Wednesday, 18 May 2011 VICE Mayor Rodrigo Duterte urged the Department of Labor and Employment in the region to look closely at the operations of labor-contracting service firms and order them to give minimum wage and benefits to workers. Speaking in the public affairs program “Ato ni Bay,” he proposed to schedule a meeting with labor officials to protect the working class. He observed that many big establishments like malls no longer directly hire employees and instead source out their labor needs from these manpower and allied service companies. But that doesn’t excuse these companies from flouting the law. “Workers must be protected by law,” Duterte said, adding that manpower agencies must close shop if they cannot follow the law. He recalled that in the past, workers could apply directly as masons and carpenters in construction sites, a practice that belongs to a bygone era. As the city develops, direct hires are avoided by companies in favor of labor-contracting, a procedure initially applied to security guards. “The problem is labor-contracting firms deduct huge amounts from the gross salaries of employees under their scheme, and could hardly protect the employees from the abuses of their clients. Often, workers receive their salaries which are way below the minimum wage. There is always a time to look into it and the time is now,” he said. Duterte said that if the DOLE cannot do anything, he will initiate a move at the Sangguniang Panlungsod to conduct a public hearing on the issue. He maintained that it is not acceptable to place workers in servitude. “Workers must receive their salary and other benefits in accordance with the provisions of the law,” Duterte said. Duterte warned that through the council, he will look into the operations of manpower agencies. He also encouraged contractual workers who have problems with management to come to his office. We will assist you secure your clearance from the National Bureau of Investigation, City Prosecutors’ Office and the police. We will vouch for you,” he said. "We are constantly viewing the performance of the BoC. We look at the raw data and the collections have increased...but I am not satisfied," he said. Aquino said the tax collections registered by the BoC have shown positive increase since he took office, but this performance was smeared by the discovery of smuggled items in Cagayan de Oro and Bukidnon recently. The President expressed disbelief over the claim made by Customs officials in Cagayan de Oro that they did not know how the smuggled hot vehicles got through the port. "They are supposed to be the one tasked to make sure that no smuggled item gets through. Why are they claiming to having no knowledge about it?" he said. The President was referring to the National Bureau of Investigation's May 3 twin raids in Talakag, Bukidnon, and Cagayan de Oro City, which seized 21 high-end motorcycles and four luxury cars, including the controversial $80,000 chopper motorcycle that supposedly belonged to Hollywood screenwriter Skip Woods. Aquino disclosed that within the next two months, major changes within the system of the BOC would be implemented – designed to improve its services, including curbing corruption and preventing smuggling. "We have been discussing steps on how we are supposed to improve the services of the Customs...expect that in two months," he said without elaborating. This was the reaction of Aquino over the appeal of the People Power for Reform Volunteers (PPRV), headed by Karina David, and the anti-corruption group Ehem!, for him to reactivate the Designated Examination Area (DEA) in Davao and replicate it in other ports across the country as a means to fight corruption at the BOC. A DEA facility is currently being set up in Cagayan de Oro. The DEA facility in Davao, the first in the country, opened in 2009 but was stopped by the BoC in February 2010 after its private partner, businessman Rodolfo Reta, squealed on the supposed questionable cargoes to Customs officials. Benjie Lizada, lead convenor of PPRV-Davao, said the DEA system, which was a brainchild of the BoC itself, was so effective in Davao City that just a few months after its operation, 40 vans of smuggled rice had been discovered and reported. Manalac, assistant vice president for Mindanao, said the bank has been aggressively looking for more sites to set up branches as it took note that the island has performed better. ”We are looking for development areas to set up branches,” Manalac told the TIMES, pointing out that the criteria that an area must have are that it is progressive and that the deposit levels of the residents are high based on records of the Philippine Deposit Insurance Corp. Another point of consideration, he said, is that the area only hosts a few banks. “The Mindanao market for banks is still very big,” he said, taking note that there are several areas that have few banks. “We want to set up five more branches in Mindanao this year,” he added, as the bank already has 14 branches out of the 187 branches nationwide. After the Floirendos took over the island, construction of the seven villas started. It was in 1994 that the construction was completed. Dapa, a graduate of management accounting from one of the city’s universities, sailed to Cebu in 2008 to join a call center. “Cebu call centers pay higher, much higher compared with Cagayan de Oro,” he said noting his monthly pay hovers between P19,000-P20,000 monthly. Cagayan de Oro contact centers’ pay starts at P8,000 monthly, said Ms. Caragos. Trish, who asked that her name be withheld, admits using her current stint at Concentrix as a stepping stone to a higher-paying call center job outside the city. “Small city first, before the big ones,” she said. There are many others employed in local call centers with the same plan. Ms. Caragos ultimately attributed the nascent state of the industry to the sweeping generalizations of Mindanao’s security. Travel bans on the island have not yet been lifted by the US, the UK, France, New Zealand, Australia and other countries. She