believes the Capitol awards committee acted in accordance with procedures under COA Circular No. 92386. The circular pertains to the rules and regulations on supply and property management in the local governments.

Villa yesterday said he also took note of the Court of Appeals decision, in the lifting of the temporary restraining order (TRO) earlier granted to SM Prime Holdings, the other bidder for the subject property, which stated that that the COA memorandum that SM Prime had alleged as basis for supposedly winning the bid is not applicable (to the COA rules on bidding).

COA memorandum is different from COA circular, a memorandum is an issuance for internal guidelines to the auditors, while a circular is, as the name suggests, circularized for government-wide application, he said.

The circular contains the policies and guidelines that COA sets as part of its quasi-legislative function, he said.

The Court of Appeals 20th Division in Cebu has lifted the TRO that it earlier granted to SM Prime which filed a petition seeking to restrain Governor Alfredo Marañon Jr. from signing the contract with Ayala Land.

Meanwhile, Ayala Land is proposing to develop the 7-7-hectare property into a Capitol Civic Center with P6 billion in investments.*

BACOLOD City – Regional Trial Court Branch 50 Presiding Judge Estefanio Libutan Jr. has scheduled on December 9 the next hearing for the civil case for certiorari filed by SM Prime Holdings, Inc. (SMPHI) against Negros Occidental governor Alfredo Marañon Jr., members of the provincial board and the provincial committee on awards and disposal of real properties in line with the sale and purchase of the Capitol’s 7.7-hectare properties to Ayala Land, Inc. (ALI).

In yesterday’s hearing, Inocencio Cabahug from the regional office of the Commission on Audit (COA) was presented for direct questioning and cross examination.

SMPHI was presented by its lawyer, Atty. Vince Bayhon while Atty. Mary Ann Lamis represented the provincial officials.

During the December 9 hearing, Atty. Ryan San Juan, vice president for legal of SMPHI, will take the witness stand.

The provincial officials will also present witnesses after SMPHI’s completes the presentation of its own witnesses.

Meanwhile, Lamis said that the provincial government can proceed with its activities pertaining to the sale and purchase of the Capitol properties to Ayala pending the resolution of the case because no injunction was issued against the provincial officials.

This after the Court of Appeals has lifted the 60-day temporary restraining order issued over the same properties.

Junked na lahat ng cases. I just don't know if SM will raise this up in the Supreme Court or whatever. What I know is that they might not since they are greatly losing a PR war with Ayala in Bacólod. A Supreme Court petition would just worsen their loss thus far. :cheers:

Capitol eyes COA decision on Ayala deal by Nov. 10

THE decision of the Commission on Audit (COA) on the controversial lease and purchase of the 7.7-hectare Capitol property by Ayala Land Inc. may be finally known on November 10.

Governor Alfredo Marañon Jr., who has expressed optimism on COA approval of the controversial land deal, said COA is set to hold an en banc deliberation of the land deal on November 10.

Once COA approves the deal, Capitol will immediately sign an agreement with Ayala, Marañon said.

COA national office will deliberate on the matter after its regional office already submitted its comment about the transaction.

THE Provincial Board is set to approve Wednesday the ordinance on the permanent closure of a road artery inside the 7.7-hectare Capitol property, which are up for purchase and lease by the Ayala Land, Inc. (ALI).

Negros Occidental Vice Governor Genaro Alvarez said the permanent closure of the road along Gatuslao and San Juan Streets is necessary for the consolidation of various titles covering the 7.7-hectare prime property of the Provincial Government, which is the subject of lease and purchase by ALI.

Marañon has confirmed that the Commission on Audit (COA) will decide on the approval of the contract between the Provincial Government and Ayala Land in an en banc session scheduled on December 10.

Marañon has expressed optimism that COA will approve the contract.

He stressed that as soon as COA renders its approval, the contract-signing between the Provincial Government and Ayala Land will then be processed.

Bacolod City News Danny Dangcalan Negros Occidental Philippines

The Sangguniang Pan-lalawigan (SP) of Negros Occ. has approved on its third and final reading a proposed ordinance that mandates the closing of minor roads in Bacolod City.

