Spanish Colonial Fortifications of the Philippines

1) Fuerza de Capul
Fuerza de Capul was built by the Jesuits in the 18th century and was renovated by the Franciscans in the 19th century. The site is a fortified church, it is in good condition with modifications. The fortress is rectangular in plan with a bastion in every corner. There are two round, and two spade shaped bastions. The fortress is made of stone walls.
2) Daunis watch tower
Dauis watch tower was built by the Augustinian Recollects in 1774 in the town of Dauis, island of Panglao, Bohol. The watchtower guards the strait between Panglao and Tagbilaran. The watch tower is hexagonal in plan and it has three levels. The structure is made of cut coral stones. Above the doorway is the date of construction, and the insignia of the Augustinian Recollects. In some corners there are stone carvings of a human head. The eaves of the tower's roof is decorated with tassel like wood carvings and the roof is supported with cantilevered wood beams.
3) Punta Cruz Fortification
Punta Cruz was built by the Augustinian Recollects in 1796 along the coast of Maribojoc town in Bohol Province. The fortress has a triangular base with a hexagonal second level. The structure is made of cut coral stones. In its entry, there is an inscription of when it was built and the Coat of Arms of Spain.
4) Fuerza de San Andres
Fuerza de San Andres was built by the Augustinian Recollects in the early half of the 17th century. The fortress is situated on top of a hill, overlooking the town and coast of Romblon, Romblon. This is one of the two fortresses in the town of Romblon. The fortress is rectangular with circular watch towers in every corner, and is made of coral stone.
5) Fuerza de Sta. Isabel
Fuerza de Sta. Isabel is a quadrilateral fort with four bastions each of which has a bartisan. Each bastion is attributed to following Saints; San Toribio, San Miguel, San Juan and Sta. Isabel. The stone fortress was built by the Augustinian Recollects in 1738. The fortress is made out of stone walls. A chapel is erected inside the fortress.

Satements of authenticity and/or integrity

1) Fuerza de Capul
The fortress still has the original Spanish era construction and layout. In its immediate periphery new developments were introduced.
2) Dauis watch tower
Dauis watch tower was built by the Augustinian Recollects in 1774 still maintains its original features. Except for the surrounding grounds which was turned into a park, and the roofing were replaced with corrugated GI sheets.
3) Punta Cruz Fortification
Punta Cruz was built in 1796 still maintains its original features. Except for the surrounding grounds which was turned into a park, and the second level room, the roof was replaced with corrugated GI sheets.
4) Fuerza de San Andres
Fort San Andres is almost intact, except some damaged portions of the fortress walls.
5) Fuerza de Sta. Isabel
the fortress still has the original Spanish era construction and layout. In its immediate periphery new developments were introduced.

Comparison with other similar properties

1) Fuerza de Capul
This property has withstood the test of time, and it is in good condition, intact compared to other similar properties. The structure is an example of a fortress church with significance to the protection of both faith and trade.
2) Dauis watch tower
This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of a tower fortress.
3)Punta Cruz Fortification
This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of fortin / garrison type fortress.
4) Fuerza de San Andres
This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of a medium sized fortress built on top of a hill.
5) Fuerza de Sta. Isabel
This property has withstood the test of time, and it is in good condition / intact compared to other similar property. The structure is a manifestation of faith and power. It is an example of a fortress church complex.

