Buniah unveils Dh300m Sports City project: Dubai-based real estate and hotel advisory provider Buniah on Sunday said it is launching a Dh300 million Oasis Tower Two project in the landmark Dubai Sports City.
This project is a joint venture between Buniah Group and Oasis Ventures Group, it will comprise 240 fully furnished apartments.
Buniah chief executive officer Mohammad Al Saafeen said, "The real estate market and construction industry in the Middle East is witnessing increased demand and Oasis Tower Two is one of Buniah's superbly-inspired and carefully-planned projects aimed at meeting this need alongside highlighting the company's vision of monumental, progressive developments."
Schedule
The construction contract will be awarded in April and construction is expected to begin in June, he said, adding that the tower is expected to be complete by December 2009.
The 28-storey Oasis Tower Two will comprise four different types of furnished apartments ranging from one and two bedroom to executive suites and studios.
The two-bedroom apartments will have a built-up area of 1,650 square feet, while the one-bedroom apartments will be 1,010 square feet, executive suite of 703 square feet and studio apartments of 552 square feet.
The tower will feature a five-floor parking, alongside ground plus 22 floors.
Along with visa facilitation and VIP services, the project also emphasises 24-hour security, convenience stores, coffee shop and fine-dining restaurant, rooftop swimming pool and jogging track, fully-equipped glass gymnasium, sauna and steam room, and a social event deck.
The apartments have been priced thus - Studio at Dh432,816, executive suite at Dh522,231, one bedroom at Dh730,987 and two bedroom at Dh1,159,183.
Buniah has various projects in the pipeline including a Dh800 million digital park development in Al Jeddaf area and a four-storey building in Jumeirah Village. The company will be announcing, in the next few months, a mixed-use development in Amman, Jordan.

sorry to say but i think you may be mistaken brighton holdings doesnt seem to have anything to do with the oasis tower 2 development. The website has been updated with pictures. However, these pictures are from the beginning of June. I went to see the project in March and they were digging out the foundations. The pictures seem to be progressive albeit a bit slow. I just wanted to know if anything has been done since June.

OASIS tower 1 & 2 are from the same company no .?( not sure where i got brighton holdings from) OASIS tower one is dead so i am asuming the same with OASIS 2 ?
What i mean is Oasis one has had no construction since last year !

i went to see both of the sites at the end of march this year and the foundations were actively being escavated for oasis tower two but you were right nothing was going on a oasis tower one. However, if you go onto the dubai oasis website they have updated pictures at the start of June and construction was progressing albeit a bit slowly but nonetheless it was continuing on both buildings.
irishdave August 14th, 2009, 09:44 AM I have had another argument with the developer on oasis 2, nothing has happened, they have been digging that hole now for 18 months. There has been zero progress, construction, which was promised to start on July 1st (end date end 2011) has still not started.
As usual, absolutely no reason for delay. They will never give a reason.
Nothing has happened on Oasis tower 1 since last October. (look carefuly at their new pictures, they are careful not to show the floor height)
I have also heard from a very good source that both projects are on hold. developer denies this, but clearly there is nothing happening.
I work in construction and the work they have done in 18 months on Oasis 2, i would finish in 1 day.
heartbreaking as it is, this is a lost cause. If we can get enough people together who have invested in this project, to stand up, we might be able to get it canceled. Otherwise OGV will just keep delaying with no reasons.

No they are not asking for payments. But think about it. We have paid more than 60% and for that money we could now buy a ready apartment and rent it out and by the time Oasis tower 2 gets delivered we would have 50-60% of our investment back...

To fill you in in what i have heard. My friend works for DSC and she informs me that they have not applied for any NOC's for services, (necessary before construction starts). She put me on to one of the developers consultants, who told me that both Oasis Towers ARE DEFINATELY on hold.

It is my opinion that the developer like many in Dubai, have no money. I may be wrong but the developer is doing nothing show me otherwise.

I think all the investors should get together or get organized and make a combined effort. I have seen some big developers refund money after pressure from the majority of investors in the project...