Authored by Board Member Emilio Yulo III, who is also chairman of the SP Committee on Laws, the ordinance will close Road Lots 1, 2, and 3 situated between San Juan St. and Gatuslao-South Capitol Roads or near NFA Building and DENR Building.

FRANK Carbon, president of the Metro Bacolod Chamber of Commerce and Industry (MBCCI), expressed optimism that the Commission on Audit (COA) will come out soon with the approval of the contract between the Capitol and the Ayala Land Inc (ALI) involving the lease and purchase of the 7.7-hectare prime property of the Provincial Government.


Negros Occidental Governor Alfredo Marañon Jr. said last week that the COA en banc was supposed to decide on the review last week.

He has expressed optimism that COA will approve the contract, as the Provincial Government has fully met the requirements on the matter.

ALI proposed to pour in some P6 billion for the development of a lifestyle center for shopping, entertainment and dining, a hotel to attract business tourism, Business Process Outsourcing offices, a multi-purpose events and convention center, residential and commercial zones with high-rise towers in the midst of private gardens, and a redeveloped Capitol Park as the focal point of the project.

Guv hoping CA ruling will make COA act

Marañon said he hopes the CA decision will be an eye-opener for the Commission on Audit to act soon on the contracts on the sale and lease of the property that the provincial government sent to it for review in July last year.

In its decision promulgated February 16, the CA denied SMPHI’s motion for reconsideration to its resolution on Sept. 6, 2011 denying its application for a writ of preliminary injunction against the provincial government.

The CA also dismissed a petition for certiorari filed by SMPHI against Bacolod Regional Trial Court judge Estefanio Libutan Jr. for denying a temporary restraining order it sought against the Negros Occidental provincial government on the sale and lease of the 7.7-hectare property.

The CA said the petition and motion for reconsideration filed by SMPHI before it are without merit.

THE Provincial Board of Negros Occidental is asking the Commission on Audit (COA) to decide now whether it will approve the purchase and lease contract of the 7.7-hecatare Capitol prime property with Ayala Land Inc. (ALI).

Vice Governor Genaro Alvarez said Tuesday the Provincial Board has passed a resolution during its session in Murcia town last week asking the COA to render its decision on the Capitol-ALI land deal.

While there were some members who commented and chose to abstain, the resolution was approved by the majority and was sent to COA Manila by registered mail last week, Alvarez said.

Alvarez said the board is supporting the call of Negros Occidental Governor Alfredo Marañon Jr. to COA to come up with its decision on the contract which was sent to Manila in July last year.

He said they have been expecting the approval of COA, believing that all legal procedures were followed on the land deal.

Alvarez said the delay on COA’s decision is adversely affecting the development work that is set to be undertaken by ALI in the amount of P6 billion.

Earlier, Marañon lamented that COA is seem to be purposely delaying the approval of contract for the sale and purchase of government lot to ALI.

He pointed out that under the Constitution, COA should act on the matter within 60 days upon receipt of the said contract.

BACOLOD CITY, March 9 (PIA6) -- The Commission on Audit is set to deliberate the deal between the provincial government of Negros Occidental and Ayala Land Incorporated (ALI) on March 19, 2012.

In an interview over a local radio station here, COA Spokesperson Atty. Gilbert Kintanar disclosed that the Commission Proper (CP) composed of COA Chairperson and two commissioners are to deliberate on the deed of sale and contract of lease between the provincial government of Negros Occidental and ALI.

He also strongly denied claims that COA is delaying its decision on the case.

Kintanar said that COA is doing its best to hasten the process with respect to the request of Governor Alfredo Marañon Jr. for a speedy disposition of the case but added COA needed look into the legality and reasonableness of the price and the profit as specified by law, and make sure this is being followed as this involves a big amount of money.

“The COA approval is really a requirement of the law in the disposition of property by any government agency or any local government units,” Kintadar said in the same radio interview.

