The developers have been forced to pay $18,000 to the City Council for a canopy that extends 1 metre over Council land.

As you can see here the curved canopy slightlly extends over part of the footpath.

If that tree is the top out tree, then that's the biggest top out tree I've ever seen.

if the council had the hint of a neurone as a brain they'd be actually be encouraging this. they spent god knows how much on that darwin city future doc and it talked at length about pedestrian cover from the heat and rain.

it's a huge problem in the city for retail (which is just about completely dead now) and now a developer provides some and it isn't much, the DCC want money.

I'd say it's because this is actually a balcony extending over the footpath - part of the occupiable space of the building, that they were fined. And presumably it wasn't part of the approved plans. Surely the council doesn't make developers pay extra to put up a regular awning with development approval.

DCC have little say in development approval or overview. Thank god.

And as for your last sentence, its the DCC.

Oh, I hadn't realised it was the Territory Government who was responsible for development applications. In which case it makes a bit more sense as to how this situation arose.

Looks as if stage 1 is all but completed. Be interesting to see who some of the retail tenants will be.

Here's some photos from the project's facebook page.

This one gives a good indication of the size of building 1

Hi sorry to bump this thread but i was looking over all the photos and i just realised there were two stages of this development but it appears that there's like only one stage shown in the photos.

I would think stage 2 would have been like completely finished by now or would have been put on hold. Holy Frog you live in Darwin? Can you please confirm?

Thanks. I hadn't thought of looking at Google Earth. I thought it would be out of date. Good to see the imagery date is Late November last year.

Also i just realised that is a funny spot for a few midrises. In between a highway with low density on the otherside and bound by light industry and what looks like a school.

Its at the top of one of the 2 hills in Darwin. So there is significant fall off esp on the left hand side of the photo. The ocean is about 400m left of those buildings.
Even at lower levels all those buildings have pretty much unobstructed views over the ocean or back into city.

Yes. They have a school in front (St Johns) and schools across Gilruth Ave (Darwin Middle and Darwin High)

The Avenue has been (is still) subject to litigation between the parties involved in the development. So the 2nd building has been shelved.

Given the state of the economy here (terrible) it wouldn't be a great time to start it anyway.