16 cityhood laws constitutional, SC seals with finality

TACLOBAN CITY, Leyte, July 4 (PIA) -– The local chief executives of the 16 new cities can now fully concentrate on local governance as the Supreme Court has recently ordered its Clerk of Court to issue an entry of judgment on their cityhood case, sealing with finality their constitutionality.
Declared as constitutional were Republic Act (RA) Numbers 9389 (Baybay City in Leyte), 9391 (Catbalogan City in Samar), and 9394 (Borongan City in Samar), all of Eastern Visayas Region.
Also declared as constitutional were Republic Act Numbers 9390 (Bogo City in Cebu), 9392 (Tandag City in Surigao del Sur), 9393 (Lamitan City in Basilan), 9398 (Tayabas City in Quezon), 9404 (Tabuk City in Kalinga), 9405 (Bayugan City in Agusan del Sur), 9407 (Batac City in Ilocos Norte), 9408 (Mati City in Davao Oriental), 9409 (Guihulngan City in Negros Oriental), 9434 (Cabadbaran City in Agusan del Norte), 9435 (El Salvador City in Misamis Oriental), 9436 (Carcar City in Cebu), and 9491 (Naga City in Cebu).
In an eight-page resolution, penned by Associate Justice Lucas P. Bersamin, the SC said that it cannot entertain the motion for reconsideration (MR) of petitioner League of Cities of the Philippines, et al. of its April 12, 2011, resolution being a second motion for reconsideration (MR) pursuant to Section 2 of Rule 51 of the Rules of Court.
The SC said that a second MR is a prohibited pleading, and only for extraordinarily persuasive reasons and only after an express leave has been first obtained may a second motion for reconsideration be entertained.
“Accordingly, the finality of the resolutions upholding the constitutionality of the 16 Cityhood Laws now absolutely warrants the granting of respondents’ Motion for Entry of Judgment,” the SC ruled.
It maybe recalled that after the February 15 SC Resolution declaring the cityhood laws of the League of 16 as constitutional, the League of Cities of the Philippines (LCP) on March 8, 2011 filed an "Ad Cautelam Motion for Reconsideration".
The LCP motion was however "denied with finality" by the SC in its resolution dated April 12, 2011. In the resolution, the SC reiterated that the 16 Cityhood Laws were not violative of the Constitution and the Local Government Code (LGC).
LCP filed again a "Motion for Leave to File Motion for Reconsideration of the Resolution of April 12, 2011" last April 29.
“We should not ever lose sight of the fact that the 16 cities covered by the Cityhood Laws not only had conversion bills pending during the 11th Congress, but have also complied with the requirements of the LGC prescribed prior to its amendment by R.A. No. 9009. Congress undeniably gave these cities all the considerations that justice and fair play demanded. Hence, this Court should do no less by stamping its imprimatur to the clear and unmistakable legislative intent and by duly recognizing the certain collective wisdom of Congress,” the SC ruled. Meron silang branch noon dito sa Catarman kaya lang nasa second floor ang location hindi napapansin ng prospective costumer kaya nagclose. At saka ayon sa mga coffe drinkers na nakapunta doon yong seneserve nilang coffee or the kind of stuff that they are serving in Catarman branch ay hindi kasing lasa nung sa Calbayog branch kaya ayaw nila itong ipatronize. Alam nyo naman yong ibang taga Catarman ayaw nilang ma shortchange.

Maupay nga kulop! I am new to the forum. I lived in Samar for 2 years, but that was 10 years ago. I will finally be getting back to Samar for a visit.

I plan to Go from Tacloban to Guiuan, then Guiuan to Calbayog. My question is this: How do I get from Guiuan to Calbayog and can it be done in one day?

My guess is take an early ride to borongan, transfer to a bus going to Catbalogan (or Calbayog if they have it).

Anyone with any advice or experience with this?

I will be there Aug 15-18th.

^^Di ko lang sure kung anong class ng Leyte Park Hotel at iba pang hotels sa Tacloban at Ormoc.
Dati may balita na gagawa daw ng 3-star hotel sa Calicoan island, Guiuan, pero mukhang wala pang bagong developments dun.

TACLOBAN CITY – A first case of Philippine Eagle was retrieved alive but wounded in the upper portion of its breast last July 1 in Calbiga, Samar.

“According to the people living in the area, there were three hunters who saw the Philippine Eagle last June 23 that was already wounded, they were Pastor Abanag, Abar Galvez, and Noynoy Mabahin. Pastor Abanag was the one who took care of the eagle”, said Arnulito Viojan, Regional Team Leader REWT 8, Wildlife Traffic Monitoring Unit (WTMU).

