Their clean bill came from the Court of Appeals, which last November also affirmed the June 17, 2008 decision of the Alaminos Regional Trial Court to dismiss the case because it was filed in the wrong venue. The Pangasinan court acted on the complaint against Audi AG, filed on June 1, 2005 by Proton and its affiliate Auto Prominence Inc., which also asked for payment of damages. On June 1, 2005, APC and Proton also initiated estafa case against Audi officials—all based in Germany—with the City Prosecutor of Alaminos City. The estafa case was dismissed by the Department of Justice and the appellate court, leaving the civil aspect of the suit unresolved. The complaint filed against PGA Cars Inc. represented by its president Miguel G. Coyiuto and its chairman, Robert G. Coyiuto was also dropped. The case arose After Audi terminated on September 27, 2004 its direct dealership agreement with Proton and Auto Prominence because it was dissatisfied with the way the latter represented the Audi brand in the Philippines. Citing provisions of the original contracts between Proton and Audi, the appellate court stressed that the parties intended Germany to be the exclusive venue and place of jurisdiction for all actions pertaining to the contracts. Manaoag Church is one of the Philippines' most widely visited Roman Catholic Pilgrimage sites. Though Pangasinan Gulf beaches; Lingayen, Tundaligan and San Fabian aren't as popular as Boracay or Puerto Galera, the long stretch of grey sand attracts pilgrims filling up picnic grounds as well as nipa cottages equipped with videoke machines. The tasty Dagupan Bangus must be credited to this phenomenon I presume. From Manaoag, we drove about three (3) hours to Bolinao for late lunch. This, I suggest is the best place to watch sunset, aside from the peach-white sand Patar Beach has to offer for sun worshippers. This, despite negative publicity last year generated after the Task Force Kalikasan of the provincial government reported about new fishpond structures and blamed the city government for their establishment. The provincial officials later backtracked and said the structures were almost 30 years old, built when the park was still managed by the Philippine Tourism Authority and are no longer operational. “We are happy that people did not believe the negative reports and saw for themselves that the islands are clean and well-taken cared of,” Mayor Hernani Braganza said. City tourism records showed that the most number of foreign tourists are Koreans, 4004; followed by Americans, 1,663; Canadian, 402; Australians, 396; Japanese, 344; and German, 316. Even Africans came to enjoy the sights in the islands, such as those from Kenya and Congo which had one visitor from each, although 21 simply listed themselves as Africans. There were actually 162,653 who toured the islands in 2010; 9,995 of them foreigners while 152,658 were Filipinos. Hundred Islands park manager Rey Livara said the figure did not include those visiting Bolo Beach, fast becoming a favorite of picnickers, and the mangrove parks which bird watchers frequent. A report of the Pangasinan provincial tourism office likewise showed that Alaminos is the province’s tourism capital. The number represented more than 75% of the total number of tourists that visited major tourist destination in the province. Braganza said the increasing number of tourists to the Hundred Islands “is a victory for the city.” It was Braganza who worked for the transfer of the park’s supervision and management from the Philippine Tourism Authority to the city government in 2005. “This is another remarkable feat for all Alaminians who defended the city’s pride from the malicious reports and politically-motivated efforts to destroy the image of the Hundred Islands,” he stressed. The provincial tourism report belied accusations that the Hundred Islands had became “stinky” and an “ugly sight”, due to alleged fishpond operations in the area, he said. In November last year, the provincial government, through its Task Force Kalikasan, reported that there were new fishpond structures in the islands, and blamed the city government for allowing the illegal operations in the national park. The Hundred Islands, the country’s first national park (proclaimed as one in 1940) is under the direct supervision, management and control of the city government after 65 years under administration of the PTA. City Agriculturist Emma Molina said the city government is now just waiting for the dredging machine, owned by the provincial government which organized Task Force Kalikasan, to be moved to Dagupan. The city government of Dagupan will shoulder the cost of the machine’s oil, maintenance and food for the members of the Task Force that will carry out the dredging work. Molina, speaking over the radio program Pantontongan Tayo, said the rivers are now ready for dredging following the dismantling of fishing structures in the areas of Salapingao, Pugaro, Carael and Lucao Meanwhile, the city’s own dredging machine, which is currently undergoing repair, will also be used in some areas, including Dawel, Tanap and Bonuan Gueset. She added that the so-called “skylab” structures that are still visible will be before the dredging operations begin. Meanwhile, several fish pen operators have decried the demolition of their fish pens which is being implemented together with a