1- can you explain all the fees and taxes?

With fees and taxes there is no VAT on the purchase prices, However there is a 1 % goverment tax on completion.


2- Is this Condo hotel model?

No this is a residential apartment complex with a rental management facility.


3- Do you will build a golf place dedicated to the project?

No there are 2 golf course close by where a 20% discount is offered to residents.

4-The appartments is it furnished?

No, however they have a A fully fitted Kitchen with Cooker, hob, extractor, fridge freezer and stainless steel sink.

5- why the price per sq meter is more expensive than appartments in Sousse?

This is the first true exclusive five star development to be built in Tunisia and the only residential complex to offer the high standard of facilities as stated in our brochure.


6- Please can you outline all the fees (e.g. maintenance fee, etc)?

There will be a service charge for the up keep of the resort that each property owner will pay this is not confirmed yet and will be when the resort is completed. we estimate this figure to be around 40 - 50 Euros per month, as with regards to maintenance this will be down to the owners to maintaine their own apartments. The rental management company will look after the service of the apartment for the rentals that they do for you. This will be included in their fees.

7- can I use the apartment for personal and rent ?

Yes both.


8- is there penalty in case of delay on the delivery?

No there are no penalty clauses. We do however expect to complete the development before the stated completion of Nov 2010.


4- is the rent return is guaranteed return or just for marketing prospective? what is the occupancy time in this area?

No the rental estimates are not guaranteed return. There will be a rental management company on site who will let the apartment for you. you will pay only 10% fess to them of the rental amounts archived. You will also have to pay a income tax of 8.3% on all rental income from this in Tunisia.

The rental market in Tunisia is very strong due to the high domestic demand for rental accommodation in addition to the demand from Europe and Tunisia’s neighbours Algeria and Libya. Furthermore, due to the country’s location, Tunisia benefits from all year sunshine ensuring the rental season is much longer than in Europe. In fact, over the past years temperatures in early spring have been recorded as high as 40 degrees Celsius, however most of the time they are in the region of 25C to 35C.

Having the highest home-ownership rate in Africa and certainly one of the highest in the world, Tunisia is a middle-income country which has outperformed most of its African neighbours both in terms of economic growth and political stability. As a result of their relative wealth, the Tunisian people are able to take frequent holidays in the most popular regions of Tunisia such as Sousse and Hammamet boosting the demand of the rental market.

Tunisia’s larger neighbours, Libya and Algeria do not offer tourist facilities, resorts or hotels anywhere near the scale that Tunisia does, and as a result many Libyan and Algerian nationals tend to take their holidays in Tunisia boosting the demand for rental properties even higher.

Last, but not least, we have the European contingent of holiday makers who arrive in Tunisia in their millions each year looking for a warm, sunny climate to spend their holidays. Being less than 3 hours from the UK and most of Europe, Tunisia offers something new and exciting for everyone and has been an established tourist destination with Europeans over the past 2 to 3 decades. Generally, tourists who visit Tunisia tend to come back year on year, and those on their return trips will prefer to rent accommodation giving them more flexibility than a hotel does. As a result, there is considerable demand for rental properties all year round. In the summer, couples and families with younger children tend to visit the country whereas in the winter we see a lot of retirees and Golfers in particular. Whatever they are looking for, Tunisia offers it all!

Using the rental figures above, we can work out the annual rental yield on the properties. We will make the following assumptions:


Rental Yield

Property is a 1 bedroom apartment priced at €45,000

Property is rented out for 13 weeks per year (quarter of the year)

6 weeks rental in the peak season at €575 per week

4 weeks rental in the medium season at €460 per week

3 weeks rental in the low season at €350 per week

Total annual rental return = €6,340

Gross Yield = €6,340 / €45,000 = 14.08%

Net Yield (gross yield minus 10% rental management charge) = 12.68%

Time taken to pay off the property = 100 / 12.68 = 7.89 years

The above figure shows us that even using a conservative rental window of only 13 weeks per year you are able to pay off for the property in less than 8 years using rental income alone. Below we examine the potential capital growth using the same apartment.

