Krazy February 16th, 2005, 06:13 AM Development work in remote areas to begin in July Abu Dhabi: Residents in remote areas will see their neighbourhoods get bigger and better by the end of summer, the Minister of Public Works said yesterday. "A lot of work is being done to develop remote areas in the emirates," Shaikh Hamdan Bin Mubarak Al Nahyan, Minister of Public Works, told Gulf News on the sidelines of the Federal National Council session yesterday. "We are preparing developmental plans for these areas and the groundwork will take place between the end of July and beginning of August. We are working as fast as we can because we understand that residents in these areas are in dire need of basic facilities and proper housing." Addressing council members he said: "Our main priorities are developing road networks, housing, health and education. After these basic facilities have been set up, we will then develop parks and recreational facilities for youth." President His Highness Shaikh Khalifa Bin Zayed Al Nahyan donated Dh1.5 billion for the work. Shaikh Hamdan said there is a five-year plan for the development of these areas. "There is no end point for our work. People will always need additional houses, schools and other facilities. So we will never stop our work in these areas." FNC speaker Saeed Mohammad Saeed Al Gandi asked the minister if there were any plans to develop residential areas. "Don't you think it is more advisable to develop a residential area with no less than 10,000 residents?" he said. "These areas can have a school, a hospital and all the facilities an individual needs to live." Studies are being done to develop comprehensive residential areas for residents in remote areas, the minister said. People’s faces are creased, dust hangs in the air as if stuck in time, the whole area has been faded by the burning sun. This place wears its history with pride and sadness, because it knows that death is on the way. “It’s very bad that they are closing the souq. If you go to another market it will not be like this,” says Ghodratollah Kouhgard, a trader from Iran. At midnight today, one of the capital city’s few remaining historic landmarks will be shut down. In place of the Old Souq a new building complex will eventually rise, its luxury shops and restaurants acting as another gleaming showpiece for the UAE’s constant push towards modernisation. “Malls are no good, they are very expensive. Customers come here knowing they can purchase all kinds of things cheaply. In this market you can buy Arabian items, Indian items, Pakistani items, Bangladeshi items,” says Mohammad Alam, a perfume salesman. The Old Souq assaults your senses from the moment you see it. Surrounded by tower blocks and two busy roads, the market is a scar on this city’s well-polished landscape. Small, dilapidated shops overflow with people buying everything from shoes and make-up to books and food. Traders advertise their goods by shouting loudly and quickly, lowering or increasing the product’s price depending on how wealthy the customer looks. There truly is nowhere else like this in Abu Dhabi and for all those who move through here every day, the market’s imminent closure is something to be mourned. “This souq is much better than other places. It’s an old souq. All people come - rich, poor, young and old people,” says Mohammad Sohel, a Bangladeshi salesman. “If they demolish this there will just be shopping malls and they have no tradition and no culture.” The market has been open since the early 1960s and its age shows in the wistful way traders talk about their time here, the way they solemnly nod their heads when asked if they will miss the place once it is gone. History is also evident on the tables and shelves inside most stores. All that now fills one cosmetics shop is empty perfume bottles, rusty tins of mascara and a thick layer of dust. A sign posted outside says the owner has moved his goods to the Fish Market, five-minutes drive from here. The Old Souq’s demolition is part of a broader modernisation scheme launched by Abu Dhabi Municipality and Town Planning Department some time ago. During the last 12 months alone the city has lost other historical landmarks such as the GCC Roundabout, Volcano Fountain and Clock Tower, so the only real surprise is that the market has escaped closure for this long. Many traders here believe the first nail was put in the Old Souq’s coffin by a blaze that destroyed scores of its shops two years ago. The charred skeletons of those gutted stores still remain, acting as a constant reminder of that grim February night. “The fire caused problems because after that everyone said it should be demolished,” Mohammad Sohel recalls. Others trace the origins of the Old Souq’s demise even further back, to September 11, 2001. “From 1990 until 1997 it was very busy. We had so many Europeans, so many tourists coming here. Now every day gets worse. Maybe the tourists and the Europeans don’t come to the Middle East since 9/11,” says Abdul Hamed Al Baloushi, who runs a music store here. The 34-year-old is unlike many of his colleagues because he is a UAE national. Most of the traders