Pero hindi ba, dapat pag nag-akusa ka at nagfile ng case, ibig sabihin may cause of action ka na at dapat may proofs ka na. Hindi yung inuungkat mo at sinasali sa kaso yung hindi kasama sa accusations.

re sale of property between father and daughter, there can be a sale there, but is raising eyebrows is the question whether the daughter had the capacity to buy it and not just an attempt to transfer properties by using dummies. in all probability, this is a fictitious sale as there is really no consideration paid by the daughter between them. really out of the ordinary as daughters would typically ask these properties for free or advance legitime.
in real life, buying a property from you parents spot cash, is that a typical behavior between father and daughter? you are going to law school right, it is obvious din naman yan na may tinatago. how would you explain vidals unwillingness to submit it if you have nothing to hide.
di ba presumption of evidence yan, na evidence willingly withheld by one party is presumed to be adverse to him. kaya lumabas na lahat yan. not to mention corona failure to disclose in his saln that from 2002-2009 that his wife worked in government as mandated by law.
as a fellow lawyer, i have no sympathy for this cheap justice, er, i mean thief justice, oops, i meant chief justice. with corona, he seemed to have muddled the 3 concepts.
in criminal law, your contention would be correct as there are strict rules of procedure, but in the impeachment court, i think they have given more leeway to it being a political/criminal process.
for example, betrayal of public trust is a broad offense which can absorb most of the charges but to pin them down in any of the 8 would be enough.
tip. carpio, drilon, enrile all belong to sigma rho. so you should know where this trial is headed.

his net worth=14m? meaning, if today, he decides to sell all his properties and buy only one property, he can only buy one worth P14m which is his net worth. wag mo na isama future income kasi hindi counted sa net worth yan.
if you are worth only P14m now, and receiving an annual salary of less than a 1m pesos. how can you afford to buy and sell properties worth P50m?
kaya marami mga government officers nadadali dyan. sometimes it is not even required that the asset be listed in your name, like a car, as long as it is proven that there is " beneficial ownership" meaning, ikaw gumagamit araw araw. :lol::lol:

For sure hindi absolute requirement yun specially kung publicly known yung fact. So hindi kagad natin pwedeng i-claim na nandudugas si Corona dahil lang hindi niya nilagay sa saln nya na married siya kay mrs. Corona. Substantial compliance sa rules relating to saln is enough. What is substantial compliance depends on the court na.
Ang point ko lang, theprosecutionn really has to prove na nandugas nga si Corona sa saln nya. So far, hindi pa nila napapatunayan. Mere discrepancy should not lead us to an adverse conclusion.

i am sure that they will do that. although i am not into too much of litigation, i am sure that it will go that direction. marking of evidence pa yan and testimony ng mga witnesses. when the prosecutors will argue the case, ipapakita yan, kaya nga kim henares was summoned to produce the income returns of the couple, upon the approval of the president of course kasi you can be criminally liable if you show that document.
nilalatag lang nila ang evidence, kaya nga cuevas was arguing yesterday to have the case dismissed etc. etc. etc and the documents rejected. once admitted as evidence, later on during the offer of evidence, patay na. :lol::lol:

Defense lawyers on Thursday expressed concern that some senators were acting as “substitutes” for fumbling House prosecutors in the impeachment trial of Chief Justice Renato Corona.
Serafin Cuevas, Corona’s lead counsel, lamented how Senator Franklin Drilon saved the day for the prosecution and compelled Enriqueta Vidal, the Supreme Court clerk of court, to release to the impeachment court the chief magistrate’s statement of assets, liabilities and net worth (SALN) without authorization from the high tribunal.
The defense panel may have to seek relief from the high tribunal “if we feel that their actions are already constitutive of grave abuse of discretion,”:bash: said the former Supreme Court associate justice.
“They (senators) are judges. They shall remain impartial and shall decide on the basis of the Constitution and the law,”:ohno: Cuevas said in a news briefing after the trial on Wednesday night.
Cuevas said Corona’s legal team was discussing the possibility of bringing its concern to the Supreme Court if it becomes more apparent that some senators are favoring the prosecution panel.
The 83-year-old lawyer shrugged off suggestions that a decision to seek legal remedies would delay the proceedings, arguing that lawyers were obligated to ensure the best legal action for their client.
“We are prepared for this eventuality … We will invoke our right to get a relief from the Supreme Court. Where else can we go? That is the only recourse left on our table … We are merely abiding by the dictates of the Constitution,” Cuevas explained.
Former Senator Francisco Tatad said he approached Drilon during a break in the proceedings on Thursday to express concern about his observation that the senator was “doing a job” but was “beginning to sound like (he is) a member of the prosecution.”
Tatad told reporters Drilon snapped back at him, “Why, what’s your problem? You disqualify me! Disqualify me!”
Tatad said Drilon told him to “sit with them in the defense panel.”
“I’m not here to be part of either prosecution or defense panel. I’m here to write a book on the impeachment. This would be my second book on impeachment,” said Tatad, who wrote the book, “The Impeachment of President Joseph Ejercito Estrada” several months after his ouster in 2001.
Tatad, who was Senate majority leader when Drilon was Senate President, said he told the senator-judge “that I’m interested in credibility of the impeachment process.”:bash:

