Not bad eh ? Selects projects are all around 20 dhs psf in chiller --- some one is earning on top out of theirs though --they must be ?

Yes even 'Select Steve' admits that Select's high service charges suck! 17.1 inc. chiller is not bad by comparison.

Dear Valued Customer,

Re: Notice of Default towards payment of Service Charges for Ocean Heights

We write to advise you that our records indicate that a vast number of Owners have
defaulted in their Service Charge Payments.

Unfortunately, the default has resulted in a cash flow shortage in the management
account of the building. Therefore, the only option available is to defer or cancel certain
services provided to the building.

In the event of the deficit not being remedied in the very near future, services and
facilities as listed below (but not limited to) will be closed and/or scaled down to minimise
costs:

- Cleaning;
- Security;
- Payment to DEWA affecting power & water supply to the building;
- Payment to District Cooling service provider (IA) – affecting Air
conditioning within the building;
- Swimming pool, Sauna and Steam rooms, Gyms;
- Maintenance (scheduled and reactive) of common area equipment:
- Waste collection;

The Developer and the Owners Association Management Company are not liable to the
owners for any claim whatsoever including claims based on the stoppage/disconnection
of services at the building.

If you have recently settled your account please forward us details of the payment in
order for us to update your account status and please disregard this correspondence.
Please note that should you wish to pay for only the current quarter, the remaining
balance for the year should be covered by post dated cheques (local bank).
In the event a third party Collection agency is appointed to recover overdue service
charges, any fee levied by the agency will be charged back to the Unit owners.

Should you have any query with regard to the annual service charges or require a copy
of your Statement of Account please contact us at crm@damacproperties.com or call us
on 800-DAMAC (local toll free) or +9714 5156111 where the team will be happy to assist
you.

I find it extreemly furstrating but not suprising that the emphasis of payment is on the landlord. When all steps are followed i.e. payment by TT/cheque, invoice reference details etc. one still has to chase Damac to prove that funds have been transfered. Then they hit with late payment fees because they cannot allocate funds promptly and correctly.

I doubt there are any owners left that trust DAMAC.

Their building management team simply demand payment, based on figures they have made up without explanation and then demand it be paid into changed bank account numbers. All apparently under the authority of RERA but we only have DAMAC's word on that.

No wonder they have a high incidence of default.

A little bit of honesty, transparency, and provision of expenditure accounts might improve the situation but the fundamental lack of trust in a developer that lacks morality is the real problem.

The sooner RERA actually show some teeth, the sooner all these default issues will disappear.

It has to be easier for RERA to pick on one major developer, on one very clear cut issue, and actually remove their license to operate. That would quickly motivate the rest of the developers to start following the rules rather than perpetually testing how far they can go. Only when the developers are following the rules can RERA hope to begin to tackle the thousands of individual property owners that can all point to something in the law or their contract where the developer has been cheating.

With no cheating on the developer side, it should be far simpler to follow an automatic process that puts the full cost of service fee default with the owner.

They were testing the lights on the SZR side earlier, in addition to the yellow horizontal strips that I've seen before, they had vertical multi-colour moving strips down either side. Unfortunately I only managed to get these crappy mobile phone pics but would look cool if they're on all night.

Interim Owners Association has met twice already. Board has been elected. First board meeting took place this week.
