Wow this is the first time ive seen anything going up more than 2 storeys in that lot. The jinx is definitely broken. Wag lang ma demanda si ongpin for insider trading like what the current senators specifically osmena wants baka matigil na naman ang project.

MANILA, Philippines - Senate probers are prodding businessman Manuel V. Pangilinan to sue and recover, on behalf of other Philex Mining Corp. shareholders, over P400 million in short-swing profits that, Sen. Serge Osmeña said, were “unduly earned” by Marcos-era Trade Minister Roberto Ongpin in 2009 from trading Philex shares.

“Manny Pangilinan has to act fast or else Philex would virtually be waiving its right to get back the hundreds of millions of pesos in short-swing profits that Ongpin made,” Osmeña told reporters.

Osmeña said Pangilinan, as the majority shareholder of Philex Mining, only has until Wednesday to file the recovery suit, since the Security Regulation Code (SRC) mandates that “any claw back action should be done within two years from the date that the short-swing profit was realized.”

Under the law, Pangilinan can claim on behalf of the mining firm the short-swing profits that Ongpin earned in late 2009, according to the senator.

Osmeña warned that if Pangilinan fails or refuses to go after Ongpin, the SRC states that 60 days after asking the issuer or majority shareholder/s to file such suit, minority stockholders “in the name and in behalf of the issuer [Philex Mining]” can move to recover the short-swing profits. However, the suit should be filed also within the two-year period.

Osmeña, who is chairman of the Senate Committee on Banks and Financial Institutions, explained that filing the lawsuit against Ongpin would enable Philex shareholders to recover the short-swing profits, pegged at a minimum of P412 million by the Commission on Audit, that Ongpin was said to have made as a Philex director.

He invoked Section 23.2 of the Securities Code which states: “For the purpose of preventing the unfair use of information which may have been obtained by such beneficial owner, director, or officer by reason of his relationship to the issuer, any profit realized by him from any purchase and sale, or any sale and purchase, of any equity security of such issuer within any period of less than six months, unless such security was acquired in good faith in connection with a debt previously contracted, shall inure to and be recoverable by the issuer, irrespective of any intention of holding the security purchased or of not repurchasing the security sold for a period exceeding six months.”

Honestly, what is the purpose of the Philippine Senate anyway but to act as the ultimate crab mentality peeps just to score some pogi points! They are so bloody useless and contribute absolutely NOTHING to the progress of the country.

I hope Alphaland big projects like Alphaland Tower , Shangri-la at the Fort (20% share? ) and Alphaland Bay city will not be affected by this recent events involving Ongpin.

All systems go for all these projects. In fact, AC has been quietly building up its landbank in the CBD and will be announcing another project by next year.