Lauro Vizconde has decided to appear in the impeachment trial of Chief Justice Renato Corona to discuss the details of a private meeting with him in September 2010.
Vizconde, 74, said that during this meeting Corona told him about the alleged efforts of Senior Associate Justice Antonio Carpio to pressure (binabraso) colleagues to vote for the acquittal of Hubert Webb, son of former Senator Freddie Webb.
The younger Webb had spent 15 years in prison awaiting the final ruling of the high tribunal in connection with the rape of Vizconde’s daughter, Carmela, who was later murdered, along with her younger sister and mother in their Parañaque City home on July 31, 1991, in which he was the principal accused.
Vizconde said he had spent the past two weeks agonizing on whether to testify against Corona whose revelation to him in that private meeting was cited as one of the grounds in Article 3 of the impeachment complaint against the chief magistrate for betrayal of public trust and culpable violation of the Constitution.
Prosecutors said the disclosure constituted a “serious breach of the rule of confidentiality” on cases pending in the high tribunal.

Pnoy will just appoing his ally to the CJ position. Graft and corruption will not be solved at all. Prices will not come down, people wont have more jobs. The country's peace and order situation will not get better. Gas prices will not go down. Going abroad to work will still be the number one priority for most pinoys because of the lack of income opportunities in our country. The only good thing i can milk from these crass proceedings is for its entertainment value. This i agree is better than those stupid telenobelas being force fed to us day in day out on local tv.

The Ombudsman said the company that came out of the Requinto-Montesclaros deal did not have complete processing permits from the Department of Environment and Natural Resources (DENR).
And when he issued the permit, Tupas Sr. knew that his daughter-in-law, Binky April Montesclaros Tupas, and her father were involved in Requinto?s project, the Ombudsman said.

?The FIO adds that accused is in the best position to know that MMEI [the company] was using Requinto?s Isag [industrial sand and gravel] permit to conduct illegal crushing operations of raw materials extracted from other areas without the necessary mineral processing permit from the DENR,? the decision read.
Tupas Sr.'s relationship with the Montesclaroses gave Requinto's company unwarranted benefits and an undue advantage,? the Ombudsman said.
Thus, despite the violations committed by the firm, Tupas Sr. did not lift a finger [against them], the decision said.

Evidence is evidence, whether it's a strong one or a weak one at least they presented them. It would be more interesting to know what the defense have to say in rebutting them.

If Chief Justice Corona is impeached due to his SALN, would that set a precedent throughout all the branches of the government making almost all officials in the Philippines subject to impeachment???? I mean do we honestly think that the SALN of our representatives and senators are free of questionable transactions???

Can justices of the supreme court be impeached based on ideology and political alliances???
We know that supreme court justices are fetted by the senate during the nomination process, in which im sure all of the nominated justices profess their strict adherance to interpretation of the law instead of imposing their political or personal preferrences, but we all know this is a half truth for all nominees, so when justices start to show their political leanings and preferences while already serving the court, can this be reason enough for impeachment?

