Bid to remove bus tragedy judge rejected
No fair-minded observer could conclude remarks might be perceived as bias, High Court finds

A High Court judge yesterday rejected the Department of Justice's attempt to seek a judicial review of another judge's refusal to disqualify himself from the Tuen Mun bus tragedy trial.

Mr Justice Michael Hartmann, of the Court of First Instance, ruled that Deputy District Court Judge Ian Thomas had made no comments in favour of or against the prosecution or the defence in the trial, from which he has been asked twice to recuse himself.

Truck driver Li Chau-wing has denied a charge of dangerous driving causing death after his vehicle and a double-decker bus collided in July last year.

Twenty-one people were killed in the crash.

A Department of Justice's spokesman said yesterday the department would not pursue the judicial review any further.

"We would respect the decision of the judge and will now proceed with the prosecution," he said.

Senior government counsel Lynda Shine had applied for the deputy judge to step down after it emerged he privately commented on the case to a justice department prosecutor, Gavin Shiu, at the Hong Kong Archbold Criminal Law Conference last weekend.

The prosecution had raised fears of apparent bias because Mr Shiu had a social conversation with Deputy Judge Thomas in which the judge said he was dealing with a bus accident case involving dangerous driving causing death.

Deputy Judge Thomas mentioned that he would probably refuse the defence's late application for live-note stenographers and the judge said words to the effect that "careless driving was an offence he either 'did not believe in' or thought was of little efficacy".

"Mr Shiu asked the judge why he thought so. The judge said something about it being an insurance matter," according to the judicial review application.

Barrister Kwok Sui-hay, for the government, said yesterday the case warranted further investigation and urged Mr Justice Hartmann to grant leave for full argument.

But Mr Justice Hartmann said there was nothing that might demonstrate an arguable case.

"In my judgment, I fail to see how any fair-minded observer acquainted with the facts of this case could conclude that the remarks of the judge, read in context, could possibly give rise to any real perception of bias on his part," he said.

He took the view that Deputy Judge Thomas' comments were of a general nature and they were "totally unrelated to any evidence to be given at trial".

"His comments were of a jurisprudential nature," the judge said.

"Judges are at the centre of the judicial process and it has long been accepted that they may in appropriate circumstances state their views as to deficiencies in the law and how they see those deficiencies being rectified."

The bus crash trial resumed at 2.30pm in the District Court.

The CMB Dart is for corporate use. The rest of their fleet was sold to NWFB - the new operator that took over their routes. Most of those buses have subsequently been retired.