working in the market come from India, Pakistan, Iran or Bangladesh, and much of the money they make is sent back home to their families. These are the people who will suffer most because of the souq’s closure. Many of the traders plan on relocating to Madinat Zayed Shopping Centre, although very few are optimistic about the move. Others are going to Abu Dhabi Fish Market and some just have no idea what they will do next. ALDAR Properties, the company behind the Dh1.3 billion building project, hopes to create “a prestigious and fully integrated mixed-use scheme at the heart of Abu Dhabi”. This will include a hotel, luxury shops, flats, restaurants, offices and a traditional market. Krazy March 4th, 2005, 11:25 AM GCC rail link ABU DHABI: A German company will sign A memoranda of understanding with the government of Abu Dhabi on the development of a railway linking Abu Dhabi with the neighbouring GCC countries. Dornier will investigate and conduct feasibility studies on how to link the Emirates with its neighbouring GCC countries. These will then be later developed into a master plan and later a detailed plan on how to construct a railway system in addition to the UAE's existing road network. ADTA was set up in September last year and since then it is actively engaged in organising the tourism industry by marketing its potentials. This week, it is participating in the international tourism show, ITB-2005, taking place in Berlin by leading a delegation of 26 companies providing hospitality services in the emirate. The industry stakeholders see the establishment of the tourism authority as emirate's commitment to boosting the tourism sector which offers tremendous potential for meetings, incentives, conferences and exhibition (MICE) market. Shaikh Sultan bin Tahnoon Al Nahyan is the chairman and Mubarak Al Muhairi, director-general of the new authority who have been given mandate for the development and promotion of tourism in the emirate. It is an indication of the government’s determination to secure Abu Dhabi’s rightful place on the international tourism map. The ADTA is working closely with the hotels, airlines, destination management companies and other travel-related organisations in Abu Dhabi to promote the emirate and raise its international profile as an upmarket destination offering superb facilities to the visitors — whether seeking a new cultural experience, an action-packed holiday or simply a relaxing escape. The agreement was also signed by Mark Nickles, Deputy Chief Executive Officer of Global Insight, the international consultancy firm which will conduct the study. The agreement provides for field surveys on tourism expenditure in the emirate and its distributions and assessment of the environment of investing in tourism. The study will also involve training of UAE nationals. A high level delegation, led by Sheikh Sultan bin Tahnoun Al Nahyan, chairman of Abu Dhabi Tourism Authority (ADTA), will represent the emirate at the exhibition, which will convene at Messe Berlin, the city's main trade show venue. The fair features an extensive gathering of exhibitors from the travel and tourism industry and attracts nearly 125,000 visitors every year. "The ADTA intends to conclude several agreements with tourism and travel authorities in various countries of the world," Mubarak Hamad Al Muhairi, director general of ADTA, told WAM today. He said his agency had drawn up an intensive action plan to make utmost use of participation in such an international gathering. He said, while in Berlin the ADTA delegation would hold talks with tourism officials of Germany, Britain and other countries to reach cooperation agreements with them. The authority will involve the private sector to invest in tourism related projects, the authority's top official said. "Abu Dhabi Tourism Authority (Adta) will act as the catalyst in driving and coordinating the growth and development of the emirate's tourism infrastructure, facilities and services," said Shaikh Sultan Bin Tahnoon Al Nah-yan, Adta chairman, after the opening of the International Tourism Exchange (ITB) here. "Tourism zones will be set up and many additional hotels and leisure facilities will be created and some of these projects will be announced shortly," he told reporters at the Adta pavilion. Adta also plans to develop Abu Dhabi's islands as tourism spots. "We will utilise the natural assets of Abu Dhabi such as islands but the private sector will be encouraged to invest with whom we plan to work closely." Over 10,400 companies from 181 countries are participating in ITB, the world's largest travel and tourism event. Unveiling Adta's strategy, Shaikh Tahnoon said the focus will be on tourism promotion, development and regulation. "We will work with hotels, airlines, destination management companies and other travel related organisations in Abu Dhabi to promote the emirate and raise its international profile as an upmarket destination." In parallel with its promotional role, Adta will actually drive development in the emirate as part of the diversification plans. "Building the tourism infrastructure is our goal here along with provision