REad your facts and the law, Tigidig. It was a majority decision by the Supreme Court and not just Corona alone. CJ Corona did not just whip it out of his belt. Of course, if there is no case yet filed against GMA, why would you prevent her from travelling abroad? The right to travel and to be presumed innocent until proven guilty are rights of the individual against the State as enshrined in the Philippine Constitution. A TRO is meant to preserve the status quo. The SC has discretion to issue it ex parte and it also can determine if there is already substantial compliance with its conditions. Nagpapadala ka sa media at propaganda. Ang hindi mo alam o pilit kang nagbubulag-bulagan ay yung dark underbelly kung bakit gusto nilang tanggalin si Corona at ang ibang SC Justices. Susunod-sunorin daw nila. Eh kasi, gusto ni PNoy iluklok yung sarili niyang appointees para lahat ng kaso niya maipanalo niya. Utusan ba naman i-defy ng Sec. of Justice niya ang lawful order of the Supreme Court. Violation of separation of powers of the branches of government. Culpable violation of the Constitution. Tigs wake up buddy... You are buying into the misinformation of the media. You cannot impeach a chief justice on basis of supposed political alliance or accused bias in favor of a particular political party. NO LAW WAS BROKEN and the supreme court voting UNANIMOUSLY defended their decision with full interpretation of the law. The administration however could not defend their moves through interpretation of the law and that's why they have brought their case to the media through misinformation and character assassination. They get rid of Corona but in the end that is just one justice out of several more, do they intend to kick out every single justice until they submit to the will of malacanang????? MANILA, Philippines - There was nothing unusual about Chief Justice Renato Corona’s receiving P10-million discount for his purchase of a penthouse unit at the upscale Bellagio in Bonifacio Global City in Taguig, the chief magistrate’s lawyers said yesterday.
“It is not unusual to give discount, the standard is 15 to 20 percent,” defense panel spokesperson Karen Jimeno said.
Jimeno also noted that the unit purchased by Corona and his wife Cristina has “defective areas” which need to be rectified or repaired. Jimeno said the couple bought the condominium unit at the height of the financial crisis and “it would not be unusual (for the developer) to give 40 percent discount.”
During Corona’s impeachment trial, private prosecutor Joseph Joemer Perez said he received information from Megaworld finance director Giovanni Ng that Corona received a P10-million discount for the 300-square-meter Bellagio property, which was purchased for P14 million.
Ng said the sales and marketing department usually gives up to a 15 percent discount to clients who avail of shorter term payments for units.

Megaworld should definitely sue then if they were indeed blackmailed/coerced especially now that this pricing anomaly is in the open. Keeping silent about this issue does not do them any good because they'll come across as a guilty party as well (discounted pricing for favorable decision kind of deal). I agree that this transaction was inappropriate. It was a lapse in judgement on Corona's part that's difficult to defend. If a case against megaworld were to reach the supreme court , it begs to question, would he excuse himself???
But, is this transaction an impeachable offense??? Can a supreme court justice be impeached solely on this transaction??? I can hardly believe Chief Justice Corona as being either pretty naive or not too bright to allow himself to be put in such a compromising position. He should know better, more so because he is part of the Philippines justice system which should remain impartial and uncorruptible. And unfortunately perception and truth can be a blurry line and now he is paying for it.
How can Corona in good/clear conscience allow one's self to accept a 40% discount amounting to P10M from Megaworld and not think the very perception alone that this can be interpreted as taking a bribe (true or not) can compromise and ruin not only him, his career, and even worse by defacto the whole Philippine judiciary system. It's just so wrong and irresponsible, especially holding the position he has. Well i wouldn't mind a recall of all members of congress... the hard part about that is that it must be initiated by the public, to which a majority can be bought by politicians. Ah... a hopeless case.