Kintanar revealed that COA Central Office received on October 4, 2011 the endorsement from COA Regional Director Salvador Isiderio with his recommendation with respect to the deed of sale and contract of lease.

This was forwarded the following day by the Commission Proper Secretariat to the Legal Services Sector of COA which studied the legality of the contract and returned the contract to the CP Secretariat January 11, 2012 which in turn scheduled it for deliberation by the Commission Proper’s meeting last January 19, 2012.

After the January 19 deliberation, there were some questions raised and it was sent back to the Legal Services Sector for further study.

The CP received again the contract on February 24, 2012, and has set deliberation in the next CP meeting on March 19.

“We see no delay in the process, in fact, this maybe the fastest case we have acted upon because once the Secretariat received the document, it was immediately scheduled for deliberation in the next CP meeting,” Kintanar added during the radio interview.*(JCM/EAD-PIA6 Negros Occidental)

Kintanar said the CP had deliberated on the said contract last March 19, and their decision was to form a technical team from their Technical Services Office to evaluate and re-appraise the value of the 7.7-hectare property.

Kintanar stressed that the forming of technical team to evaluate the property in question is a normal process done by the CP in this kind of transaction that involves a big amount.

This is just to ensure that the final contract in the sale of the property is in favor of the government, Kintanar said.

He explained that CP is giving utmost priority to the Capitol-Ayala deal but they have to do their mandate, by ordering the re-appraisal of the property.

Kintanar said as soon as the CP receives the report of the technical team, they will set another meeting to deliberate on the matter. The next meeting of the CP is tentatively scheduled on April 13, he said.

Guv may testify on SM vs Capitol-Ayala land deal case

Lamis on her part contended that SMPHI does not have a strong case against the Provincial Government, as far as the certiorari case is concern.

Lamis explained that the second bidding on July 7 ,2011 prior to the negotiated bid was declared a failure by the Committee on Awards and Disposal because both bidders, SMPHI and Ayala Land Inc., were not able to meet the appraised value or the floor prize fixed by the Committee on Award and Disposal.

She added that, contrary to the claims of Bayhon, the appraised value or floor prize deso not need the approval of the Comission on Audit.

The fixing of the floor prize is management responsibility, she further stressed.

When asked of the possibility of COA not to act on the contract before the main case is settled, Bayhon said: "It's COA's call but I believe that, to be careful about the matter, it would be prudent to wait for the court's ruling, although it's not required that they wait for it. But if they want to wait for it, then that will only show that they are being prudent on their action.”

The Appraisal Team from the central office of the Commission on Audit has arrived in the province to determine the reasonableness of the purchase and lease of the 7.7-hectare property of the provincial government to Ayala Land Inc.

Encarnacion Esmino, supervisor of the three-man Appraisal Team, said they immediately started the inspection upon arrival yesterday. The inspection will last until Saturday.

The team was created only last week when COA started deliberations on the contract.

The team will then submit their report to the Commission proper in 15 days after the inspection.

Esmino said the appraisal will determine if indeed the transaction is advantageous to the government, which is part of the review of COA Central Office of the contract between capitol and ALI.

"We were instructed by the commission proper to study the reasonableness of the sale of the land. To know the real value of the different factors of the property subject to sale and the lease," Esmino said.

Negros Occidental Governor Alfredo Marañon Jr. has been complaining about the delay in COA's action on the transaction, saying that COA should have acted on the matter within the 60-day period prescribed by law.
"We would only focus on the price. The bidding conducted was not our objective here," Esmino added.

When asked if the letter of SM Prime Holdings, Inc. has something to do with the sending of the appraisal team to the province, Esmino said they didn't know what prompted the Commission proper in sending them to the province although she said that it's standard operating procedure that COA sends the appraisal team on transactions under review.

After this, we might have good news by april 13 as the COA technical team sent by COA national office, is convinced that the deal was above board and that, it is more advantageous to the government. hopefully, this be resolved soon, so that after Centrio in CDO, ACCC in bacolod will be next.:)

Among the matters the team looked into is the claim of Manuel Villadelgado Jr. to a portion of the land the Capitol is putting up for sale and lease, and data from the National Housing Authority and the Bureau of Internal Revenue on the cost of the land, Pinongan said.