one-year moratorium on fish pens imposed by the city government. After the dredging, Molina said the fish industry can begin to engage in raising high value products like malaga and talakitok in addition to bangus, the city’s trademark product. BACK TO FISH PONDS Meanwhile, Molina also called on fish farmers to return to fishpond operations to give the city’s rivers time to “breathe”. Most fishponds have been converted into “transition ponds” where bangus fingerlings are cultivated to a certain size and then transferred to the fish pens. Many fishpond owners have since shifted to fish pen operations along the rivers because it is deemed cheaper. About P1 million is needed to develop a hectare of fishpond, while only about a small fish pen requires much smaller capital. But suddenly last week, the minority group in the Sangguniang Panlungsod (SP), raised the question of why the budget hearings are being done before the council as a whole. Councilor Redford Erfe Mejia, the lone member of the minority group led by Councilor Brian Lim, in a privilege speech last January 31, asked why the budget hearing is being conducted by the committee en banc presided by Vice Mayor Belen Fernandez and not by the committee on finance. Councilor Maybelyn Fernandez, who referred the budget hearing to the committee en banc, replied that Mejia’s question is no longer valid at this point because that issue should have been raised at the time that the referral was made. “I believe Councilor Erfe Mejia was present when I referred the budget proposal to the committee en banc and no member of this body manifested his or her objection at that time. In fact all of us already participated during the budget hearing,” Fernandez said. She added that the minority in the council are now under estoppel, a legal rule that prevents someone from stating a position inconsistent with a previous one, especially when the earlier statement has already been put into effect. “The fact that all of us actively participated during the previous hearing — nag-question naman sila, may mga tanong sila, and I don’t think there was even an instance when they raised their hands and not recognized by the presiding officer,” Fernandez said. Fernandez pointed out that parliamentary procedures dictate that the SP cannot go back to an issue that had long been discussed and settled. “We can’t go back on what we have already settled,” she said. Councilor Jesus Canto echoed Fernandez’ position saying the minority’s question is now “already moot and academic”. He felt that the members of the minority insinuated that they did not stand up to object when the hearings were referred to the en banc because they didn’t have the numbers to do otherwise anyway. Fernandez said the minority should still have objected then and their position would have been reflected in the minutes of the council session. "By keeping silent, they joined the consensus," the vice mayor said. "Does the minority want to delay the process further by changing the process midway?" she asked. RESOLUTION Meanwhile, Lim, the minority leader, proposed that a joint resolution by the members of the majority and minority be passed assuring the passage of the 2011 budget before the March 31 deadline. The move was rejected by the majority of the council. "We will pass the budget with or without the resolution," said Fernandez, stressing that such a resolution is unnecessary because they were elected by the people and are accountable to them. "Stop insulting, fault-finding the Sangguniang Panlungsod and give us time to carefully study the budget," said Fernandez. At the same time, the vice mayor concurred with the suggestions of Councilor Jesus Canto during their session Monday for the council members to observe a moratorium on giving comments regarding the pending passage of the 2011 proposed city budget to prevent flaring the already fiery situation. Mayor Benjamin Lim has been lambasting the SP for allegedly delaying the passage of the proposed budget due to political reasons. Lim’s party is represented by a four-man minority team in the SP. Some department heads from the executive branch have reportedly sent letters to the SP, pressuring them to pass the budget. Lim’s State of the City Address (SOCA) has been moved to February 14 as the mayor intends to attend the State of the Province Address (SOPA) of Governor Amado Espino Jr. on February 7. The venue has also been moved from the Museo De Dagupan to the People’s Astrodome. In a letter to the Sangguniang Panlungsod, Lim asked the council to allow the use of this venue as it can accommodate both the officials and the public who would like to hear the SOCA. Under the Local Government Code, the mayor is supposed to deliver the address before the SP during a regular council session. (RLC) is accelerating expansion across all its business segments with capital expenditures seen to rise by almost 40 percent this year to P9 billion in a move aimed at further boosting its presence and securing profitable long-term growth. RLC president and chief operating officer Frederick Go said the company is building four malls and two office buildings this year to take advantage of a growing economy and steady inflows from Filipinos living and working abroad. Among the new malls scheduled for construction this year are in Pangasinan, Palawan, New Manila and Cebu, he said. “We