Hay nako pare pareho lang mga pulitiko. All of them have skeletons hidden in their closets. Corona was just unfortunate enough to be facing this problem. Other politicians have even bigger houses and much much more real estate properties. For example Senator Drillon lives in forbes, his current residence is worth P195million, which is under the name of her daughter. Her daugther bought the house some 10 years ago for P130million. So we all know that Drillon has been a senator for many many years already and before that serves as DOJ secretary of cory aquino. With govt salary being soooo low how and where the hell did he get the money to buy a P130million home in forbes park no less? His daughter may certainly not be that rich to afford one too. Senator's drillon situation is parallel to that of cj corona. Corona bought the condo unit under his daughter's name too but we all know it was corona who paid for the unit. Kaya pare pareho lang yan. For example Senator Drillon lives in forbes, his current residence is worth P195million, which is under the name of her daughter. Her daugther bought the house some 10 years ago for P130million. So we all know that Drillon has been a senator for many many years already and before that serves as DOJ secretary of cory aquino. With govt salary being soooo low how and where the hell did he get the money to buy a P130million home in forbes park no less? His daughter may certainly not be that rich to afford one too. Senator's drillon situation is parallel to that of cj corona. Corona bought the condo unit under his daughter's name too but we all know it was corona who paid for the unit. Kaya pare pareho lang yan. THE defense lawyers of Chief Justice Renato Corona debunked allegations linking the discounted sale by Megaworld to the Coronas of a penthouse unit at the Bellagio Tower in Taguig with a number of cases at the Supreme Court involving the developer’s other property.
Appearing before the Impeachment Court on Tuesday, Megaworld Senior Vice President for Marketing Noli Hernandez also testified, under questioning by Senator-Judge Alan Cayetano, that Megaworld lost two cases involving P47 million in the Supreme Court when Corona was already in the SC.
Hernandez said there were several reasons for the P10-million discount to Corona. He said the condominium unit, then priced at P78,000 to P80,000 per square meter was damaged by a typhoon before it was sold to Corona in 2008.
“The original price was P24 million but in 2008 the situation drastically changed for the realty market environment,” he said, citing the Lehman Brothers debacle. “Unfortunately, there was also a typhoon and the unit sustained water damage and we decided its going to cost us more if we had it redone and opted to sell it at a discount instead.”
The prosecution earlier said the Bellagio property, which Corona had acquired in 2008, was not reported in his 2009 Statement of Assets, Liabilities and Net worth (SALN).
Asked by Senate President Juan Ponce Enrile if it was common for Megaworld to give such discounts, Hernandez replied: “No, sir. The discount was not a favor but due to force majeure.
Hernandez said the same discount, ranging from 15 percent to 20 percent, would have been given to any buyer other than Corona because they computed the cost of repairs and “decided it would be wiser to just sell the damaged unit at a discounted price.”
In a separate statement, defense panel spokesman Mon Esguerra disputed claims that Corona allegedly favored Megaworld in an SC decision. “The timing of the decision and the discount do not add up,” he said.
Esguerra also said that while the prosecution would have wanted to make it appear that the large discount given by Megaworld Properties and Holdings Inc. to Corona for his purchase of the Bellagio unit was a “favor,” the facts do not add up.
He said court records showed Megaworld Properties and Holdings Inc. v. Cobarde was written by then-Associate Justice Corona and was promulgated on March 31, 2004. The decision granted the petition of Megaworld and absolved it from the responsibility of paying broker’s commission in a compromise agreement. In the case, the Supreme Court ordered Megaworld to be paid P5,853,793.01 by the opposing parties.
“Connecting the decision to the alleged 40 percent discount amounting to P10 million requires some manipulative thinking,” Esguerra defense said. The circumstances of the sale reveal that the Bellagio condominium unit was bought in October 2008, with the last payment made in October 2009; the decision on the Megaworld case was written in March 2004.
“Esguerra said the decision was also concurred in by two other associate justices: Associate Justice Angelina Sandoval-Gutierrez, now retired, and Associate Justice Conchita Carpio-Morales, the current Ombudsman appointed by President Aquino.
Esguerra also said that in Megaworld Globus Asia Inc. v. Tanseco, a decision written by then Justice Carpio-Morales and promulgated on October 9, 2009, Megaworld lost the case for failure to complete and deliver a condominium unit to its buyer. Megaworld was ordered to pay P21,725,438.02. “The unfavorable ruling to Megaworld was concurred in by then-Justice Corona. Clearly, no favors there,” Esguerra said.
He also cited another case where Corona took part. The case was Megaworld Globus Asia Inc, vs Clerica Holdings Inc. in 2007 where Megaworld was ordered to pay P14,522,955.00, “Again, where was the favor there?” Esguerra asked.
Megaworld, in a statement to the media which listed the cases cited, said, “A cursory examination of the records of the Court’s decisions, which are open to the public, including legal ‘analysts’ and ‘commentators,’ would readily show that Megaworld has never requested nor obtained any favor from anyone in the Court, including the Chief Justice.”
It also said: “For the record, we wish to state that in all our business dealings with Chief Justice Corona, the company has neither solicited nor obtained any favor either from the Chief Justice or from the Court. The records of decided cases involving our company are open to scrutiny since the same form part of public documents. In all these cases, we have followed all judicial processes, availed of all legal remedies and abided by all the final decisions of the Court…. As a company, we shall continue to uphold the highest standard of ethical business practices.”

