The ICC court in the Hague and politics in EA

Dear all, it is important for us to be following the turn of events in the Hague with those Ocampo four having charges to answer and try to have useful discussion how will their cases shape up the political dynamics in the region! For instance We see now in Tanzania politics has moved into worship houses and all other gatherings including burial ceremonies, the tendency is catching up fast something that was uncommon but not a strange thing in all our neighbors'! I do ask for all of us to use this thread in effective manner to see what regional blocks import and export!

WHY KIBAKI SNUBBED KOFI ANNAN

PRESIDENT Kibaki's confidants advised him not to meet Kofi Annan this week in Nairobi because they claim he is biased.

On Thursday the former United Nations Secretary General warned that electing either Deputy Prime Minister Uhuru Kenyatta or Eldoret North MP William Ruto as president would complicate Kenya's foreign relations.

Annan has been in Nairobi this week with former Tanzanian President Benjamin Mkapa to assess Kenya's preparedness for elections in 2013. Annan was the chief mediator in 2008 in the negotiations after the post-election violence that led to the establishment of the coalition government.

Five senior Kibaki confidants privately told the organisers of Annan's visit that there was no reason for Kibaki to meet Annan "since his mission ended four years ago".

"The general feeling around the PNU side of the coalition was that Annan had overstayed his welcome to Kenya. Each time he came he seemed to be closer and more comfortable with Raila's side of the coalition. He also has been behaving like Kenya's prefect," said one adviser.

"In any case, he wanted to know how government was preparing for elections. The Prime Minister is the coordinator of all ministries and we believe he must have briefed Annan on the progress so far. So we asked the President to concentrate on other important national issues," said the official in the Office of the President.

Speaking as he left on Thursday afternoon, Annan said he and Mkapa had expected to meet Kibaki when they arrived on Monday. Initially they were told that Kibaki was unavailable because he had gone to Uganda for the 50 years of independence celebrations. They had then expected to meet him on Thursday but they received no word from State House.

Presidential Press Services boss Isaiah Kabira told the Nation that the Head of State had a busy day on Thursday chairing a Cabinet meeting that had to approve 14 bills.

On Wednesday met Prime Minister Raila Odinga, commission chairmen, and civil society leaders to discuss among other things the upcoming elections.

Kibaki's advisers were also unhappy that Annan had refused to meet Uhuru yet he met Prime Minister Raila Odinga and Deputy Prime Minister Musalia Mudavadi who are both campaigning for the presidency.

"Why was Uhuru left out of the itinerary yet he is a serious presidential candidate? Why did Annan meet Raila, Mudavadi and Eugene only and not Ruto, Uhuru and other presidential aspirants? We can only conclude that there are people he favours," said assistant Agriculture minister Kareke Mbiuki, an ally of Uhuru.

Yesterday Uhuru told TNA aspirants gathering at Kasarani that foreigners should not meddle in the Kenyan elections. He said he would accept the voter's verdict.

His comments were echoed by political consultant Tony Gachoka who has worked with Uhuru in the pasty. "The judiciary under foreign directives cannot block Uhuru and Ruto from running for office. Let the people decide," said Gachoka.

"Uongozi mwema (good leadership) can only come though universal suffrage and not through a court bench of three sitting in judgement on leadership and usurping the will of the Kenyan people," said Gachoka.

The presidential advisers also privately accuse Mutunga of "meeting and entertaining foreigners who want Uhuru and Ruto barred from contesting the presidency".

Mutunga met Annan this week and US Secretary of State Hillary Clinton in July. Both leaders praised the ongoing reforms in the judiciary. Kibaki's advisers have become increasingly uncomfortable with the pronouncements being made by Chief Justice Willy Mutunga.

This week Mutunga said that Kenyans should review the Matemu and Baraza rulings if they wanted to know who would pass the integrity test.

Mutunga was referring to the recent High Court decisions in August and September that nullified the appointment of Mumo Matemu as the chair of the Ethics and Anti-Corruption Commission and the decision of the tribunal recommending the removal of Deputy Chief Justice Nancy Baraza.

Mutunga's comments indicate that the courts may take a tough line in the case challenging the integrity of Ruto and Uhuru. The ruling is expected later this month and will determine whether they will be eligible to contest in the presidential election in March.

A “political merger” of TNA and URP is nonsense on stilts. It won’t take a step without collapsing into a heap. That’s because oil and vinegar don’t mix. Let’s call a spade by its name.

There’s no love lost between Deputy Prime Minister Uhuru Kenyatta and Eldoret North MP William Ruto.

If you believe the International Criminal Court, the two went at each other hammer and tongs in 2008.

Don’t be fooled that the wily and cunning Mr Ruto will be Mr Kenyatta’s bride.

Nor should you expect the brash Mr Kenyatta to prostrate himself before Mr Ruto.

Which begs the question – how can you have a “political union” where there’s no master and servant? That because you can’t.

The weird courtship between Mr Kenyatta and Mr Ruto is grounded on two mortal “fears” – the fear of the ICC and the fear of PM Raila Odinga.

A paradox

They’ve formed a pact because the ICC accuses them of masterminding the violence targeting “each other’s people” in 2008.