I think we should try to find more investors and put more pressure to get all our money back!
No forfait...nothing 100% refund,that's all.
And I think we should suit them also...
In fact we made this investment (at least I did it) asking for the 8% for 3 years... it was the prospective... it was guaranteed.
We can anyway ask a refund for the apartment expense,moral damages and at least,but not last for the interests our money would have maturated in our bank accounts.
Bank transfer expenses(wouldn't have been sustained without the plan to transfer these money for the apartment/s)and phone calls etc... are additional expenses caused by their inefficiency...
There's lawyer who make miracles...
Asking for more is never bad, I believe so.

I have been reading all the negative news about Dubai-oasis and like you guys I am also an investor.
I own a 1 bed unit and my friend owns a studio, I recently heard some negative news from one of their x employees so I decided to confront them.
I reside in the UK, soon as I heard the bad news I caught the first flight out to Dubai, once I arrived in Dubai and went to their office where I was told the meeting was to be held, When I turned up to the meeting I realized the office that I was standing in was a complete different company.
The firm that I walked into was called Buniah, I was told that they and khamas group had taken the project over and that they would build the project as they have a 50/50 partnership with Dubai-Oasis. I was in shock because I thought the project had been sold on after Dubai-Oasis had made their money & left these other guys to cream off what ever else they can get off the investors.
I have also been dealing with RERA for some time now, I was given the branch details for where their escrow account was held and told to enquire how much money they held against my unit (bearing in mind I have paid 70%, which is around AED 600,000).
I decided to contact the bank; the staff were very helpful and naïve as they thought I worked for Dubai-Oasis. I asked for a statement beginning from Jan 09 up till July 09, to my astonishment they emailed me the full statement (which I can email to you guys) for the escrow account, Firstly I checked the balance it was around AED 9,700,000 and did not have any money in it against my unit which means all my funds that I have paid are not covered by escrow (which gave me a few sleepless nights!)
I also happen to be an agent for Dubai-Oasis so I have access to their database of how many units they have sold in all their projects (I can forward the access details to you guys), they have sold 385 units in Oasis tower 2 valued around AED 350,000,000 but they only have a fraction of that money in the escrow account, when I asked they gave me some bullshit about escrow, saying that most the investors paid before escrow was in place even though when me & my Friend bought the units after escrow was in place they gave us different bank details to put the money into.
I did go to the their main Dubai office after, they also gave me some bullshit so I abused them & left, I think the only way we can work forward is to get all the investors together, so I have created a new email which we can all keep in touch and decide on what action we are going to take, the email address is oasisinvestors@gmail.com I hope we can get to the bottom of this issue, please quote your unit number as a reference and I am sure we can get this problem sorted.

Here is their reply to mail email where I enquired about reasons for the delay and possible discounts.

We thank you for your investment in our project and sorry for the delay in Kamal not replying to your email.
There were several reasons for the delay of the project. The major reason being attainment of licenses and other permissions from Dubai Municipality, Master Developer and the Land Dept. This is a very lengthy process and the authorities concerned have not been forthright in processing the necessary paperwork required due to changes in the laws and the new procedures by different departments. In light of these, we would like to inform you that the management has decided to put a delay on your next installments for 9(nine) months from the last due and paid installment.
Regarding rental guarantee and penalty from the developer side for the delay in the project as mentioned in the agreement, we are in discussions with the management and will inform you soon once finalized.
Regarding discount, we are in discussions with our all our suppliers and main contractor. If they agree to give us discounts, we will definitely give this benefit to all our investors depending on the percentage we receive and the timely payment from their side. This is also under discussions and we will inform you once finalized.
For your information, the progress of the site is as follows:
Due to dispute with the neighbouring site for extra shoring work caused us the delay to start construction.
- 20th Aug. 09 is the new completion date for the piling contractor.
- Main Contractor will submit his program starting work at 20th Aug. 09 instead of 1st July 09.
- Tower Crane is already at site.
- Work done in percentage :
Piling 81
Excavation 90%
Main Contractor mobilization 95%.