A TRO is meant to preserve the status quo. The SC has discretion to issue it ex parte and it also can determine if there is already substantial compliance with its conditions. not necessarily bro, fungible items or consumer items like tv/phones/shoes lose their value immediately upon use. buy a cellphone or shoes now, next month when you try to sell it, it is already depreciated.
real estate on the other hand will appreciate or retain their value if property management, location etc are above standard or well maintained, secure.
eastwood is really a dense project and i would agree that they made a killing selling that one but i do not think that property values there will hold longterm as wear and tear will eat into property values easily due to density issues.

lili, i have read it and in fact watched the replay of the hearing. anyone in the real estate industry would be laughing his ass off with what he was saying because his statements do not add up. of course megaworld will deny it because under the graft and corrup practices act, the bribe giver will also be liable as the bribe taker.

1. the unit suffered water damage because of a typhoon, but since condo's are enclosed, only water seepage is the only possible cause. and senator osmena correctly pointed out that water problem is the least of the problems because it only takes a coat of paint. and water seepage does not cause scattered problems but localized problems where the water will flow. but the question is, how much water damage will there be when the unit is semi-bare.

why would he declare a property with an market value of 14-24m as Php6.8m?

if corona had the delicadeza (which he obviously didn't), he wouldn't even be buying that property in the first place kasi dumaan sa kanya ang kaso nila.

During the last elections, there were really no substantial debate on issues that could have enlightened the public as to where candidates stood on issues. There was no conversation among the public about ideology or principles. If the public did know more about how Aquino would approach the economy during the elections, then maybe some people's minds would have changed, although i doubt this because I don't think Pinoys are all that concerned about where candidates stand on issues during elections. Its all about the personality.

incorrect analogy lili. in congress, it is always a numbers game and hence, the influence of the president is enormous kasi coterminus ang term ng congressmen sa president every 6 years and during the mid term congressional election, malakas ang hatak ng president if he is popular.

Sir, nasa Penthouse yong unit, usually ang design nang ganyan ay panoramic kaya prone to typhoon damage. Masyadong mahal ang mga materyales diyan say salamin dahil makakapal ang kailangan at tempered dahil sa wind velocity. Kapag nasira yan palit halos lahat. Kapag pinasok nang tubig yan at hindi basta seepage yan dahil sa ordinary days nga magalakas ang hangin lagi sa taas bagyo pa, halos apektado ang wiring, ceiling, painting na mas mahal gastusan dahil kasama pa ang pag-kayod at dismantling kung grabe may mg i-dedemolish pa yan.

a semi-bare unit will not suffer that much damage, but a semi-bare unit will not cost as much precisely because it is inhabitable. a unit, just for being complete and habitable, will cost more of course. add the fact taht furnishings, decors, drives the price of the unit higher even further

but the CAR issued by the BIR will have its own valuation. the taxes will be based on the BIR zonal value or the market value whichever is higher. check arnold clavio article now regarding discrepancy sa binayaran na tax ni corona.
kasi dapat the taxes should be paid on the market value because it is the higher amount, bakit pinalusot sa BIR nung 2009 na naging based on zonal na according to the article.

MANILA, Philippines - The House prosecution panel on Thursday denied saying that Chief Justice Renato Corona has 45 real estate properties.
During questioning, Senator-judge Francis Escudero said he has counted so far 18 properties, excluding the 6 parking lots the prosecution said were not properly disclosed in the statement of assets, liabilities, and net worth.
“You announced to the media, there are 45 properties,” he asked lead House prosecutor Iloilo Rep. Niel Tupas Jr.
"We just want to put on record that the 45 did not come from the prosecution. It was a letter..." Tupas replied before being cut off due to loud groans from spectators inside the Senate.
Tupas said the 45 properties were listed by the Land Registration Authority, which was attached in their complaint. He said the prosecution will be presenting titles to 24 properties instead of 45 since the other real estate titles were canceled or sold.

