Dr. Richard Espeno March 1st, 2012, 10:03 AM I think CJ is perceived by Aquino as pro-GMA. Since Aquino wants to persecute GMA, then he knew that he has to get rid of Corona because the case will ultimately go to SC.
As to Aquino and his officials, how come the political opposition is silent and is not filing cases against them? Does it mean they are coward or they can't find cases to charge them? Remember, the Judiciary is perceived to be anti-Aquino with the recent development. In this regard, it is easier for the opposition to file cases against the corrupt officials of Aquino. I would be glad to see both parties to be put in jail!!!!!! :cheers:

if we file cases just based on perceptions then i can always file a case against anybody including Aquino...maybe Aquino and cohorts are filing cases against their oponents because they are in power...they have de lima, DOJ, NBI, police , AMLA , 188 congressmen and all machineries of governement

I subscribed and am consistent to my principle that whoever is guilty of graft and corruption must be charged regardless of party or political affiliation.
If CJ is guilty, then he should be convicted. Other cases should be filed whether pro or anti-Aquino.

Nice job laying your predicate there, dokey! I agree with you that if ever there will be moves to cleanse the government of corruption, we should "cut the head, and the body will fall".
The way things are unfolding, it seems there's more to these "anti-corruption" drive of the president than what meets the eyes!

In a text message to ABS-CBN News, Bayan secretary-general Renato Reyes, Jr. chided lead prosecutor Niel Tupas, Jr. for resting the prosecution's case last Tuesday in spite of a pending request for the testimony of Supreme Court Associate Justice Ma. Lourdes Sereno on Article 7.
In a letter received by the office of Bayan Muna Rep. Neri Colmenares, who wrote Sereno on behalf of the prosecution, Sereno said the termination of the prosecution's presentation of evidence superseded the request.
"[T]he termination of the presentation of evidence by the Prosecution panel... has superseded your invitation," Sereno said in her letter-reply to Colmenares.
"Clearly, Sereno was preempted by Tupas yesterday when he shut the door on Sereno's testimony. Tupas bungled what could have been a chance to expose Corona's partiality towards [Gloria Macapagal Arroyo]. It raises the question, were Aquino's allies in the Prosecution really serious in pursuing the GMA-related articles of impeachment?" Reyes said. :naughty: :naughty: :naughty:
"Why cut the presentation of witnesses like Sereno so abruptly?" he added.
Reyes pointed out that Sereno's decline of the invitation made no mention of a February 14 Supreme Court resolution barring justices and court employees and personnel from testifying in the Impeachment Court.

In terminating the prosecution's case, Tupas said they have already presented "sufficient evidence" to convict the Chief Justice.
The trial is suspended until March 12 when the defense shall present its own evidence to refute the allegations in the Articles of Impeachment.

hindi na siya natatakot na hindi maihalal o muling maluklok sa kadahilanang may babalingan siyang bagong tungkulin/gawain.

After some hemming and hawing, Iloilo Representative Niel Tupas Jr. on Wednesday finally confirmed he and a Philippine Savings Bank branch manager, Anabelle Tiongson, had met before.
In a phone interview over Radyo Inquirer prompted by a photograph that appeared in the social network Facebook on Monday, Tupas confirmed he and Tiongson met at a wedding held 25 years ago.
In the picture, a man wearing a barong Tagalog—identified as Tupas—and a woman in an off-shoulder gown— supposedly Tiongson—are shown flanking a young, newlywed couple.
Asked if he had seen the picture, Tupas said in Filipino: “It was shown to me yesterday, so I remembered. I was 15, that was 25 years ago.”
He maintained, however, he did not know that Tiongson was the same woman who was in the photo with him as part of a wedding entourage.
“You don’t really get to know the other people in such occasions,” he said.
The head of the prosecution panel in the impeachment trial of Chief Justice Renato Corona, Tupas was grilled by Senator Jose “Jinggoy” Estrada over the alleged closeness of the Tupas and Tiongson families of Iloilo.
At the trial, Tupas denied having met, or having been introduced to Tiongson before. The latter also said she only got to know of Tupas through the media.
Tiongson appeared before the Senate impeachment court to testify on Corona’s bank accounts at the PSBank branch on Katipunan Avenue in Quezon City.
The accounts were the subject of a subpoena served by the prosecution based on supposed copies of Corona’s bank accounts. Representative Rey Umali, a member of the prosecution panel, said the documents were given to him by a “small lady.”
The provenance of the Corona bank records got even more complicated after Tiongson said Quezon City Representative Jorge “Bolet” Banal had visited her office to inquire about the veracity of the documents on Corona’s bank records.