of other facilities for tourists." The regulation and classification of Abu Dhabi's tourism sector is the third area of focus. "This is to ensure consistently high quality standards. It includes licensing and classification." Mubarak Al Muhairi, Adta director-general, told Gulf News that tourism will figure prominently in the emirate's future growth strategy. "We are serious and the plan is to add 20,000 more hotel rooms in the next 10 years to cope with demand and growth in tourism from the present 7,500 rooms." Krazy March 13th, 2005, 06:27 AM Abu Dhabi's second air terminal opens in months Berlin: The Abu Dhabi International Airport's second terminal will be operational by August to handle 8 million passengers annually by 2008, after which a new airport will be built, a top official said. "A second terminal is coming up just 700 metres from terminal 1 as an interim solution until a new airport is built," said Dr Shaikh Ahmad Bin Saif Al Nahyan, Chairman of the Department of Civil Aviation. "Terminal 2 is being built as a fast-track project to be ready by August this year. It will have two separate buildings, one for arrivals and one for departures," he said, without stating the costs. Currently the airport handles 5.4 million passengers annually. Terminal 2 will be connected to terminal 1 with service transport for quick transfers and transit at both terminals. "The new terminal will provide all services and will serve a host of airlines. There are infrastructure modifications being undertaken to ease the flow of traffic. At terminal 1 we are looking at a host of re-modifications and re-distribution of services," said Shaikh Ahmad, adding that details will be unveiled shortly. To accommodate more aircraft, the airport is building nine new aircraft stands away from the terminal. "We are expecting high growth in traffic and Etihad Airways is also expanding fast. Therefore this programme is fast-tracked with approval from the higher authorities." The airport handled 5.4 million passengers in 2004, 22 per cent higher than the preceding year. Prospects for similar growth are projected for 2006 and the coming years. The Abu Dhabi Duty Free has already signed up 1,250 square metres of space at the second terminal, said Mohammad Mounib, ADDF general manager. "We had a good year. We hope this year too we will repeat our business performance," Khalifa Nassar Al Mansouri told reporters at the ITB-2005 in Berlin. He said that his group is working on the feasibility studies to capitalise the huge growth of tourist traffic into the country, which necessitates in creating more tourist facilities and infrastructure. He said that work on Jumeirah Beach Hotel, a $100 million project is in full swing and by 2007, the property would be opening up its doors to the guests. Already in a phased-manner, ADNH has refurbished and renovated its major properties in the capital, he said, adding that work on Hilton hotel renovation costing Dh50 million has just just completed, giving a new look to 145 rooms, lobby and restraurants. He said that next on line to be refurbished is the Le Meridian hotel, on which work would start next month . It will also cost Dh50 million. To a question, he said that though there is no immediate plan to venture-out of the UAE, since ADNH believes in good rate return on investment to start up a new project, "Our options are open, but we will first see the growth opportunities available in the Gulf region." He did not favour the idea that hotel owners and management should dictate their tariffs to the market. " We must leave it to the free market forces to fix it," he said. About ADNH's presence at the ITB-2005, he said that the group has long association with the travel exhibition, as Germany is the most important market for Abu Dhabi due to which the group takes part in the ITB. The 14-month contract calls for the construction of a 600-metre bridge with eight lanes linking the mainland with the island. A local firm identified as The Consultant Engineering & Project Management Company is the consultant for the bridge project. Located northeast of the capital and covering an area of 5 million square metres, Abu Shuoom island will be developed into a city with residential and commercial properties, hospitals, schools and entertainment hubs. A consortium made up of Malaysia’s PPM International, the local Al-Rayyan Investment Company and National Real Estate Investment Company, both local, were selected to develop the project in December. A project manager is expected to be appointed during the first quarter. Emirates Pearl is one of several multi-billion dollar, mixed-use and hospitality developments proposed for the emirate. An even larger project, Al-Raha Beach complex, was officially unveiled on 8 February. Under the estimated AED 54,000 million ($14,700 million) plan, Al-Raha is set to become a new city district with a built-up area of 12 million square metres. The city, to be built on reclaimed land, will comprise numerous towers and low-rise developments on the waterfront and house about 120,000 people. Linked to Khalifa Town ‘A’ and Al-Raha Beach hotel, a network of water taxis