SC: Cityhood of 16 towns constitutional
The Supreme Court, by a vote of 6-4, reversed Tuesday its November 18, 2008 decision and declared as constitutional the cityhood laws or Republic Acts converting 16 municipalities into cities.
In a 35-page decision penned by Justice Presbitero J. Velasco, Jr., the Court granted the second motion for reconsideration of the Court’s earlier decision which had ruled that the said cityhood laws violated Sections 6 and 10, Article X of the Constitution.
Declared as valid and constitutional are RA Nos. 9389 for Baybay City in Leyte), 9390 (Bogo City in Cebu), 9391 (Catbalogan City in Samar), 9392 (Tandag City in Surigao del Sur), 9393 (Lamitan City in Basilan), 9394 (Borongan City in Samar), 9398 (Tayabas City in Quezon), 9404 (Tabuk City in Kalinga), 9405 (Bayugan City in Agusan del Sur) RA 9407 (Batac City in Ilocos Norte), 9408 (Mati City in Davao Oriental), 9409 (Guihulngan City in Negros Oriental), 9434 (Cabadbaran City in Agusan del Norte), 9435 (El Salvador City in Misamis Oriental), 9436 (Carcar City in Cebu), and 9491 (Naga City in Cebu).
All cityhood laws, enacted after the effectivity of RA 9009 increasing the income requirement for cityhood from P20 million to P100 million in sec. 450 of the Local Government Code (LGC), explicitly exempted the respondent municipalities from the said income requirement.
Concurring with the decision were Justices Renato C. Corona, Teresita J. Leonardo-De Castro, Lucas P. Bersamin, Roberto A. Abad, and Martin S. Villarama, Jr. Justice Antonio T. Carpio wrote a dissenting opinion and was joined by Justices Conchita Carpio Morales, Arturo D. Brion, and Diosdado M. Peralta.
Chief Justice Reynato S. Puno, Antonio Eduardo B. Nachura, and Mariano C. Del Castillo did not take part.
The Court held that consistent with its plenary legislative power on the matter, Congress can, via either a consolidated set of laws or a much simpler, single-subject enactment, impose the said verifiable criteria of viability [for cityhood].
These criteria need not be embodied in the Local Government Code, albeit it is the ideal repository to ensure, as much as possible, the element of uniformity. Congress can even, after making a codification, enact an amendatory law adding to the existing layers of indicators earlier codified, just as efficaciously as it may reduce the same, the decision said.
The Court held that the favorable treatment accorded the 16 municipalities by the cityhood laws rests on substantial distinction. It noted that respondent LGUs had pending cityhood bills before the passage of RA 9009 and the year before the amendatory RA 9009, respondent LGUs had already met the income criterion exacted for cityhood under the LGC of 1991.

At least may city nanaman ang probinsya na under sa kanilang administration. This is a great news. Sana magstop na ang paggawa ng maraming cities dito sa Pinas. Marami ang mag 'cities' kung tawagin pero hindi naman mukhang city or di nga nakapasa sa requirements. We have towns na dapat nang tawaging 'cities' pero hindi maapruaprubahan ng SC.

At urban na tingnan ang Borongan, Catbalogan since capital sila ng kanilang respective provinces except for Baybay. Baybay too has a bustling economy. Since ngayon papasok na ang Prince Warehouse. Congrats!

Robert Go, who was in this city this week to sign an amended memorandum of agreement with city officials led by Mayor Michael L. Cari, said that instead of the usual “warehouse” type of a shopping center that they are known for, their mall here will be a mini-version of the bigger malls in the country.
Set on just around 9,500 square meters of what will be the former public market of Baybay, he said that the mall will be designed and conceptualized in such a way that it would capture customers from various ages, and make them stay there for a day, instead of just shop and run.
Go said that at the moment of the interview, three people who were formerly connected with Ayala Center in Cebu when the now well-known haunt, Ayala Terraces, was being developed, was doing a study of their Baybay location.
The initial concept is to develop not merely a grocery/department store, but also strategically located specialty shops and variety zones that will cater to children, teens and adults. They are even mulling making the whole area a “hot spot” for the hip crowd who’d want to surf over a cup of coffee.
To do this, Go said, they are also inviting big and established names from various food and retail industries to come over – alongside local shops which can meet the mall’s stringent standards.
“What is important is we get locators from big cities so that people here will not see the need to go to Cebu or Manila anymore, because what they seek is already here”, explained Go.
Included in their study, he said, is the affordability of the food and retail lines they would carry. “We must also consider the buying power of the people here” pointing out that Baybay was a vibrant place having a college and a university, aside from a sprinkling of technical schools.
The Prince Warehouse is looking at catering to the needs of the people all the way from Abuyog on the North, Matalom on the south, even Ormoc City.