There was no conversation among the public about ideology or principles. “It is clear under Canon 5.04 of the Canons of Judicial Ethics, judges are prohibited from receiving gifts in any form,” Tañada said.
Noli Hernandez, Megaworld Corp. senior vice president for marketing and sales, testified at the Senate impeachment trial on Tuesday that Corona had received a P5-million discount from the original P24-million cost of the unit to P19.6 million because of the effects of the global financial crisis and the “water damage” caused by a typhoon on the “semi-bare” unit.
From P19.6 million, Hernandez said Megaworld offered an additional P5-million discount, P3 million of which was given “because the client was paying almost in cash,” Hernandez said.
‘Special’ discount only 1M
He said the only “special” discount given to the Chief Justice amounted to P1 million.
But Tañada insisted that even ordinary judges from the Metropolitan Trial Court and the Regional Trial Court were disciplined for receiving P50,000.
“And what makes the discount received by Chief Justice Corona different?” Tañada asked.
‘Badges of fraud’
“Our witnesses from Megaworld have testified that they really gave a special discount (to Corona). But like we said, that now goes into the moral fitness of the Chief Justice. It is now up to the impeachment court how it is going to appreciate (the evidence),” Quimbo said.
He maintained that the prosecution was also able to establish the “badges of fraud” surrounding Corona’s statement of assets, liabilities and net worth (SALN) from 2002 to 2010 as opposed to his lawful income.
Based on the evidence presented so far, Corona and his wife Cristina bought the Bellagio property for P14.5 million in 2009; a unit at Bonifacio Ridge, also in Taguig City, for P9.1 million in 2004; and a unit at The Columns in Makati City for P3.6 million in 2003.
However, the prosecution noted that Corona undervalued the three properties by P16.9 million in his SALN and only declared these in his 2010 filing.
In his 2010 SALN, Corona declared that the Bellagio property cost P6.8 million; Bonifacio Ridge, P2.3 million; and The Columns, P1.2 million.
‘Almost in cash’
Aurora Representative Juan Edgardo Angara said the next question would be where Corona got all the money to pay for the Bellagio property “almost in cash.”