Capital Growth

Current price €45,000

Initial Investment (before completion) of 50% = €22,500

Appreciation during construction of 25% per year

Value of apartment on completion in 2 years = €70,312

Profit of €70,312 -€45,000 = €25,312 is made during construction alone.

Since only €22,500 was invested, the return on capital invested in only 2 years is = 112%

Emerging markets are attracting considerable attention during the current economic downturn as property investors seek out bargains. But getting the right information on which to base an investment decision is critical, as can be seen on the property forums this week. Location, budget, flight data, occupancy rates, rental yields, are just some of the important pieces of information needed according to a thread on the totallyproperty.com (http://www.totallyproperty.com/new-emerging-property-markets/7816-help-anyone-considering-tunisia.html) emerging property markets forum that looks at Tunisia.
While many developers and investors are pouring into other North African countries including Egypt and Morocco, Tunisia offers the same climate but the property market is very new.



Indeed it is perhaps too new as finding the kind of data mentioned above is difficult, as the thread indicates. There are no prices, no decent pictures and no decent websites according to one post on the thread.
The scant information that is available does give an indication that it will become a growing market for those willing to take a risk. The fact that it is a French speaking country is mentioned several times as a negative rather than a plus. However a number of Dubai based developers are investing in the country.
For those who have actually visited Tunisia the outlook is promising. Sidi Bou Said and Port el Kantaui are both mentioned as worth looking at.
But like all emerging markets care needs to be taken. Forum member OPH mentions two projects. Le Voilier which is still pre-release and is not backed by any due diligence or in any position for reservations at the moment. 'The better option is the Dunes Golf and Spa which has full due diligence, predicted rental yields of between 10-14% and prices from just 20,000GBP (approx 26,000€),' he writes.
The latest figures show that British first time buyers are increasingly looking abroad to buy as they can't afford to buy in the UK. In many articles Calabria, on the toe of Southern Italy is often mentioned as an emerging market, a bargain place to buy as prices are low, living costs are low and there is the opportunity to get in before everyone discovers it.
But as many investors or would-be investors know you can't rely on the marketing blurb. Some concerns are raised on the Channel 4 overseas forum (http://community.channel4.com/eve/forums/a/tpc/f/186602047/m/9450014149). These centre on Calabria being a 'backwater', having a very small rental season and 'a winter ghost development'. On the plus side prices are 30% cheaper than popular areas like Spain and there are nearby mountains for ski-ing.
The discussion also shows the importance of visiting property before buying. One development has a road and a train line between it and the sea. Now this might not bother people if trains are infrequent, but noise could be an issue when it comes to renting.
Overall general opinion is that this is an emerging market and as such there is still a lot of investment needed especially in terms of infrastructure and transport. Indeed there is a petition on the Calabriahomes.com forum (http://www.calabriahomes.com/) aimed at persuading the low cost airlines to increase the number of flights to this part of Italy.

Egypt is also often mentioned as an emerging market with good potential. And according to a post on the propertyshowrooms.com forum (http://www.propertyshowrooms.com/forum/Topic512-30-1.aspx) there are still developments that are so new not many people know about them yet.
One mentioned is the Zafarana Beach Resort. There apparently isn't much to see at the moment but one poster says there is a lot of development going on, prices are low and it should be very popular in five years time. The area is described as good for diving so there is rental potential.
Romania is another country where bargains can be found if you look outside the capital Bucharest, according to a post on the propertysecrets.net forum (http://www.propertysecrets.net/forum/state_of_affairs_in_romania_article_by_liamvalencia/10044/33563.html). Prices of €30,000 and €50,000 can be found Cluj, Transylvania, according to poster Liamvalencia. He describes it as 'a beautiful places, full of culture, mountains nearby, lakes etc. And booming industry and universities'.
For those who already have investments the effects of the credit crunch make a popular talking point. A thread (http://www.propertysecrets.net/forum/property_confidence/10041/33523.html) on the same forum shows that in some areas investors have property that is now worth less than they paid for it a few years ago.
For example flats in the suburbs of Madrid which sold for €180,000 in 2005 are now for sale at €120,000. And prices in Bucharest are also going down.