is also planned to link the complex with Abu Dhabi’s city centre, and various islands such as Saadiyat. "We plan to add two new properties one in Abu Dhabi and one in Dubai, in 2005 and 2006, respectively. We are interested in managing hotels across the UAE and the Gulf," said Khalifa Nasser Al Mansoori, chairman of Abu Dhabi National Hotels Company (ADNH). "There are opportunities in some GCC cities. Abu Dhabi to get another airport by 2009 Abu Dhabi: Abu Dhabi's new airport will become operational in 2009 as part of a plan to handle increasing air traffic, an official said. “The Abu Dhabi International Airport’s expansion is taking place in two phases. In the first phase, a new terminal is being built and will be ready by August 2005. “In the second phase, a totally new airport will be built [and] become operational in 2009,” said Dr Shaikh Ahmad Bin Saif Al Nahyan, chairman of Abu Dhabi Civil Aviation. “The new airport will [be located] around the same area as the existing airport. The second phase is still [being] planned,” Dr Shaikh Ahmad said, speaking aboard a refurbished Gulf Air A330 yesterday. The investment outlay in the new airport was not disclosed. The first of six A330s being refurbished for Gulf Air was unveiled yesterday. It entered service on the Abu Dhabi-London route. The other five will be upgraded by July as part of a $10 million (Dh36.7 million) programme. Earlier, Dr Shaikh Ahmad and senior officials representing the Civil Aviation Department and Gulf Air inspected the new-look aircraft. The refurbishment programme is a “journey of change”, said James Hogan, president and chief executive of Gulf Air. After the refurbishment of all six A330s, the airline will begin the same procedure for six A320s and five A340s, Hogan said. “The second phase of the refurbishment of the A320s and A340s will start later this year, with investments of over $10 million [Dh36.7 million]. The new premium cabins will create a five-star ‘hotel’ in the sky, re-creating the golden age of travel that Gulf Air was renowned for two decades ago,” Hogan said. “This will also improve the yield and attract more passengers,” he said. "UAE nationals have already been granted the right to own property," said Khaldoon Khalifa Al Mubarak, CEO of the Mubadala Development Corporation (MDC), an investment arm of the emirate. MDC CEO was giving a presentation on corporation's business activities at a meeting organised by the Australian Business Council (ABC) President Brian Daniels, which was attended by about 100 members of the group besides Australian Ambassador to the UAE Noel Campbell. Khaldoon Khalifa Al Mubarak gave a run-down of the MDC business activities, its objectives and took some questions also from the audience. He said that Abu Dhabi is clear in diversifying its oil dominated economy and boosting its non-oil economic profile, and towards this ends, the emirate is in process of launching various proactive and bold initiatives which will put it among the top business and investment havens. The emirate, he said was all out for helping the private sector, as it believes is engine of growth. Talking about Dolphin Energy, a project which is developing the Dolphin Gas Pipeline, the first cross-border natural gas network in the GCC region that will supply gas for current and future power generation and water desalination plants and industries in the UAE and Oman. The project will produce natural gas from Qatar's north field, which will then be processed through Dolphin's processing plant at Ras Laffan. The processing plan will strip out commercially valuable liquid hydrocarbons and the resulting dry gas will be transported by pipeline to Abu Dhabi via 400km pipeline. "The gas is scheduled to be on stream in the fourth quarter of 2006", said Khaldoon Khalifa Al Mubarak. Though he hinted that the pipeline, which was scheduled to be extended to Pakistan and India, he said it might not go beyond the UAE. He said that Mubadala has a number of substantial projects under its belt particularly in the energy, utilities, real estate, basic industries, IT and services. He said that Aldar Proprieties, a recently launched real estate development, management and investment company has been mandated to create unique projects in the emirate, as a first step and later throughout the UAE and the region. Exhibition industry watchers see the decision to shift responsibility for the licensing of exhibitions to the Abu Dhabi Tourism Authority from the General Exhibitions Corp as an important step towards achieving this goal. The Abu Dhabi Tourism Authority has become the sole licensing authority for all exhibitions in the capital, an official said. According to the chairman of the Tourism Authority, Abu Dhabi wants to increase the number of exhibition delegates visiting the capital by 600 per cent over the next decade. "All exhibitions in Abu Dhabi will henceforth be licensed by the Abu Dhabi Tourism Authority (ADTA), according to a decree. The details are being finalised," Mubarak Al Muhairi, director-general of ADTA, told Gulf News. ADTA was established in late 2004. The General Exhibitions Corp (GEC), a Government of