PART 3-Opinion and Proposal

LOT 1152, JALAN BELFIELD KUALA LUMPUR Kami adalah pemilik berdaftar bagi suratan hakmilik Geran 27011, Lot 1152, Seksyen 69, Bandar Kuala Lumpur. Berhubung dengan Draf Pelan Tempatan Kuala Lumpur 2020, kami mengemukakan bantahan kuat terhadap cadangan mengubah zoning kegunaan tanah Lot 1152 kami daripada kegunaan "Bangunan - Perdangangan" sejarang mengikut suratan hakmilik kepada "Public Open Space" dalam Draf tersebut. 1. We are the registered proprietors of Lot 1152, Seksyen 69, Bandar Kuala Lumpur, Daerah Kuala Lumpur measuring 18,342 sq.metres or 4.53 acres (“Lot 1152”). 2. The title to Lot 1152 carries the category “Bangunan – Perdagangan”. 3. The Draft Kuala Lumpur City Plan 2020 now Proposes to zone Lot 1152 as “Public Open Space”. 4. We strongly object to this proposal for the following reasons :- a. The proposed designation as “Public Open Space” is inconsistent with the permitted use sated in the title, which is “Bangunan Perdagangan”. We have always been paying annual quit rent for the land based on commercial category. b. The adjoining land (Lot 679) which was previously Police Quarters and Institutional land is now proposed to be zoned for ‘Mixed Commercial’ with a plot ratio of 6 : 1. Whereas, our private land with “Bangunan – Perdagangan” use is proposed for “Public Open Space”. This is greatly inequitable. c. The land has never been opened up or made available to the public and has always been maintained by us. It is close to a busy main road and highly unsuitable for use as public open space or park. There is minimal surrounding population to enjoy such a park. d. The proposed change in zoning to “Public Open Space” is totally inconsistent with the approval in principle we receive from Datuk Bandar KL dated 19.1.1992. This conditional approval was in response to our application for 6 towers, each comprising a hotel an apartments. A copy of this approval is attached. e. The proposed zoning is grossly unjust and renders our property worthless, thus depriving is of valueable development rights.