after asking OGV where is our money, as it is not in the Escrow account which Kamal has verbally assured me on more than one ocasion that it is. I have got no replys, i have been mailing them for almost one week with zero reply.
i can tell you from a construction view point (im in construction) i have done more work on my site in 2 hours than they have done in 2 years with no exageration. Simply put there is nothing happening on site. The interest earned on 10,000,000 (all that is in Escrow account ) will easily pay for 1 excavator and a couple of helpers to spend 2 years digging a hole. If it was me i could finish all the basements in 1 month, very easily. There is simply nothing happening and i dont think anything ever will.
It seems to me they have spent / wasted or even conned us out of money. Even if it was not an intentional con, they are obviously telling lies now and have been for some time.
I am very busy with mobolizing on a project just now and need to concentrate on that (otherwise i'll loose my job aswell) when it has settled a bit, i will follow up on what legal action i & we can take as a group.
i will keep you all posted.

Even if this was true and i have not heard this, it will not help us. There is no way he will bail out a small developer who has squandered money.
And to clean up all the dust on all the projects in Dubai (finish them in other words) will cost billions. The money is simply not there.
I know i am being negative, but i'm in Dubai and that is the reality.

I think irishdave is right, we need to work together very quickly or else this developer is going to leave us all high and dry.
I have so far compiled a list of around 10 investors that I am keeping in regular contact with.
Guys I think the time for talk is over, lets get a lawyer involved to get whatever we can out before it's too late!
Firstly Irishdave as you are in Dubai can you please recommend a good property lawyer, I will update the lawyer on everything and will also keep all the investors up to date, Once I forward the proof I have regards to the Escrow account having a limited amount of money in it as well as the fact that the project should have been finished in Sept, 09 we can have a starting point, I believe once the lawyers look further into this developer they will have no choice to come clean.
I am aware from reading on the net that the owner of Dubai-oasis (Mr Elahi) has a lot of interests in the UAE, so it would make sense to take full legal action because by us bringing heat on him regards to Oasis Tower it could also jeopardize his other interests particularly his banking business he has in the UAE, which I’m sure he would like to avoid.
Lets stop talking and putting something into action, I will mail all the investors on the list I have compiled about the legal case that I think we should open against Dubai-Oasis.
I will forward all the correspondences that I get from the Lawyers to everyone, As far as the cost goes I think we should all chip in as it would benefit us all if we manage to get our funds back, If there are any people out there that do not want to chip in then we will remove their unit number from the list that I will forward to the Lawyers so they will not benefit if anything positive comes out of this. If you think about it the amount of money we all can potentially lose is very significant, in fact there are people out there that don’t probably earn in a year or in some cases decades what we are all individually about to lose to this developer.

Some sad news - Mathew Thomas unfortunately died of a heart attack 2-3 days ago. He was in charge of customer care.