The question of what are impeachable offenses surfaced on day 11 of the Corona impeachment trial, as prosecutors continued to present proof on Article 2 or the chief justice's alleged failure to disclose his true wealth in his statements of assets, liabilities and net worth (SALNs).
A debate on whether Corona can be impeached for filing questionable SALNs ensued after Senator-judge Ralph Recto asked one of the registrars of deeds the meaning of the different items in the SALN.
He asked if the fair market value, zonal valuation and deeds of sale should all be disclosed in the SALN. The fair market value is the price by which 2 parties decide on, while zonal value is fixed by the Bureau of Internal Revenue for purposes of taxation. The price in the deed of sale, meanwhile, follows closely the zonal valuation.
All parties agreed that all these should be included in the SALN.
Recto also noted there is room for corrective measures. A person who has omitted unintentionally some details may correct his or her SALN. If found it was unintentional on his part, he is not liable under the laws.
Prosecutor Elpidio Barzaga said omission, or leaving some items blank in the SALN, falls under the crime of perjury.
"According to the Supreme Court, if there has been omission or not a faithful or true declaration of the properties, the filer will be liable for perjury because statements as far as the SALN is concerned is made under oath," he said.
Is perjury a high crime?
Enrile then posed the question: “If it is a crime, is it a high crime?”
"No, your honor. It is not a high crime," Barzaga replied.
Enrile then said: "All right, you read the Constitution. Culpable violation of the Constitution, treason, bribery, graft and corruption, and other high crimes could be the basis for impeachment. So that's the law."
Associate Justice Serafin Cuevas, head of Corona's defense team, said the Chief Justice is not liable for any discrepancies in his SALNs.
"If there may have been discrepancies, inaccuracies, or incompleteness, these can me remedied after a review of the SALN has been made. If it is not intentional, no criminal liability or any administrative liability is incurred by the filing official," he said.
Other senator-judges also stood up and reminded the prosecutors about what is provided in the Constitution.
Joker: Evidence must amount to impeachable offense
"Not every offense, omission is an impeachable offense," said Senator Joker Arroyo. "So the responsibility of the prosecution is to present evidence that would amount to an impeachable offense, and the defense must defuse it."
Arroyo noted that United States President Bill Clinton was impeached, but senators acquitted him because they did not believe that the accusations lodged against him were impeachable offenses.
"We might be wasting our time discussing crimes that are not impeachable," Senator-Judge Francis Escudero said.
Arroyo added, “What we’re overlooking here, we should check if offenses have reached level of impeachable offenses.”
Escudero agreed, saying: “Assuming he’s seen on television jaywalking, is it already an impeachable offense? Pag nakita syang nagbigay ng lagay para mapabilis ang kaso, is it already an impeachable offense.”
He noted that in the United States, there is a “range” for a particular offense.
Prosecution: Corona betrayed public trust
Prosecution panel chief Rep. Niel Tupas explained that their complaint says Corona's failure to truthfully disclose his SALN is a betrayal of public trust
He cited an opinion of Fr. Joaquin Bernas, one of the authors of the 1987 Constitution.
Bernas has explained some issues regarding what the Constitution says about impeachable offenses.
"The offenses for which an officer may be convicted on impeachment are 'culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of public trust,'" he said in his blog.
"The word 'other' modifying 'high crimes' indicates that every offense in the list must be a 'high crime.' This meaning is dictated by the principle of legal construction that the word 'other' makes the meaning of all those enumerated of the same level of gravity. In legal gobbledygook this is the eiusdem generis rule," he added.
Enrile has ordered the 2 parties to submit a legal memorandum on the issue.
After the trial, prosecution panel spokesman Rep. Sonny Angara said the framers of the 1987 Constitution added betrayal of public trust as an impeachable offense due to the high crimes committed by the Marcoses.
"Pinakamahalaga po diyan, iyung pagtaksil at pagkalulo sa tiwala ng publiko o betrayal of public trust, kasi nga malawak po iyan kaya nga yan ang intension ng ating may akda ng ating Saligang Batas na talagang panagutin po ang mga makasalanang opisyal," he said.
Tamano explains betrayal of public trust
ANC's resident legal analyst, lawyer Adel Tamano, explained that betrayal of public trust is also a ground for impeachment introduced in the 1987 Constitution.
"What are the grounds for impeachment? Under Article XI, Section 2 of the Constitution, there are 6: 1 - culpable violation of the Constitution; 2 - treason; 3 - bribery; 4 - graft and corruption, 5 - other high crimes, 6 - betrayal of public trust."
"You might ask what is high crimes. The easiest way to understand it is that these are crimes of such gravity. For example, murder, it is so serious that is is so obvious that an impeachable official should be removed from public office. The impeachable act is so grave that it constitutes a high crime," Tamano explained.
"Fr. Joaquin Bernas, when he talks about betrayal of public trust in his book, he says betrayal of public trust is a catch-all provision, and even acts that are not necessarily criminal can be a betrayal of public trust," he said.
"But if you take a look at the Constitutional records, it is very clear that not every act is a betrayal of public trust," he added.
Tamano said any impeachable act has to be of such magnitude that it impacts on the moral fitness of the official, leaving no other recourse but to remove the official by impeachment.
Recto asks: Was there intent to deceive?
In an interview with ANC after day 11 of the trial, Senator-judge Ralph Recto said they will look into the "timeliness" of Corona's declaration of 5 properties.
"Should we fault him for declaring them in 2010 kung nakaligtaan in the previous years? I don't know, but we will look into that later on."
Recto said that while Corona declared 5 properties in his SALNs, some declarations were "late in many instances."
He added that the Senate impeachment court also needs to review the valuations of the declared properties.
"Dapat ilalagay mo iyung value. Iyung assessed, iyung market value, and the third will be the transaction value," he said. "Iyun ang maliwanag sa batas, tatlo eh. Kung 2 out of 3, ano ang ibig sabihin niyan?"
"Kung 1 out of 3, kung transaction cost lang ang inilagay niya, may misdeclaration din ba iyon dahil di niya na-fill up iyung acquisition?" he added. "The current fair market value, that's another issue."
Recto said he will grill Corona's lawyers when they present their own evidence in the impeachment court.
"I will confront them as well with many parts of the law," he said.
"Katulad niyan iyung accounting. Iyan ba may deceit on the part of the Chief Justice?" he asked.
"Halimbawa na hindi pa nata-transfer sa iyo iyung ownership of the property pero iyung accounting practice, dapat, may nilagay ka na roon na advance payments o di kaya may liabilities ka pa for installments," he added.
"Was there a willful intent on the part of the Chief Justice to reduce his net worth and not to disclose his properties? I think that these are valid issues that we should ask the defense also later on," Recto said.