“Didto han sumat, may nakuha nga tingga ha lawas. Tapos ginderetso ito nam pagpa-x-ray ha Bethany ngan nakit-an nga mayda gihap usa nga tingga han bala which is embedded in its left wing,” Viojan added.

The Philippine Eagle underwent an operation which took 40 minutes before the bullet was removed since it was located between its two muscles.

Viojan further emphasized that they are still observing the health and condition of the Philippine Eagle and might return it to Brgy. Buluan, Calbiga, Samar. If they pursue returning the Philippine Eagle to the place where it is found, they will conduct an information campaign particularly film showing that will tackle the law regarding Philippine Eagles, its importance and other concerns.

It was also noted that aside from Calbiga, Samar, there were also other areas that have data about Philippine Eagle such as Las Navas; Maslog; Sulat; and Taft, Eastern Samar.

Presently, the Philippine Eagle is at the care of Department of Environment and Natural Resources Regional Office 8. Last Tuesday, they fed it with 250 grams of food and employed proper treatment for it to easily get well.

Sure na yun. What they are still ironing out pa kasi are the incentives such as taxes etc...Reps from Gaisano were at the City Hall last Thursday nakasabay ko sa Cokaliong. They met Mayor Aquino for these perks.

TACLOBAN CITY –State-run Land Bank of the Philippines is expanding its operation in this city with the construction of a two-storey building in Sagkahan district that will centralize different banking units.

Land Bank assistant vice president for Eastern Visayas Alex Lorayes said that construction of the P24-million building is now in progress and it will be completed before the end of the year.

“We will be at par with private banks in terms of facilities. It is expected to bring greater convenience to clients. The site will also have a wider branch lobby and spacious parking to accommodate,” Lorayes said.

The new building will house the Land Bank regional office, Tacloban Branch, Development Assistance Center, Agrarian Operations Center, Accounting Center, Lending Center and the Field Legal Services.

Currently, Land Bank’s different units are located in different areas in this city with the bank’s operation heavily concentrated in a rented facility located at Corner Salazar and Justice Romualdez Streets, the city’s business district.

Lorayes said that despite completion of a new facility,they will still maintain a branch in city’s downtown area to boost its presence.

The new site is located in a 3,500 square meter lot in Real St., Sagkahan District. The building has an approximate floor area of 1,500 square meters.

Lorayes reiterated the need to improve its facility to answer the growing demand for banking. Tacloban is the second biggest branch in the Visayas of Land Bank in terms of volume of transaction and deposit portfolio.

Earlier, the bank reported that total deposits portfolio in the region has reached P10 billion in December 2010. The amount has been maintained until the first quarter of 2011.

Meanwhile, Land Bank will be setting up new branches in Guiuan, Eastern Samar; Allen, Northern Samar; Carigara and Palompon, both in Leyte.

According to Lorayes, the first that will be set up is the branch in Guiuan town after the bank completed its feasibility study in the area and sought for board approval.

”We have already acquired the site in Guiuan. We are looking at operating in the area by the end of 2011 or early next year,” he said.

In Allen, LandBank has been present at the ferry terminal through its automated teller machines (ATM) outlet. Officials here are set to present the result of feasibility to the board this month.

Land Bank’s study is on progress in towns of Carigara and Palompon. The country’s official depository bank seen the need to expand operation in the region with growing number of transactions in its existing branches.

“The study is centered on the volume of business that will be generated both from the government and private sector. We also take a look of local development plan of the local government that would draw investments. Like in Guiuan, if there are more tourists coming to surf, people will need capital to set up new business. We will be there to meet their needs,” Lorayes explained.