I'm not saying na Tacloban is earning big pero we are not IRA dependent. Ang mangyayari ngayon ang IRA share ng ibang cities ay mababawasan to give way for the new cities. Kawawa naman yung iba diba? I think almost 30M ang mababawas sa IRA share ng Tacloban para sa bagong cities. 30M? Makakapalit na kita hin 6 ka set hin traffic lights. Sayang.

TACLOBAN CITY – The developer of the MacArthur Park Beach Resort Hotel is scheduled to open the newly-built facility on the third quarter of 2010 after completely turning the property into a world-class hotel, a provincial government official said.
Nelieta C. Baguna, head of the Leyte Tourism and Investment Promotion Center, said that officials of a Singaporean conglomerate are planning to open villas while it will continue to construct the hotel’s main building between July to September next year.
“The latest plan is to open single detached villas to cater needs of visitors who want to experience the comfort of home,” Baguna told Leyte Samar Daily Express.
Early this year, the provincial government signed a contract with LKY Property Holdings Incorporated, which gives the latter a right to officially proceed with their renovation of the temporarily province-run MacArthur Park Beach Resort Hotel.
The contract earned the developer a 25-year contract to take-over the state owned tourism facility. The Singapore-based chain of hotels is the same investor that bought the ownership rights to the Mayon Imperial Hotel in Legazpi City, Albay.
According to the provincial government, the company will invest at least P300 million for the full renovation of the 43-room hotel that would include knocking the present structure and building a new five-star hotel structure.
“LKY Holdings is currently flattening the ground after they tore down the old building. Full blast development will proceed after the Christmas holidays,” Baguna said.
The provincial government has been aggressive in luring hotel investments since it’s one of the weak points of the province in terms of tourism. There were big groups that were discouraged to hold activities in the province because of constraints in accommodations.
Leyte Governor Carlos Jericho L. Petilla said that they have intended to invite the private sector to develop the property. “It has been tried and tested that if it is the government that runs a facility, more often, it loses.”
The provincial government has been subsidizing P400,000 a month expense since its formal take-over from January 2009 until the third quarter when LKY started the construction.
The property is situated along the historic Red Beach , site of one of the greatest naval battles in history. The hotel is just few meters away from the MacArthur Landing Memorial in Palo, Leyte .
Old hotel rooms are all decorated with native materials and MacArthur pictures. It has picnic grounds, swimming pools, picnic tents and tables, beach kiosks, volleyball ground, and indoor games facilities.
The MacArthur Beach Resort and Hotel was built by then First Lady Imelda Romualdez-Marcos in the town of Palo, Leyte and sequestered by the government after the Edsa Revolution in 1986. (Sarwell Q. Meniano)

TACLOBAN CITY— The President’s alter ego in the region projected a better climate for businesses in the region next year with the high occupancy rate of hotels and increasing volume of air traffic in Tacloban - the regional capital.
“The growing number of visitors is an indication that local economic activity is improving. We can look forward for more economic activities in 2010,” said Presidential Assistant for Eastern Visayas Cynthia Nierras.
Nierras said that number of incoming and outgoing aircrafts have significantly improved in the past three years due to increasing demand for air travel from and to Tacloban City from Cebu and Metro Manila.
“Branch managers of airline companies told me that all seats are filled for Manila-Tacloban and Tacloban-Manila flights,” she stressed.
The Civil Aviation Authority of the Philippines reported that the Tacloban Airport has been accommodating incoming and outgoing flights daily.
“In terms of hotel accommodation, I have a hard time getting reservations even for those high officials from Manila because almost all hotels are fully booked year round,” Nierras told Leyte Samar Daily Express.
“This was also confirmed by hotel owners. These are the things that we have experienced just this year,” she added.
In a recent gathering, the official told members of the business community to be optimistic for next year’s economic growth.
“The potential is there. We just need to stay competitive,” the presidential assistant pointed out.
It can be recalled that it was this year that Robinsons Place expanded to Tacloban City, a few months after Gaisano Central opened its mall type store in this city late 2008. (Sarwell Q. Meniano)