This is a paradox – but one I can explain. The violence wasn’t personal to either Mr Kenyatta or Mr Ruto.

The true objective wasn’t to attack people but to capture, or retain power. That’s how poor people are sacrificed by political elites every election cycle. It’s nothing personal. That’s how Mr Kenyatta and Mr Ruto can still come together to seek the highest office in the land.

For Mr Kenyatta and Mr Ruto, the fear of the ICC looms larger than the fate of the 1,300 dead, the IDPs, and the survivors.

The prospect of spending decades in a cold prison in Europe is a horrifying probability. Misery loves company. That’s why Mr Ruto and Mr Kenyatta are locked in an uncomfortable embrace.

They are probably the only two people who truly understand each other’s pain. They must spend sleepless nights – breaking out in cold sweats – in terrible nightmares.

They’ll do anything to save elves, including probably refusing to show up for trial at The Hague. That’s why they must win the election if they want to defy the ICC – like Sudan President Omar al-Bashir.

Mr Odinga is the second “fear” which unites Mr Kenyatta and Mr Ruto. This is a fear of “payback”. The Kenyattas and the Odingas have had a long running political feud.

Mzee Kenyatta turned on Jaramogi, Mr Odinga’s father, even though the latter refused a British offer to become Prime Minister in place of the former. Mzee Kenyatta later detained Mr Odinga.

In 2002, Mr Odinga led a rebellion in Kanu that denied Mr Kenyatta the presidency. In 2007, Mr Kenyatta joined President Kibaki to deny Mr Odinga the State House.

Mr Ruto fell out with Mr Odinga and left ODM. The two – Mr Kenyatta and Mr Ruto – have vowed to end Mr Odinga’s quest for the State House.

Mr Kenyatta isn’t just driven by vanity to seek the presidency. He’s now the head of an ideological faction – political conservatives – that’s ruled Kenya since independence. He – and this elite – want to safeguard their patrimony.

Many of them fear that Mr Odinga would scrutinise how their wealth – including land – was acquired.

There should be no doubt that many of those who plundered the country under Mzee Kenyatta, Mr Moi, and President Kibaki should be held to account.

Who knows whether Mr Odinga would do it, but they don’t want to wait and find out.

They’ve demonised Mr Odinga by falsely claiming he orchestrated the ICC against them. But fear isn’t enough to unite Mr Kenyatta and Mr Ruto.

Tribal constituencies

Mr Kenyatta and Mr Ruto must contend with “their respective tribal constituencies”. There’s growing evidence that Mr Ruto may not hold onto the Kalenjin, especially if he plays second fiddle to Mr Kenyatta.

The Kalenjin wonder why the Kikuyu can’t support “their son” instead. Perhaps the Kalenjin are aware of one important historical fact – the House of Mumbi has never supported a non-Kikuyu presidential candidate.

The Kalenjin can take this to the bank – Mr Ruto won’t be the first “outsider” candidate to win Kikuyu support.

Mr Ruto can only join Mr Kenyatta as the subordinate, not the other way round. And the Kikuyu will completely desert Mr Kenyatta in droves if he subordinates himself to Mr Ruto.

The risk for Mr Ruto – if he becomes Mr Kenyatta’s sidekick – is loss of face among the Kalenjin. This opens the door wide for Mr Odinga to scoop up Kalenjin voters.

It will also strengthen the hand of two key regional players – Industrialisation minister Henry Kosgey and Agriculture minister Sally Kosgei – against Mr Ruto. Mr Odinga may even pick one of the two his running mate.

This could likely doom Mr Ruto’s political career. So, this is the question – is Mr Ruto willing to become Mr Kenyatta’s sacrificial lamb? Can his hatred for Mr Odinga trump his instincts for political survival? Or will his mortal fear of The Hague drive him irrevocably into Mr Kenyatta’s vice-like iron grip?

I can see why Mr Kenyatta sees a Uhuru-Ruto ticket as a plausible strategy out of the ICC and a roadblock against an Odinga presidency.

Except it isn’t. I think it’s more like a suicide pact. Mr Kenyatta and Mr Ruto shouldn’t act as though they are guilty of crimes against humanity unless they believe they are.

That’s why the better strategy is to drop their presidential bids and first clear their names at the ICC. A strategy driven by fear suggests less faith in their innocence. It smacks of a desperate all-or-nothing strategy for survival.

Dk Magufuli alisema kati ya wagombea wote waliojitokeza kuwania kiti cha urais nchini Kenya, hakuna anayemfikia Odinga na hiyo inaonyesha kuwa wakimchagua atawasaidia bila ubaguzi.

WAZIRI wa Ujenzi, Dk John Magufuli jana aliungana na Waziri Mkuu wa Zimbabwe, Morgan Tsavangirai kumpigia debe mgombea wa urais wa Kenya, Raila Odinga huku akisema mgombea huyo kupitia Chama cha Orange Democratic Party (ODM), anastahili kuwa Rais wa nchi hiyo kutokana na sifa zake za uongozi.