^^Di ko lang sure kung anong class ng Leyte Park Hotel at iba pang hotels sa Tacloban at Ormoc.
Dati may balita na gagawa daw ng 3-star hotel sa Calicoan island, Guiuan, pero mukhang wala pang bagong developments dun.

Nag-Leyte Park Hotel kami ng isang kaibigan ko from Manila who wanted to see Tacloban herself. Ang napansin ko lang, parang luma na yung room which we occupied. But siguro nag-upgrade na rin sila ngayon.

its a Catarman based transpo business. it usually caters to night passengers from northern samar to tacloban via a door to door passenger services. Ngayon mukhang gusto nila rivalan yung Grandtours sa daytime. baka terminal to terminal na rin lang ang services nila at mawala na ang door to door services. sayang naman.
Nag-Grand Tours ako nung last week ng June from Calbayog to Catarman. Medyo disappointed lang ako kasi 1st time kong sasakay sa kanila tapos ang daming tao sa loob at parang walang sistema. Marami ako kasabay na kumuha ng ticket kasi yung mga tagaCatarman na na-canceled ang byahe ay dun pala inilagay sa plane to Calbayog. Hay sus, nagkanda-ipit-ipit ako para lang ma-accommodate sa 8AM trip. Tapos di ko alam kung ano pa ang inaasikaso nila, puno na ang van, but we left at 8:30 na. We were half an hour delayed. I should just have waited for the 9AM trip para hindi ako nagka-ipit-ipit :(

Tama ka dyan ang mahal ng lote lalo na dito sa Catarman. May mga hindi magandang attitude yung ibang mga naunang nakapwesto dito sa Catarman. Kung tutuusin marami pang nakatiwangwang na mga properties sa downtown mismo kasi yung iba gusto lang mag ipon ng sobra-sobrang properties para sa kanilang mga anak/apo at ayaw mag benta sa mga investors. At kung mgabebenta naman, sobrang mahal naman. Tulad nung sa Chowking, balibalita dito na gusto nilang bilhin yung underused na property sa corner ng Rizal at Moore Sts (near gasoline station) going to UEP. kahit daw doble or triple pa sa current fair market value, ayaw pa rin ibenta ng may-ari. Sa tingin ko parang my mga anti-development attitude ang ibang tao rito. hindi rin naman kasi sila nag iinvest ng malaking business para mautilize yung property nila.

CALBAYOG CITY -- Just as people here continue to ask who was behind the killing of Mayor Reynaldo Uy two months ago, so they are still wondering how it is that the city treasury effectively owes PhP 56 million (USD 1.3 million) to the national government after failing to remit tax revenues from 2007 to 2010.

But it seems discrepancies in remitting claimed taxes appear to date back even further.

The collection scandal has reportedly been an open secret among many of the 1,000 plus employees of the local government unit here who maintain deductions payable and due to the Bureau of Internal Revenue (BIR), the Government Service Insurance System (GSIS) and the likes of the Pag-Ibig Fund were neither properly collected nor passed on.

A letter sent by BIR District Officer Rolando B. Espina dated July 19 last year and addressed to then Mayor Uy maintained the city government of Calbayog had failed to remit its withholding taxes equivalent to PhP 56.411 million dating back to 2007, under the term of then mayor and now Samar’s first district Rep. Mel Senen Sarmiento.

The formal complaints made in the letter included withholding tax returns, reports not being submitted on time and the information indicated in the returns and necessary attachments being incomplete.

The revenue officer duly concluded that the city government as the holding agent clearly and willfully committed a gross violation of the Tax Code.

Details of discrepancies

According to the final assessment of Revenue Examiner Ryan T. Elvina, for the year 2007, only PhP 10.005 million (USD 283,214) was remitted out of PhP 12.248 million (USD 291,619) calculated and no funds were submitted for the months of September and October 2007 despite amounts of PhP 883,000 (USD 21,024) and PhP 979,000 (USD 23,309) being listed in the Annual Information Return of Income Taxes Withheld on Compensation.