CEB highlights Tacloban as most convenient to travel to Cebu and Manila

TACLOBAN CITY-Budget carrier Cebu Pacific (CEB) yesterday highlighted inter-island flight from Tacloban as the “most convenient to travel to Cebu and Manila.”
“CEB is a great airline for business and leisure travelers due to its convenient same day returns. Our Tacloban-Manila flights, for example, begin at 6:05 a.m. and the last return flight is at 4:25 pm,” said CEB Vice President for Marketing and Distribution Candice Iyog.
In Tacloban Airport, CEB has been operating a daily ATR 72-500 service from Tacloban to Cebu, and a five times daily Airbus service from Tacloban to Manila.
Iyog said in statement yesterday that the lowest possible year-round ‘Go Lite’ fare for the Tacloban-Cebu route is P988.
For those going from Tacloban to Manila, it’s P1,188. Passengers with check-in luggage will just add P100 upon booking.
As this developed, the airline company urged ferry and bus passengers to try airline alternative for their travel needs.
“CEB can get them to their destinations faster at comparable fares. Passengers can book early to avail of our low fares, and are advised to check-in at the airport early during peak travel periods,” she added.
In his recent visit to the city during the opening of Robinsons Place Tacloban, Lance Gokongwei, CEB’s president and chief executive officer, said that the local economy is progressing.
“I think the city has been progressive even flights of Cebu Pacific (CEB) have increased. There’s a lot of demand for travel to Tacloban and Region 8. From last two to three years ago, we are only doing two times a day flight. Now, we are going five flights daily from Manila and once to Cebu,” Gokongwei said.
Gokongwei-owned CEB flies to 32 domestic and 14 international destinations, using one of the youngest fleets of aircraft in Asia. Since its inception in 1996, it has flown over 36 million passengers, making it the third largest low-cost carrier in Asia. (SARWELL Q. MENIANO)

Good news! I hope Philippine Airlines and Zest Airways follow!!! Napakaganda talaga ng market nila dito sa Tacloban. DZR is one of the busiest airports here in the Philippines.:D

TACLOBAN CITY— The President’s alter ego in the region projected a better climate for businesses in the region next year with the high occupancy rate of hotels and increasing volume of air traffic in Tacloban - the regional capital.
“The growing number of visitors is an indication that local economic activity is improving. We can look forward for more economic activities in 2010,” said Presidential Assistant for Eastern Visayas Cynthia Nierras.
Nierras said that number of incoming and outgoing aircrafts have significantly improved in the past three years due to increasing demand for air travel from and to Tacloban City from Cebu and Metro Manila.
“Branch managers of airline companies told me that all seats are filled for Manila-Tacloban and Tacloban-Manila flights,” she stressed.
The Civil Aviation Authority of the Philippines reported that the Tacloban Airport has been accommodating incoming and outgoing flights daily.
“In terms of hotel accommodation, I have a hard time getting reservations even for those high officials from Manila because almost all hotels are fully booked year round,” Nierras told Leyte Samar Daily Express.
“This was also confirmed by hotel owners. These are the things that we have experienced just this year,” she added.
In a recent gathering, the official told members of the business community to be optimistic for next year’s economic growth.
“The potential is there. We just need to stay competitive,” the presidential assistant pointed out.
It can be recalled that it was this year that Robinsons Place expanded to Tacloban City, a few months after Gaisano Central opened its mall type store in this city late 2008. (Sarwell Q. Meniano)