Well, he meet her 25 years ago....but the FACT THAT THEY HAVE MET and Tupas and Tiongson vehemently denied that they did ( without 2nd thought whatsoever ) when asked by Sen Estrada and inside the impeachment court is already tantamount to deception and deceit...the fact that THEIR FAMILIES KNOW EACH OTHER there is no reason that THEY COULD HAVE WORKED TOGETHER IN SOME ASPECTS...maybe even Tupas not knowing it....but really he doesn't know anything??...what a lawyer and a congressman he is :ohno::ohno:....the relation between thier families should be investigated as they could have collaborated one way or another to get those bank accounts ( of course with the blessing and PROTECTION of pnoy)....but know this...specially the constituents of Tupas....HE HAS AN INNATE, NATURAL ABILITY TO LIE AND DECEIVE....as clearly shown during the trial...and now too....Do you really still want this guy to represent you in congress??:ohno::bash::ohno::bash:

What are you guys talking about? She called a spade a spade. What's wrong with that? The prosecutors performance and behaviour are more embarrassing to Filipinos, because the world might think that if educated Filipinos (like these lawmakers and lawyers) lacked the competency to do their lawyer duties, what more the ordinary Filipinos? Dumb and dumber? She basically touched on an intrinsic prob in the country. The lack of diligence and focus to go for the highest quality performance.

As in my earlier posts, I don't care if all the congressmen and senators or all government officials in any political affiliation shall be charged with graft and corruption as long as we get rid of this disease that has afflicted the entire nation for so long as I remember. :ohno:
Systemic or process change in the way the govt does its business. E.g. automate government services and transactions (e.g. like the NBN project) so that all gov't activities are online and traceable. Automate gov't financial transactions, e.g. pay by debit card, direct deposits, wire transfers instead of cash and carry. Government system is archaic, paper, pencilm carbon paper, typewriter and eraser age.

Order kasi yan mula sa malacanang after witnessing the huge huge number of people that attended the inc gathering in luneta. Kinabog si pnoy ng makita ang kaibahan ng dami ng tao pumunta sa luneta at ng pumunta sa rally nya sa edsa nung people power celebration. As proof na natakot nga si pnoy ipinadala nya kinabukasan si exec sec ochoa sa INC HQ to ask for an audience with the INC leaders kaso lang ochoa and pnoy were denied a meeting.

