5Pointz Plan Approved, Owner Makes Community Promises

As expected, City Council approved plans today for two residential towers to replace the Long Island City graffiti mecca 5Pointz. Brownstoner Queens has the latest details on the agreement made with property owner David Wolkoff, who will begin demolishing the current warehouses in the near future. Here's what the deal calls for:

· 210 affordable units, up from the initial offer of 54. All told, there will be 1,000 new apartments across both towers, which will rise 41 and 47 stories.
· 12,000-square-feet of artist and gallery space, up from 2,000-square-feet. Wolkoff increased the amount after the local community board shot him down.
· Jonathan Cohen, curator of 5Pointz, will have the opportunity to curate 10,000-square-feet of "art panels and walls" in the new buildings.
· 32,000-square-foot public park
· 50,000-square-feet of street level retail
· 250 space public parking garage
· The use of 100 percent union construction workers

It's officially time to say goodbye. The wrecking ball comes next, and the first tower should be complete by late 2015.

5Pointz developer blocked again from razing graffiti site

A judge’s temporary restraining order barring G&M Realty’s Jerry and David Wolkoff from demolishing the 5Pointz graffiti site has been extended for an additional 14 days.

The move, which blocks owner Jerry Wolkoff from acting through Nov. 10, comes as Judge Frederic Block called for a hearing to determine whether he should issue a preliminary injunction that would prevent the developer from altering the building until a lawsuit brought by a group of 16 artists is resolved, the LIC Post reported.

The suit, which claims that the site contains over 350 original works of graffiti art worth saving, cites copyright law and the 1990 Visual Artists Rights Act, which affords the creators copyright protection in their works regardless of who owns the physical space on which the work is created.

According to Jeannine Chanes, attorney for the artists, the artwork should fall under VARA, since it was finished post-1990. She claims the work can only be changed with each artist’s consent. Wolkoff’s attorneys, conversely, have argued that the artists should have expected the site to be torn down eventually and had no reason to believe the art would be in place permanently.

They probably could've made something out of the grafitti if they could have demo'd the building without completely destroying the facade. BTW, this situation has sparked a social media outrage

Demolition Starting up at 5Pointz

The warehouse, of course, will be replaced with two condo towers.

Yet another massive security breach in NYC... I can't help but wonder if there's a connection to he whitewashing of 5pointz though. Even though it's in Queens