Baybay, Borongan, Catbalogan, 13 others in RP retain citihood status
Tacloban City (December 24) -- It is indeed a Merry Christmas for the cities of Baybay, Borongan and Catbalogan in Eastern Visayas.
The Supreme Court reversed its decision on the fate of the cityhood of 16 Philippine municipalities that was earlier nullified by the tribunal.
With a vote of 6-4, the Supreme Court en banc granted the second motion for reconsideration filed by several municipalities that earlier lost their city hood because of the tribunal's November 18, 2008 decision that held the city hood laws unconstitutional.
The Supreme Court thus restored the validity of the city hood laws that created cities out of the towns of Baybay in Leyte; Borongan in Eastern Samar; Catbalogan in Samar and 13 others.
The others are Carcar, Bogo, Naga in Cebu; Tandag in Surigao del Sur; Tayabas in Quezon province; Lamitan in Basilan; Tabuk in Kalinga; Bayugan in Agusan del Sur; Batac in Ilocos Norte; Mati in Davao Oriental; Guihulngan in Negros Oriental; Cabadbaran in Agusan del Norte; and El Salvador in Misamis Oriental.
The High Court ruled that the authority to create, divide, merge or abolish boundaries of a city is essentially legislative in nature.
With the Congress' power to create political units, the Supreme Court said it "can surely exercise the lesser authority of requiring a set of criteria and standards" including income requirements for prospective cities.
The decision of the Supreme Court was welcomed by Mayor Fidel Anacta of Borongan City; Mayor Tekwa Uy of Catbalogan City and Mayor Michael Cari of Baybay.
For one, the employees of these LGUs have already been given salaries of city employees. These LGUs will no longer have to worry how it could shoulder the salaries for these employees.
These LGUs can now fast track the implementation of infrastructure project as they are now assured of getting bigger IRA as cities. (PIA 8)

Kaadlawan fest by the beach evokes spirit of Christmas
Tacloban City (December 24) --The Kaadlawan Festival by the beach of Tanauan, Leyte once again drew a big crowd as people from all walks of life and of different ages came to the Skimboarding Area at Barangay Santo Niño to witness the different presentations evoking the true spirit of Christmas.
Held on December 20, the Kaadlawan Festival is an array of performances presented by the town's young talents in colorful Christmas costumes, from the selected kindergarten and elementary pupils, high school and college students, faculty and professional singing groups.
Mayor Roque Tiu said that in 2006, the municipal government decided to transfer the venue of the Kaadlawan Festival nightly activities, from the Tanauan Ampitheater to the Skimboarding Site in preparation for the December 27 Opening of the National Skimboarding Competition which is held in the area.
The entire two-hectare area which has been decorated with Christmas lanters, with kiosks scattered all over the area, huge tents to provide shelter for the spectators and the stage with the sea as its backdrop, provided a conducive atmosphere to this year's Kaadlawan Festival.
As usual, the presentations were well-applauded. The presenters, from the young toddlers to the professional groups, performed well and their enthusiasm in contributing their own respective talents to make the Festival an outstanding success is inspiring and worth emulating, Mayor Tiu said.
Conceived and initiated by Mayor Roque Tiu in 1994, the Kaadlawan Festival is a fitting tribute to the Lord Jesus Christ in anticipation and in commemoration of His Birthday. This is a much-awaited event where the best talents from the different sectors and from the different schools of the municipality perform Christmas plays, songs and dances. It is an offering of the best talents to Him from whom all these good things came from.

Foreign, local riders set to join Tanauan Skimboarding Open Competition
Tacloban City (December 25) -- The 2009 Tanauan Skimboarding Open Competition which is scheduled for December 27 to 30 at the Bantay Dagat Area, is set to be participated in by riders from all over the country and from other parts of the world. Mayor Roque A. Tiu informed that the Local Government of Tanauan, Leyte has been hosting the national event for five consecutive years already.
This year's competition is expected to be more exciting with the participation of riders from all over the country and from Singapore, Malaysia, Canada, Australia, Hongkong and the United States. The riders will start arriving on December 26 and will stay during the whole duration of the Skimboarding competition, Mayor Tiu said.
It would be recalled that Skimboarding Competitions has been usually conducted on Easter Sunday, Mayor Tiu said, when there are many beachcombers visiting the shores of Tanauan.
However, since 2007, the National Skimboarding Competition has been held in December, after Christmas and right before New Year.
He clarified that the holding of the Competition in December was though of, because it is believed that there are better waves in December and so the skimriders will enjoy the competition better.
Mayor Tiu informed that the Tanauan Skimboarding Open Competition will formally kick-off on December 27 but the nightly activities at the Site started on December 20 as the local government decided to hold the annual Kaadlawan Festival there.