I do hope that the money already invested (I only have 3 instalments remaining) is not lost. I have not paid any further instalments since December 2008 because of the constant runaround received from everyone connected with this project and particular because of non contact.
What is the best contact details for everyone in relation to getting names sent to these jokers in Dubai of how many complaints there really are - a list can also be provided to the agents responsible for selling these properties and they should be reported to the authorities in the UK.
xx (who I have found out through this thread is no longer living) has been avoiding the situation as has xx (who has never responded to my emails). Instead xx sent me an email regarding the holy month of Ramadan. If he had time to do that he had the time to send me information which I had requested since Dec 2008. I responded by advising him of this and received nothing in response. I also find it disturbing that they seem to play on the fact that they have little knowledge about anything going on including the English language.
xx (sales) was the original buyers contact and wrote in his original letter that if there were any queries that he would be happy to answer them - never heard from this person after the first payment was made and all he did when he replied was refer me to someone else and this went on for months until I got jack of it. They knew how to contact when they wanted another instalment from me.
The email from xx to me Jan 2009 -
"Please refrain from barraging me with email's in future and I am sure you can appreciate its the weekend here, if this happens again I will simply reduse to respond. This not the way to handle this.
As I have stated to you the development is well on the way and new further developments have been launched Lynncoln and Oasis Heights.
If you are not confident with my information I advise you make direct contact with xx.
I am forwarding other launched developments in my next emails to you.
This is the type of response above that no customer should receive considering that I had contacted him by phone and also by email several times advising him of the difficulty I had experienced.
I'm not sure if it has happened to anyone else but when I was making these enquiries since December 2008, my emails started bouncing back. Their excuse was that they had server problems. It is not correct as there were no problems when I didn't ask any questions but kept paying when their request by email was received.
This company still exists and have left messages with the new manager however no response. xx is now with xx in the UK (and continues to send me emails on other properties) and appears to be of no assistance either when contacted. In fact he became very hostile when I continued to send him the emails I had sent to Dubai to show him how my emails were bouncing back.
Does anyone know what to do as I am from Australia. I am very concerned that all the monies invested so far could be lost and I am not sure if it has anything to do with the GFC as the project did not start until very late and nothing has progressed much since my initial enquiries with xx when the project was supposed to originally begin and had not. I had requested pictures and received nothing, not even a response. I have spent more than $100.00 in phone calls and they do not return your calls or emails. I am sure everyone is in the same position.
I will include the last information dated 5 April, 2009 received on 2 July, 2009 from xx (after speaking with xx by phone who referred me onto xx) which I was not happy about and made enquiries after that. To date there has been no response to my questions to this correspondence one of which was that I will not accept something that is unsigned.

Hello daywalker - I only have one unit in Oasis 2 Tower. It is a good idea to get together on this issue with all the investors. I have just found this site and had no knowledge of it's existence no matter how long I have googled to find out if anyone else was in the same predicament and perhaps being scammed. There appears to be many and I have just contacted the email address provided by Nadeem. Am awaiting a response so that this nightmare can be sorted out.
Is anyone paying any further instalments? I stopped paying in Dec 2008 and told them the reasons why. I have not been provided with any responses to my questions including getting my money back as no one budgetted for a completion date of 2011 as I have recently been advised by Mathew Thomas. He told me that he would pass on my questions to Kamal. He has not responded.
There is a law in Dubai passed some time ago that if 20 percent had been paid and construction not commenced that no further monies should be paid to the developer. I have put this question to the oasis and no response received. I have also contacted RERA and have received no response to my complaint.
In this case Oasis 2 has not commenced construction - there are no visible floors at all. They are still in the pilling and drilling stages which has been going on for far to long without any further advancement.
I hope that being in contact with all of you makes it easier to put the complaints across. As an individual I have found it extremely difficult as no one wants to listen and they play this dumb act each time.
Not sure how best this can be tackled however if everyone is in the same position perhaps the power of many may get them to answer the questions. I want my money back (with interest) as I am sick and tired of waiting as this whole project seems to have left a bad stench with me and to be honest I am no longer interested.