The studios in The Dunes were designed to be modular from the beginning. What this
means is that two studios combined make a spacious 1-bedroom apartment whilst
three of them can make a very spacious 2-bed apartment where the living room is in
the middle and on either side of it are two suites with their own bathrooms and
kitchens. All that is required is a door inter-connecting them which can be fitted quite
easily upon completion.
Since studios offer the highest rental yields out of all of our apartments, this type of
set up is ideal as it offers the maximum flexibility. When the whole family is visiting the
whole apartment is utilised, whilst at other times they can be rented out as separate
self-contained units ensuring that the property’s investment potential is always

The deal is as follows:

1) The client pays for the flights
2) All accommodation and transfers are booked and paid for by ourselves (a maximum of 3 nights)
3) A full viewing of the development and surrounding area is done on a personal basis
4) If you decide to proceed with the purchase of your apartment/apartments then when your initial deposit has been received by the developer then we will reimburse you UP to €600 off the cost of your flights (you must provide receipts for the flights)
5) You will also receive as much free time as needed to make an informed decision.

1- I think the prices of Dunes are expensive too and they are asking for a 60% deposit before delivery...too high

2- I agree

3-the residence is more than 100 meter from the beach ... most of the appartments don't have see view...
remember if you want to buy in Tunisia, I really recommend you go and visit before you decide....in your trip check alot of projects near buy to do fair comparison...

i am an agent involved with The Dunes development. we have had much success with The Dunes. yes the prices are not as cheap as other countries but it is all relative, we are expecting fantasic returns on both appreciation and rentals. The Dunes is a true 5* resort with fantastic facilities and after seeing the site on many occasions with guidance you will have fantastic sea views.
only 50% is needed before completion and this money is not given directly to the developer, it is held in a bank and given to the developer at each stage of the construction. the money is only relaeased once an inspection has been carried out.

The English Patient and Raiders of the Lost Ark were shot here, but it was George Lucas who blazed the way in 1977 when he declared its "beautiful countryside and unique architecture" ideal for his latest movie, Star Wars.

He also noted that North Africa's smallest nation offered a "high level of sophistication."

In property terms, Tunisia has been overshadowed by Egypt and Morocco, but the wind is changing. New laws allowing foreigners to own freehold property have stirred interest in the country, which boasts a strong economy yet much cheaper real estate.

Steve Worboys, the Managing Director of the Experience International Agency, said, "Investors are attracted by the increasing demand for summer holiday accommodation in the most popular resorts, such as Port El Kantaoui on Tunisia's Gold Coast."

Tunisia, which lies due south of Sardinia and enjoys 1,400km of Mediterranean coastline, welcomed 6.8 million tourists in 2007 and the figure is forecast to increase by 4.3 per cent a year over the next 10 years.

The economy is also being bolstered by a strong export market in minerals and food products.

Tourism in Tunisia dates from the 1960s. Today, millions of predominantly German, Italian, French and Spanish holidaymakers visit the major resorts of Hammamet and Monastir. Operators from the UK include ThomsonFly, Thomas Cook and First Choice.

The Tunisian Government wishes to diversify the tourist offer and to attract more high-end visitors. For the property investor, it all adds up to one issue - bed space, or the shortage thereof.

Investment, largely from the Middle East, is set to dramatically improve the situation.

Oil-rich Dubai is funding two massive new tourism projects in the capital: Mediterranean Gate, or Century City, a £23.6 billion project comprising hotels, golf courses and marinas, and Tunis Sports City, a £4.7 billion development that will create several Olympic standard academies.

Both offer thousands of residential properties opportunities for the investor.