are very optimistic about the real estate industry. There is general confidence in the economy and the growing business process outsourcing sector and OFW remittances are supporting consumer spending,” Go said. Go said the programmed capital budget, which is significantly higher than the P6.5 billion spent last year, excludes special land acquisitions that the company intends to pursue to capitalize on strong demand for residential properties. The company is looking to acquire two parcels of land in Metro Manila to be developed for office space. For hotels, RLC plans to put up a total of 30 Gohotels in and outside Metro Manila over a five year period. Programmed for opening this year are in Bacolod and Dumaguete. The next sites will rise Palawan, Iloilo, Cebu, and Tacloban for 2012 and Pangasinan, Ilocos Norte, Zamboanga, Batanes, and Gensan in 2013. RLC is looking to expand overseas to further augment revenues. A planned stock rights offering of 1.3 billion shares, with a current market value of about P18.07 billion, is being planned within the first half this year to fund land acquisition, project construction and development, possible expansion in China and other general corporate purposes. The rights offering shares will come from a planned capital hike from P3 billion to P8.2 billion of which 25 percent or P1.3 billion (at par value of one peso per share) will be subscribed and at least P325 million will be paid by way of the stock rights offering.RLC earlier said the increase in capital would give it “flexibility to access the equity capital markets in the future since the subscribed capital has almost reached the authorized capital stock.” The company has offered to develop the 103-hectare Food Terminal Inc. Considered on one of the special projects of the Espino administration, the zone will have its groundbreaking ceremony on April 5 Barangay Estanza in Lingayen as part of the celebration of the 430th “Agew na Pangasinan.” Former President Fidel V. Ramos, a full-blooded Pangasinense, will be the guest of honor and speaker of the event, as a tribute to his vision that led to the segregation of parcels of land in Barangays Sabangan, Estanza, Malimpuec and Capandanan in Lingayen for eco-tourism and other sustainable projects of the province. It was President Ramos who signed Proclamation No. 1258 in June 22, 1998, which empowered the provincial government to pursue the development of the 300-hectare eco-tourism zone in that area. Gov. Amado Espino, Jr. will lay the time capsule that bears the documents describing the plans and the vision, inside a specially marked area on the site. The eco-tourism zone will be a self-contained community that will include an 18-hole golf course, beach front residences, high-end and mid-range subdivisions, commercial area, amusement park, resorts and hotels, restaurant and retail shops, water sports area and a yacht club. Local and foreign investors already visited the area and have expressed interest to invest in the eco-tourism zone. Representatives from the business sector, tourism officers, regional officers of government agencies, and other stakeholders will witness the groundbreaking ceremony. Luyag na CaboloanAn ancient kingdom called Luyag na Kaboloan, with Binalatongan as its capital, existed in the fertile Agno River valley. Urduja, a legendary woman warrior, is believed to have ruled in Pangasinan around the 14th century. The Luyag na Kaboloan expanded the territory and influence of Pangasinan to what are now the neighboring provinces of Zambales, La Union, Tarlac, and Benguet. Pangasinan enjoyed full independence until the Spanish conquest. Religion before CatholicismThe ancient Pangasinan people, like other Austronesian peoples, believed in mana, an Austronesian concept which can be describe as the essence of every being and everything that exists. To the Pangasinan people, mana can be inherited or acquired, like from an ancestor or something in nature. They practiced Shamanist or animist beliefs and rituals, and worshipped a pantheon of anitos ("deities"). Their temples or altars were dedicated to a chief anito called Ama Kaoley (“Supreme Father”) who communicated through mediums called manag-anito. These mediums wore special costumes when serving an anito and they made offerings of oils, ointments, essences, and perfumes in exquisite vessels; after the offerings were made, the anito is supposed to reply in a secret room to their questions. Spanish colonizationOn April 27, 1565, the Spanish conquistador Miguel López de Legazpi arrived in the Philippine islands with about 500 soldiers to establish a Spanish settlement and begin the conquest of the archipelago. On May 24, 1570, the Spanish forces defeated Rajah Sulayman and other rulers of Manila and later declared Manila as the new capital of the Spanish East Indies. After securing Manila, the Spanish forces continued to conquer the rest of the island of Luzon, including Pangasinan. Provincia de PangasinanIn 1571, the Spanish conquest of Pangasinan began with an expedition by the Spanish conquistador Martín de Goiti, who came from the Spanish settlement in Manila through Pampanga. About a year later, another Spanish conquistador, Juan de Salcedo, sailed to Lingayen Gulf and landed at the mouth of the Agno River. Limahong, a Chinese pirate, fled to Pangasinan after his fleet was driven away from