Akizungumza katika Mkutano Mkuu wa ODM jana, Dk Magufuli alisema hakuna sababu zozote zitakazowafanya Wakenya wasimchague Odinga.

“Nataka kuwaambia Wakenya kwamba Odinga ni mcha Mungu, mnatakiwa kujua hilo. Kama mimi ningekuwa Mkenya ningempigia huyu jamaa kura ili aongoze nchi. Lakini sasa kwa kuwa siruhusiwi hata kupiga kura, basi nawaambia msiache kumchagua huyu atawaongozeni vizuri,” alisema Dk Magufuli.


Dk Magufuli alisema kati ya wagombea wote waliojitokeza kuwania kiti cha urais nchini Kenya, hakuna anayemfikia Odinga na hiyo inaonyesha kuwa wakimchagua atawasaidia bila ubaguzi.


Alisema na hata Odinga ambaye ni Waziri Mkuu wa Kenya akiamua kugombea ubunge katika Jimbo lake la Chato, hawezi kumshinda.


“Kwa hiyo nasimama hapa ndugu zangu wana ODM kuwapa pongezi kubwa sana, mmmefanya kitu kikubwa sana kwa sababu mmechagua jembe,” alisema.


Huku akishangiliwa na maelfu ya wajumbe wa mkutano huo, Dk Magufuli alisema kama angekuwa akipiga kura angempa Odinga kura zake zote kwa sababu ni mtu mwenye upendo, uvumilivu, asiye na makuu wala ubaguzi na anayependa kushirikiana na watu wote.
Alisema Odinga ni mpenda amani na kusisitiza kuwa amelisema hilo kwa sababu amani ni muhimu katika maendeleo ya Afrika Mashariki na Afrika kwa jumla.


Alikipongeza chama hicho kwa kuamua kushirikisha vyama zaidi ya 15 na kuweka nguvu zao pamoja ili kushinda katika Uchaguzi Mkuu unaotarajiwa kufanyika Machi 4, 2013.
Akizungumzia uhusiano wake na Odinga, Dk Magufuli alisema walifahamiana tangu alipokuwa Waziri wa Ujenzi wa Kenya wakati yeye akiwa Waziri wa Ujenzi wa Tanzania.


“Uliwahi kufika Tanzania mara nyingi na hata kuhudhuria mazishi ya baba yangu mpendwa, ukaja na mawaziri zaidi ya watano pamoja na mke wako katika jimbo langu ninalotoka linaloitwa Chato,” alisema.


Bila kuwataja majina, aliwapiga vijembe baadhi ya wagombea wengine nchini Kenya akisema hawawezi kutembea nje ya nchi hiyo kutokana na kubanwa na sheria, huku akisema Odinga ana uwezo wa kutembea ulimwenguni kote bila pingamizi.


Kuhusu Muungano wa vyama vya kisiasa nchini humo, Dk Magufuli alisema hiyo inaleta changamoto kwa siasa za Kenya… “Huu ni muungano mzuri ambao naukubali sana, hususan walioungana na Odinga ni dhahiri kabisa kwamba wanamtabiria ushindi mkubwa.”
Alisema Wakenya wanatakiwa kuachana na uongozi wa makabila akisema hautawafikisha popote kwani ni kikwazo cha maendeleo na pia ndicho chanzo cha migogoro nchini humo.
“Msilete ukabila… mtakuwa mnaivuruga Kenya yote, watu watakufa, watakosa uhuru wa kuishi sehemu moja kama Waafrika wengine,” alisema.


Alisema vurugu zinazofadhiliwa na utawala uliopo madarakani na ukandamizaji wa washiriki wengine wa shughuli za kisiasa hauhalalishi uchaguzi kuwa huru na wa haki.
Aliwaonya wajumbe hao kutorudia tena kuunda Serikali ya Umoja wa Kitaifa kama ilivyo sasa kwa kuwa Serikali ya aina hiyo hujenga chuki kati ya viongozi na kudhoofisha utendaji wa Serikali.


“Hakikisheni mnaipigia kura ODM kwa wingi ili ishinde Uchaguzi Mkuu ujao na kuunda Serikali moja ambayo itapimwa kwa kuzingatia programu zake.

Kenya Deputy Prime Minister Uhuru Kenyatta, a leading presidential candidate in the 2013 Kenya general elections and his running mate William Ruto have been banned from visiting Europe.

Uhuru and Ruto, who are both facing crimes against humanity charges at the International Criminal Court (ICC), have been banned from traveling to any country in the European Union with the only exception being the city of Hague, Netherlands where the ICC is based.

The two were indicted earlier this year along with former Had of Civil Service Francis Muthaura and journalist Joshua arap Sang over involvement in the post-election violence in 2007-2008. They have all declared their innocence and their trials are expected to begin in April 2013.

Uhuru's party TNA recently formed an alliance agreement with Ruto's URP and Mudavadi's UDP to run under the Jubilee coalition. Under the agreement, Uhuru will on December 18 battle it out with Mudavadi for the coalition's flag-bearer position.

The winner of the nomination process will contend as the coalition's presidential candidate, with Ruto as the running mate (Mudavadi, Uhuru Head for Tuesday Showdown).