Governor Alfredo Marañon Jr. said that, hopefully, with the review of the sale and lease of the property, the COA will rule on its review of the lease and sale of the property to ALI.

Actually NPA ako (No Permanent Address)...I'm from CDO but my work base is in Tacloban; I travel occasionally to Bacolod, among other office locations, for directorate meetings and product launches...hope the Ayala-SM debacle ends soon. This is not good for the local economy:ohno:

Currently SM Bacolod is 70,000 sq.meter; an additional +/- 100,000 sq.meter floor space will be added to add up to a total of 170M worth of leasable space...this is exciting news! Happy for you guys. Is this sign that SM has already rested its case re Ayala-Capitol project? I can only surmise...

I just read an article in PDI yesterday about SM sprucing up their Bacolod Mall, spending 1.5BB for the expansion. Currently SM Bacolod is 70,000 sq.meter; an additional +/- 100,000 sq.meter floor space will be added to add up to a total of 170M worth of leasable space...this is exciting news! Happy for you guys. Is this sign that SM has already rested its case re Ayala-Capitol project? I can only surmise...

^^pompe is right..SM already sensed "defeat", first, the lifting of the TRO by the CA; second, COA TT's re-appraisal further strengthens the deal to be advantageous to the gov't.:)

^^re: ALI-capitol deal...things geared towards that direction, although, COA is yet to decide come April 13 but initial findings from the technical team sent by COA national office states that the price is advantageous to the government and that transaction went above board. :)

nope they have millions of questionable delays. this should be corrected. we as a people of Negros should appeal to what is ours should not be shunned by those who do not live here.

Ayala Land Inc. has informed Gov. Alfredo Marañon of its decision to focus its development plans and resources on other projects in Negros Occidental, following the delay of the Commission on Audit in reviewing the deed of sale and contractof lease to them of the 7.7-hectare prime property of the provincial government in Bacolod City, he said yesterday.
Jose Emmanuel Jalandoni, ALI senior vice-president, in a letter dated April 4 released by the governor to the media yesterday, said they will focus their plans and resources on their Northpoint project in Talisay City, as well as other potential opportunities in the province.
He assured Marañon of the company’s commitment to Negros as a “growth center” for its development, and said they will continue to look forward to bringing more quality products and lifestyle developments to the Negrenses.
ALI had hoped to invest P6 billion to redevelop the provincial capitol property of Negros Occidental in Bacolod City into a 7.7-hectare mixed use civic and commercial district.
The provincial government of Negros Occidental awarded ALI the right to purchase 3.66 hectares of the property, and to lease the remaining 4.04 hectares for a period of 50 years.
Marañon, who has blamed COA for the delay in the approval of the Capitol-ALI deal, said they have no choice but to de-prioritize the Capitol Civic Center project, in order to move on and focus on other development projects in Negros Occidental.
Jalandoni said “We agree that this project has been long delayed and is affecting the progress and economic development of Negros Occidental and the Negrenses”.
He admitted that it had also affected other ALI plans in Negros Occidental.
Thus, he added, “we fully understand and respect the need to de-prioritize this project for the sake of continued progress in Negros.”
Marañon expressed his gratitude for the continued support of ALI the development of Negros Occidental. He, however, stressed that they are not giving up the fight yet.
The SM Prime Holdings Inc. filed a petition last year before the Bacolod Regional Trial Court seeking the annulment of any negotiated sale and lease by the provincial government of its property to ALI, and for SMPHI to be declared the winning bidder of the July 7 bidding.
The next hearings of the case have been set on April 27 and May 25.
The creation of the COA technical team to evaluate and re-appraise the value of the Capitol property, although the provincial government complied with the requirements asked from them, including the submission of contracts for approval on July 22 last year, is expected to further delay the realization of the project, Provincial Administrator Enrique Pinongan said earlier.* GPB

the project will push through if COA would fast track the project, business should continue for other projects. thats how i see it. meaning to say, chill lang muna, kasi may nagmamatigas na idelay talaga.