BAYBAY, Leyte – A researcher of the Visayas State University (VSU) in this seaside town has been awarded a research grant by the Southeast Asian Ministers of Education Organization (SEAMEO)-Southeast Asian Regional Center for Graduate Study and Research in Agriculture (SEARCA).
Beatriz Jadina was among eight Southeast Asians who qualified for the Seed Fund for Research and Training (SFRT) grant given by the Southeast Ministers of Education Organization-Regional Center for Graduate Study and Research in Agriculture (SEAMEO-SEARCA).
Los Baños-based, government-hosted SEARCA, headed by Director Gil C. Saguiguit Jr., is one of 19 regional “centers of excellence’’ of SEAMEO, an intergovernment treaty organization founded in 1965 to foster cooperation among Southeast Asian nations in the fields of education, science, and culture.
Under the SEARCA-funded SFRT, Jadina will conduct a study titled “GIS (geophysical information system)-aided Biphysical Characterization of Leyte Landscape in Relation to Landslide Occurrence.’’ Aside from Jadina, three other Filipinos, two Indonesians, and two Vietnamese were awarded the SEARCA research grant in 2009.
The three other Filipino grantees are Feleciano Bejar of the Samar State College of Agriculture and Forestry, Dr. Hilconida Calumpang of Silliman University in Dumaguete City, and Dr. Margaret Calderon of the University of the Philippines Los Baños – College of Forestry and Natural Resources.
The Indonesians are Dr. Sunarso and Wahya Andy Nugraha and the Vietnamese are Nguyen Dean Khoi and Nguyen Van Kien.
The eight were recognized at a recent program at SEARCA during the observance of the center’s anniversary.
Education Secretary Jesli Lapus, assisted by Dr. Saguiguit, presented the awards to the grantees. Lapus is the Philippine representative to the SEAMEO Council (SEAMEC), the organization’s highest policymaking body composed of the education ministers and secretaries of the 11 SEAMEO member-countries.
The SFRT is a competitive grant aimed at providing assistance to selected promising but fund-strapped research projects of nationals of SEAMEO countries to enable them to carry out research and training initiatives supportive of agricultural and rural development. Each grant is worth up to $15,000.
Launched in 2005, the program has, to date, benefited 16 Filipinos and 25 other Southeast Asians.