recalled a group of investors that was interested in Cagayan de Oro but “canceled their trip” when they found out it was situated in Mindanao. She said the Cagayan de Oro BPO industry is at an “incubation” period and that it requires more fortified ties with the academe. The training, which started last May 16 at the Brokenshire Resort and Conference Center in Davao City, will end on June 3. They have come from as far as Nigeria and Sierra Leone in Africa, Spain and Germany in Europe, United States and Canada in North America, Afghanistan and Pakistan in South-Central Asia and Japan and Laos in Asia. They represent diverse sectors in those countries such as the government sector, civil society organizations, peace movements, academe, military, legal profession, religious sector, and the youth sector. The Forum is co-chaired by the Mindanao Development Authority (MinDA) representing the government and the Catholic Relief Service (CRS) representing the civil society organizations. The fraternity, called the Philippine Boxing Brotherhood (PBB), aims to sustain the search for new boxing stars in the country, somebody who will follow the footsteps of world eight-division champion Manny Pacquiao. The PBB will realize this by staging a monthly dinner boxing, which starts in July in a posh venue in Davao City. Piñol said they are eyeing either Apo View Hotel or the Pinnacle as venue of the monthly boxing card to be called "Tomorrow's Champions". Piñol said boxers who will display exceptional talents in the sport will be linked up with world-caliber trainers in the United States where their boxing skills get to be sharpened. Not only this, boxers who will travel to the US can be booked with bigtime American promoters to give them the break to stardom. "We all beamed with pride as boxing icon Manny Pacquiao overwhelmed a much bigger opponent in Shane Mosley and successfully defended his World Boxing Organization welterweight title proving to the world that a Filipino athlete could dominate sports given the opportunity," said Piñol, who is president of the Braveheart Boxing Club. "Hardly do we realize that the happy days of Manny Pacquiao's victories will soon be over. Manny is 32 years old and it is safe to say that within the next two to three years, he will hang up his gloves," Piñol added. The former governor called boxing promoters and managers to a luncheon meeting Saturday at the Yellow Fin Restaurant where he presented his project. He got an overwhelming support from stakeholders, including former Jose Abad Santos mayor Alexander Wangkay. To show their full support, the promoters and managers named Piñol as the interim chairman of the Philippine Boxing Brotherhood. Wangkay was elected vice chairman. A week before Compostela Valley opened on May 14 this year’s 3rd Summer Beachfest bearing a marine environment theme, 21 Hawksbill turtle hatchlings were rescued from sea predators off Kopiat Island. This incident has encouraged Compostela Valley Tourism Officer Christine Dompor to strongly push for the declaration of Kopiat Island as a turtle sanctuary, and make it a parallel project of the Summer Beachfest which is being held annually to entice visitors to enjoy Compostela Valley’s beach resorts. In a press conference, Dompor said she had made initial negotiations with Lapanday Food Corp. which operates a portion of the 87-hectare Kopiat Island, for a collaborative project geared towards protecting sea turtles which find their way to the island to hatch. Dompor was glad that that the turtle hatchlings were rescued by workers of Lapanday as this reflected the heightened community awareness on the importance of protecting marine life. “We are practically concerned about conserving the breeding and hatching sites of the endangered hawksbill and leatherback turtles. In fact the theme of our annual festival which is a joint project of the province’s resorts association is all about protecting the marine environment, Dompor said. Eaten by predators While the Tourism Office along with members of the Small Hotels and Resorts (SHARE) in Compostela Valley got busy preparing for the Summer Beachfest, Lapanday workers during the first week of May, discovered several exposed turtle eggs and found out that a large iguana was feeding on them. They then collected the uneaten eggs and placed them together with dozens of other eggs that they had found after digging a mound of sand. The workers secured the site until the eggs were hatched. The workers collected 99 eggs. When these were hatched later, baby turtles fin-paddled towards the open sea. But large fish preyed on the helpless swimming tiny turtles. Twenty one managed to swim back to shore and were rescued by the workers. With the help of the notified officers of the Protected Area Wildlife Division of the Department of Environment and Natural Resources (DENR) XI office in Compostela Valley, the hatchlings were gathered together and caged on the shore until they were strong enough to be freed into the open sea. Breeding ground of turtles Kopiat Island, off the coast of Pindasan, dots the Mabini Protected Landscape and Seascape of Davao gulf. It is a known breeding ground of the hawksbill and leatherback turtles. Sea travel around Kopiat Island takes about 20 minutes by motorized boat, while in-land tour in the 87-hectare island takes about 45 minutes. A portion of the island encircles a seven-hectare lagoon. Unknown to many, the island hosts unspoiled reef areas with rare coral beds that house exotic marine life. All of the five marine turtle species in the Philippines found in Davao Gulf are the Hawksbill, Oliver Ridley, Green Sea, Loggerhead, and the Leatherback turtles. Two – the hawksbill and the leatherback turtles – lay their eggs on the coasts of Kopiat island. Leonilo Rivera, chief of Protected Area and Wildlife of DENR XI said the coastal area of Kopiat Island is considered as wildlife habitat and that “the turtles found there are considered as protected and regulated.” “Whatever initiative that the local government may have in the area