The site is a fortified church, it is in good condition with modifications. The fortress is rectangular in plan with a bastion in every corner. There are two round, and two spade shaped bastions. The fortress is made of stone walls. 2) Daunis watch tower Dauis watch tower was built by the Augustinian Recollects in 1774 in the town of Dauis, island of Panglao, Bohol. The watchtower guards the strait between Panglao and Tagbilaran. The watch tower is hexagonal in plan and it has three levels. The structure is made of cut coral stones. Above the doorway is the date of construction, and the insignia of the Augustinian Recollects. In some corners there are stone carvings of a human head. The eaves of the tower's roof is decorated with tassel like wood carvings and the roof is supported with cantilevered wood beams. 3) Punta Cruz Fortification Punta Cruz was built by the Augustinian Recollects in 1796 along the coast of Maribojoc town in Bohol Province. The fortress has a triangular base with a hexagonal second level. The structure is made of cut coral stones. In its entry, there is an inscription of when it was built and the Coat of Arms of Spain. 4) Fuerza de San Andres Fuerza de San Andres was built by the Augustinian Recollects in the early half of the 17th century. The fortress is situated on top of a hill, overlooking the town and coast of Romblon, Romblon. This is one of the two fortresses in the town of Romblon. The fortress is rectangular with circular watch towers in every corner, and is made of coral stone. 5) Fuerza de Sta. Isabel Fuerza de Sta. Isabel is a quadrilateral fort with four bastions each of which has a bartisan. Each bastion is attributed to following Saints; San Toribio, San Miguel, San Juan and Sta. Isabel. The stone fortress was built by the Augustinian Recollects in 1738. The fortress is made out of stone walls. A chapel is erected inside the fortress. Satements of authenticity and/or integrity 1) Fuerza de Capul The fortress still has the original Spanish era construction and layout. In its immediate periphery new developments were introduced. 2) Dauis watch tower Dauis watch tower was built by the Augustinian Recollects in 1774 still maintains its original features. Except for the surrounding grounds which was turned into a park, and the roofing were replaced with corrugated GI sheets. 3) Punta Cruz Fortification Punta Cruz was built in 1796 still maintains its original features. The structure is an example of a fortress church with significance to the protection of both faith and trade. 2) Dauis watch tower This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of a tower fortress. 3)Punta Cruz Fortification This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of fortin / garrison type fortress. 4) Fuerza de San Andres This property has withstood the test of time, and it is in good condition / intact compared to other similar property. This is an example of a medium sized fortress built on top of a hill. 5) Fuerza de Sta. Isabel This property has withstood the test of time, and it is in good condition / intact compared to other similar property. The structure is a manifestation of faith and power. Declared as constitutional were Republic Act (RA) Numbers 9389 (Baybay City in Leyte), 9391 (Catbalogan City in Samar), and 9394 (Borongan City in Samar), all of Eastern Visayas Region. Also declared as constitutional were Republic Act Numbers 9390 (Bogo City in Cebu), 9392 (Tandag City in Surigao del Sur), 9393 (Lamitan City in Basilan), 9398 (Tayabas City in Quezon), 9404 (Tabuk City in Kalinga), 9405 (Bayugan City in Agusan del Sur), 9407 (Batac City in Ilocos Norte), 9408 (Mati City in Davao Oriental), 9409 (Guihulngan City in Negros Oriental), 9434 (Cabadbaran City in Agusan del Norte), 9435 (El Salvador City in Misamis Oriental), 9436 (Carcar City in Cebu), and 9491 (Naga City in Cebu). In an eight-page resolution, penned by Associate Justice Lucas P. Bersamin, the SC said that it cannot entertain the motion for reconsideration (MR) of petitioner League of Cities of the Philippines, et al. of its April 12, 2011, resolution being a second motion for reconsideration (MR) pursuant to Section 2 of Rule 51 of the Rules of Court. The SC said that a second MR is a prohibited pleading, and only for extraordinarily persuasive reasons and only after an express leave has been first obtained may a second motion for reconsideration be entertained. “Accordingly, the finality of the resolutions upholding the constitutionality of the 16 Cityhood Laws now absolutely warrants the granting of respondents’ Motion for Entry of Judgment,” the SC ruled. It maybe recalled that after the February 15 SC Resolution declaring the cityhood laws of the League of 16 as constitutional, the League of Cities of the Philippines (LCP) on March 8, 2011 filed an "Ad Cautelam Motion for Reconsideration". The LCP motion was however "denied with finality" by the SC in its resolution dated April 12, 2011. In the resolution, the SC reiterated that the 16 Cityhood Laws were not violative of the Constitution and the Local Government Code (LGC). LCP filed again a "Motion for Leave to File Motion for Reconsideration