It looks like there a more investors involved even if they are from the Oasis 1 - same company. I found a thread on another site.
How about getting all the investors and writing to Oasis first and then send off copies to everyone else of some authority there - it would perhaps make it very obvious that we are not going to stand back and have our money lost particularly with everyone involved. So far everyone has been doing this individually which has not worked as they know when there is a force of many they cannot ignore.
It's great to get onto a lawyer if they will actually do something however before that happens as they may drag this out which will end up costing us even more money can we just all be included in a letter to management and all the staff we have contacted including Kamal. Unless someone really knows a lawyer they can depend on and who can actually do a good job on everyone's behalf then perhaps it may be worth considering to seek legal representation but before this happens how about giving them one more option to respond and stop playing games as construction to the building as we all know as not begun. If we are all listed on the letter they will have no reason to ignore - a copy of the letter sent to them be provided to all the investors and also the agents responsible for selling these properties will need to take notice as they require to stop selling in Dubai and they need to be reported - I believe they have not sold off all the units in Oasis 2 and therefore there are still some available as well as some for re-sale!!.
There has to be some consumer protection in Dubai and if IrishDave resides in Dubai are you able to find out as I have made many attempts without success. Even RERA were hopeless and I received no response by phone or email when a complaint was made about oasis and the agent. I am sick to death of getting the run around and I'm sure everyone else is feeling the same. It doesn't need to be a complex letter just to have everyone's name and also the information that Nadeem supplied in this post (regarding escrow account and the fact that the money is not against his unit). They need to show in black and white the statement of everyone's purchase and to stop hiding the information from the investors.
Just think how much interest they are earning and where have they put the money if it's not in the account? Why didn't they set up an escrow account? as I was informed that this was all above board and the reason why solicitors were not required in relation to the purchase as in Dubai the law is different and that the purchase of the property was guaranteed by OGV. Isn't there something in the contract that states all of this and if any delays isn't there something that can be done?
What if they have invested money on the stock market?? We all know what that means and in view of the GFC it may be that the money is not in the account because it's all been lost.

Under Law No 9 of 2009, Real Estate Regulatory Agency (Rera) has stipulated that if – after a thorough government review – a project is cancelled, all cash paid by buyers will be returned by developers upon termination of contract.
Effectiveness
Law No 9, which provides a sliding scale for refunds, has been signed and approved. The law however, only becomes official and legally binding once it gets published in Dubai’s official gazette.
Rera will apply the law and give directions to developers on what steps to take. , Head of Real Estate
Rera officials couldn’t be reached for comment by press time. The new rules amend previous laws and will frame new procedures for “terminations of sale and purchase agreements for off-plan units and will set the damages payable to the developer depending on the progress of construction”, according to Lovells law firm.
xx stated that if a “developer’s project is cancelled by Rera” the “purchaser shall be refunded all monies paid to date”.
The changes may help unravel months of uncertainty by investors who have faithfully continued to pay instalments to developers who failed to begin any construction on projects to which buyers legally signed contracts.
“Law 9 will provide significant guidance to the real estate market and will clarify the uncertainty on terminations and damages,” said Lovells.
xx Lovells Head of Real Estate Middle East, said the final version of the new law contains the full refund provision for cancelled projects only.
x was part of a Rera working group that helped draft the new rules.

As previously reported by XPRESS, the new law contains a sliding scale that spells out the rate of investor compensation to be paid by developers based upon the amount of construction completed.
Roughly 875 projects are now being visited by government inspectors across Dubai to determine the progress of each development.
The new law, meanwhile, dictates that all terminations “must be served through the Dubai Land Department and the purchaser shall be given 30 days to rectify a breach”.
Sliding scale
The following is the percentage of refunds as provided for in Law No 9:
* 80 per cent completed: Buyer forfeits 100 per cent of cash he/she has paid to date
* 60 per cent completed: Buyer forfeits 40 per cent of purchase price
* Less than 60 per cent completed: Buyer forfeits 25 per cent of purchase price
* Construction hasn’t started: Buyer forfeits 30 per cent of cash he/she has paid to date
* When project is officially cancelled by Rera: Buyer shall be refunded all cash he/she has paid to date.
If you view the RERA website under the heading Projects you will find that oasis 2 (developer ID is 311 Oasis Group Ventrues OGV found from the RERA site under Developer)
Oasis 1 Tower is Brighton Holdings limited (developer ID 296) - Under the heading projects as mentioned there is no progress indicator in either Oasis 1 or 2!!