Abu Dhabi exhibitions-organising body, was previously the sole licensing authority for exhibitions in the capital. It will continue providing logistical support to those seeking to hold exhibitions here. The shift of licensing powers to ADTA from GEC is consistent with Abu Dhabi's tourism-related ambitions, industry sources said. It means a single agency can focus on identifying ways to maximise the number of business travellers and tourists who visit the capital. A more centralised approach makes this task easier, they said. "GEC will remain independent," Al Muhairi said. He spoke on the sidelines of the MICE (meetings, incentives, conferences and exhibitions) industry Mid-East Congress that began here yesterday. "The target for leisure tourists has been fixed at three million against current arrivals of 835,000," he said while inaugurating a three-day meeting, Incentives, Conferences and Exhibitions (MICE) Middle East, which will discuss issues relating to the industry. The emirate, which has over 200 islands, sun-shine, beaches, rugged mountains, lush green fields, and desert besides a world class infrastructure to hold MICE events, wants its rightful share from an industry which has a turnover of $400 billion. Outlining the role of his new Authority, he said that it is regulating the tourism sector, developing its infrastructure improving the profile, apart from destination marketing across the globe. "We are working to develop the tourism industry in the emirate by identifying the areas where private sector can make investments and help improve the hospitality infrastructure," said Shaikh Sultan bin Tahnoon. About the emirate's potential for leisure and business tourism, he said that peace and tranquillity, exemplary law and order, physical, sports and recreational infrastructure would be marketed in the Western Europe. "In geographical terms, the Authority has identified Western Europe as our primary target market. The initial focus will be on the two largest sources of outbound travel, the UK and Germany, together with German-speaking Switzerland and Austria. This is reflected in our plan to establish on-the-ground representation in these two markets during 2005," he explained. In subsequent years, he said that there will be a gradual rollout of representation and promotional activity into other European countries. Activities promoting the MICE sector will also initially target Europe but are likely to be more international in scope. On the homepage just click Portfolio and then goto the International projects section to see all these projects. Here's an article (http://www.ameinfo.com/47040.html) concerning the launch of the Moorish-themed tower in DMC and its name is Al Sufouh. Of course no render and virtually no information since its launch in October of last year and its a very good, naturally, since the design won an architectural competition. Also in this article (http://www.isleind.org/LII2005Conf.asp) it talks about this guy who works at TVSA who "has contributed the original design concepts for the Megapolis of Dubai’s Business Bay, the extension of Dubai Creek back into the Persian Gulf, the new Global Village and the Seven Pearls of the Emirates among others." Also how can they not know about a tower that they have on their website, they definitely have info now. Plus, the design on their website for DSC is very different from the ones we've seen and it would nice to know whats up with that. Al Ghafli said that the establishment of Sorouh comes within the framework set by the President, His Highness Shaikh Khalifa bin Zayed Al Nahyan and General Shaikh Mohammed bin Zayed Al Nahyan, Crown Prince of Abu Dhabi and Deputy Supreme Commander of the UAE Armed Forces, to establish new development projects enhancing the economic performance and adding to the active development of the construction sector, coping with the current economic boom in the various sectors. He pointed out that the shareholders' stake is to constitute 45 per cent valued at Dh1.125 billion, whilst the public subscription constitutes the remaining Dh1.375 billion. Krazy May 4th, 2005, 05:59 AM Abu Dhabi all set to place itself on world tourism map May 3, 2005 The tourist sector in Abu Dhabi is now set for take off in the coming years, according to a report published online by the Oxford Business Group (OBG). "While Abu Dhabi's tourist sector has long been one of the emirate's more under-developed sectors, it is now set for take off in the coming years. Spurred by the will to diversify the oil state's economy, the Abu Dhabi Executive Council has placed tourism at the centre of its strategic thinking," said the OBG in its online print. The OGB is a leading publisher of economic and political intelligence on the emerging markets of the Southern Balkans, North Africa, the Levant and the Gulf. Across the world, Dubai has successfully marketed itself as an international destination. The newly established Abu Dhabi Tourism Authority (ADTA), the print said, has been tasked with increasing tourist numbers in the emirate from around 830,000 a year in 2003, to over 3m by 2015. "Of this figure, half are expected to be