Their clean bill came from the Court of Appeals, which last November also affirmed the June 17, 2008 decision of the Alaminos Regional Trial Court to dismiss the case because it was filed in the wrong venue.

The Pangasinan court acted on the complaint against Audi AG, filed on June 1, 2005 by Proton and its affiliate Auto Prominence Inc., which also asked for payment of damages.

On June 1, 2005, APC and Proton also initiated estafa case against Audi officials—all based in Germany—with the City Prosecutor of Alaminos City. The estafa case was dismissed by the Department of Justice and the appellate court, leaving the civil aspect of the suit unresolved. The complaint filed against PGA Cars Inc. represented by its president Miguel G. Coyiuto and its chairman, Robert G. Coyiuto was also dropped.

The case arose After Audi terminated on September 27, 2004 its direct dealership agreement with Proton and Auto Prominence because it was dissatisfied with the way the latter represented the Audi brand in the Philippines.

Citing provisions of the original contracts between Proton and Audi, the appellate court stressed that the parties intended Germany to be the exclusive venue and place of jurisdiction for all actions pertaining to the contracts. Rey Requejo
