I am sure that its rendering would look awesome.

I think Dusit thani hotel should thinking about the exterior facelift.

Well, Soi Ruamrudee is indeed narrow, I can't believe such a tiny soi can handle many large scale projects.

they will disturb many people!!

Isn't there supposed to be regulations about constructions/building densities with such small sois?

How can they do that?. Along the road is full with constructions already.

no way, that is why they don't! just a wish...
but for some development that for example, connect Rumrueedee with Wireless (ex: Conrad), the access should be public and not reserved to only clients. that would help the congestion and access to rumruedee (maybe i am wrong, just a feeling)

this soi is on construction every wherre. i have recently moved there, a bit disturbing.. there will need to make the soi larger once everybody will move in there!!!

I would expect something more outstanding on that plot! something like All Season Place/Conrad. I think main problem is that soi 2 and 3 and quite small, same as Ruamruedee. From my understanding, that is the reason why the tall of the building is very limited.

^ Limiting the height makes sense. Well, height doesn't matter so much as they built architecturally sound buildings, not white slabs of stone.

Definitely true!!.last week I went to some restuarant in the soi.It's just minute away from BTS.But,I was so lazy to walk.then I found the bike.I waved him at BTS pleonchit.I told him I need to go to the restuarant.He quoted me for 30 baht.Then I bargained him like "C'mon just a minute away" so he quoted me for 20.that was so rip off. &*x@#9 Driver!.

^^^^That's still too expensive,I suppose ,as for me, I went to The Church, I paid just 10 baht..7 baht for fare+3 baht for tips. And the Church is just located at the end of the soi. :D

Thank you Khun Chad very much for helping me finding this project topic. I live in Soi Ruamrudee and see the contruction of this project from my window everyday but have no idea what's being built. A bit surprised to know that they are not building a taller building to take advantage of the expensive location, but I agree that the soi and traffic inside are congested enough.

Does anyone know if the residence portion is up for sale yet? (I doubt if I will be able to afford it but hey... it's fun to dream anyway.)

Soi Ruam Ruedee residents win case against Aetas hotel

The Central Administrative Court Thursday ruled in favour of residents of Soi Ruam Ruedee in their suit against the Bangkok Metropolitan Administration and the Aetas Bangkok Hotel.

The court ruled that the BMA has unlawfully allowed the hotel to be built on Soi Ruam Ruedee as the soi is not thorough 10-metre wide.

The Building Control Act of 1979 prohibits construction of a large and high building on a soi, which is less than 10-metre wide.

The court ordered the BMA and Aetas hotel to comply with act within 60 days after the ruling.

Chalermpong Klubdee, the lawyer who represented the residents, said the ruling meant the hotel had to be demolished because the construction had been done and the hotel could not be modified.

I'm sure they will file an appeal against it over and over and would take years and years and years.

Im sure the appeal to the Supreme Administrative Court will take a long time....but just a bit surprised that residents won in the court....maybe lots of phu yais in that expensive soi?

Testimony in Soi Ruamrudee case wraps

The Central Administrative Court is set to deliver a verdict in a landmark case in which Pathum Wan district office is accused of falsely certifying over a period of more than 15 years that Bangkok's Soi Ruamrudee is more than 10 metres wide to facilitate the illegal construction of several skyscrapers.

In the final court hearing in the case yesterday, Chalermphong Klabdee, a lawyer representing the complainants, said in his closing statement that the soi, which runs through an area of prime real estate, was less than 10 metres wide, making many buildings along it illegal.

The coaccused, a construction contractor that is building two tall structures in the area, said the firm was led to believe by Pathum Wan district office documents that the soi was more than 10 metres wide, which would make construction of the buildings lawful.

The 24 complainants are residents living on the soi and in nearby areas. The first two accused - a former Pathum Wan district office chief and a former Bangkok governor did not show up for the hearing.

Officials from several government agencies and the court's judges jointly surveyed the soi's width and found that it was less than 10 metres wide, as stated by the complainants, who want construction of the two buildings scrapped, and no further permits granted for new buildings.