business visitors, growing organically from the current 627,000 in line with expected economic growth... "One of the principal components of this strategy is the new airline, Etihad, which was set up in 2003, is the fastest growing carrier in the world. Its current fleet of eight aircraft will soon be augmented by the 29 it bought recently (with options for a further 15) in a shopping spree costing more than $7bn." "The government will designate certain 'Tourism Zones', where the legal, licensing and ownership framework will be more attractive to the private sector. But the government will not use public money to build the facilities," he said. ADTA's role is instead to be a facilitator, providing the private sector with whatever it needs in order to stimulate growth. However, ADTA will also be keeping strict control over quality through a centralised licensing and classification process. The print said ADTA intends 44% of the 17,000 new rooms it wants to see built in the emirate in the next decade to be five star. The master plan involves the construction of a new midfield passenger terminal, a second runway at a distance of 2,000 metres from the existing runway, cargo and maintenance facilities and other commercial developments on land immediately adjacent to and north of the existing airport. The first phase is due to be completed by 2010. Once completed, the project will also provide a top-quality home base for Etihad, helping it to continue the steady expansion of its operations, Overall, the project will see a doubling of the existing airport land area to 3,400 hectares, with dedicated buffer zones to the north and south. The new facilities will be designed for an initial handling capacity of 20 million passengers a year when they open in five years’ time, and an ultimate capacity of 50 million passengers a year. The announcement was made at the Arabian Travel Market 2005 yesterday by Khalifa Al Mazrouei, chairman of Supervision Committee for Expansion of Abu Dhabi International Airport (SCADIA), on behalf of Shaikh Ahmed bin Saif Al Nahyan, Chairman of Abu Dhabi Civil Aviation Department and President of Etihad Airways. Al Mazrouei said: “As the capital continues to expand, Abu Dhabi International Airport will be even better placed to provide access to the greater metropolitan area. Once completed, the expanded airport facilities should be sufficient to meet projected demand for another 50 years.” The master plan for the project has been completed by New York-based Skidmore, Owings & Merrill, while another US firm, Parsons International has been appointed as the programme managers. Phase one of the project is scheduled start in four months' time. Earthworks will start one month prior to the completion of the design, which will take 18 months to complete. Another key part of the project is the provision of a substantial increase in cargo facilities, with an ultimate handling capacity of around two million tonnes of freight a year. A major user will be Etihad Airways, which has identified air freight, in particular transit cargo, as one of its key growth areas. The other airlines currently serving Abu Dhabi International Airport will also benefit from the expansion. Close to the new cargo facilities land has been allocated for related commercial activities, including free trade zones. Aircraft maintenance facilities will continue to be concentrated on the south side of the existing airport. The plan also sets aside land for the growth of other operators, such as Royal Jet and Abu Dhabi Aviation. One of the first phases of the project will be the construction of a second runway, scheduled to start next month. Planned at 4,100 metres in length, the new runway is widely spaced allowing for complete independent operations and is designed to cater for the latest generation of aircraft, including the new double-decker Airbus 380. Etihad Airways is due to take delivery of its first A 380 in 2007. Al Mazrouei said that Abu Dhabi International Airport, which has been recording 20 per cent year-on-year growth in passenger traffic for the last four years, was running over capacity. The emirate needs 7,000 more rooms to cope with the expected demand. "Abu Dhabi is set to make a giant leap in tourism, resort and leisure," Abdullah Khalfan Al Rumaithi, managing director of the National Corporation for Tourism and Hotels (NCTH), said. "We are planning to build more than ten hotels by 2010 to meet the growing inflow of three million holidaymakers by that time." NCTH, a 40 per cent Abu Dhabi government-owned company, will launch within the next two weeks an expansion of the Abu Dhabi InterContinental Hotel, one of the emirate's key resorts. "The Dh100 million project, expected to be completed by the end of 2006, will add 50 rooms, taking the total room capacity to 380," he said. The project also involves the construction of seven meeting and conference rooms equipped with ultra-modern technology. "The rooms, to be named after each of the seven emirates, will open in September," he added. NCTH hotels achieved more than 90 per cent occupancy in the first four months of this year, making it the highest