Probe on Surigao mining firm sought

SURIGAO CITY, Philippines – The Department of Finance has urged the Department of Environment and Natural Resources (DENR) to look at the operations of Philnico Industrial Corp. (PIC), which has been conducting mining activities in a mineral reservation in Surigao City.

In a letter to Environment Secretary Ramon Paje, Finance Secretary Cesar Purisima said PIC has paid only US$1.25 million of the US$263.8 million it owed to the government since 1996.

The amount is for the purchase of state’s interest in Nonoc Mining Industrial Corp. (Nonoc), which had the mining rights in the Surigao Mineral Reservation.

The purchase was made under the terms of an Amended and Restated Definitive Agreement (ARDA) executed in 1996 by the PIC, Nonoc, and the government through the Asset Privatization Trust (now Privatization Management Office).

The ARDA was executed after the PIC defaulted in its previous agreement with government and the original mineral production sharing agreement was revoked by the government. The company, having said it had entered into a deal with a “financially able partner,” then sought and was allowed re-negotiation through an amended agreement.

Under the amended deal however, Purisima said PIC still had not settled its obligations to the government, stressing that its $1.25 million payment was only "less than one percent" of the total amount it had to pay.

“With PIC’s failure to meet amortization payments, PMO demanded that PIC comply with its obligations under the ARDA or it will be constrained to exercise its remedies under the ARDA,” the letter stated.

“Instead of complying with PMO’s demands, PIC filed a complaint against the PMO to prevent it from exercising its available remedies in the ARDA. The case was filed on 2 February 2003," it added.

"Despite the lapse of eight years, there is no indication as to when the case will be decided by the courts. In the meantime, PMO is deprived of its remedies under the ARDA while PIC is able to continue mining the project area through subcontractors.”

The Finance chief said there were reports that said Hinatuan Mining Corp., Philnico’s subcontractor, "as well as other entities have been continuously conducting mining operations and shipping nickel ore from the project area."

“The PMO has been forced to expend considerable resources in order to defend and vindicate the rights and interest of the Republic. I am pro RH Bill even I'm not capable to get pregnant :lol: jok! honestly, RH Bill is one way or another to help ease our poverty problem which is considered already as pandemic. RH Bill doest not encourage abortion according to anti RH Bill simply because without contact between egg and sperm cells will never create life so eventually no practice of abortion but it is preventing unwanted pregnancy specially minors and less fortunate families. IMHO at the end the general public mainly enjoy the benefits once this bill once passed and become law.

MANILA, Philippines — The Department of Finance (DoF) urged the Department of Environment and Natural Resources (DENR) to intensify the drive to preserve Philippine resources, asking the department to look into the operations of Philnico Industrial Corporation (PIC) which has been conducting mining activities in a mineral reservation in Surigao.



In a letter to Environment Secretary Ramon J.P. Paje, Finance Secretary Cesar V. Purisima said PIC has paid only $1.25 million of the $263.8 million owed to the government since 1996 for the purchase of state’s interest in Nonoc Mining Industrial Corporation (Nonoc), which had the mining rights in the Surigao Mineral Reservation.



The purchase was made under the terms of an Amended and Restated Definitive Agreement (ARDA) executed in 1996 by the PIC, Nonoc, and the government through the Asset Privatization Trust (now Privatization Management Office).



The ARDA was executed after the PIC defaulted in its previous agreement with government and the original mineral production sharing agreement was revoked by the government.



The company, having said it had entered into a deal with a ‘financially able partner,’ then sought and was allowed re-negotiation through an amended agreement.



Under the amended deal however, Purisima said PIC still had not settled its obligations to the government, stressing that its $1.25 million payment was only "less than one percent" of the total amount it had to pay.



“With PIC’s failure to meet amortization payments, PMO demanded that PIC comply with its obligations under the ARDA or it will be constrained to exercise its remedies under the ARDA,” the letter stated.



“Instead of complying with PMO’s demands, PIC filed a complaint against the PMO to prevent it from exercising its available remedies in the ARDA. The case was filed on 2 February 2003," it added.