Chalermphong said earlier that officials at the district office or any other government agency would faced criminal prosecution for abuse of power if evidence could be produced proving illegal acts.

A lawyer from the Foundation for Consumers yesterday lodged a complaint with the Administrative Court against the Bangkok governor and the director of the Pathumwan District Office.

Lawyer Chalermpong Klabdee represents more than 20 residents of Soi Ruamrudee, including Grand Chamberlain Khwankeo Vajarodaya and Chulalongkorn University lecturer and royal doctor Dr Songkhram Sapcharoen.

The complainants accuse the Pathumwan District Office of issuing a document containing false information to allow the construction of two tall buildings on Soi Ruamrudee. The owner of the two construction projects is said to have good connections with influential people.

The Bangkok Metropolitan Administration (BMA) has been blamed for not stopping the construction despite pleas from local people. "In spite of protests from the residents, the BMA and the Pathumwan District Office have allowed the construction to go ahead," Chalermpong said yesterday.

He said Apirak Kosayodhin, who is now seeking his second term as the Bangkok governor, headed the BMA at the time this case arose and then developed. So far, the complaint has not named Apirak in person.

"We have no intention to discredฌit anyone. We have to lodge the comฌplaint now because the case will soon expire," Chalermpong said, "We just complained about the office of Bangkok governor."

According to a BMA regulation, if a road is not wider than 10 metres, any construction along it must not rise above 23 metres from the ground.

Chalermpong insists that Soi Ruamrudee is not 10 metres wide along its entire length and thus should not be the location for an 18 story condominium and shopping complex and a 24 story hotel, which are set to emerge there.

He said that the BMA passed a regulation about construction heights in narrow lanes after a fire broke out at a big hotel in Soi Ruamrudee. As the soi was too narrow for fire trucks to carry out their operations efficiently, the fire caused huge casualties.

"It has been two years and seven months since the people filed comฌplaints with the Bangkok governor and the Pathumwan District Office director, but they ignored the comฌplaints. Moreover the construction of the buildings continues," the lawyer said.

Chalermpong added that grave danger could haunt the residents of Soi Ruamrudee if a fire breaks out. He also pointed out that the presence of a big hotel and another large complex would increase traffic congestion in the area.

In response to the complaint, Apirak explained that he had in fact already ordered the Pathumwan District Office to look into the case after receiving the residents' complaints.

Pathumwan District Office director Surakiart Limcharoen, meanwhile, said officials were now checking as to why the width of Soi Ruamrudee was not consistent.

"We have to check whether some portions of the soi are less than 10 metres wide because of encroachment," he said, "We have asked the Land Department to check the soi and confirm its width."
Surakiart said he welcomed the residents' move to bring the case to the Administrative Court.

ศาลพิเคราะห์ข้อมูลหลักฐานที่ผู้ฟ้องและผู้ถูกฟ้องนำเสนอแล้วเห็นว่า ซอยร่วมฤดีเป็นทางสาธารณประโยชน์และเป็นสถานที่ตั้งอาคารที่พิพาทมีความกว้างไม่ถึง 10 เมตร ตลอดแนวจริง ตามข้อมูลการรังวัดของกรมที่ดิน ได้รังวัดสอบเขตทาง ตามคำสั่งของศาลปกครองกลางเมื่อวันที่ 23 กันยายน 2553 จึงขัดกับกฎกระทรวง ฉบับที่ 33 (พ.ศ.2535) ในข้อ 2 ออกตามความในพระราชบัญญัติควบคุมอาคาร พ.ศ.2522 ที่ห้ามมิให้มีการก่อสร้างอาคารขนาดใหญ่ และได้มีคำสั่งให้ผู้ถูกฟ้องคดีคือผู้ว่าราชการกรุงเทพมหานคร และผู้อำนวยการเขตปทุมวัน ต้องปฏิบัติตาม พ.ร.บ.ควบคุมอาคาร พ.ศ.2522 ภายใน 60 วัน นับแต่วันที่ศาลมีคำสั่ง

