I have just spoken a reliable source (cant mention names) and the following feedback is as follows:
Completion date most likely December 2010. There will unlikely be a further delay, all contracts with sub-contractors are in place to finish the project. The power is connected to SEWA and is up and running. The delay is caused by the installation of the vacuum sewage system - this will take another 3 to 4 months for completion. Once this in place, the remaining paving, tarring, gardens, lighting will be completed. The have plans for 4 more communities to be developed and are in the process of finalising the plan The Government of Umm Al Quwain is a shareholder in the project and are very keen for the entire development to be finalised. The 2nd phase is currently out for tender. Apparently the area has already been marked out for phase 2. However, at this stage Emaar main concern is to finish Phase 1 so that residents can move in and then they will concentrate on the other phases. Obviously, this will be subject to demand and will not be completed by 2011 as initially stated. The temporary blue walling along the entrance road is to protect the landscaping and road from wind, dust and sand as there are big open areas around.

The intention is to convert the old Emaar sales office into some type of Emaar hospitality Centre i.e. entertainment, restaurant. The future sales office will be located in one of the villas within the Mistral community. Emaar are intending to do a further thorough inspection of each villa for any defects and will be supplying us with a year or more warranty.

magoo79,TracyB and SJM11 and Blackangus,

I have just discovered this forum and like yourselves am in a similar situation. I purchased a property with an Amlak mortgage and am of course now concerned about the future of the development. Although i am not planning to actually re locate from Dubai and actually live in the villa i was planning on renting the property out. How easy that will be is anyones guess. The whole thing has become even harder now that i am actually relocating away from UAE later this year unexpectadly. Anyhow i would be very interested in anything being done as a group as dealing as an individual with either Emaar or Amlak i have discovered is not very fruitfull.

Hi All,

I will PM my contact info to Black Angus after this post, I urge others to do so. I think we should arrange a meeting once Emaar provides the mandatory update in a few days.

We should discuss the general Emaar contract and identify if there is any item w can leverage towards our rights.

It may seem hopeless, but we should atleast try something.

I received personal contact information from magoo79 (+ friend), Tracy B and SJM11. Still missing sye and RN156.

I agree with magoo79 that we should meet after receiving the letters from Emaar. In the mean time I will have the contract seen by a friend lawyer.

I think Magoo79 maybe right regarding the handover date. The contract does state June 30th, 2009 as an estimated date. The actual completion date will be considered June 30th 2012, which means they can delay be another year, plus ninety days without consequences. Worst case scenario therefore, is we are looking at a handover of October 1st, 2011.

Tomorrow is the BIG day as we should be receiving letters from Emaar. Let's see what they have to say...

For obvious reasons I'm limiting my comments here, I hope to share more feedback tomorrow via private emails.

Emaar's update - December 2010

Hi all,

I haven't recieved any letter yet, but my friend called Emaar yesterday to inquire and they said the letter has been sent and it says that our properties will be delayed till December 2010. I think it's reflecting in thier system now, so the robots said it like it was..... lol...

And they used the word "Revised Completion Date".

Here is my analysis:

- "Estimated Completion" was June 30th, 2009


And contractually it was 12 month extendable, so the did to....

- "Completion Date" as June 30th, 2010

And again contractually they have 12 months delay allowed, so they used half thier right.....

- "Revised Completion Date" as December 30th, 2010

And again contractually they will have another 6 months to extend, which they may use to send us letter by Nov 30, 2011... so that will make it

- "Final Completion Date" as June 30th, 2011

This one will be last per the contract, and they will have 90days from it to deliver otherwise we have the right to refund, which is probably a bleak chance, as they will cook up something. Nevertheless, there is nothing positive for us in all of this, except uncertainity and pile up of more and more interest because of thier planning, completely unfair, but I guess justifiable by the contract.

In summary, I think we need to all meet up and discuss ideas on anything that could make the experience better for us i.e Pushing for community center, asking for credit notes, simply asking for a refund based on a legal advice etc etc....

Blackangus, let's plan for one.... any place for a venue.

We also got the letter today, no surprises in it, and no assurance that the project will be handed over then, as December 30th, is the new completion date, not the handover date. They could still stretch it out until September 30, 2011, without any penalties.