"Despite the lapse of eight years, there is no indication as to when the case will be decided by the courts. In the meantime, PMO is deprived of its remedies under the ARDA while PIC is able to continue mining the project area through subcontractors.”



The Finance chief said there were reports that said Hinatuan Mining Corp., Philnico's subcontractor, "as well as other entities have been continuously conducting mining operations and shipping nickel ore from the project area."



The PMO has been forced to expend considerable resources in order to defend and vindicate the rights and interest of the Republic. Pro-Reproductive Health Bill lawmaker Kabataan party-List Rep. Raymond Palatino said Pacquiao failed to convince his colleagues to reject the measure with his interpellation of Minority Leader Edcel Lagman Wednesday night.

"He failed to convince colleagues to reject RH. Lagman, being the debater extraordinaire that he is, scored a grand knockout against the boxing champ. He stung like a bee while Pacquiao merely floated in air," Palatino said.

The fighting congressman was allowed by anti-RH lawmakers to be among the first to take on Lagman, the principal sponsor of the bill.

Palatino said it was a missed opportunity for the anti-RH camp. “If I were their tactician, I would have reserved Manny for a later debate, give him time to study bill, consult the pro-life constituencies to deepen his awareness of issue. Why did they allow a rookie to face a veteran and experienced parliamentary debater?”

The interpellation was described by observers as a dud, a letdown of sorts for people who expected fireworks.

Pacquiao stuck to his prepared set of questions, did not ask follow up questions, and asked questions that were already answered before. He also stammered and didn’t seem comfortable talking.

Palatino feels Pacquiao could have come better prepared for the debate. “They should have trained him first. He didn't become a great boxer in one night. Same with Congress debates, it's a skill that requires practice," he said.

Pacquiao is not without defenders.

Lagman’s minority colleague, Zambales Rep. Mitos Magsaysay, feels Pacquiao gets an A for effort especially since he is a neophyte lawmaker.

“First termer iyan. A for effort and guts and willingness to do it. It's not easy for a first-termer to speak in plenary. At least siya he made effort to ask questions. How many congressmen do not open their mouths? Kung bitin, kasi he didn’t rebut,” she said.

Magsaysay also defended Pacquiao from criticisms that he kept repeating questions that were already asked.

“He’s just asking in behalf of Filipino people who haven’t heard previous interpellations. Eh paano naman tao na hindi nabasa RH bill at hindi alam rationale ng pro-RH side? Sometimes when you ask a question again, you might have a different premise. Pro-RH side should be patient enough. Narinig mo ba si Congressman Pacquiao na pintasan yung kabilang side?" she asked.

Magsaysay also gave Pacquiao points for boosting interest in the RH debate.“Nakatulong siya, kaya siya interesado, good for both sides. Kung di siya nagtanong, di sila manunuod.”

Manny's debating performance was indeed mediocre. Yes, what can we expect of a solon with no formal education? Despite of that, his courage to stand and voice out is remarkable. His commitment to serve the people is overwhelming and beyond doubt. E 'yong iba dyan akala mo kung sino. Graduate nga ng college,may mba,mpa,PhD,Llb,etc e wala na man palang binatbat. We should all laud Manny for putting up a gallant stand in the face of experienced lawmakers, because if we put it the other way around; I don't think that lawmaker will last ten seconds in the boxing ring! Not only will he be stung by a bee, he'd probably be flat on his stomach. At the end of the debate, Pacquiao is still standing consciously so if we take the average of the bout in the ring and in congress, Manny still wins!

A new RH bill angle exposed! It's about money!

The debate on the controversial Reproductive Health (RH) bill resumed in Congress this week, where the pros and the antis debate once more on this highly-toxic issue, often with those supporting the RH bill (notice they have dropped their new name Responsible Parenthood and returned to using once again the term Reproductive Health) peddling lies in order to sell their proposed bill. I fully agree with pundits that this controversy has polarized the Filipino people. I would even dare say that something good has come out of this debate because it allowed the Filipino people to totally look at the RH bill from different angles... from the moral, the legal to the economic issue - whether our large population is the cause of our poverty.