นายเฉลิมพงษ์ กลับดี หัวหน้าศูนย์ทนายความอาสา มูลนิธิเพื่อผู้บริโภค กล่าวว่า การที่กฎหมายกำหนดห้ามมิให้มีการก่อสร้างอาคารสูงและมีขนาดใหญ่บนถนนที่มีความกว้างไม่ถึง 10 เมตร ตลอดแนวนั้น เนื่องจากกฎหมายนี้มีเจตนารมณ์ เพื่อประโยชน์เกี่ยวกับความมั่นคงแข็งแรง ความปลอดภัย การป้องกันอัคคีภัย การสาธารณสุข การรักษาคุณภาพสิ่งแวดล้อม การผังเมือง การสถาปัตยกรรม และการอำนวยความสะดวกแก่การจราจร แต่เนื่องจากอาคารที่เป็นข้อพิพาทก่อสร้างเสร็จสิ้นเรียบร้อยและเปิดดำเนินกิจการเป็นโรงแรม จึงน่าจะเข้าข่ายในกรณีที่เป็นอาคารที่ไม่สามารถแก้ไขเปลี่ยนแปลงให้ถูกต้องได้ กทม.และสำนักงานเขตปทุมวันจะต้องใช้อำนาจหน้าที่ตามมาตรา 42 แห่ง พ.ร.บ.ควบคุมอาคาร พ.ศ.2522 สั่งให้เจ้าของหรือผู้ครอบครองอาคารดำเนินการรื้อถอนอาคารนั้นทั้งหมดหรือบางส่วนได้ภายในระยะเวลาที่กำหนด แต่ต้องไม่น้อยกว่า 30 วัน

หากไม่มีการรื้อถอนตามคำสั่ง สำนักงานเขตมีอำนาจขอให้ศาลมีคำสั่งจับกุมและกักขังบุคคลซึ่งไม่ปฏิบัติตามคำสั่งได้ และดำเนินการหรือจัดให้มีการรื้อถอนอาคารดังกล่าวได้เอง โดยที่เจ้าของหรือผู้ครอบครองอาคาร ผู้รับผิดชอบงานออกแบบอาคาร ผู้รับผิดชอบงานออกแบบและคำนวณอาคาร ผู้ควบคุมงาน และผู้ดำเนินการ จะต้องร่วมกันเสียค่าใช้จ่ายในการรื้อถอนทั้งหมด

ด้านนายธีระชน มโนมัยพิบูลย์ รองผู้ว่าราชการกรุงเทพมหานคร กล่าวว่า ยังไม่ทราบคำสั่งศาลปกครองดังกล่าว แต่จะเรียกผู้อำนวยการสำนักการโยธา กทม.เข้าหารือ และต้องรอดูท่าทีของบริษัทเอกชนที่จะต้องรื้อถอนอาคารว่าจะอุทธรณ์ภายใน 30 วันหรือไม่ เพราะเป็นสิทธิที่จะทำได้

ขณะที่นายวินัย ลิ่มสกุล ผู้อำนวยการสำนักการโยธา กล่าวว่า จะให้เจ้าหน้าที่ตรวจสอบเอกสาร แต่เบื้องต้นยังไม่ขอออกความเห็นใดๆ จนกว่าจะตรวจสอบเอกสารทั้งหมดเสร็จสิ้น

นางภาวิณี อามาตย์ทัศน์ ผู้อำนวยการเขตปทุมวัน กล่าวว่า เพิ่งทราบข่าว และยังไม่ทราบรายละเอียดว่าเป็นอย่างไร เพราะเอกสารอยู่ที่ฝ่ายโยธาเขต ต้องรอตรวจสอบในวันที่ 10 กุมภาพันธ์ เรื่องนี้ยืดเยื้อมานาน ผู้ที่รับทราบรายละเอียดคือ นายสุรเกียรติ ลิ้มเจริญ รองผู้อำนวยการสำนักป้องกันและบรรเทาสาธารณภัย กทม. ซึ่งดำรงตำแหน่งผู้อำนวยการเขตปทุมวันในขณะนั้น เพราะตนเพิ่งมารับตำแหน่งช่วงปี 2553
