Not 100% on the particulars, but I know PATH shares right of way with railroads which means it falls under FRA regs that the NYC subway does not. They've been trying to get out from under them for years, but to no avail. Its not as easy as saying NYC subway should just take it over as there'd be a lot of red tape to sift through.

Absolutely, I am under no pretense that the PATH can be taken over by the MTA at the drop of a hat, for that reason and others. However, I think it is noteworthy that the MTA Staten Island Railway falls under FRA jurisdiction since there is a connection to trackage that sees freight traffic from the national network; the rolling stock is modified to adhere to FRA standards. It is my understanding that, similar to the Staten Island Railway case, the FRA oversees PATH not because it shares ROW with the Northeast Corridor but with a switch that used to connect the PATH to the national network until some years ago. I am fairly sure that switch has been removed. I am not 100 % on the particulars myself, but I find it frustrating that the FRA imposes extra mandates on the PATH system, at considerable cost, that likely don't do much to enhance safety over where it would be under the FTA.

Only a small portion is connected to the National network...less then a mile of trackage... I'm not sure why the FRA is making such a big deal about this...

I find it truly appalling that as of 12pm the PATH has not restored service between Newark & JSQ due to the snow despite there only being a few miles to clear.... They supposedly have 620 workers clearing the line by hand...but still this is ridiculous... SEPTA , NYC Subway , LIRR and MNRR all have there lines fully operation and while some lines did not come back online intill last night or early this morning...those lines are in some cases 4x the length of the affected PATH area.... This reeks of mismanagement , and shows a shake up is needed at the PATH....I rarely rant when things do not directly affect me , but this is ridiculous... If I did have to go to Newark today , getting to Jersey City would take me an hr or more without the PATH...