Yes, those supporting the RH Bill would dare, misinform, cajole or even lie to the Filipino so that they could have this bill passed, while those that are against the RH bill can only tell you one story... the truth!

We’ve so often quoted the world’s foremost liar, Joseph Goebbels, Adolf Hitler’s Propaganda Minister (who at the end of the German Reich killed his own family and committed suicide) who made this most quoted quotation, “A lie repeated a thousand times, assumes the substance of truth.”

The RH bill has been peddled in Congress since the year 1999 in so many different House Bill numbers, selling us all sorts of lies, like for instance, contraceptives are not abortifacient. The latest that was revealed no less than by the former Health Secretary Esperanza Cabral is that contraceptives can cause breast cancer, though it reduces the risk of cervical cancer.

But one good news out of this debate comes from Senate President Juan Ponce Enrile who expressed his opposition to the RH bill saying, “As far as we are concerned here, I don’t think it is a priority. I’ll be very frank with you. As far as I’m concerned, I am not ready to tinker with anything that is an act of God.” Thank God for Sen. Enrile, but what about Sen. Ed Angara and Sen. Miriam Santiago, who recently attacked the Pacman? Ah, that’s what we shall tackle in our column tomorrow.

Meanwhile, there’s that alleged anomaly that Senate Majority Leader Vicente Sotto III exposed during his privilege speech concerning a P2.6 billion allocation for Family Health Programs during the time of Health Sec. Cabral dubbed the Maternal Neonatal and Child Health and Nutrition (MNCHN) program of the local government units (LGU) which some LGUs say they never got. Sen. Sotto is right in asking for an investigation into this potential mess before the Senate would tackle the RH Bill, which also earmarks a large amount of government funds.

There’s more to the corruption issue now plaguing the RH controversy and it’s about money, money and more money from faceless pharmaceutical lobbyists who no doubt are funding Congressmen and women who support the RH Bill. Here’s a letter that reveals this reality.

“Dear Bobit, I have always wondered why the RH Bill is being pushed through even though with or without it, the consumer is free to purchase contraceptives in the counter. So I made some analysis. Based on National Census Statistics Board data 2000, about 24 percent of the Philippine population is above 20 years old. Based on the same statistics, about 50 percent of that are females.

“Considering we have a total population of about 90 million that means the total population of Filipinos above 20 years old is about 22 million. Half of that would be 11 million females. This is the present target market for contraceptives. If I am not mistaken, based on what I have found out from the internet, the cost of using birth control pills is about P1,000 a month.

“The total potential value of the market in the Philippines is therefore computed to be: 11 million x P1,000 per month x 12 months or a total of P132 billion per year. The problem for the contraceptive manufacturers is that 90 percent of the market belongs to the lower income who cannot afford to spend P1,000 per month. So in order to give this market purchasing power, the RH Bill is now being pushed to enable the government to use taxpayer’s money to subsidize these contraceptives.

“To further expand the market, the 10 to 15 years old will be given sex education in school and they will be allowed to purchase contraceptives even without the consent of their parents. That could mean another 4,000,000 potential users. The value of this additional market is calculated to be another P48 billion. Adding the two markets gives us a whooping valuation of P180 billion per year. Now I understand why the RH Bill is being pushed very hard. amu sab ako pagtoo but when I saw the rendering posted by mike, it's a Mall type of Structure with available rentables spaces. Actually it's a two level structure with hotel rooms and department store (if im not mistaken) located at the second floor.

to some 5 star resorts there are PRT gym coz its a requirement, dont know with the others. For me, bringing a surfboard is already a lifting exercise. lol.With the boardshort,there is a store a a few steps from intersection to cloud 9 which sells a lot of things like souveniers and swimming equipment and boradshorts are included..its better to just buy na lang here sa surigao city before going there like bench, penshoppe, habagat store and others which might not be a good quality and available sa General luna and Dapa.:lol:

They just really wanted to make use of the entire space and for as long as those bedrooms are well ventilated and accessible, that will do. I suggest perhaps they should make an atrium in between the hallways to get away with claustrophobic feel of the space that opens towards the ground floor hallway.itd has also an advantage as to the firemen to gain access during fire occurence..They should separates the store and bedrooms that of 2 hours fire rate and acoustic considerations..

