Having seen the latest update pics on the Damac site for EG2 I am not holding my breath as to a completion date in the first half of 2010. I'm not even sure as to the veracity of the pics anyway since if you compare those for Mulberry and those for Magnolia they are obviously of the same building!! So who knows what is really happening there.

there is new update on Damac website for EG1&2 dated 13/10/09
Honestly i canot find any diffrence from aug. to Oct.they have list of monthly
updates if you compare the only diffrence you will find on Oct. you can see Dust sheets are added, there is only one inside shot and no surrounding photos are added

i wonder if there is any penalty damac have to pay if they are not ready by x date??any body have any info pls shasre with us

*date of completion

*date of completion of infrastructure in JVS

* any show apartment for me to see how the fittings will done ?

* is there any choice of fitting & fixture we can choose?

* how will the apartments will be powered as there are no electricity in JVS

*Above all i have no reply from UK office have you clsed this office down?

see what you guys push them with pls send mail make phone calls do some thing ask question and share with fellow investors

Hi All
i spoke to CRM at damac Dubai Office today and they told me the completion for EMG2 is moved to end 2010,
as per my payment sechudule 80% was due 31/12/07 but i paid my last installment on 19/5/09 for 80% and ballance on completion
in my contarct there is no where mentioned completion date
can some one confirm have they got any completion date Given by damac in writing?
becuse as per there contarct clause no. 13.1 says
"If the buyer has fulfilled all his obligations in term of this agreement and the seller is unable to give possession and occopation of the unit by exended anticipation completion date,without prejudice to the provisions of clause 14,the seller shall pay a penalty at the penalty rate to the buyer on all payments made by the buyer toward the purchase price for the period starting the next day of the completion of the six months of the extended Anticipation Complettion date, untill the date that possession and occupation is offered to the buyer.

Guys if we not send any notice they will not pay.
is there any lawer in this forum can gauide us or any body suggest a lawyer to me to take any action

Thanks for this Mirpuri. Well done. I must say that I am not altogether surprised at the delay. I have just returned home from a short holiday but will look at my agreement and will post my own views upon the contractual effect of the delay as soon as I have done so. As you refer to the Damac UK office would I be correct in assuming that you are in the UK? If so perhaps we could have a chat about the way to go once I have reviewed my contract.

Hello everybody, As per EG1 they wrote me in May that the completion date was 1st June 2009. Damac can extend upto six months after which they will pay the purchaser as per contract. So from December if they do not complete they will have to pay the Buyer

Also Nakheel are the ones to blame of the infastructure delay in JVS

I agree with you about inffastructure is not fault of Damac but our agreement is with Damac unless we complain to Damac no body is going to do any thing as you can see we were made to believe that project would be ready by end of 2008 but you can see it is going to be 3 year late and no inffastructure we need to send letter to all bodys like Rera- Nakeel -Damac if all the investors of JVS send letters to Nakeel belive me they will take notice
i hope all of you need to tell to another investor to send complain letters to authorities' such nakeel Damac-Rera and keep send every month eaither by your self or by your lawyers

Damac have posted construction up date for nov.
Normaly they give 3 photos for each building today they posted only 3 photos for 3 buildings that is for EMG1 & 2 on EGM1 inside picture showing kitchen cabinets Very poor quality and col. for luxury devalopment by Damac
as for EG 2 very little to see any progress

Are they seriously asking for AED 1522 per sq. ft. in JVC?......and it's supposed to be a "distressed sale"! Do they expect to get any buyers?

I should perhaps say that I am a long retired solicitor still with some knowledge of UK law but knowing next to nothing about the Dubai legal system.
The notes I have made are lengthy.
Do you feel I should post them on this open forum or would it be best to put them on the Facebook site which is more restricted? Any views anyone?

If you go Dubai Marina thread you will see the members are so active and they inform there fellow members of any thing to do with devalopment and i think we should the same for example pls see comment of one of member telling how to che check snaging list Snagging -

Liabilities and legalities

Fully understanding the snagging process is TERRIBLY important for all of us.

There are fundamental problems with Emaar's snagging process.

For instance, it is completely INVALID to do a snag without water or power. One of the tests that all of you should plan to do is to fill all basins with water, plug them up. Fill the tub with water and leave these over night. Or 2 nights. Then check for local leaks. Check your downstairs neighbor for hidden leaks coming from above them from your tub or sink plumbing!! Have your upstairs neighbor do the same test. There's clearly no time during the orientation but we should have a year to perhaps try.

Then you also need to check each socket and switch.

Impossible without power or water utes switched on.

Also, we should find out what Emaar's warranty terms are for the 1 year: does anyone have this in writing (fat chance, I think) Are all items all covered for the year, then we're ok. Are cosmetics covered for 1 year? They have told me that on the phone but we cant take their word.

Can anyone try to get this in writing? Anyone managed to develop any insider friends who may pass these things along to us without too much fuss from within Emaar?

Am I correct in assuming that on Facebook access to the EG entry is limited to approved applicants? If the answer is made that this is correct then I will post an entry there on receipt of such confirmation for the reasons stated below.

That would mean any buyer could gain access on that site if they so wished as I and others on this site have done.

I would prefer to discuss any proposed or potential course of action against Damac in a private forum rather than on an open forum to which they have access, and which I have no doubt they do read. I would not want them to know anything of our tactics if we do choose to take steps against them.

As a matter of interest my son has spoken to Damac and been informed that completion for EG2 is posted for the 3rd quarter of 2010 which of course means it is unlikely it will be handed over until 2011 at the earliest if past experience is anything to go by. This confirms what they told Mirpuri.

It is a disgrace that they have not formally advised us as buyers but that seems par for the course.