Hello Oasis tower 2 - www.dubai-oasis.com has other projects listed eg. Oasis 1 and I find it very strange that a brand new website has been commissioned with very little information and is very poorly layed out - you are right the pictures are most probably outdated!!
Here's the funny thing in an email I received on 24 March 09 from client care (no name) here's an extract from that email -
"The Construction of Oasis Tower II has started since Dec '08 . So far we have done with the Shoring and we are in Middle of Pilling and Enabling stage. We would make sure to keep you posted regularly with the updates on the project.Alternativley you can also log on to www.dubai-oasis.com for all the details regarding Oasis Tower II.
Currently majority of the client are happy with Oasis Tower II since the contruction has started and work is in progress":shocked:
A serious contradiction considering everyone here is really peeved about the whole project not progressing and I'm sure there are more investors out there who feel the same way!!
Mmmmm and also very strange is the fact they claim it started in Dec 08...this is the same time when I started seriously asking them questions!!!

I have been trying to get information like everybody else on what has been the cause of so much delay in the project but have not gotten a satisfactory response from the developer. I bought this unit in 2007 and since then all that has happened is that they have changed their customer service staff multiple times. First it was Pradeep Nair, then it was Rhea, then Lily Eskandari and now it is Mathew Thomas and they all give you the same bull shit.
I agree with everybody on this forum that we should try and get this project cancelled so we can get our money back. There is no point in waiting another 2 years and still be looking at the pictures of a hole in the ground that they have dug.
I live in the US so it is difficult to even call them because of the time difference etc.
Anyways I am ready to do whatever it takes to pursue this legally with RERA.

I have actually spoken to mathew thomas, but he couldn't give me any answer at all...instead he gave me an email adress where I should write to...they never replyed any of my emails.
Am really angry, and am in if you would like to run anything against them. They havent even have sent me a contract on my units.

3. Unfortunately there is no class action suit available in Dubai no matter how big the group is. Each individual must pay their own way to get a result or it is dealt with by no win, no fee option (that is if any lawyer will accept this to be the case which it has been found that no one is willing to undertaken this option from the many law firms contacted). Am I correct - do you know if Sunil Thacker has undertaken cases on a no win, no fee option?
4. Your cousin's contracts would all be identical to any other buyer in that same complex which means the lawyer would know if they had a case against the developer or not - is that correct?

Please can any body tell me the latest market price of a studio apartment in Oasis Tower 2. the price should be the latest as much near to the date today i.e 27/11/2009.

You are asking for the impossible - no one is interested in buying or providing you with the market value of your property. It will be a lot worse now since everyone outside of Dubai has now been advised how bad the situation really is in Dubai. If Nakheel (which is govt backed and one of the largest developers in Dubai) is in trouble how does anyone expect any of these projects to be completed by an unknown developer such as OGV or BHL? None who have completed any projects to date. At least Nakheel has delivered many projects up until this stage!!
The developer won't answer the question either. Have you contacted them to ask?

3. Do you own more than one unit?
4. Are you taking this action on your own or with other investors in the same project that you know?

13. In respect to point 12 above how do you find out if it is or isn't registered with the lands department?

I am an investor in CRW. Really dont have much information than what I get on this forum or the DSC guys as I am based in India.
I was there last year on an visit. Security is there, but they did allow me to go inside and have a look at the development. It might be more strict now possibly because of the construction going on inside. The security was more worried about accidents inside the construction site.

It would appear that no one really knows anything but again it's been reported on here that CRW is going well and it's nearly finished that's if you believe everything you read. Is there any reason why you need to feel concerned about CRW? - I don't have access to Dubai either just the same as you and am only trying to find out what the real situation is there and why the tight security.
It was the same back in 2007 no one was apparently able to go there because of the construction (however all building sites are locked and safe) you should be able to enter the area but you don't have to go into the specific lots as it is obviously a safety issue...Just to see from the outside is enough therefore photographs could be taken particularly if someone has access to high range cameras. It also means that DCS the master developer is not doing their job either and demanding that these areas be built up within certain time frames and there must be time frames involved otherwise nothing would ever get built.
It would be very disappointing to know that there will be a lot of skeletons left uncompleted or vacant plots where buildings have been completed because it actually affects everyone not just those who think they should feel luckier that their buildings are getting built. One has to consider that this would mean devaluation on property values no doubt and if there is vacant lots it looks a very ugly site and no one will be interested in going there therefore every single person should be worried not just those who think they are above everyone else just because their building is topped out!! This could mean that nothing is developed for another 20 years the way Dubai has run into debt.
Do you know who in DSC is able to inform what is going on - is there a name and contact?