Manila in 1574. Limahong failed to establish a colony in Pangasinan, as an army lead by Juan de Salcedo chased him out of Pangasinan after a seven-month siege. By 1580, Pangasinan was made into an "Alacadia Mayor" by the Spanish Governor of the Philippines. Roman Catholic Augustinian, Franciscan, and Dominican missionaries arrived with the conquistadors and most of the inhabitants of Pangasinan converted to Roman Catholicism. In 1611, Pangasinan became a Spanish colonial province, comprising the territories of Zambales and some areas of La Union and Tarlac. Lingayen was made the capital of the province (and still is to this day). Continued resistance to Spanish rule was forced to go underground or flee to the mountains. Rebellion against the Spanish rule[edit] Malong liberationAndres Malong, a native chief of the town of Binalatongan (now named San Carlos City), liberated the province from Spanish rule in December 1660. The people of Pangasinan proclaimed Andres Malong Ari na Pangasinan ("King of Pangasinan"). Pangasinan armies attempted to liberate the neighboring provinces of Pampanga and Ilocos, but were repelled by a Spanish-led coalition of loyalist tribal warriors and mercenaries. In February 1661, the newly independent Kingdom of Pangasinan fell to the Spanish. Palaris liberationOn November 3, 1762, the people of Pangasinan proclaimed independence from Spain after a rebellion led by Juan de la Cruz Palaris overthrew Spanish rule in Pangasinan. The Pangasinan revolt was sparked by news of the fall of Manila to the British on October 6, 1762. However, after the Treaty of Paris on March 1, 1763 that closed the Seven Years' War between Britain, France and Spain, the Spanish colonial forces made a counter-attack. On January 16, 1765, Juan de la Cruz Palaris was captured and Pangasinan independence was again lost. Philippine revolution against SpainMain article: Philippine Revolution Against Spain The Katipunan, a nationalist secret society, was founded on July 7, 1892 with the aim of uniting the peoples of the Philippines and fighting for independence and religious freedom. The Philippine Revolution began on August 26, 1896 and was led by Andres Bonifacio, the leader of the Katipunan. On November 18, 1897, a Katipunan council was formed in western Pangasinan with Roman Manalang as Presidente Generalisimo and Mauro Ortiz as General. General Emilio Aguinaldo proclaimed Philippine independence on June 12, 1898. Dagupan City, the major commercial center of Pangasinan, was surrounded by Katipunan forces by July 18, 1898. The Battle of Dagupan lasted from July 18 to July 23 of that year with the surrender of 1,500 soldiers of the Spanish forces under Commander Federico J. Ceballos and Governor Joaquin de Orengochea. Andres Urdaneta monument, in front of the City Hall.The Battle of Dagupan, fought fiercely by local Katipuneros under the overall command of General Francisco Makabulos, chief of the Central and Directive Committee of Central and Northern Luzon, and the last remnants of the once mighty Spanish Army under General Francisco Ceballos, led to the liberation of Pangasinan from the Spaniards. The five-day battle was joined by three local heroes: Don Daniel Maramba from Santa Barbara, Don Vicente Prado from San Jacinto and Don Juan Quezada from Dagupan. Their armies massed in Dagupan to lay siege on the Spanish forces, making a last stand at the brick-walled Catholic Church. Maramba led the liberation of the town of Santa Barbara on March 7, 1898 following a signal for simultaneous attack from Makabulos. Hearing that Sta. Barbara fell into rebel hands, the Spanish forces in Dagupan attempted to retake the town, but were repulsed by Maramba's forces. Thus, after the setback, the Spaniards decided to concentrate their forces in Lingayen to protect the provincial capital. This enabled Maramba to expand his operations to Malasiqui, Urdaneta and Mapandan, taking them one after the other. He took one more town, Mangaldan, before proceeding to Dagupan to lay siege on the last Spanish garrison. Also on March 7, 1898, the rebels under the command of Prado and Quesada attacked convents in a number of towns in Zambales province, located west of Lingayen, which now constitute the western parts of Pangasinan. Attacked and brought under Filipino control were Alaminos, Agno, Anda, Alos, Bani, Balincaguin, Bolinao, Dasol, Eguia and Potot. The revolt then spread to Labrador, Sual, Salasa and many other towns in the west. The towns of Sual, Labrador, Lingayen, Salasa and Bayambang were occupied first by the forces of Prado and Quesada before they proceeded to attack Dagupan. At an assembly convened to organize a central governing body for Central and Northern Luzon on April 17, 1898, General Makabulos appointed Prado as politico-military governor of Pangasinan, with Quesada as his second in command. His appointment came a few days before the return of General Emilio Aguinaldo in May 1898 from his exile in Hongkong following the signing of the Pact of Biac-na-Bato in December 1897. Aguinaldo's return gave fresh impetus to the renewal of the flame of the revolution. Thus, on June 3, 1898, General Makabulos entered Tarlac and from that day on, the fires of revolution spread. So successful were the Filipinos in their many pitched battles against the Spaniards that on June 30, 1898, Spanish authorities decided to evacuate