One possibility that was mentioned to me was he refused to take the money back because if he did he would have no grounds for a potential lawsuit later. Again I am guessing but I am thinking the NBA while not actually committing to an expansion franchise gave him a very strong reason for him to believe there will be one in the not too distant future. That said, because of past assurances that did not materialize under Stern he may not fully trust them and is keeping the lawsuit in his hip pocket as leverage for the NBA to make good...........all speculation
