Gramercy claim bucked

The race for the country’s tallest residential building has reached the courts with Gramercy Residences’ developer being accused of fraud and misrepresentation for claiming to have 73 floors, although it is allowed to go as high as 68 floors only.

Picar Development Inc., which is building the adjacent 70-story Stratford Residences on Kalayaan Ave. in Makati, also asked the Muntinlupa regional trial court last week to stop Gramercy from constructing the additional five floors.

In its complaint, Picar attached a letter from the Makati City Hall certifying that the local government had not received any application from Century Properties Inc. to raise Gramercy from 68 to 73 floors.

Picar also asked the court to stop Century Properties from claiming its project as the “Philippines’ first super tall building and will also be the highest” to protect the public who might buy “on the mistaken belief that The Gramercy Residences has the distinction of being higher than The Stratford Residences, if not the highest in the Philippines.”

Court Asked: Stop Gramercy Construction

late news? they didnt stop construction

the neighboring rival developer only "ASKED" the court, nothing else? the court didn't say anything to the gramercy developer..

the headline can be misleading


what they going to do? demolish the additional 5 storeys they've constructed?

yeah especially the last photo's angle.. it looks like a lot of concrete, but we don't mind it anymore because soon it will be surrounded by glassier buildings like the Trump Tower & Movenpick Hotel... & cover it

Lawsuits, How Many?

What is the number and reasons for the suits against Century involving Gramercy Residences?

Belair Soho is now gaining their freedom after their Annual Meeting with more news to follow. In Soho Central, we have an unjustified delayed Annual Meeting and a building with many problems due to poor management and construction issues.

Fees that feed the vultures

Yes, you will learn about the management practices and decisions all made in secret when your turnover and Board forms. Is it true your building will turn over when incomplete? How will turnover take place in December 2012 and Unit Owners sign for condos not yet complete?

Is it true that one ridiculous fee is for PLDT and is a prepaid charge of 50,000 pesos for one year whether or not you are there and use it? Who profits from this?

Is it true that your one-time association fee upon turnover is 39,000 pesos?

Are there any other milking fees?

Cash cows is what the developers see.

Is Gramercy developed with any other concern as was Soho Central and Belair?

Looking forward for Gramercy

The following is from Bel-air Soho on their recent victory in the struggle for freedom. When we were there at the Annual Meeting it was refreshing to witness Unit Owners standing up to the dictatorial developer Board. Those buildings such as ours being controlled in secret with secret meetings deciding on our money in secret need to join together and learn from each other.

We have GOOD NEWS and NOT SO GOOD NEWS for you.

First, the GOOD NEWS. Although a little bit late, we were able to oblige the Century Properties controlled Soho Board to call the Annual General Meeting (AGM) this year. During the “FIRST” successful AGM held on August 24, 2012 at Oxford Hotel in P. Burgos St., Makati City, SEVEN of our co-owners were elected as the BOARD OF TRUSTEES and OFFICERS, namely:
Mr. Laurentius Peters – Chairman (0917-5966833)
Mr. Luis Bernardo Estrellado – Vice Chairman (0916-4689721)
Mr. Crispin Santiago – President (0917-8832287)
Mrs. Emma Nadura - Treasurer (0921-8285691)
Ms. Iris Sunga – Secretary
Dra. Aurora Fajardo – Member (0935-9141260)
Mr. Joshua Gatmaitan – Member
The determination of the owners to proceed with the AGM and elect the FIRST set of Board of Trustees was eloquent proof that the owners were no longer willing to let their rights be trampled and wants to free themselves from the tyranny of the Condominium Project Developer, who after SELLING us our respective units, seems to still want to continue controlling and KEEP ON EARNING more at our expense. In view of the election of an Official Board of Trustees, the Self-appointed Board ceased to have legal authority to function as a Board and much less to manage the business affairs of our Association.

Now, the NOT SO GOOD news. The Self-appointed Board, after walking out of the AGM when they failed to legalize their position by trying to nominate representatives or proxies and even those ABSENT, submitted to the Securities and Exchange Commission (SEC) a General Information Sheet (GIS), that contains blatant lies stating there was no election held and the Self-appointed Board continue to be Trustees on “HOLDOVER CAPACITY” after we submitted our GIS on 29 August 2012. This shows proof that they’re NOT WILLING to give up their position even after 7 years of disregarding the owners’ rights.

The First Elected Trustees issued a letter to the Self-appointed Board, who by the way are NOT EVEN UNIT OWNERS, to effect a peaceful and smooth handover of the management and responsibilities to the Elected Trustees. However, instead of heeding to the demand, they ignored it, continue to be in command of our building and manifested the ultimate proof of bad faith, which is, OPENING a NEW BANK ACCOUNT. This reveals that they really DO NOT WANT OWNERS TO KNOW HOW THE MONEY IS SPENT, after the Elected Trustees were granted an authority to check and approve all the withdrawals on the official Soho Condominium Corporation account at BPI Polaris Branch.

For the first time in 7 years, the unit owners through our elected TREASURER got the means to look into the expenses of the Condo Corp. Recently, CPMI tried to liquidate a check amounting to ONE HUNDRED EIGHTY ONE THOUSAND PESOS P181,000.00 issued to CENTURY PROPERTIES MANAGEMENT, INC. where apparently some of the Self-appointed Board are major stockholders.Should this management be retained and paid after what they’ve shown for the past 7 years? We should be aware that the ongoing rate of management fees for a small condominium like BelAir Soho is between P40–50,000 ONLY.

Since the Self-appointed Board was booted out office when we asserted our rights as owners, they no longer have the legal authority to be demanding or collecting any dues from us. We therefore urge you to continue depositing your dues to our official depository bank BPI POLARIS ACCT NUMBER 3071–0722-57 and DO NOT pay in CASH or CHECK directly to CPMI or to anyone associated with the Self-appointed Board, or other persons under their employ. This act will assure that all expenses made will be accounted and safeguarded.

If it is not possible for you to pay thru the bank, you may handover your payment to our elected Treasurer Mrs. Emma Nadura, who may be contacted at ________________________ and she will be the one to deposit your payment to our official depository bank.

These Self-appointed Board, through their CPMI manager Colly Cansino, are threatening us by saying that deposits made to our OFFICIAL depository bank will not be honored although they did not tell the reason why. Please think this over. If an escrow account is a legally acceptable form of payment, then, why would paying through our own official depository account becomes unacceptable?

We understand that this may be a period of confusion for all members and tenants. As your duly elected Board of Trustees for the year 2012, we assure you of our commitment to uphold and protect the general interest and common good of the entire membership of the association. Who else would be better to preserve the value of our investment but us unit owners helping each other.

We will continue on updating all of the latest developments. If you have any questions or would like more information, you may call any of the Elected Board of Trustees whose contact numbers appear above opposite their names. You may also email us at [email protected].

It is also but proper to WARN our friends and relatives, who are potential buyers, about Century Properties Condominium Projects and their BAD BUSINESS CHARACTER of controlling and earning from the management of the building until they can do it forever, by way of appointing their officers as Trustees after completion of the Project, engage the services of the law firm and property management they own, CPMI, and manage the building with their AUTOCRATIC and NON-TRANSPARENT STYLE OF MANAGEMENT.