all their forces to Dagupan where a last stand against the rebels was to be made. Also ordered to go to Dagupan were all civilian and military personnel, including members of the volunteer locales of towns not yet in rebel hands. Those who heeded this order were the volunteer forces of Mangaldan, San Jacinto, Pozorrubio, Manaoag, and Villasis. Among those brought to Dagupan was the image of the Most Holy Rosary of the Virgin of Manaoag, which at that time was already the patron saint of Pangasinan. When the forces of Maramba from the east and Prado from the west converged in Dagupan on July 18, 1898, the siege began. The arrival of General Makabulos strengthened the rebel forces until the Spaniards, holed up inside the Catholic Church, waved the flag of surrender five days later. Armed poorly, the Filipinos were no match at the very start with Spanish soldiers holed inside the Church. They just became mere sitting ducks to Spanish soldiers shooting with their rifles from a distance. But the tempo of battle changed when the attackers, under Don Vicente Prado, devised a crude means of protection to shield them from Spanish fire while advancing. This happened when they rolled trunks of bananas, bundled up in sawali, that enabled them to inch their way to the Church. American colonization The pre-World War II Pangasinan capitol in LingayenPangasinan and other parts of the Spanish East Indies were ceded to the Americans after the Treaty of Paris that closed the Spanish-American War. During the Philippine-American War, General Jose Torres Bugallon from the town of Salasa fought together with General Antonio Luna to defend the First Philippine Republic against American colonization of Northern Luzon. Bugallon was killed in battle on February 5, 1899. The First Philippine Republic was abolished on 1901. In 1907, the Philippine Assembly was established and for the first time, five residents of Pangasinan were elected as its district representatives. After the downfall of Marcos, all local government unit executives in the Philippines were ordered by President Corazon Aquino to vacate their posts. Some local executives were ordered to return to their seats as in the case of Mayor Ludovico Espinosa of Dasol, where he claims he joined the UNIDO, Mrs. Aquino's party during the height of the EDSA Revolution. (RLC) is accelerating expansion across all its business segments with capital expenditures seen to rise by almost 40 percent this year to P9 billion in a move aimed at further boosting its presence and securing profitable long-term growth. RLC president and chief operating officer Frederick Go said the company is building four malls and two office buildings this year to take advantage of a growing economy and steady inflows from Filipinos living and working abroad. Among the new malls scheduled for construction this year are in Pangasinan, Palawan, New Manila and Cebu, he said. “We are very optimistic about the real estate industry. There is general confidence in the economy and the growing business process outsourcing sector and OFW remittances are supporting consumer spending,” Go said. Go said the programmed capital budget, which is significantly higher than the P6.5 billion spent last year, excludes special land acquisitions that the company intends to pursue to capitalize on strong demand for residential properties. The company is looking to acquire two parcels of land in Metro Manila to be developed for office space. For hotels, RLC plans to put up a total of 30 Gohotels in and outside Metro Manila over a five year period. Programmed for opening this year are in Bacolod and Dumaguete. The next sites will rise Palawan, Iloilo, Cebu, and Tacloban for 2012 and Pangasinan, Ilocos Norte, Zamboanga, Batanes, and Gensan in 2013. RLC is looking to expand overseas to further augment revenues. A planned stock rights offering of 1.3 billion shares, with a current market value of about P18.07 billion, is being planned within the first half this year to fund land acquisition, project construction and development, possible expansion in China and other general corporate purposes. The city government is headed by officials of Chinese descent — Dagupan Mayor Benjamin Lim and Vice Mayor Belen Fernandez, whose original surname was also Lim, but her father adopted Fernandez as the family name. The top two officials also own the city’s giant retail businesses. However, Fernandez was not around during the celebration, during which students of the Kian Tiak Institute, a Chinese boarding school in Tarlac, and the Pangasinan Universal Institute, a Chinese school in this city, rendered musical, dance and song numbers. Mayor Lim said it was fitting for the city to celebrate the Chinese New Year as there are more than 6,000 residents of Chinese blood. “There’s so much Chinese in our midst. I won’t be surprised if you have Chinese blood. Even (national hero Jose) Rizal, former President Corazon Aquino, President Aquino, are of Chinese descent,” Lim said. He said the celebration was a appropriate occasion to welcome the Year of the Metal Rabbit, “and with rabbit symbolizing speed, we should work fast for the benefit of the Dagupeños “Let us consider establishing a China Town in the city, considering the number of Chinese businessmen in the city who are the biggest contributor to the economy and who employ many residents,” he said.