Gem Estates is marketing another beachside project, the Dunes Golf & Spa Resort, located next to the Port El Kantaoui marina resort which has two 18-hole golf courses.

Comprising studios, one- two- and three-bedroom apartments, the gated resort fronts white sandy beaches and will have five-star facilities, including Thalasso Spa centre with indoor pool and Turkish baths.

The properties are being sold freehold and are finished to European standards with Italian-style kitchen, air-conditioning, Tunisian marble flooring and satellite TV.

Two outdoor pools, a poolside bar, and underground parking complete the offer.

Owners will be offered a 20 per cent discount at Port El Kantaou's golf course and watersports from diving to fishing and boat excursions are available year-round.

I was in Port Cant . couple years ago and I saw this district -very dusty and trashy .:ohno:No touristic zone !:ohno:Roads is terrible .They could to say about 5 star condo -but this place not for this kind of property . And 30000 euro for room with size like prizon chamber !!!:bash:

actually the area is boom litterally dozen of residential complex,retailers are popping out. But I do agree that this particular project is overpriced ....

Gem Estates is marketing another beachside project, the Dunes Golf & Spa Resort, located next to the Port El Kantaoui marina resort which has two 18-hole golf courses.

Comprising studios, one- two- and three-bedroom apartments, the gated resort fronts white sandy beaches and will have five-star facilities, including Thalasso Spa centre with indoor pool and Turkish baths.

The properties are being sold freehold and are finished to European standards with Italian-style kitchen, air-conditioning, Tunisian marble flooring and satellite TV.

Two outdoor pools, a poolside bar, and underground parking complete the offer.

Owners will be offered a 20 per cent discount at Port El Kantaou's golf course and watersports from diving to fishing and boat excursions are available year-round.

Prices start from £20,000 for a studio apartment and construction is scheduled for completion in 2011.

Your cannot find a nice apartment for 20,000 euros/£

These must be in the area of Chott Miriam miles outside sousse.

Even houses in Menzel Bouguiba go fo 200,000+ dinars

Cannot argue with our attractions and climate but its better to buy in Las Vegas at the moment and probably cheaper also!

Has anyone had dealings with a Tunisian property developer “La Dous”. We have read some negative information on the internet about this company and them delivering apartments smaller than advertised? We are looking at possibly buying in the Dunes resort in El Kantaoui. Can anyone confirm if this is true or not?

Also earlier in this thread it refers to the development being secured against bankruptcy etc due to an escrow account? I have read elsewhere that there is no such thing on the development anymore? Any reason why they stopped offering this protection....I may just buy something thats ready and completed now unless someone can convince me otherwise? Any help would be appreciated!

Yes I believe this is true. The same thing happened to my sister and she is not happy about getting an apartment which is 30% smaller than being sold. I strongly urge you not to proceed or wait until they are completed or simply just buy an apartment elsewhere which is finished now. If this developer lies about the size of the apartment, what else are they not telling you?

The Dunes Golf & Spa – La Dous Immobilier
I have decided to join this forum so that I can inform others regarding the development the “Dunes Golf and Spa” and the developer La Dous. I would like to point out at this stage that I am only doing so to inform you of my findings and not to stop you from making your own decisions. My findings are set out in a further 2 forum posts below called “The Articles” and “The remedies”.

I recently decided to buy in the Dunes Golf and Spa close to El Kantaoui developed by La Dous and I was delighted with my decision since at face value it looked a good investment and I had always wanted to buy in Tunisia. I am sure you would all agree Tunisia is a very special place. Anyway it was only when I got my contract that I started to become concerned and started to do some digging about. I have spent the last few weeks trying to find out the pitfalls in the contract but by doing this I have also found out, through my lawyer in Tunisia, other very concerning facts regarding the development and especially the developer La Dous. I want to inform others of my findings so they can make an informed decision on whether to buy in this development or not.

When I received my contract from La Dous and read through it there were a number of points that concerned me and I have laid them out below individually with my findings. I have gone through the issues below however first I would like to cover the very first issue I came across.

