I was told once that whatever interest is due on any late payments will be calculated on handover. Sounds to me like they can give any figure they like. Keep those receipts safe and try to pay on time. The email concerns the CORPS Fund and my Sale Agreement which took them 2.5 years to send me. Having heard some of you mention that you also bought your properties back in 2005 and had contracts straight away which don't include CORPS funds i thought you might like to see this. Please let me know your thoughts. I have taken out any personal info as im sure you can understand. i would like to take my questions to someone more senior within ETA other that that of customer relations. Does anyone know the contact details of a Director or MD of ETA? Dear Eta Star Further to my emails below I am very angry and disappointed that as of 17th February 2008 I have had no response to any of my emails dating back from Dec 2007!! My questions to you are of a very important nature as they concern my Sale Agreement between myself and you ETA Star. I feel that this Sale Agreement has not been constructed correctly and therefore I being penalised for extra costs! My questions to you for the 5th time, are as follows; Firstly my Sale Agreement (Contract) that I was sent back in Dec 07 is not dated correctly. I originally purchased my flat back in May 2005 when I gave you a 10% deposit (I have receipt of this). Therefore I believe my contract should be dated May 2005 and not Dec 2007! It is also disgusting that it took you 2.5 years to send me any kind of contract!!!! I have friends who have also bought properties from yourself back in MAY 2005 and they have contracts that are dated correctly (May 2005) and received them on paying their deposits!! Their contracts also have no mention on page 6 of a CORPS Fund, and mine does, which leads me to my second question. WHY do I have this extra clause of having to contribute to a CORPS Funds? This CORPS Fund will cost me approximately an extra £8,157.00 to what I have already paid on purchasing this property. There was no mention of a CORPS fund when I first bought my property and if there had of been I wouldn’t have proceeded with this purchase. Can you also please tell me why a CORPS fund (SINKING POLICY) is so costly on a brand new building? This is leading me to worry that construction may not be as secure as I was first led to believe? I do not feel it fair that some customers have to pay this extra CORPS fund and others who got their contracts earlier do not. The 2005 contracts also state that the completion date of Goldcrest Views 2 will be March 2008, where my contract dated Dec 2007 (which is wrong) states completion date of March 2009, I assume you have done this to avoid paying compensation for late completion. Corpus fund: Corpus fund is the initial contribution of the Apartment owner to the Apartment owner’s Association. It’s a one time payment kept for ‘future capital expenditure’ and the same is maintained by the Building Owner’s Association. The issues like where to invest the corpus fund and if interest accrues shall be decided by the Owner’s association from time to time. The Constitution of the Home Owner’s Association gives the power to the association to decide on utilization and investment of the fund. If the customer sells the flat the same shall be obtained from the new buyer. I have tried e mailing several times with no response. When I call them,I keep getting transfered to a person who transfers me to another and so on. But now I am stuck cause I have paid almost full amount and they have used the deposit money of all who purchased the apartments to start other developements and don't care about the previous ones. Bathroom is similar than the Goldcrest Views , kitchen tiles different but good quality. ETA are saying June on the website and yet I read postings that believe it will be end of 08, or the start of 09. I wonder if there is a definitive date that can be verified by the developer so that purchasers of units can be sure for their planning purposes. Also, having looked at the Goldcrest Views forum they appear to have a contact in place for the regulatory side of the completion giving the relevant details for land registry etc. There is also the issue of the residency visas which I have not seen any information. Grateful if anyone from ETA can advise on these queries. Having seen it I'm not so sure. I got right up to the front door of the building and the lobby hasn't been started - a lot of interior finishing to do still, although the outside looks good. Spoke to Parveen about Corps fund, she tells me that apparently this cheque won't be cashed unless they have agreed with you first - the association will hold a meeting to determine the useage of the cash and that they have agreement from the owners association. If you sell your apartment you get your cheque back and the new buyer writes this cheque out again. Hope that is some help on the corpus fund. Please let me know your thoughts. I have taken out any personal info as im sure you can understand. i would like to take my questions to someone more senior within ETA other that that of customer relations. Dear Eta Star Further to my emails below I am very angry and disappointed that as of 17th February 2008 I have had no response to any of my emails dating back from Dec 2007!! My questions to you are of a very important nature as they concern my Sale Agreement between myself and you ETA Star. I feel that this Sale Agreement has not been constructed correctly and therefore I being penalised for extra costs! My questions to you for the 5th time, are as follows; Firstly my Sale Agreement (Contract) that I was sent back in Dec 07 is not dated correctly. I originally purchased my flat back in May 2005 when I gave you a 10% deposit (I have receipt of this). Therefore I believe my contract should be dated May 2005 and not Dec 2007! It is also disgusting that it took you 2.5 years to send me any kind of contract!!!! I have friends who have also bought properties from yourself back in MAY 2005 and they have contracts that are dated correctly (May 2005) and received them on paying their deposits!! Their contracts also have no mention on page 6 of a CORPS Fund, and mine does, which leads me to my second question. WHY do I have this extra clause of having to contribute to a CORPS Funds? This CORPS Fund will cost me approximately an extra £8,157.00 to what I have already paid on purchasing this property. There was no mention of a CORPS fund when I first bought my property and if there had of been I wouldn’t have proceeded with this purchase. Can you also please tell me why a CORPS fund (SINKING POLICY) is so costly on a brand new building? This is leading me to worry that construction may not be as secure as I was first led to believe? I do not feel it fair that some customers have to pay this extra CORPS fund and others who got their contracts earlier do not. The 2005 contracts also state that the completion date of Goldcrest Views 2 will be March 2008, where my contract dated Dec 2007 (which is wrong) states completion date of March 2009, I assume you have done this to avoid paying compensation for late completion. I am very angry that I do not have the correct contract and therefore you seem to be penalising me with extra costs. Why should I be penalised for you sending me my contact 2.5 years late!!! In normal circumstances, the contract should state the size of apartment before / after the design revision, then the purchase price should be adjusted accordingly. It is worth to question the developer, as the orginal contract clearly identified the sqft is intended for your studio. I still think JLT have a long way to go, it will remain to be a big construction site for a long time. Maybe the market correction come 1st before all the JLT towers / Lakes is completed. Lee. jackcustard October 4th, 2008, 11:43 AM Here's the terms of my contracts :- 13.1 Except for any delay by an event of force majeure, if the Buyer has fulfilled all of his obligations of payment and the Seller is unable to deliver vacant possession of the unit by the Long Stop Date, the Seller shall pay interest to the Buyer on all the payments made by the Buyer, from the Long Stop Date until the date that possession of the unit is offered to the Buyer by the Seller. 13.2 If the giving of vacant possession of the unit is delayed beyond the Ultimate Long Stop Date, the Buyer may, on a written notice to the Seller, terminate this agreement and upon termination the seller shall return all payments made by the Buyer within 60 days from the date of the written notice, along with Interest calculated from the date each payment was made. I've paid all payments except one on GC2 and 40% on GCE. The floorplan doesn't give you an accurate picture at all, full of midget furniture, if you know what I mean. Mine has quite a big balcony, which takes up a lot of the sq footage. Finishing was nice, though, especially the bathroom.