@wednesday, the project will push through..as explained by gov. Maranon sa media interview shown sa TV Patrol Negros dated 11 april 2011..im trying to find the video pero di pa updated ung TFC channel ng abs..he said na nagpadala ng letter sa kanya stating their support sa province and at the same time they are waiting for COAs decision para maumpisahan na.

So, for the meantime, focus muna sila sa Ayala north point community mall na nasa 2nd floor na..:cheers: and other projects within negros.:)

this SM vs Ayala reminds me of the story about the SM vs Robinsons dispute on the Ortigas-EDSA lot back in the old days. Sy and Gokongwei settled the dispute through a flip of a coin (literally), in which Gokongwei won. Robinsons then went on to build Rob Galleria on the disputed lot. Now if Ayala and SM can do the same simple thing, again. But of course, after seeing how beautiful Ayala's proposal is, I'm hoping this lot in Bacolod goes to Ayala.

^^thanks for the info @anak...i didn't know a billion peso project can be settled just like that. funny, isn't it. hehe. well, with regards to the SM-ALI dispute over the capitol property, SM's move to expand their existing mall by investing 2.5Billion, the same amount of investment they should be putting to the capitol property is, for me a sign that they accepted "defeat". it's maybe speculative to say this, but COA's inaction to approve the contract points to a grand plan by the SM group to at the very least, delay the project and thus gives them due advantage to position themselves before Ayala comes in the picture.:)

This is sad news. I was really hoping this project will materialize, but if everything fails, there's still hope in Talisay...Time is of the essence for businesses, big or small, so if some quarters in the government are dilly-dallying the decision to completely hand over the precious space to the property giant, then Ayala will have to train their sights elsewhere...hahay pastilan gobierno!

This project is overdue already, due to the COA delays, but AyalaLand stated they will pursue their plans as soon as COA approves the sale and lease. Mas mabuti na lng to marami ngang projects jan, 5 years nang nkatiwangwang ung lupa, ngayon pa lng idedevelop. :) At saka marami namang projects na khit 10 years na ang delay nagpupush-through prin sa huli...Sa tingin ko hindi naman tatagal to...Ayala ang developer eh...kailangan lng talaga ng COA approval..:cheers:

This project is overdue already, due to the COA delays, but AyalaLand stated they will pursue their plans as soon as COA approves the sale and lease. Mas mabuti na lng to marami ngang projects jan, 5 years nang nkatiwangwang ung lupa, ngayon pa lng idedevelop. :) At saka marami namang projects na khit 10 years na ang delay nagpupush-through prin sa huli...Sa tingin ko hindi naman tatagal to...Ayala ang developer eh...kailangan lng talaga ng COA approval..:cheers:

Personally, I don't think Ayala's gonna easily give up on Bacolod, and Negros in general...An Ayala mall befits a market as sophisticated and mature as Bacolod's, so it's a huge loss on their not to be in the middle of the action...Yes, COA has to work on the approval quick!

Audit commission issues gag order on Capitol-Ayala deal

THE head of the Commission on Audit (COA) in Bacolod said he can no longer answer media queries insofar as the issue on the lease and purchase contract between the Provincial Government and the Ayala Land Inc. (ALI) covering the 7.7 hectares Capitol prime property is concerned.

This after COA-Central Office, through lawyer Gilbert Kintanar, chief executive staff, issued a gag order to all assistant commissioners, all cluster directors and all regional directors.

Subject of the said memorandum is “directives for contact with the press and the general public.”

The memorandum that was received by provincial auditor Ernie Villa last March 26 said: “to centralize all incoming and outgoing communications relating to the Commission on Audit Central Office and Regional Offices, effective immediately all requests for contact with members of the press and their agencies, including for interviews, publicity or responding to publicity should be addressed to the Public Information Office.”

The said memorandum points to Director Rolando Macale as contact person and also stated that complaints may be sent to COA Citizens’ Desk.