If youll examine the floor plan, there are 3 fire exits located at hallway terminations which is good and the problem here is more energy will be consumed for lighting the hallwaysand stairs ( to some parts which does not have windows) and with proper ventilation of the toilets, they will be using much exhaust fans on each toilets unless they will provide air vents.

thats right.lets just observe how they will tackle on this matter.:) The fate of the business depends on how they provide the need of their customer as to convenience and comfort. Selda mu lang, bartolina jud.hehe..bitaw, dili man sad ta kasiguro if fixed na ni nila nga plan. There are maybe some changes along the way.

The Department of Trade and Industry, through the Rural Micro Enterprise Promotion Program (RUMEPP) will be conducting a Small and Medium Enterprises (SME) Negosyo Caravan on May 30-31, 2011 at the City Cultural Center, Surigao City.

thats right.lets just observe how they will tackle on this matter.:) The fate of the business depends on how they provide the need of their customer as to convenience and comfort. Selda mu lang, bartolina jud.hehe..bitaw, dili man sad ta kasiguro if fixed na ni nila nga plan. There are maybe some changes along the way.
This is my first time to see hospitality planning with rooms missing windows or natural source of light. They could do away with skylights or perhaps a well appointed interior with a 3D landscape feature recessed in the wall to compensate for it but I also have some doubts why the OBO approved this in the first place let alone my hesitation on the fire code compliance here!, note, the dry goods section adjacent to the rooms, highly combustible; I hope they have at least a 3hr fire rating separation there as well as compliance on the existing distance. I don't mind staying in rooms with comfortable accommodation plus retail and food units below for convenience, but this kind of planning scares me. I did remember some hotels with rooms backed on to firewalls but some architects are smart enough to create some set back or some voids for natural light to pass thru and when you look below, there is at least some landscape accessible from the lobby. Its all about efficient planning.

as i said this is not the final floor plan since they only applied for fencing permit.Not yet for building permit.

It's good that we already have an idea that it is a mix occupancy. Since it would be the first of its kind in the city we are looking forward that the OBO will be very deliberate in reviewing the design plans and specifications prior to issuance of building permit to ensure that the provisions of the National Building Code and its IRR are satisfactorily met.

Aw kalaong ko na final na ini na layout. Just a cause for concern since I thought it was the official floorplan. We'd like to welcome businesses in the city but it has to be done right. I'm not even sure how the planned hotel/lodging can mesh and share the same floor with the store using the current building codes in the PH. You might have a better idea on this since you are the expert.

Finance asks DENR to take
a look at nickel miner in Surigao


The finance department has urged the Department of Environment and Natural Resources to intensify the drive to preserve state resources by looking at the operations of Philnico Industrial Corp. (PIC), which has been conducting mining activities in a mineral reservation in Surigao.

In a letter to Environment Secretary Ramon J.P. Paje, Finance Secretary Cesar V. Purisima said PIC has paid only $1.25 million of the $263.8 million it owes the government since 1996 for the purchase of the state’s interest in Nonoc Mining Industrial Corp. (Nonoc), which held the mining rights in the Surigao mineral reservation.

The purchase was made under the terms of an Amended and Restated Definitive Agreement (ARDA) executed in 1996 by the PIC, Nonoc, and the government through the Asset Privatization Trust (now Privatization Management Office).

The ARDA was executed after the PIC defaulted in its previous agreement with government and the original mineral production sharing agreement was revoked by the government.

The company, having said it had entered into a deal with a "financially able partner," then sought and was allowed re-negotiation through an amended agreement.

Under the amended deal, however, PIC still had not settled its obligations to the government, stressing that its $1.25 million payment was only "less than 1 percent" of the total amount it had to pay, Purisima said.

