屠殺八港人慘案 願來港出庭卻受阻撓馬尼拉專訪:門多薩弟爭取視像作供 【
本報訊】馬尼拉人質事件死因研訊至今仍無任何菲律賓方面的證人落實來港作供,令證供完整性大打折扣,槍手門多薩的弟弟格雷戈里奧( Gregorio Mendoza)是至今唯一表明願意來港作供的菲國證人,然而被菲律賓政府視為眼中釘的他,背負 3條刑事重罪在身,屢次申請出國被阻撓,看着日子一天天過去,他相信來港機會渺茫,正努力向死因庭爭取以視像會議代替出庭作供,期望在死因庭完結前「盡爆」所知真相,並能親口代兄長向死難者家屬道歉。 記者前日在馬尼拉找到格雷戈里奧,身穿警察制服的他沒有佩槍,在酒店房間接受訪問時,神色凝重的懇求記者幫他向所有香港人傳達他的訊息。 案發當日,門多薩弟弟格雷戈里奧被菲警按倒地上。資料圖片 由菲律賓司法部長德利馬( Leila De Lima)領導的人質事件調查委員會( IIRC)公佈調查結果後,原本並無建議向格雷戈里奧提出刑事起訴,但其後總督府作出修改,令他最終被控5宗罪,首兩項分別是由菲律賓國家警察總局( PNP)及國家警察首長( NPC)提出的「行為不檢」指控,屬警隊內部調查,餘下3項刑事檢控先後由司法部提出,直指他涉嫌與兄長門多薩是同謀,分別為嚴重非法禁錮、非法藏有槍械及嚴重違反紀律,案件已展開多次聆訊,他本周四亦要再次上庭應訊。雖然戴罪在身,但格雷戈里奧的警察職務尚未被終止。去年 12月,當格雷戈里奧收到香港警方邀請到港作供的信件後,他已即時透過律師回函,表明願意赴港作供,但他的旅遊證件一直被扣起,出入境部門說:「這要向外交部門問准」。之後一直沒有回音。 3項刑事檢控中,他只夠錢付第二及第三控罪的 10萬披索保釋金,餘下首控罪的 20萬披索保釋金,月薪只有 8,000披索的他卻一直沒能力繳付,格雷戈里奧說:「他們就是這樣千方百計不讓我到香港作供!」 求中國大使館協助 格雷戈里奧表示,香港死因庭可能在本月 18日就結束,能夠赴港的機會已非常渺茫,如今尋求視像會議越洋作供,是他最後的希望。他上周曾接觸駐馬尼拉的中國大使館,遞交了寫下作供內容的文件,希望對方轉交香港死因庭,當時一名姓黃官員表示會代他嘗試,但沒作出承諾。到處碰壁後,格雷戈里奧昨決定親自向香港死因庭傳送電郵,正式提出以視像會議作供的要求,希望獲得正面答覆及安排,就算只剩下一天,仍會繼續爭取。「我只求一個機會,可以讓我說出真相,可以讓我能親口代我們一家向死難者家屬道歉,那是我一直想做的事。」格雷戈里奧對記者說。記者:馮少榮 梁曙光 ![]() ![]() 菲警解剖驗屍程序混亂港法醫縷述驚奇見聞 《馬尼拉人質慘劇聆訊 第 17天》【本報訊】馬尼拉脅持人質慘案死因聆訊,再揭菲國糊塗賬,披露當地解剖及殯儀程序馬虎兼錯漏百出。驗屍由菲警負責,撰寫報告過於簡單兼與事實不符。驗屍時沒照 X光,沒驗衣物,解剖後更無縫合傷口,匆匆將遺體送往沒有任何冷藏設備的殯儀館。有本港法醫對菲國見聞感驚奇,直言與文明地區的做法不符。 遺體沒有名牌識別 衞生署法醫科高級醫生藍偉文,事發翌日凌晨抵馬尼拉,安排將遺體運返香港,並希望以觀察員身份參與當地驗屍工作。但其中三名死者早已被解剖,他只能旁觀汪子林及楊綺華夫婦的驗屍工作。而謝廷駿、傅卓仁及楊綺琴的家屬,成功申請不在當地解剖遺體。驗屍由菲律賓警員執行。當時遺體沒有名牌識別,只在腳內側寫上一個英文字母作記認。而量體重、測屍溫、抽取身體樣本等基本程序,統統欠奉。藍指出,文明地區剖驗遭槍擊死者,會先以 X光檢查,確定體內子彈碎片的位置,「用對遺體傷害最細嘅方法去搵」。死者衣物亦要獨立檢驗及拍照,了解彈道痕迹。但這兩項重要程序,菲警均沒做。 剖屍不縫合無冷藏 菲警又以「蠟染」技術套取死者手背上火藥痕迹。藍指香港已很久沒採用,他只曾在書本見過,此法主要用以調查死者生前有否開槍,且驗手掌而非手背。據他打聽,菲警只受訓一年便獲准處理驗屍,是否具醫學背景則存疑。最令他感驚奇的,是菲警剖屍後竟沒有縫合傷口,反而交由殯儀館處理,令他無從監察。而殯儀館在炎炎夏日,未能提供冷藏屍體裝置。就算藍提出自資購買冷凍器材或乾冰,館方也稱做不到。由於害怕遺體儀容會在一兩日內轉差,故家屬只好接受館方建議,進行防腐注射程序,大大影響返港覆檢遺體的準確度。負責在港解剖的法醫高永富則指出,菲方驗屍報告在殉職領隊謝廷駿的年紀及身高上出錯,女團友梁頌詩的傷勢不是沒有提及,就是「唔知邊度嚟,搵嚟搵去都搵唔到」。他又指菲報告只得半頁紙,過於簡短欠完整。