A “not guilty” verdict of the Senate impeachment court on Supreme Court Chief Justice Renato Corona could make President Benigno Aquino 3rd a lame duck leader because he had personally exerted efforts to remove the top magistrate from office.
But former Sen. Francisco Tatad said that he believed that it was not too late for President Aquino to prevent this from happening and he should start by distancing himself from the impeachment proceedings at the Senate impeachment court.
“Certain errors were made, certain statements were issued that are not needed . . . but there is still time for him to distance himself,” Tadtad added during an interview aired on ANC on Friday morning.
He said that there was a need for the President to improve his public posture and act more like a statesman rather than giving all his attention to the conviction of Corona.
Tatad added that there were problems that needed Mr. Aquino’s attention and that they should be his priority and that he should leave the impeachment process to itself.
The President even before the House of Representatives impeached the Chief Justice had been attacking Corona, calling him a “disciple” of then-President Gloria Arroyo in his public speeches.
He cited Corona’s vote in declaring as unconstitutional an executive order establishing the so-called Truth Commission and in issuing a temporary restraining order against a travel ban on Mrs. Arroyo.
The President also hailed the congressmen who supported the impeachment of Corona.
Tatad said that Mr. Aquino’s confidence in Congress could be wrong based on the performance of members House prosecution panel who are having a hard time proving their supposed case against Corona.
“I do not believe that he [President] has people around him who tell him these, most of them only listen and agree and they are so afraid to disagree with him,” he explained.
Tatad noted that what Mr. Aquino needs are people who can disagree with him when needed, not those who agree with everything that he says and do.
He said that it was not the impeachment trial that had “shaken” the judiciary but the President’s open intervention in the Corona case.

MANILA, Philippines – Whether a slip of a tongue or not, the prosecution panel admitted that Chief Justice Renato Corona has filed his statement of assets, liabilities and networth (SALN).
This after prosecution lawyer Arthur Lim admitted that they have the copies of the SALN of Corona.
Lim made the admission as Bureau of Internal Revenue (BIR) commissioner Kim Henares told the impeachment court during the resumption of the hearing today that the bureau is conducting a probe on the discrepancies of the income tax returns of Corona.
Henares said that the BIR has sent letter of authority to Corona to inform him that he was under investigation.
The BIR chief, however, noted that they started the probe late January, days after the start of the impeachment trial against the Chief Magistrate.
"I'm investigating after a review of SALN, ITRs of CJ Corona, and his family," he said.
But Presiding Judge-Senator Juan Ponce Enrile retorted: "But it is only now that you are conducting probe."
Henares was allowed by the court to continue her testimony after the prosecution insisted on having another round of direct examination with her.
Even as Enrile told the prosecution that it is already finished with the direct examination, he still allowed the BIR chief to continue her testimony.

Wala ren naman mag lakas loob na mag file ng complaint sa kanya dahil sa maraming dahilan. Una, sikat pa sya ayon di umano sa mga bayarang survey firms. Pangalawa, takot ang taong mag file ng complaint dahil alam nila kung gaano ka vengatibo si pnoy, bastat kaaway lagot ka. Pangatlo, ang mga kongresista ay natatakot magfile ng complaint kasi hawak ni pnoy ang pork barrel nila, pag nagcomplaint ang isa sa kanila pihado tanggal sila sa listahan tulad nung isang congressman na liberal na ayaw pumirma sa impeachment rap.
Pero lahat ng bagay may hangganan, pag napuno na ang mga tao, pag nagising na sila sa katotohanan, pag kumalam na ang kanilang sikmura,kikilos din ang mga yan upang mag file ng complaint dahil ayaw nilang pagbalingan ng galit ng taong bayan.
