you are absolutely right, i have sent an email to ENI asking for the budget report for last year so we can make sure all owners have paid their service charges last year, and also to know exactly the actual charges for last year and whether there was a surplus or deficit and where are these money now ... so far no response , without this report i don't think i will pay them a single Dirham!!!

What I am not paying is the substation connection fee ENI had to pay to Business Bay LLC as no where in the contract does it mention I have to. Only connection charge we have to pay is directly to DEWA as this is "impossed directly by any utility or authorities for these services to the property(your unit)" as stated under 8.1

What I am also not paying is empower annual consumtion fee as we are already paying directly to Empower as "demand charges" which is a fancy word for empower infrastructure tax.

Also as we are paying an audit fee, demand a copy of the audit for service charges from last year.

I am going to RERA tomorrow morning as I have finally a meeting in the area and at 3:00 i have a meeting with ENI regarding the service charges. Last updae is "they are working on the RERA approval" so till you get a copy of it, dont pay anything.
I also asked for a copy of the audit as well as this years service charges breakdown is 100% identical as last year hence based on an estimate.

BTW there is a yahoo group, I suggest we use Facebook. I will set it up today.

1. ENI and Rera are meeting next week as the audit has not been done by ENI yet
2. Do not pay any service charges unless Rera approved
3. Do not pay substation charing charges as this is so far an illegal claim from ENI

BTW there we 5-6 people complaining about the substation charge before me, I encourage everyone to do the same. Will share the email address tomorrow or go directly to Rera building in Deira, 2nd floor.

It was my pleasure meeting you yesterday in your office and I would like to thank you once again on behalf of all owners of Churchill Towers project for your help and support.

As discussed, I am sending you herewith (see below) the email communication from ENI which clearly confirms that the service charges will be applicable only from the day Empower connection is ready.

When you meet with ENI next week, please demand the following:

1. Empower certificate clearly showing date of commencement of service
2. Explanation on why the owners are being threatened to pay a “Substation connection sharing charge”
3. Explanation on why the owners are being threatened to pay service charges they claim are due from 15.08.2011 if the building was not cleared for occupancy till 27.10.2011
4. Explanation on why the 2011 service charge is 100% identical with 2010, hence not based on audit
5. Explanation on why they demand to pay service charges if NOT approved by RERA
6. Sales and Purchase agreement clearly mentions we should pay only 50% and other half after 6 months, why do we have to pay in full?
7. When is the owners association being established


I am sending you herewith all supporting documents as follows:

1. Service charges breakdown for 2010 and an email showing the same breakdown has been given by ENI for 2011 as well, hence not based on real consumption.
2. Invoice for 2010 service charges paid in full on 21.07.2010
3. Key handover certificate. We were denied keys until proof of empower registration, this was open only on 26.10.2010 by Empower

Even though there are lots and lots of free parking spaces ENI are now allocating parking space and charging 4000AED for an additional space. A notice up today is saying people will get fined 500AED if you park in someone elses space. Totally illegal!! Anyone else have views about this?

Can someone confirm exactly what we should be paying in terms of service charges? Are the Empower charges in addition to the service charge fees?

Yep, totally arbitrary prices. Seems to me ENI are trying to milk the building as much as they can until the Owners Association is established. I wonder if they are deliberately prolonging the process...

Have been receiving lots of emails from ENI that the Dubai Land Dept is ready to issue the Title Deeds for Churchill. ENI is issuing NOC on payment of all outstanding charges (2nd year maintenance fees, substation charges etc). Has anyone paid these and got NOC & Title Deeds recently?

I have not received anything from my entire investment in Churchill Towers. After I couldn't pay the remaining %50, they sent me a cancellation letter for my units in residential tower and that was it. The guys at ENI keep ignoring my emails and phone calls and I do not live in Dubai. What should I do?