盼親口向受害者家屬道歉
【本報訊】他是槍手門多薩的弟弟,過去 3個月,他四處奔波要來港作證,除了揚言要站在法庭上「爆」真相,還有一個理由,就是親口代兄長向慘劇中的死難者家屬說句道歉。 指菲政府兩個面孔 前天,格雷戈里奧( Gregorio Mendoza)帶着他最喜歡的三子來見記者,在這位即將報考警察的兒子面前,他除了講述自己來港作供的願望,更眉頭緊皺地寫了一封給香港市民的信。格雷戈里奧在信中說,我盼望及祈求與我的家人,為門多薩隊長(槍手)的錯誤行動,向所有人質死難者表達最深切的同情、慰問及道歉。格雷戈里奧除了表示並不認同兄長的錯誤行動,更指從心底裏願意到香港作證。訪問進行期間,遇難康泰團領隊謝廷駿的兄長致電格雷戈里奧。謝兄說,曾向菲律賓駐港總領事館了解,得悉格雷戈里奧來港是絕無問題的,只視乎其個人意願。格雷戈里奧聽到這番話後一臉茫然,無法理解菲律賓當局對着他與對着港人為何有兩個面孔,感覺非常荒謬( ridiculous)。

Hostager-taker's brother gives side via video conference

He is a brother of the late Senior Inspector Rolando Mendoza of the August 23, 2010 Manila hostage crisis that claimed the lives of the police officer and his 8 hostages from Hong Kong. The Hong Kong Special Administrative Region government initiated the video conference after some Philippine authorities refused to attend the Coroner's Court's inquiry in the former Crown Colony. The Hong Kong government leased the PLDT facility in conducting the video conference. SPO2 Mendoza's lawyer, Atty. Romulo Macalintal, was impressed at the way the Hong Kong Coroner Court took the deposition of his client. "Napakaayos ng proseso, para bang kami'y nandoon din mismo sa court nila at it was handled by a judge," Macalintal said in an interview. According to Macalintal, his client's deposition was given in Filipino. "They asked in English and they translate it to Tagalog, tapos si SPO2 Mendoza sumasagot sa Tagalog at ita-translate naman sa English, kaya tumagal ng mahigit apat na oras," he said. What impressed Macalintal more was the manner the Coroner Court gave the questions. "Hindi sila paulit-ulit at kalmado and the lawyers were prepared in their questions,” he added. According to SPO2 Mendoza, the thread of questions included the event when he was included in the negotiation team, the instructions given by Manila Mayor Alfredo Lim, and the document sent by the Ombudsman that was read to his brother. "Tinanong din nila kung bakit umabot sa ganung punto at ano ba ginawa ng mga opisyal ng gubyerno" he said. Mendoza's emotions welled as he told reporters that he blurted out before the Coroner's Court why he should not be criminally charged. "Humingi na din po ako ng tawad sa mga taga-Hongkong, sinabi kong hindi gusto ng pamilya namin ang nangyari, pero hindi naman porke't kamag-anak namin si Kapitan, kami na ang sisisihin" he said. Philippine and Hong Kong journalists were not allowed to view the deposition, but Macalintal released a CD copy. Justice Undersecretary Leah Armamento also attended the deposition proceeding. "Observer lang naman kami dun. It's the Hong Kong police that was calling the shot," she said. Armamento was smiling as she faced reporters, saying the Coroner's Court used the Incident Investigation and Review Committee report in handling the deposition. She added that they will talk to Hong Kong authorities to find out who's next in line for the deposition that will be held until Friday. The Standard Thursday, August 30, 2012 Seven out of 10 residents believe the government should do more for the victims of the Manila tourist bus tragedy two years ago. Seven Hong Kong tourists and their guide were shot dead and seven wounded after the bus hijacking by a rogue cop ended in a bloody firefight. That is up from a similar poll last year, when 57.1 percent said the government had not tried its best to assist victims in their fight for justice. Democratic Party legislator Fred Li Wah-ming said the increase, as reflected by the 564 people surveyed by the Democratic Party this month, reflects the determination of the public to get an apology from the Philippines. The same percentage of respondents believe Chief Executive Leung Chun-ying should meet victims. "Leung responded swiftly to the Diaoyus conflict by summoning the Japanese consul in Hong Kong, so why doesn't he do the same with regard to the hostage tragedy?" Li asked. Around 80 percent of respondents insist a black travel warning against the Philippines should remain in force. Survivors and families of those killed have launched an online petition urging President Hu Jintao to raise the issue with Philippine counterpart Benigno Aquino at talks next month. |