BAYBAY, Leyte – Here’s a chance for students in Region 8 to shine and win big prizes. The Visays State University Alumni Association, Inc. (VSUAA Inc.) is sponsoring the Campus Idols Summit 2010. An amateur singing competition, the project aims to heighten environmental awareness and showcase the singing prowess of high school and college students in Region 8.
Qualified to join the contest are students, 15-19 years old by January 30, 2010. To join the contest, contestants should submit their demo-CD showing them perform a song of their choice. One part should show the contestant singing one verse and one chorus of the song without an accompaniment and the other, singing the whole song with an accompaniment. Whole body and close-up shots of the aspirant should be emphasized in the video.
Along with the demo-CD, contestants should also send their certificate of registration (COR) validated by the university registrar or principal where they are currently studying, photocopy or a scan of his/her school ID, a birth certificate issued by the local civil registrar, and a duly accomplished entry form that can be downloaded through www.vsualumni.wordpress.com.
From the entries sent, 12 contestants will be chosen as finalists. The Finals Night is on February 19, 2010 at the VSU Gym. During this occasion, contestants will perform novelty, love, rock and environmental songs.
The Ultimate Campus Idol will receive P15,000. First runner-up will receive P12,000 and second runner-up, P8,000. Winners will also receive trophies. Finalists will also receive a consolation prize of P1,000 each.
Interested students may send their entries to Dr. Rotacio Gravoso, Multimedia Development Center, Visayas State University, Baybay City, Leyte, Philippines (Telefax: 053-335-2620) on or before January 10, 2010. Tacloban City (December 25) -- President Gloria Macapagal-Arroyo called on Filipino soldiers to continue building bridges with the local people through Kalayaan Barangay projects that build schools, bridges, and farm to market roads.
In her speech during the 74th Anniversary of the Armed Forces of the Philippines on December 24, President Arroyo noted that those involved in Kalayaan Barangay projects have been given recognition and awards in the AFP rites.
"These projects have improved the quality of life of the people in these areas rendered vulnerable to the tyrant calls of rebellion and terrorism because of poverty," President Arroyo said.
The Gawad sa Kaunlaran was awarded to the unassuming Colonel Arnaldo F. Fernandez Jr, commander of the 53rd Engineer Brigade of the Philippine Army, in his pursuit of socioeconomic and non-combat activities of the AFP.
Colonel Fernandez, together with the Army engineers under his command in the Visayas, is known in the countryside as the one who was responsible for the completion of six units, two-classroom school building, construction of Department of Education two classroom school buildings in Eastern Samar, rehabilitation of National Telecommunication Commission building at Jaro, Iloilo, among many other accomplishments in implementing President Arroyo's Kalayaan Barangay projects in the insurgency stricken hinterland areas.
President Arroyo underscored that her administration has staunchly pursued the modernization of the Armed Forces alongside raising the soldiers' salaries and incentives to the level of school teachers.
"I have also expanded housing and other benefits, including scholarships for family members and more protection for the soldiers in their retirement with the help of government and private institutions like the Philippine Association of State Colleges and Universities, which had been a good partner in providing scholarships, and the Air Materiel Wing Savings and Loan Association for the retirement benefits," she said.
"We have also made sure the families of soldiers killed in battle will be provided for at least during the grieving period," she said.
The President thanked Filipino soldiers "for the many ways they rendered service to the Filipino people. Those assigned to implement Martial Law in Maguindanao showed our people that the Philippines is a law abiding, democratic nation and respect human rights."
She commended soldiers who participated in the relief and rescue operations during storms Ondoy to Pepeng in September and October and the imminent eruption of Mayon Volcano, which raised the need to evacuate people to safer grounds, "who have shown the meaning of courage and sacrifice outside the battle field."
The President also urged the Filipino soldiers to continue running after terrorists who destroy the peace and livelihood of the people.
"Don't stop until we have brought final peace and prosperity throughout the country. Let us pursue the soldier's mandate for peace and to help during calamities and storms," the Commander In Chief stressed. (PIA 8)

In the province of Leyte, this reputation is especially accorded to natives of Jaro, an interior town located 39 kilometers northwest of Tacloban City. Even the Philippine Law Dictionary added legitimacy to this stereotype by including among its entries the phrase "good-bye Jaro." This refers to the sharp long-bladed bolo, the ubiquitous tool of the Leyteño (i.e., Jaro) farmer, when used to stab or hack a person to death.
My readings, interviews, observations and related efforts to understand the popular stereotype on the people of Jaro, Leyte, made me conclude that it could have originated from the fierce resistance waged by the Jaroanons against the American regime during the Pulahan Wars at the turn of the century.
It may be noted that the "official insurrection" in Leyte collapsed after only 16 months of symbolic and so-so resistance with the surrender in May 1901 of Gen. Ambrocio Mojica, the Caviteño appointed by Pres. Aguinaldo as politico-military governor of the province. Col. Florentino Peñaranda, Capt. Jesus de Veyra, other leaders and a handful of their followers had surrendered by June 1902.
However, the surrender of the "official revolutionists" did not end the war in Leyte. Instead, the struggle assumed greater ferocity and force after it was picked up by the Pulahan (the freedom fighters in red uniforms), a pseudo-religious social movement with millenarian aspirations and mostly peasant membership. The so-called "Pulahan Wars" against the American regime in Leyte lasted five years from 1902 to 1907.
Among the Pulahan leaders in Leyte, official records acknowledged the leadership roles and importance of the brothers Juan Tamayo and Felipe Tamayo, who were labeled as bandits from Jaro, Leyte. Juan Tamayo seemed to have been the second-ranking leader of the Pulahan in Leyte after "Papa" Faustino Ablen, the Pulahan "pope" in the island. Felipe Tamayo served as "chief of staff" of Ablen.

Yap, me too, I think its not temporary. Besides kun ako it may tag-iya I will not spend millions of pesos para hito na building ngan temporaryo la ngayan.
