Yes the spire is counted. In this case i think it is ok like this, because the spire can be considered an architectural element of the building. In other cases (for exaple for the Heron Tower in London, another U/C Skyscraper that i like) i would not consider it, cos it looks like just an antenna.

A lot of rankings use emporis's figures and they will classify the heron tower at 202m i.e. excluding antenna. Do you know what they'll do for this building?