At the beginning of the Promesse Contract (this is the contract between the buyer and the developer – La Dous) it states that the developer La Dous has a running capital of 300,000 Dinars (145,000 Pounds). I was horrified that La Dous only had this small amount of backing so my lawyer did some digging about and these are his findings. La Dous has a huge mortgage on the 1st phase called residence JHINA. In which he has only sold less than half of the apartment. The land that the development is being built on is mortgaged entirely by the banks. My heart sank when my Tunisian lawyer summed it up by saying “this developer could go bust at anytime since he does not have sufficient funds set aside for when anything goes even slightly wrong”.

The Articles
1. In one of the first articles when translated states “Any difference in the surface area which appears following this plan compared to the surface stated above gives neither right to the restitution of balance nor to refunding of surface area”. Therefore la Dous can hand over a studio which states say 23 meters squared on the contract but is actually far smaller and I would have no recourse if this happened. I could simply trust that he would however after reading some other forum articles out there I am not sure I should and lets not forget the fact that the communal area is included in the meters of the apartments so the apartments are already 30% smaller then they are advertised at.

2. In the contract it mentions the bank account that I have to send my funds to. I was assured by the agent that my funds where safeguarded and that it was a sort of Escrow account. I asked my lawyer to obviously make sure that this was the case. He came back to me and told me that the contract even states that it is a normal current account so therefore the funds would be placed into the developer’s current account where he has access! This was obviously very worrying and after digging about further and asking other forum members on this forum and others I have since found that yes the developer used to have an account that was blocked however now this account has been changed to a new one at a bank called the STB Bank and this new account for client funds is a simple current account. My lawyer has also informed me that it is common place in Tunisia that the developer would give me a bank Guarantee however developers are not forced by law to do so. So I am left with the question do I hand over my hard earned cash to a developer that will place the funds in a bank account where he can take the funds without any questions? I spoke to my Tunisian friends and they say that developers in Tunisia disappear with client’s money all the time so this did not sit well with me at all.

3. The contract also mentions that I get a 2% payment if the development goes over the allocated time frame. However my lawyer is also not happy with this article since it is worded in way that I will only get 2% of the money I have advanced I.E. 2% of 50% not 100%!! So what I will end up getting is 1% of the actual price. He mentioned that in Tunisia this is normally much higher. Also it does not state if the development is not finished say in 2 years after the stated completion date that I will get all my advanced funds back. It is left open on purpose so I could be waiting for 5 or 10 years and be getting a 1% return on the value of the property!! That’s not a great investment. I know banks are not giving much on savings just now but I am sure it’s more than that surely.

4. Later on in the contract it states that if you for any reason decide not to continue with the purchase of the property you will have lost all advanced funds. In Tunisia by law the developer can only hold onto 10% of the funds. My lawyer told me that this is the final straw for him and that he has advised me not to sign this contact unless the contract is changed in my favour.

The Remedies
The changes he suggests are:
1. The exact meterage of the apartment stated and the % of the communal areas separate.
2. To have a 2% plus or minus on the meterage of the apartment and if the apartment is smaller than stated then the developer has to pay a penalty.
3. That the funds are placed in an Escrow Account and it to state that the developer has no access to these funds at all. Better still to have a Bank Guarantee!
4. To have the proper compensation under Tunisian law if the property runs over the allocated timeframe. If it goes over say 2 years late then all funds paid to the developer are paid back plus interest.
5. To have the article which states that you lose all the advanced funds changed to a penalty of 10% and the remaining funds given back.

My lawyer says the above is the norm and that any developer that does not want to give this is certainly not worth going into a contract with. He even went as far as saying even if the developer did change the contract with the above changes he would still not want me to sign the contract due to the precarious position the developer is in.

I was very nearly a victim of this company s sharp practice, it turned out my lawyer who recommended this project was in on the scam. Luckily my new lawyer saw them off and I am now awaiting repayment of my legal fees. My advice would be to have nothing to do with them.
