PALAIS ROYALE TO GET GOING AFTER 3 YRS OF STOP WORK

Once the HC approves BMC's review report, the builder will be able to apply for fresh clearances. Investments worth hundreds of crores stuck in the building, where a duplex can cost up to Rs 75 crore.

Construction at Palais Royale, one of the city's tallest residential buildings where a duplex apartment can set you back by up to Rs 75 crore, could restart soon, after being stalled for nearly three years.

Municipal Commissioner Ajoy Mehta carried out an inspection of the Worli building being constructed by industrialist SS Kasliwal-led Shree Ram Urban Infrastructure Ltd. last week and decided to review its excess refuge area, one of the main reasons why the building had landed in trouble.

While as per municipal laws and the National Building Code, a building's refuge area cannot exceed four per cent of its total area, in Palais Royale's case it was as high at 27 per cent. Accordingly, in 2013 the then municipal commissioner Sitaram Kunte issued an order asking Shree Ram Urban Infrastructure to shave 13 floors off Palais Royale.

The order was challenged at the Bombay High Court, and the court observed that the refuge area could vary from building to building, depending on several factors, including number of residents, size of apartment, and amenities provided.

"The municipal commissioner visited the building and has initiated a review of the refuge area. A detailed study will be conducted to see how much refuge area can be permitted based on various factors. Once a report is ready it is likely to be put before the HC," a senior civic official said.

The building was mired in controversy after a public interest litigation was filed by NGO Janhit Manch, alleging the developer had violated FSI norms by constructing 13 extra floors and had built a public parking lot without permission.

Officials said that at the moment the BMC is only looking at the excessive refuge area. "The issue of the public parking lot will be decided later. At the moment we are only looking at how much refuge area can be permitted," the official added.

A division bench of Justices Abhay Oka and C V Bhadang had said in January this year that the BMC commissioner will have to decide on a reasonable refuge area in four months. The builder can then apply for regularisation of both wings, the court said. The court also said the builder will have to seek regularisation by applying for a fresh commencement certificate.

The HC bench, however, also said that the builder will have to bring down any floors that the municipal commissioner deems illegal.

In September 2013, the BMC had asked the builder to rework its plan to include the area that was exempted from the FSI. However, the court said the municipal commissioner was not justified in restricting the refuge area.
