Very Very impressive!!

The only thing is i'm not that keen on the small bridge to the smaller tower. Looks like an after thought.

Court criticises 'hostile litigation'
Judges highlight the relentless pursuit of the Chinachem empire by Nina Wang's father-in-law

The enormous costs order issued yesterday against Wang Din-shin, the father-in-law of Nina Wang Kung Yu-sum, was very much of his own making, the Court of Final Appeal said.

Had the 96-year-old father of late tycoon Teddy Wang Teh-huei not taken such a hostile approach to the battle over whether or not a will written by his son in 1990 was genuine, the claim against him would have been far less than the HK$560 million he now faces.

Instead, he had engaged in what amounted to a hostile takeover of the Chinachem Group by probate.

"In exercising its discretion, the court draws a distinction between litigation reasonably undertaken by a person in order to require the validity of a will to be investigated by the court, and litigation which is fundamentally hostile," the full bench of the court said.

The court yesterday dismissed arguments by Edward Chan SC, for Mr Wang, that the nine-year battle over the will, which featured allegations from day one of forgery and fraud, was necessary.

Mr Chan had argued the will needed to be tested because of the failure of Teddy Wang to tell his father about the new will, the way it was produced by Mrs Wang, and the unusual aspects of the documents that appeared with it.

But the court disagreed, saying that while the size of the estate and the unusual manner of the will's surfacing may have required some investigation as to its bona fides, the manner in which Mr Wang went about it was wholly hostile.

"He had decided, even before mention of the 1990 will, to institute legal proceedings to wrest control of the Chinachem Group from Mrs Wang," the judges said.

They noted he had waited just two days after the expiration of the seven-year limit for declaring a missing person dead before launching an action to have his son's demise made official.

Then, once the existence of the 1990 will became known, he did not even wait for its contents to be revealed before alleging it was a fake and stating in a sworn affirmation that Mrs Wang had, "in other words, probably committed a crime".

This strategy of attacking Mrs Wang led to adverse findings against her in the Court of Appeal, which in turn led to her facing criminal charges that were withdrawn late last year after the Court of Final Appeal found the will was genuine.

"Mr Wang Snr had obviously made up his mind that he would fight to obtain control over the estate {hellip} no matter what," the court wrote. "The assertion that the 1990 will propounded by Mrs Wang was a forgery became fixed in his mind and he was determined to do all he could to prove that fact."

The five judges agreed with Geoffrey Vos QC, for Mrs Wang, that the whole saga amounted to "hostile litigation par excellence".

It was only because of the fact that some litigation was to be expected when dealing with an estate of such magnitude that the court did not order Mr Wang to pay the entirety of the costs associated with the epic battle.