"With PIC’s failure to meet amortization payments, PMO demanded that PIC comply with its obligations under the ARDA or (the PMO) will be constrained to exercise its remedies under the ARDA," the letter said.

"Instead of complying with PMO’s demands, PIC filed a complaint against the PMO to prevent it from exercising its available remedies in the ARDA. The case was filed on 2 February 2003," it added.

"Despite the lapse of eight years, there is no indication as to when the case will be decided by the courts. In the meantime, PMO is deprived of its remedies under the ARDA while PIC is able to continue mining the project area through subcontractors."

The finance chief said there were reports that Hinatuan Mining Corp., Philnico’s subcontractor, "as well as other entities have been continuously conducting mining operations and shipping nickel ore from the project area."

"The PMO has been forced to expend considerable resources in order to defend and vindicate the rights and interest of the Republic. These efforts will however be all for naught if PIC or its subcontractors are allowed to continuously deplete the mineral resources while at the same time tying up the matter in court," the letter said.

"As the government agency with the mandate to protect the Republic’s interest over the environment and its natural resources, we urge the DENR to take the necessary action/s against PIC’s continued exploitation of the project area."

LOCAL Water Utilities Administration chairman Prospero Pichay Jr. was suspended by the Office of the Ombudsman on Friday over the acquisition of a controlling stake in a thrift bank in 2009.

Acting Ombudsman Orlando Casimiro ruled there was enough evidence that Pichay, a former congressman from Surigao del Sur, committed the administrative offense of grave misconduct.

“We have now determined that it is very likely that there would be a manipulation of evidence through intimidation of witnesses or tampering with records,’’ Casimiro said.

On Friday, President Benigno Aquino III also suspended three LWUA Board members—Bonifacio Mario Peña, Susana Dumlao Vargas, and Renato Velascofor the alleged anomalous purchase of a stake in Express Savings Bank Inc.

The charges against Pichay and three LWUA officials-—Acting Administrator Daniel Landingin, Acting Deputy Administrator for Investment and Financial Services Wilfredo Feleo, and Corporate Legal Officer and Board Secretary lawyer Arnaldo Espinas—were filed by LWUA employees Rustico Tutol, Luis Estrada, and Carmen Amores.

The complaint against the three trustees, on the other hand, was filed by Finance Secretary Cesar Purisima.

The complainants accused Pichay and the three officials of violating the Code of Conduct and Ethical Standards for Public Officials and Employees and grave misconduct for the alleged unlawful disbursement and investment of P870 million in LWUA funds in the thrift bank.

The complainants said the fund disbursements were allegedly made without prior approval from the Monetary Board, which went against a 2001 Bangko Sentral ng circular.

Due to the multi-million peso investment, LWUA supposedly gained 20 percent control of ESBI’s voting stock, but it was nevertheless disadvantageous to the government because no income came out from it, the complainants said.

They said LWUA did not earned from such investment and the P450 million capital subscription because not all were supported with a memorandum of agreement or certificates of investigation to protect the agency’s interest.

After reviewing the complaint, the Ombudsman said the facts that had been so far established and the documentary evidence presented supported the administrative complaint against the respondents and were compelling enough to warrant their suspension.

“The evidence sufficiently bears out that the acts which they allegedly committed constitute the administrative offense of grave misconduct which would, if proved eventually to have been actually committed after the conduct of appropriate proceedings, warrant their dismissal from the service,” Graft Investigation and Prosecution Officer II Judy Anne Doctor-Escalona said.

“Although LWUA as a government corporation with special charter has power to create subsidiary corporations such as a specialized banking institution, such powers is still subject to the review and approval of the President of the Philippines,” Doctor-Escalona said in her resolution.

Pichay, through his lawyer, said they planned to elevate the case to the Court of Appeals.