rate in 25 years. He expected the occupancy rate in all the emirate's hotels to hit a record 75 per cent this year. Krazy June 27th, 2005, 10:36 AM Freehold to boost market BY ISAAC JOHN 27 June 2005 DUBAI — The recent landmark decision by Abu Dhabi to enact a free-hold property law — a strategic move that is expected to speed up the legislation of the long-awaited federal property law enabling full foreign ownership of real estate assets in the UAE as a whole — is expected to give a new impetus to the foreign investment flow into the country. The federal legislation, also enabling foreign nationals to be issued a full title deed for their ownership of landed property anywhere in the UAE, will also prompt more developers coming to the fray with mega projects. Property developers believe that only a uniform federal property law can allay investor fears and clear all the remaining ambiguity in those transactions, which are being labelled as freehold in some emirates. Investors are aware that the current law is still not transparent with regard to foreign ownership of property in the UAE. While the current federal law doesn’t prohibit the ownership of UAE property by a foreign national, the registration procedures are yet to be clearly defined. "As there is no proper federal property law in the UAE, freehold ownership cannot be held to be illegal, but neither is it explicitly legal," one lawyer pointed out. As there is now a clear indication that a federal freehold law is in the offing, the deck is finally ready for Dubai and other emirates to go ahead with that vital piece of legislation permitting foreign ownership not only to certain developers but to all who are in the business. Such a move, which is imminent, will see scores of new developers coming to the fore with more affordable properties in relatively less prime locations for the expatriate residents and investors. And property industry sources estimate that such a scenario will lead to a drastic upward revision of the property investments from overseas. This is particularly true in the backdrop of an increasing repatriation of Arab funds from the West in addition to the investments from non-residents from the neighbouring regions. Current market research indicate the size of the AGCC real estate market to be around $ 90 billion to $110 billion with the UAE and Saudi Arabia accounting for some 80 per cent of the total market. Abdul Rahman G. Al Mutaiwee, Director-General of Dubai Chamber of Commerce and Industry, has stressed the need for a law to formalise expatriate freehold ownership of properties. "The Federal Government is currently working on the property ownership law. For current buyers, a fair contract between a property seller and buyer would ensure the rights and privileges of the expatriates owning freehold properties in Dubai. If anyone has any doubts about his rights, he should carefully study the contract," he pointed out in a recent statement. Analysts see Mutaiwee's statement as a declaration that Dubai government will safeguard the freehold rights of buyers until the federal law is passed. And it should be noted that a federal law can not be passed without the agreement of the Dubai Government. Lawyers point out that notwithstanding the legislation of a property law, there are other legal matters that should be considered by property investors. "A purchaser may be at risk with regard to the initial monies deposited. The properties in question are often not yet built, yet purchasers are paying the developers a large percentage of the purchase price." "There is no requirement under the current law for protection of the purchaser in the event difficulties arise with a developer who is not backed by the government. The matter is most likely left to the contractual agreement between the purchaser and the developer. Purchasers should consider that the contract is undoubtedly drafted in favour of the developer. There is also some uncertainty regarding the Sharia law implications of real property inheritance." Stressing the need for an inflow of fresh funds into the market by attracting foreign direct investment, analysts said there is a need to introduce the concept of securitisation and regulations that increase its flexibility and market awareness for individuals on alternative debt options such as securitization, sukuks and funds. The three new properties will come up over the next three years. "The hotel and tourism sector is poised to become the second most important sector after oil in Abu Dhabi in the coming years, and ADNH is getting ready to be a big player by setting up more hotels," Peter E. Cardnell said. "Over the next three years, ADNH is investing in three new five star hotels in Abu Dhabi alone. We are in advanced stages of negotiations. The hotels will be owned by ADNH completely and will be operated by international hotel chains," he told Gulf News in an interview prior to his departure from the group. Cardnell leaves ADNH after a four-year stint. So many of these proposals looks really good. They're really creative, especially that egg one. I hope they end up getting built, maybe in business bay.