The deductions made from the salaries of public employees in Calbayog were allegedly either not properly collected – else they were not properly and fully filed and sent back to the BIR.

Failure of the city government as the withholding agent to remit withholding taxes of the compensation income is tantamount to non-payment of payee (as cited in Benguet Corp. vs. CIR G.R. No. 141212, June 22, 2006).

Revenue Memorandum Order 8-2003 identified government officials designated as withholding agents as being personally responsible for the correct withholding and timely remittance of tax.

In the case of Calbayog, the local chief executive, city treasurer and accountant are the key officials accountable for such discrepancy, said an insider who declined to go on record while speaking to the Philippine Public Transparency Reporting Project (PPTRP).

In addition to arrears claimed, a 20 percent surcharge was imposed pursuant to the provisions of Section 249 (b)which states that any deficiency in the tax due, as the term is defined in this Code, shall be subject to the interest prescribed in sub section (A) hereof, which interest shall be assessed and collected from the date prescribed for its payment until the full payment thereof.

Elvina concluded that based on their findings, the total amount of PhP 56.411 million representing deficiency withholding tax on compensation, final tax, expanded withholding tax and due to BIR account is still due and demandable.

The city version

City Treasurer Federico Resente admits the amounts payables incurred by the city but maintains the problem with remittances dates back to before the time he assumed office in 2007.

When the land area of Calbayog (90,300 hectares) was reduced, the Internal Revenue Allotment (IRA) was also affected, says Resente. To cope with the potential decrease in IRA, they established a buffer fund or reserve fund to provide its fiscal stability in times of economic upheaval.

With respect to BIR assessment amounting to PhP 56.411 million, the city has created a task force to validate the figures given which appear based on the New Government Accounting System (NGAS) yet are not supportive of documents, he contends.

City Accountant Rodel Lim on the other hand said that the PhP 56.411 million tax deficiency is still subject for discussion. The change of leadership in the local level has affected the priorities of the government, he told PPTRP. But he added that employees’ withholding taxes are now remitted on time including the GSIS and Pag-Ibig Fund.

Remedies

Mayor Ronaldo Aquino, who just assumed the post on May 4 this year after the killing of then incumbent Reynaldo Uy, immediately created the Task Force to validate the tax assessment made by the BIR District 87.

In his letter sent to BIR Regional Director Albert B. Alocilja, Aquino appealed for more time to review and study the content of the letter sent by Revenue District 87 Officer Rolando Espina. While waiting for the report of the task force, the city offered to pay the monthly arrears in the amount of PhP 2 million (USD 47,619). This began the same month.

The new mayor asked that the surcharges, interests and other charges be suspended for fear of seriously depleting the funds and resources of the city and thereby affecting the delivery of basic social services to the people.

In his reasoning, he also cited the possibility of significant reduction in the IRA share of Calbayog due to the recent Supreme Court ruling converting a number of municipalities into cities.

The city’s IRA was PhP 827.7 million (USD 19.7 million) for 2010.

Effect

While the city government is on the process of validating the assessment made by the BIR, and waiting for the answer to its request of condonation of charges and interests, many are wondering where this money went.

In contrast to the treasurer and accountant’s defense that the amount was incurred because some contractors failed to settle their tax obligations, the BIR report clearly suggests that the LGU under the leadership of Uy’s predecessor failed to remit employees’ withholding taxes despite the reasonable time given for the city to settle.

Section 4 (b) of Republic Act 6713 states that, “public officials and employees shall perform and discharge their duties with the highest degree of excellence, professionalism, intelligence and skill. They shall enter public service with utmost devotion and dedication to duty. They shall endeavor to discourage wrong perceptions of their roles as dispensers or peddlers of undue patronage.”

That the issue of such a large tax hole in Calbayog City that dates back years , itself took such a long time to come out only underlines the problem ordinary citizens here have long faced in gaining their rightful access to information about the operation and control of public spending.