Lead counsel Serafin Cuevas on Thursday ruled out the possibility the defense would put Chief Justice Renato Corona on the witness stand, pointing out that the panel could not intervene in the questioning by senator-judges.
“I believe this is not good because the members of the impeachment court can examine him on all angles and Justice Cuevas cannot object,” Cuevas said in an ANC TV talk show. “The moment I start raising questions, the judges will say ‘out of order.’”
A day after the prosecution rested its case, Senate President Juan Ponce Enrile said on Wednesday that the Chief Justice’s best defense was to take the witness stand and personally rebut charges he fudged his statement of assets, liabilities and net worth (SALN), and showed partiality toward former President and now Pampanga Representative Gloria Macapagal-Arroyo.
Cuevas has repeatedly complained that the Senate rules prevented both the prosecution and the defense from interfering in the senators’ examination of witnesses, unlike in the impeachment trial of then President Joseph Estrada in 2000.
In the TV interview, the former Supreme Court associate justice also expressed concern about protocol and sitting arrangements in the Senate tribunal.
“We are not adoring him or we’re not idolizing him, but it is not for Chief Justice Corona only but for everybody similarly situated in the future. I hope there will be none in the future,” Cuevas said.
However, he conceded Corona could be called to testify if necessary to explain his bank accounts.
Tranquil Salvador III, another defense counsel, worried over “wider implications” in Corona appearing in the Senate and that these issues were being discussed.
Difficult situation
“He might be placed in a difficult situation,” Salvador said. “Some people may take advantage of this just to taunt him, to ridicule him, to make fun of his office, even his person and family.”
Salvador, a remedial law professor in various law schools, explained that the prosecution enjoyed “wide latitude in terms of cross-examination.”
Asked about this, Salvador replied that Cuevas as head counsel has a “strong say” on the issue which would have to be made before the defense presentation begins on March 12 after a nearly two-week break in the trial.
“Personally, if you ask me, it might be possible. But being part of a team, if the team reached a decision, I will have to abide by it,” Salvador said.
“The way I view it, it might not look good because the members of the Senate impeachment court can examine him on all angles, but Justice Cuevas cannot object. The moment I start (to object to the line of questioning of senator-judges), the judges will say, ‘out of order’ because I cannot object (under Senate rules).”
Salvador, however, refused to elaborate on Corona’s testimony, including matters that the impeached Chief Justice would be testifying on.
Difficult decision
Aurora Representative Juan Edgardo Angara, a prosecution spokesperson, said Corona faced a difficult decision.
“Whether to testify or not is the difficult decision the Chief Justice faces: on the one hand, he is the best person to testify since he would know about all the bank accounts, properties, condominiums and he could talk about the discrepancies in his SALN, which we have brought out,” Angara said.
“He could also testify that he did not extend special treatment to any litigant or any person. On the other hand, this has its attendant risks as his credibility and the consistency of his testimony could be tested severely once he is subjected to rigorous cross-examination by the prosecution, and the searching questions by senator-judges,” he added.
“If they are confident of his ability to withstand the rigors of questioning then they will likely present him as a witness. If they feel it is too risky, most likely he will not be presented as witness.”
Enrile on Thursday said Corona’s lawyers could begin arguing his case despite the unresolved issue of whether his purported dollar account should be scrutinized in the impeachment court.
But the tribunal’s presiding officer urged Corona to appear in the trial, saying doing so “will be good for the nation.”
“It will settle a lot of issues,” the Senate President told reporters. “He is the best witness to clarify the issues… I’m not the lawyer of the Chief Justice, but to me, the best person to controvert, to rebut everything that has been said against him is himself.”
Dollar account
Enrile downplayed apprehensions by the defense lawyers that Corona would only expose himself to enemy fire, saying “I’m sure that he can handle the questions.”
He said Corona would be in the best position to clarify the matter of his bank deposits, including the “internal problem” in the Supreme Court.
Justice Secretary Leila de Lima earlier testified and used a dissenting opinion of Associate Justice Maria Lourdes Sereno, as part of the prosecution’s effort to nail Corona for allegedly favoring Arroyo.
Enrile said Corona’s lawyers could start presenting evidence upon the trial’s resumption on March 12.
But for that to happen, both the defense and the prosecution should agree, considering that the Supreme Court is yet to resolve a Philippine Savings Bank (PSBank) petition against disclosing Corona’s purported dollar account.
Enrile said the Senate would eventually have to decide on the prosecution’s desire to look into the alleged dollar deposits “at a certain point.”
No amendment needed
He pointed out that the Senate, sitting as an impeachment court, was designated in the Constitution as the body with “the sole power to try and decide” impeachment cases.
“No one else can make the decision but the Senate alone,” Enrile said in Filipino. “It means that we are not under the jurisdiction of the Supreme Court in terms of having the ‘sole power to try and decide’ all impeachment cases.”
Enrile said the high tribunal would have jurisdiction only if “private rights are involved in the course of the trial.”
Enrile was not keen on asking prosecutors to amend the articles of impeachment in the wake of their decision to focus only on three charges against Corona.
An amendment would require them to send the complaint back to the House of Representatives for another round of voting.
“At this point, I will not require an amendment,” he said, noting that an amendment would be tantamount to dismissing the case and as such, would leave a “bad impression” among the people. “We have to proceed up to completion. We will make a judgment.”
But Enrile said criticisms on the quality of the articles of impeachment should serve as a lesson for House prosecutors.
“I hope the House will take this as a friendly advice that before they bring the articles of impeachment here, they should be well-crafted leaving no doubt as to what they really want to say.”