of the Resolution of April 12, 2011" last April 29. “We should not ever lose sight of the fact that the 16 cities covered by the Cityhood Laws not only had conversion bills pending during the 11th Congress, but have also complied with the requirements of the LGC prescribed prior to its amendment by R.A. No. 9009. Congress undeniably gave these cities all the considerations that justice and fair play demanded. Hence, this Court should do no less by stamping its imprimatur to the clear and unmistakable legislative intent and by duly recognizing the certain collective wisdom of Congress,” the SC ruled. Land Bank assistant vice president for Eastern Visayas Alex Lorayes said that construction of the P24-million building is now in progress and it will be completed before the end of the year. “We will be at par with private banks in terms of facilities. It is expected to bring greater convenience to clients. The site will also have a wider branch lobby and spacious parking to accommodate,” Lorayes said. The new building will house the Land Bank regional office, Tacloban Branch, Development Assistance Center, Agrarian Operations Center, Accounting Center, Lending Center and the Field Legal Services. Currently, Land Bank’s different units are located in different areas in this city with the bank’s operation heavily concentrated in a rented facility located at Corner Salazar and Justice Romualdez Streets, the city’s business district. Lorayes said that despite completion of a new facility,they will still maintain a branch in city’s downtown area to boost its presence. The new site is located in a 3,500 square meter lot in Real St., Sagkahan District. The building has an approximate floor area of 1,500 square meters. Lorayes reiterated the need to improve its facility to answer the growing demand for banking. Tacloban is the second biggest branch in the Visayas of Land Bank in terms of volume of transaction and deposit portfolio. Earlier, the bank reported that total deposits portfolio in the region has reached P10 billion in December 2010. The amount has been maintained until the first quarter of 2011. Meanwhile, Land Bank will be setting up new branches in Guiuan, Eastern Samar; Allen, Northern Samar; Carigara and Palompon, both in Leyte. According to Lorayes, the first that will be set up is the branch in Guiuan town after the bank completed its feasibility study in the area and sought for board approval. ”We have already acquired the site in Guiuan. We are looking at operating in the area by the end of 2011 or early next year,” he said. In Allen, LandBank has been present at the ferry terminal through its automated teller machines (ATM) outlet. Officials here are set to present the result of feasibility to the board this month. Land Bank’s study is on progress in towns of Carigara and Palompon. The country’s official depository bank seen the need to expand operation in the region with growing number of transactions in its existing branches. “The study is centered on the volume of business that will be generated both from the government and private sector. We also take a look of local development plan of the local government that would draw investments. A letter sent by BIR District Officer Rolando B. Espina dated July 19 last year and addressed to then Mayor Uy maintained the city government of Calbayog had failed to remit its withholding taxes equivalent to PhP 56.411 million dating back to 2007, under the term of then mayor and now Samar’s first district Rep. Mel Senen Sarmiento. The formal complaints made in the letter included withholding tax returns, reports not being submitted on time and the information indicated in the returns and necessary attachments being incomplete. The revenue officer duly concluded that the city government as the holding agent clearly and willfully committed a gross violation of the Tax Code. Details of discrepancies According to the final assessment of Revenue Examiner Ryan T. Elvina, for the year 2007, only PhP 10.005 million (USD 283,214) was remitted out of PhP 12.248 million (USD 291,619) calculated and no funds were submitted for the months of September and October 2007 despite amounts of PhP 883,000 (USD 21,024) and PhP 979,000 (USD 23,309) being listed in the Annual Information Return of Income Taxes Withheld on Compensation. The deductions made from the salaries of public employees in Calbayog were allegedly either not properly collected – else they were not properly and fully filed and sent back to the BIR. Failure of the city government as the withholding agent to remit withholding taxes of the compensation income is tantamount to non-payment of payee (as cited in Benguet Corp. vs. CIR G.R. No. 141212, June 22, 2006). Revenue Memorandum Order 8-2003 identified government officials designated as withholding agents as being personally responsible for the correct withholding and timely remittance of tax. In the case of Calbayog, the local chief executive, city treasurer and accountant are the key officials accountable for such discrepancy, said an insider who declined to go on record while speaking to the Philippine Public Transparency Reporting Project (PPTRP).