Yeah how long? Just like you had to wait since 2006 is that right and it's still not completely finished - I'd be really worried if I were you all this may have bad repercussions on your own investment!! Remember don't count your chickens before they hatch you just never know yet!!

It looks like plenty of workers are on site therefor it should be progressing fast. Plus shoring is done and pilling is completed. The tower crane is already in place and ground works are in an advanced stage. I would expect the pouring of the foundation raft to take place in January or February next year.

The link that you have provided shows the following info as you mentioned being 182 BRIGHTON HOLDINGS LIMITED from the list and is not the registered ID number as it appears on the RERA website. My understanding is that this developer (Brighton Holdings Limited) is responsible for the construction of Oasis 1 perhaps this is where the mix up is and my understanding is that their registered number is listed on the RERA website as ID 296 not 182 (I have just rechecked RERA website and this is what is indicated). Perhaps this is the building which is 22/23 floors.
There is however the Oasis 2 Tower and the developer is listed as OASIS GROUP VENTURES and ID on the RERA website is indicated as 311 (this is not indicated on the list provided in the link instead against no 311 its shows the developer as being Pearl Properties which has nothing to do with Oasis 2 from my understanding.
In all promotions and press releases Oasis 2 was advertised as 28 Stories to be constructed which included 5 parking floors and the basement plus 22 floors = 28 floors.
On the Master Plan (Dubai Sports City) Oasis 1 is indicated as number 23 and Oasis 2 is indicated as number 12.
There is a copy of the master plan on page one provided by bizzybonita as well as an article on how many floors there is. Maybe the confusion will be alleviated if someone can verify all this information in relation to construction.

I'm always very nice actually too nice and I would prefer if you are going to assume things that you PM in future because you do not know me personally at all.
I actually sent an email to Tecom and it bounced back undeliverable - let's hope they answer the phone - I am not local so time zones are different!
In relation to that billboard it does not relate to Oasis 2 this is what I am trying to point out. There are two oasis towers and that billboard does not relate to Oasis 2 Tower as already mentioned. Oasis 2 does not have Shinsung as the contractor that was for Oasis 1. I am not sure what is happening with Oasis 1 in relation to construction or how they are affected if Shinsung has gone bankrupt or if there is a construction bond (I do not know what that means so if you can explain would be helpful re bond). The floors were relating to Oasis 2 which is construction based question and what I am trying to get answers for.
Al Jassmy Contracting Co LLC is the contractor for Oasis 2.
Oasis Group Ventures Limited is the developer for Oasis 2 not Brighton Holdings Limited.
Also note The-King's comments about the floors relating to what he understands it to be for Oasis 2 Tower.

No problem however as mentioned and from my understanding Shinsung has nothing to do with Oasis 2 - are you able to verify this since your knowledge is construction and development based as the information is that Al Jassmy is the construction contractor for Oasis 2?
Also if Shinsung is bankrupt therefore who is the new construction contractor for Oasis 1?

I have paid 75% todate and haven't paid anything for more than a year, is there any action we can take against them. They are blaming dubai rera is querying the number of lifts they have in the building so they are not approving it. It seems odd as seen as plans should be agreed before construction. How coan we confirm this with rera and how can we confirm what money is in the escrow acc.

He does post information that I personally believe is useful and is one of the few who actually updates us with new pictures regardless if he invested in the project or not. I understand we are all stressed about our investment but it does not help to take it out on each other. The best we can do is act in moderation and to try and resolve our issues with the people who can actually do something about it. Good luck to all!

It sounds like this guy has put the investors deposits on future projects like the world etc.
This was problay done before escro acount was legal requirement ?
Because of the decline in real estate in dubai in general it looks like the money has been reinvested and possibly lost or tied up in other projects .
I would think the only people to help and make a desition on this has to be rera!
and we all know how useless they are .
Anyway i just hope oasis1 is finished in time when we move in to canal residence west .