especially on protecting wildlife, we are supporting their effort,” he said in a separate interview. The island is the staging point of the Summer Beachfest’s 800-metre Kopiat Swim Challenge. The provincial summer sports event has been organized to raise awareness on protecting and conserving the rich biodiversity of the Mabini Protected Landscape and Seascape in Davao gulf. The Summer Beachfest of Compostela Valley bested other tourism events last year, and it won as the national champion in the annual search for tourism best practice conducted by the Association of Tourism Officers of the Philippines (ATOP). The Provincial Tourism Office of Compostela Valley is placing so much importance on Kopiat Island as a tourism come-on lying along the Davao Gulf located in southeastern Mindanao in the Philippines. The Davao Gulf Davao Gulf has an area of 308,000 hectares and cuts into the island of Mindanao from the Celebes Sea. It is surrounded by all four provinces in the Davao Region. The largest island in the gulf is Samal Island. Davao City, on the gulf's west coast, has the largest and busiest port on the gulf. Three million people in four cities of Davao, Island Garden City of Samal, Panabo and Tagum, and in 18 municipalities are living around the gulf with thousands relying on it for food and livelihood. North of the gulf lies the coastal municipalities of Maco, Mabini, and Pantukan of the province of Compostela Valley as well as the coastal towns of Davao del Norte and Davao Oriental. Mabini, approximately 70 kilometers away from Davao City, is located in the southeastern section of the province of Compostela Valley. It is bounded on the north by Maco, on the south by Pantukan and on the west by Davao Gulf. It is part of the Mabini Protected Landscape and Seascape. The said protected seascape and landscape covers a coastal area of approximately 3,433 hectares more or less, inclusive of the mangrove wilderness area of Pindasan Island as stated in Proclamation No. 2151 dated 29 December 1981. Kopiat island and Lunod island are found off the coast of Mabini. Feeding ground to cetaceans The Philippine Environmental Governance Project 2 (EcoGov), a technical assistance project in the Philippines funded by the United States Agency for International Development (USAID), has identified Davao Gulf as a feeding ground to 11 species of cetaceans including sperm whales, killer whales, and bottle-nose dolphins. A number of these species regularly swims the channels between the islands and mainland Mabini to feed on the seascape’s sea-grasses, rich of planktons and krill. Developers like Vista Land and Phinma Property Holdings Corp. have found the Davao City property market lucrative that they are making their presence felt, complementing the activities of existing small players in the residential market as well as developers in the commercial sector. The city’s characteristic as a "melting pot" makes it an attractive place to put up new homes, luring dwellers from neighboring areas, according to Phinma Property. Villar-led developer Vista Land and Lifescape, Inc. noted that Davao City has its share of prospective buyers composed of overseas Filipino workers’ family, businessmen, and even expatriates. Within Mindanao, Davao City is the largest city, covering 8 percent of the land area of Davao region (Southern Mindanao) alone, and is among the areas that attract major investments in Southern Philippines. For the whole Davao Region, it serves as the latter’s regional center. With an international airport in its area, it is one of the primary destinations of travelers to the Philippines. Cresencio M. Montalbo, Jr., an expert with the National Center for Transportation Studies of the University of the Philippines, said setting up a BRT for Davao City would cost up to $15 million per kilometer while a railway system would cost up to $40 million per kilometer. "In terms of construction time, because of its light infrastructure requirement, a bus corridor can be done within one and a half years, while the rail-based system requires about five years," he said in an Asian Development Bank (ADB)-sponsored forum held here last week. He admitted that most urban centers with high population densities prefer railway systems to decongest their roads, since these are considered relatively faster and more reliable than bus-based alternatives. The downside, Mr. Montalbo said, is that railways are expensive and beyond the reach of many local governments. At the same time, however, he said planners may be able to put such cost in perspective by estimating their local economies’ losses from traffic. Mr. Montalbo noted, for instance, that traffic costs Metro Manila about P140 billion a year in terms of pollution, additional fuel consumption, as well as lost man-hours and investment opportunities. Losses from traffic accidents add an estimated P105 billion each year, he added. In Davao City, Mr. Montalbo said a viable BRT route would pass through major industrial, commercial and residential zones, covering five kilometers. Bus routes should be segregated from regular road lanes because they will have fixed stations, he added. Theoretically, the system will involve pre-boarding fare collection, free transfers between corridors and regular trip schedules. "There is an inherent flaw of our conventional transport system because bus drivers or operators earn based on the number of passengers they carry," Mr. Montalbo noted. "But in BRT, they are paid based on the distance they travel, regardless of the number of passengers they carry." Almec Corp., the company ADB commissioned to conduct a five-month feasibility study on a prospective light rail transit (LRT) system here, said earlier this year that the project is not yet feasible because of expected low passenger volumes. Rene S. Santiago, the leader of the team, said Davao City is 10-15 years away from needing an LRT. He noted that even the LRT system in Metro Manila has to be heavily subsidized by the government to ensure adequate returns for investors. -- J. B.
