I thought Ryan was contracting though. Usually contractors are only on a week's notice. See you later and here's a week's pay is what generally happens.

People do still get sacked, it just requires two written warnings then the third is your last. I've heard of a few lately, mainly people seem to leave of their own accord after the first warning. The other is you can be let go in the three month probation period, I've seen that happen too recently. The biggest hurdle is getting someone in management to recognise that someone is a problem then follow up on it.

If you're a contractor, you've got a two-way agreement so it depends on what that says. Usually people just agree to go their separate ways if there is a problem, but either the company or the contractor could choose to sue.

Backs up what I was saying though Kelli. If you're on your third warning you must be doing some serious misconduct.

It's very hard to sack someone for anything but gross misconduct.

What do you consider gross misconduct? The ones I'm thinking of were not following established protocols and directions (resulting in budget blow-outs) and being generally useless/unsuitable. People usually get away with that though, it was just nice to see someone get pulled up for it.

I think with gross misconduct like theft or something there would be no three warnings?

I'd have to get out the old employment law notes Kelli, it's been a few years since I looked at this. The legislation is actually quite specific in this regard. Of course there is dismissal within a contract which as long as it's a legal contract re those terms it's fine. It's more instant dismissal I'm thinking about.