The COA national office has been scored by various sectors here for the perceived delay in the decision covering the Capitol-ALI lease and purchase contract.

The delay in the decision of COA also impeded the development projects of the province to address the unemployment problem in this part of the country.

It can be recalled that Negros Occidental Governor Alfredo Maranon Jr., issued a press statement declaring the decision of the Provincial Government to de-prioritize the capitol development projects for what he claimed as unjustified delay on the part of COA.

This was also followed by ALI which also declared that they would refocus their development projects to other areas in the province.

Impeachment mulled vs COA officials for land deal approval delay

Monday, April 16, 2012

A MEMBER of the Provincial Board (PB) said if he had his way, he would initiate impeachment proceedings against officials of the Commission on Audit (COA) for delaying the approval of the contract for the purchase and lease of the 7.7-hectare prime property of the Provincial Government to Ayala Land Inc.

“If I have my way, I will initiate impeachment proceedings against the concerned officials of COA,” Board Member Salvador Escalante said.

He said the delay has already gone on for almost one year.

Escalante, who is the chairman of the Committee on Finance, added “it is unfair to the people of Negros.”

He stated that the commissioners who continue to receive their salaries should have performed their job to act on the largest project of Negros Occidental which is the 5th largest province in the country.

Malacañang to ask COA about Capitol-Ayala deal
RESIDENTIAL spokesperson Edwin Lacierda said Malacañang will verify with the Commission on Audit (COA) about the status of the contract for the purchase and lease by the Ayala Land Inc. (ALI) of the 7.7-hectare prime property of the Provincial Government.

Lacierda, in an interaction with the media Wednesday night with deputy spokesperson Abegail Valte, confirmed that Governor Alfredo Marañon Jr. personally brought up the matter with them.

He also bared that he was informed that COA chair Grace Pulido-Tan had inhibited herself in the en banc deliberation of the Capitol-ALI deal after questions were raised about the impartiality on the issue.

Reports have it that the law firm of Tan's husband provides legal services to SM.

Ayala bares P90-b projects

Ayala Land president Antonino Aquino said in an interview following the company’s annual stockholders’ meeting the property firm has been acquiring land in key areas such as Manila, Bicutan, Alabang, Bataan, Pampanga, Cebu and Bacolod for future master-planned, mixed-use developments.

Impeachment mulled vs COA officials for land deal approval delay

A MEMBER of the Provincial Board (PB) said if he had his way, he would initiate impeachment proceedings against officials of the Commission on Audit (COA) for delaying the approval of the contract for the purchase and lease of the 7.7-hectare prime property of the Provincial Government to Ayala Land Inc.

“If I have my way, I will initiate impeachment proceedings against the concerned officials of COA,” Board Member Salvador Escalante said.

He said the delay has already gone on for almost one year.

Escalante, who is the chairman of the Committee on Finance, added “it is unfair to the people of Negros.”

He stated that the commissioners who continue to receive their salaries should have performed their job to act on the largest project of Negros Occidental which is the 5th largest province in the country.

Commission on Audit chairperson Maria Gracia Pulido-Tan yesterday confirmed to Presidential Spokesman Edwin Lacierda that she had inhibited herself from the COA review of the sale and lease of the 7.7-hectare Negros Occidental provincial government property in Bacolod City to AyalaLand Inc.

In Bacolod Wednesday night, Lacierda had told the Bacolod media: “We will ask the COA chairperson if she really inhibited and if there was a formal declaration of inhibition.”

“Our understanding is that Chairman Grace Tan has inhibited herself over the concern that the law firm of her husband is the lawyer for the Sys,” he said.

The Sy family owns SM Prime Holdings that is opposing the Capitol’s sale and lease of its property to AyalaLand.

Negros Occidental Gov. Alfredo Maranon Jr. yesterday said he was very happy and thankful to God that Tan has inhibited herself.

The governor said he hopes the COA will come up with a decision on its review soon.

