The arbitrator had on Friday evening had the first preliminary meeting with both sides where DC lawyer made a representation seeking a status quo on the termination that would kick in as it had failed to get any further extension of time to furnish the bank guarantee to the Board.

The arbitrator granted a status quo at 7.30 pm which the Bombay high court stayed on Saturday on an urgent appeal made by the cricket board.

The BCCI is now all charged up and says it would be an uphill battle for Deccan Chargers given its huge debt and it would mainly be an issue of damages now, But all is not over yet say the Chargers who are an IPL franchise since 2008.

In its claim before the arbitrator the DC can seek either that its franchise status be restored and/or seek substantial damages from BCCI.

The arbitrator will go into the validity termination notice. Said a lawyer, in a fluid situation like this, it may be not be easy to say what may happen eventually.

Lawyers on both sides are not willing to spell out what may happen eventually but while the DC side insists there are still options, BCCI team is more gung ho that with a debt of Rs 4000 crore the question is whether DC would be able to even retain its players before the end of the month deadline, get new ones, pay off its creditors and stick to its undertakings.

The rules require BCCI to give its approval when any franchise is getting a new buyer, but the question now is whether there is any team to sell for DC, said a BCCI official.

As apex body for cricket administration in India it said it had on September 14 decided to terminate the Hyderabad franchise agreement with immediate effect due to non compliance of conditions and issued DC a termination notice.

The Chargers moved the Bombay HC on September 15 seeking a stay on the termination by filing an arbitration petition. On September 26 the HC appointed the arbitrator and gave him three months to arbitrate the dispute.

The HC disposed of the petition finally on October 1 with a direction to BCCI not to act on its notice pending arbitration proceedings, subject to a condition that DC furnished the Rs 100 crore bank guarantee within the set deadline. The HC also recorded an undertaking given by DCHL to pay its pending dues to IFCI limited as agreed on September 12.

The BCCI also informed the court on Saturday that it has written two letters to DCHL including one on October 11 whether it had complied with its undertaking to pay IFCI but said it received no response.

In its appeal, a copy of which is with TOI, The BCCI said DC was engaging in "dilatory tactics with an ulterior motive at defeating and frustrating the Board's legitimate rights under the agreement."

The Board said it was "not open" to continue or modify the HC's earlier order of stay. The BCCI appeal filed through advocate Viraj Maniar, appeal also informed the court that thought IPL 6 is still six months away and players' contracts were up for renewal on October 31, 2012.

If the franchises fail to extend the player's contract by then, these contracts will terminate this year and the players will be free for open bidding by other franchises for the 2013 season either by direct negotiation or players auction. Thus it is important for a franchise to be in good financial standing this month.

The BCCI said it thus needs to have alternate solutions handy and the best one is to issue fresh tenders for a new franchise. The HC had not precluded the Board from floating a new franchise in its quota of ten.

The BCCI said any further extension would threaten the stability of the league itself as it take at least 6 weeks to get players allotted to a franchise and recruit a professional cricket management team. The next hearing of the appeal is on October 17 in the high court.

Deccan Chargers’ captain Kumar Sangakkara hopes the Board of Control for Cricket in India (BCCI) will be able to resolve the crisis surrounding the IPL team, which has been terminated after failing to obtain bank guarantee.

The cash-strapped Deccan Chargers lost its status as an IPL team after the Bombay High Court stayed the order of Arbitrator for maintaining status quo on the matter till further hearing on Saturday.

The owners of the franchise had failed to produce a Rs 100-crore bank guarantee before the Bombay High Court, a condition that had been set for the struggling team's survival in the league.

They later approached the Court-appointed Arbitrator who had passed the order of status quo, according to PTI.

"BCCI moved an appeal against the Order of Arbitrator and the same was heard today morning. The Hon'ble High Court was pleased to stay the Order of Arbitrator after hearing both the parties", the BCCI said in a statement.

Sangakkara, the skipper of the Hyderabad-based franchise which boasts the likes of South African pacer Dale Steyn and Australia’s Cameron White, is hoping for a solution.

"Players have been paid and that's great. The franchise has ensured that they've always kept their word to the players and honoured all the contracts they have signed," said Sangakkara.

"They are now in arbitration with BCCI, I believe, to try and come to an agreement and the BCCI has always been very good in problem solving during the IPL they've done a great job over five years,” he was quoted as saying by Reuters.

"Deccan Chargers is a great franchise to play for, so we as players, we can't control those things, we just wait and see as to what will happen,” he added.

Running an IPL team is not a profitable venture. Only way you can make money is probably through the conversion of black money into white money. And owning an IPL has some prestige assosciated with it. If DC are not able to get the tender quashed by the court, the only way Hyderabad is going to get a team is if a Corporate with no home ties with any of the other cities bids and wins it. Then Hyd has a chance as it has the biggest fan base.

Sam Vasant Kumar, the Greater Hyderabad Municipal Corporation coach says, “we have seen many new faces on the various GHMC coaching grounds, ever since. It is heartening to see the high enthusiasm levels of children of various ages.” Apart from regular coaching classes in over 54 games in five different zones, the GHMC also organises summer and winter coaching camps for children from the ages of eight years and above.

There are several other neighbourhood sports centres that have more children dropping by on weekends and that is surely the first step towards becoming a sportsperson. Centres such as GHMC camps have been promising playgrounds for scouting sports talent.

In most cases the best of sportspersons drop out in Std. IX. Reason? They have to devote more time to their studies and with that their career in sports usually ends. “Till the age of 14 the number of sports persons in the academies is rather high,” says Mr Praveen Bhargava, the Joint Secretary of the Andhra Pradesh Lawn Tennis Academy.

Fourteen year old, N. Kishore Kumar, a Std. IX student of Sister Nivedita School and a national level skating champion, feels academics and sports can be managed easily. “Pay attention in class, work hard in both sports and studies and you can do well in both fields. If the interest is sustained and one is willing to work hard and do well, every sportsperson’s parents and school authorities will give them lots of support.” Kishore hopes to represent India in the Olympics someday.

“Today a career in sports is a good option for a hard working sports person. Sports has become very rewarding and it may be worthwhile for Indian parents and children to look at it for a good future,” says P. Gopichand, the Indian Badminton coach and mentor to the many badminton stars from the country.

Inspired

“Don’t put a limit on anything. The more you dream, the further you get,” said Michael Phelps, multiple Olympic gold medallist.

The London Olympics has served as a source of inspiration for many. Mira, a Std. XI student finds Mary Kom and Saina Nehwal inspiring. She says, “I found Mary Kom a woman of grit. She’s a mother and a sportsperson. She fought many odds to reach the Olympics and has made India proud. Saina Nehwal was a consistent player too. I like the fact that she never gave up.”Inspired by such great athletes, children are actively participating in the games period at school. Nidhi Mehra, a Std. IX student of Sri Aurobindo International School, Hyderabad says, “We have games period every week in our school. We play games like throw ball, basket ball and dodge ball. I have taken to these games with renewed vigour after watching the various games held as part of the London Olympics.”“Parents must aspire for their children to become sportspersons, just as they’d want them to become doctors or engineers. The parents and teachers have a great role to play in promoting sports in schools. The talents and interests of the child should be identified and nurtured,” explains Ms. Anita Gupta of Sherwood Public School, Hyderabad.

“I am really happy that I am playing my first game in the longer format here. No better place than this one,” he had said even before the game began.