The way forward is to consider filing legal cases. RERA is and will continue to be useless - At least with a court case the result is in sight within a certain time frame but with RERA how long it will take is anybody's guess....

I am currently putting together a list of investors to take to RERA & have oasis tower 2 cancelled, I will update oasis tower 1 investors about getting their project cancelled as soon as I have more info from RERA.
I would also ask any investors that have purchased in oasis tower 1/2 to get in touch with any other people they may know that may have also purchased in these projects.
Everybody has to be pro-active in their approach to finding as many investors as possible. The reason Oasis Venture Group have got away with so much is because investors have laid dormant for so long that it has given OVG the space & time to do whatever they want with our money!
Let's work together and get results for "EVERY" investor!!!

so if they recover say 200 investors money say 40% /50% deposits so far thats roughly speaking 9.6 million uk pounds no!
so lets give them 25 % of this for sending a few letters here and there and a day or two in court and a few other bits and bobs !

Handover Imminent? Investors’ Rights……
Nakheel’s recent restructure announcements, including a significant financial commitment from the Dubai Government, bring some hope to investors that construction will recommence on several Nakheel projects in the near future.
With this in mind, the second half of 2010 may see a surge in the number of units being handed over to investors who will finally be able to inspect their property and take physical possession.
Most contracts provide that the developer must deliver to the investor a notice of handover at least 30 days prior to completion. It is likely that this notice will include a financial statement which should set out the amount payable on completion and an invitation formally to inspect the property.
It is sometimes only at this point that an investor becomes aware of a change to the design or specifications of the property from the terms originally agreed. We refer below to a couple of common scenarios.
1. More for More
Developers have been known to demand additional amounts from investors, due to an increase in the total square footage of the property being delivered when compared with the area specified in the contract. The response to this situation depends on the exact terms of the contract.
Some contracts may expressly prohibit this, in which case its position is clear.
If the contract is silent on the issue, Article 12 of Law no 13 of 2008 applies. This states that if the property is larger than that agreed by the parties, the developer may not demand any uplift in price.
Incidentally, if the property delivered to the investor is smaller than that originally agreed, the developer must compensate the purchaser for the difference, unless the difference is marginal. Decree No. 6 of 2010 clarifies what is considered marginal by reference to a 5% variation limit.
Finally where the contract contains an express provision allowing the developer to claim an uplift should the size of the property be larger than that agreed, then the developer is entitled to claim the additional amount. This is governed by Decree no 6 of 2010 which provides that a developer may not claim the value of such increase unless otherwise agreed upon.
2. Material Changes
Where the specifications and finishes of a property delivered by a developer differ from those detailed in the contract, a close inspection of the terms of the contract is required.
A contract may include a provision enabling the developer to change, modify or vary the materials and specifications of the property, usually provided the new items are of equal or higher quality then the substituted items. In that case, provided the developer complies, such changes are allowed.
However, if the contract is silent on these issues, the position must be considered by reference to the applicable legislation.
Decree No. 6 of 2010 provides that where a property delivered by a developer is significantly different, in terms of specification, from the contract description, this forms a ground on which the purchaser may apply to the Dubai Court for cancellation of the contract, with a refund then becoming due.
In summary, a developer should hand over property complying, within reason, with the description in the contract. If that is not the case, the investor’s rights will depend on the exact terms of the contract and the content of applicable legislation.

Stop playing with each other's emotions. It is a tough time for all. I do understand that everyone (almost without exceptions) are facing delays on their projects and of the hundreds of cases that have been filed only a handful have ever been to court. It is tough, but all we can do is support each other and keep excerting pressure on the developers to continue construction (not all have ill intentions). Bad mouthing each other does not help anyone and only increases our frustration. In the end of the day all that we want, at least I believe, is to have something in our hand for the money we have paid. Regardless, I wish you all luck.