Marañon, business leaders, and town and city mayors in Negros Occidental have aired complaints against the COA delay in coming up with a decision on its review of the sale and lease of the Capitol property that was submitted to it for action in July last year.

The SM Prime Holdings Inc. has a pending petition before the Bacolod Regional Trial Court seeking the annulment of any negotiated sale and lease by the provincial government property to AyaLand, and for SMPHI to be declared the winner of the July 7 bidding of the 7.7-hectare property.

Marañon, however, has insisted that the action of the province was above-board, and SMPHI did not win the July 7 bidding for the property, because, like Ayala, it had entered a bid below the floor price set.

That is why a negotiated bidding was held, in which SMPHI refused to participate, so the sale and lease was awarded to AyalaLand, he said.*CPG

that's the big question mig, grabe ang ila lumlum asta nagkalabaug, they should have made a decision for or against the negotiated sale months ago so that the province can also decide on their next move and not left hanging...:ohno:...:bash:

NEGROS Occidental governor Alfredo Marañon Jr. said he expects speedy resolution of the Capitol-Ayala Land Inc. (ALI) contract after Commission on Audit chairperson Maria Gracia Pulido-Tan inhibited herself from the review of the said contract.

“I think it will be resolved soon,” Marañon said, adding that he is happy of the development.

He admitted he brought up the matter with Presidential spokesman Atty. Edwin Lacierda and Deputy spokesperson Atty. Abigail Valte during their visit here in the province last Wednesday.

Lacierda has assured the governor that he would verify the reported inhibition of Tan from the agency’s procedural review of the contract.

“I was officially informed that she has indeed inhibited herself,” Marañon stressed.

Tan’s inhibition from the review of the Capitol-ALI deal was sought here as the law firm of her husband reportedly renders legal services for SM Prime Holdings Inc. (SMPHI), which filed a case against the Provincial Government here seeking to annul the Capitol-ALI contract.

SMPHI claimed it won in the second bidding, so it did not join the negotiated bid the Provincial Government awarded to ALI.

Marañon said as soon as COA inks its approval, the contract will be signed by concerned parties and the implementation of the project will start.

The Commission on Audit has made public its “findings” but although it was just a news item last Tuesday, I shall comment on it just the same on Monday, taking into consideration that the report is reliable, and the response of the provincial government. COA’s decision either can make us laugh or tickle us about how COA decided on this issue. But, really, it is interesting.

BACOLOD City – Negros Occidental governor Alfredo Marañon Jr. yesterday said the lease and sale contract between the provincial government and the Ayala Land, Inc is a signed deal.

Marañon confirmed to reporters here that he and top officials of ALI signed the contract in Manila Thursday.

“It’s a go,” Marañon, who weeks ago said he was de-prioritizing the project, declared.

Signing in behalf f ALI were Antonio Aquino, ALI president, and Jose Emmanuel Jalandoni, ALI vice president.

Marañon accompanied by Atty. Mary Ann Lamis, assistant provincial legal officer, signed in behalf of the provincial government.

He explained that one of the requirements stated by the Commission on Audit in a letter sent after the COA appraisal team went here was for the contract to be signed. For Marañon, this is a technical requirement prior to the approval.

Another point made by COA was the claim made by the Villadelgado family on a portion of the 7.7-hectare property which is the subject of the lease and purchase agreement. Marañon said the provincial government has already sent to COA the copy of the court decision on the case.

With these requirements met, Maranon believes COA will render its approval of the contract.

“It’s a done deal,” Marañon stressed.

He said ALI will start their payments as soon as they receive a copy of the COA approval as stipulated in the contract.

“We are relieved and this is good for the people of Negros and Bacolod,” he stressed.

He added that everything will go as scheduled and as planned although a little bit late.

With this development, Marañon said he sees the transformation of the economic landscape of the province of Negros Occidental and the city of Bacolod.

The area for sale is 36,587 square meters amounting to P750,033,500 while the leased area is 40,481 square meters for P2,955,113 per month with 10 percent escalation every five years.

ALI is expected to pour in a total of P6 billion in investments in the disputed prime property.
