But since the Board met only on 20 February 2010 and you had not furnished the other members a copy of your letter, the Board as a collegial body was made aware of your resignation only on 20 February 2010. This was a date already beyond your term. I cannot help but wonder why you waited to resign at such a late date. You may be interested to know that the Jesuit Community met as a caucus of the ADNU Corporation on Feb. 18, and decided to adopt a practice of the other Ateneos generally limiting service on the Board to three terms. This is why in our last corporation meeting we did not re-elect Fr. Samson and Mr. Mabulo. We were not intending to re-elect you. The Board therefore heard of your resignation after your term had ended when it really had no intention of re-electing you. Actually, as President I had considered formally recommending your exclusion from the Board after your third consecutive absence, as is the practice in other corporations. Based on verifiable records, despite due notice, you failed to attend the Board meetings on 20 February 2010, 21 November 2009, 15 August 2009, 21 February 2009, and 15 November 2008. Partially because of the deteriorated relationship between AdNU and yourself, I refrained from making this recommendation, deciding it would be better simply to allow your term to expire. In both events, you were invited and even encouraged to attend so that certain questions relative to the governance in the City might be addressed by yourself. However, on both occasions, you were not personally present to articulate your position. But in both events, representatives from the City government were present to respond to issues. Transcripts of the proceedings are available on record. Your representatives were given equal chance to speak and clarify matters. The Philosophy department, in both instances, acted as an academic unit enjoying academic freedom as recognized by law. In both instances, the lecturers/presenter s were afforded the platform for the articulation of their positions; all stakeholders were duly invited. The Ateneo de Naga is a university; it is in its nature to allow space for all reasonable discourse and discussion, even concerning areas that are politically contentious. In the events organized by the Philosophy Department, the university only responded to the feltneed among members of the university and the city to articulate issues that are pertinent to the welfare of the community. There was no “unfairness” or “one-sidedness,” since opportunities for engagement were made available to all concerned parties. Your presence was sought, but for reasons undisclosed to us, you did not come. But records will also show that in your absence the side of your administration was also very competently represented during these events, notably through Mr. Wilfredo Prilles, Jr., head of your City Planning Office. On some issues, I found his arguments rather convincing. It is therefore not the case that the university “never affords the city government an equal opportunity to explain its side and satisfactorily argue its case.” There would on the other hand have been egregious unfairness or one-sidedness if a speaker were disqualified from speaking in the university on a mere suspicion or personal allegation that he is incapable of objectivity or just using the university “as a platform for those he has an axe to grind with.” This is what you emailed me on Jan. 26, 2009. I responded the following day with a statement that Fr. Wilmer Tria had assured me he would be objective even in the presentation of his critical views, and the assurance that even if he were critical the affair was public and that Gabby Bordado, Joe Perez, other city officials and yourself were invited to participate and “complete the picture.” You did not respond to my email. Presumably, this was not so because being objective relative to Fr. Tria’s views was impossible to you, nor because you had an axe to grind against Fr. Tria. In pursuit of political development and a more mature type of democratic participation in our city, we consider it good to promote an atmosphere of constant questioning and the consistent search for truth through such events. In doing so, the academic units concerned are fully aware of their responsibilities in their exercise of academic freedom. The disquisition of the UN Committee on Economic, Social and Cultural Rights on academic freedom seems instructive at this point. It says: “Members of the academic community, individually or collectively, are free to pursue, develop and transmit knowledge and ideas, through research, teaching, study, discussion, documentation, production, creation or writing. Academic freedom includes the liberty of individuals to express freely opinions about the institution or system in which they work, to fulfill their functions without discrimination or fear of repression by the State or any other actor, to participate in professional or representative academic bodies, and to enjoy all the internationally recognized human rights applicable to other individuals in the same jurisdiction. The enjoyment of academic freedom carries with it obligations, such as the duty to respect the academic freedom of others, to ensure the fair discussion of contrary views, and to treat all without discrimination on any of the prohibited grounds.” (Emphasis supplied). The case of Borjal vs. Wenceslao (14 January 1999) can also be of help in the appreciation of the events which you claim are the reasons why you believe that the University has failed to uphold truth, integrity and fairness. As eloquently enunciated by Mr. Justice Brennan in New York Times v. Sullivan, "debate on public issues should be uninhibited, robust and wide open, and that it may well include vehement, caustic and sometimes unpleasantly sharp attacks on the government and public officials”. You may also consider the wisdom in the enunciation of Mr. Justice Malcolm expressed in U.S. v. Bustos, that "the interest of society and the maintenance of good government demand a full discussion of public affairs. Complete liberty to comment on the conduct of public men is a scalpel in the case of free speech. The sharp incision of its probe relieves the abscesses of officialdom. Men in public life may suffer under a hostile and unjust accusation; the wound may be assuaged by the balm of a clear conscience. A public official must not be too thin-skinned with reference to comments upon his official acts." You have been at the helm of governance in the City for a long time, and being “too thin skinned” is normally not attributed to you. We believe it is in the welfare of all to provide space for discussion, for questions and for clarifications. While you say that you “welcome criticisms that are well-meant,” do you also purport to judge the intentions of persons who stand up in academe and speak for or against your administration? Are criticisms “well meant” when they are meant to challenge an administration to a higher standard? Are criticisms not “well meant” when they intend to lay the groundwork for a change of administration based on perceived character flaws in a politician? Are criticisms not “well meant” when they are based on a desired harmony between the affairs of the Catholic believer and the Nagueño citizen? In my view, there is space for all such criticism in an academic discussion. Since you or your work in public office are the object of critique, you are caught in a conflict of interest in welcoming or notwelcoming, allowing or disallowing, in a word, judging “criticisms that are well-meant” for academe. You claim personalities in the University “demonize” you and your administration in the classrooms. I have heard criticisms, but no demonization. You may wish to substantiate the claim. Otherwise we will just charge it to an unfortunate political paranoia at this end-stage in your administration. In considering this, you may wish to be guided by a statement by the Supreme Court in the same case of Borjal vs. Wenceslao that, “It is only in despotisms that one must speak sub rosa, or in whispers, with bated breath, around the corner, or in the dark on a subject touching the common welfare. It is the brightest jewel in the crown of the law to speak and maintain the golden mean between defamation, on one hand, and a healthy and robust right of free public discussion, on the other.” As an academic institution, we will continue to provide opportunities for discourse on matters involving public interest. In the process, the two provinces will be able to “complement” each other and offer more to visitors in terms of sports and adventure tourism. CamSur Gov. Luis Raymund Villafuerte Jr. said they are pushing for a Cebu-Naga flight this year to stimulate faster travel for Cebuanos, island-hopping enthusiasts and residents in other Visayas provinces who want to go to CamSur. Currently, visitors are flying from Manila through Philippine Airlines, Cebu Pacific and Zest Airways to Naga Airport in Pili town, Camsur. The province posted 21 weekly flights. Others travel by sea or buses that ply the seven-hour route daily to and from Manila. More flights “We are talking with different airline companies. Whoever comes first, we (welcome) them because there is good potential in the Cebu-Naga service. I understand even smaller planes could not be filled to its maximum capacity because of the really short runway. Lugi sila kasi hindi na- mamaximize ang volume. Adding more flights would mean more losses. There are also people (like us) who would prefer to take the bigger planes availble in Legaspi airport. Dr. Mendoza has been the official photographer of most Petron Calendars. He was the chief photographer of the first edition of that book. His clinic is just across mine in Plaza Medica.