I agree with you jed but, for a one day stayer guest i don't think bintana is an issue as long that the rooms are equip with entertainment facility like TV or built-in personalized audio selector plus rooms are clean including amenities like beddings and towels and most of all good service. It will also depends how the reception or booking in-charge arrange the room assignments to the guest, for instance pag long vacationers priority sila sa rooms na may window and those short stayers guest (example one day & one night) pede na sila sa middle rooms...opinion ko ra ini as former hotelier :)

4.5-magnitude quake rocks Surigao City, Dinagat Islands

A 4.5- magnitude earthquake hit Surigao City in Surigao del Norte and the province of Dinagat Islands on Saturday night, the Philippine Institute of Volcanology and Seismology (Phivolcs) said on Sunday.

According to Tony Madrio of Phivolcs Surigao, the quake struck 24 kilometers southwest of Loreto, province of Dinagat Islands at a depth of 52 km.

The quake hit at 10:56 p.m., Phivolcs added.

Intensity 5 was felt in Libjo, Dinagat Island; intensity 4 in San Jose and Loreto; intensity 3 in the municipality of Dinagat; and intensity 2 in Basilisa and Cagdianao. Intensity 1 was felt in Surigao City.

No aftershock or damage has been reported so far.

Today (6 pm to be exact) is the end of the world or the start of the end of the world, according to an unknown religious group. Not a single moment did I thought of it. I just remembered it tonight when I visited the 42 Surigao Thread. I don't think the end of the world will happen in our lifetime. Scientists have already predicted that the world will surely end but in millions or billions of years from now because the universe will ultimately collapsed.

I hope they (govt) will go hammer and tongs against PIC. when were still negotiating with Jinchuan< i had the opportunity to inter act with the PMO Lawyers. Young and idealistic, they were frustrated kay mismo an govt daw an sige pugong sa ila. PIC is well connected sa GMA admin.

If this is not working at this location, puede man siguro ibalhin sa lain na location na possible molambo. I wonder if over these years, they studied the demographics of the Night Cafe habitues kay para mahibaw-an kon unhon ini pagpagana sanan uno may gajud gusto nan mga tawo.

(Pero kon ya nay gajud ini pag-asa, dayhon ra kan ini sa mortuary para maawtopsy dajun para mahibawan kon uno may hinungdan nan pagkamatay.:D)

I would expect him so. After millions invested in the new Tavern, he certainly would not want competition not far from his doorsteps that are profiting with no capital expenditures. IMO, the set up of the cafe is not physically helpful to the overall look of the boulevard. It gives the area a falsely blighted appearance like a ghetto since the temporary structures look like barong barong or trapal trapal. I see onlookers, mostly kids, than actual participants in the event.

Medyo lipa na man tan awon an Bitaug. The water is not clear anymore. Hamok iton mga naglutawlutaw. Before when I was a small kid, my family picnicked there many times and we were the only ones there all day. Waya pa iton mga kubo kubo. (Back then, the best beach in Surigao was Sabang and Mabua). One time, I chased a 5 footer land snake out of the water that was swimming with me. It slithered through the beach and up to the mountain. Wild orchids used to grow abundantly on the rock precipices and trees above the beach. Seakayaking was fun around the island- completely peaceful and quiet with hardly anybody there.

amo gajud an problema basta ma well-known, sometimes maabuse sad jud if dili mamaintain knowing na lisud ang garbage disposal lay isolated ini nga island of basilisa..I also had a very memorable experience here..a lovely serene place to enjoy nature.As kas as i know jaon may kuno mag-asawa nga nagkeep on cleaning the place.

I think this night cafe is not really working as expected. dapat siguro tangtangon na ini kay kung ok pa ang operation nan ini amu na tana ini ang hisgutanan sa mga tawo. ni kausa waya man gani ini mahisguti sa amu ofis.

Kini si Susana Dumlao Vargas taga Surigao siguro. Dunay Susana Dumlao nga nag high school sa San Nicolas College, in fact, sya ang valedictorian niadtong 1962. Mistisahon ni sya (Chinese-Spanish) og ang iyang mother, home economics teacher ng SNC pod niadtong time. Gisundan sya ni Alicia Calejesan (Santos), nga valedictorian ng SNC in 1963.
