I'd love to see this tower get built, however I wish it would rise to a height closer to 900 - 1000 ft.

Public records show that the assemblage includes three contiguous lots at 428-432 East 58th Street between First Avenue and Sutton Place. The filing of the deed is the final step in a year-long saga over the site, which has been locked in a legal battle between Joseph Beninati’s Bauhouse Group and N. Richard Kalikow’s Gamma Real Estate. A bankruptcy court order was filed with the city’s Department of Finance yesterday, coinciding with the deed.

Gamma paid $86 million for the properties and $12 million for additional air rights in a foreclosure auction last December, The Real Deal reported at the time. Two weeks later, the firm filed plans for a 67-story, 389-unit condo building. Over the past couple months, it has finished demolishing three tenement buildings that occupied the site.


While the initial filings called for an 844-foot-tall building, Gamma President Jonathan Kalikow said the new tower will rise 700 feet. Stephen B Jacobs Group is the executive architect, but Gamma has tapped Danish-born architect Thomas Juul-Hansen to design the skyscraper, Kalikow told Commercial Observer.

Bauhouse Group had hoped to build a boxy, 1,000-foot-tall skyscraper designed by Norman Foster. The design and height inspired neighbors to organize against the development and try to secure a rezoning to prevent it from being built.

“We want to add to the architecture and rich legacy of Sutton,” Kalikow said. “Our plan, different from the prior owner’s, will certainly conform to the Sutton look and feel. The entire look and feel of the building, we want it to be contextual to the neighborhood. We don’t think the previous developer cared about whether it was contextual; he just wanted to build something eye-catching.”

Good news that this business finally seems to be more or less settled. I didn't think the 900-footer was too ridiculous, but hey, I don't live there so it's not really for me to say and surely a 700 foot tower is more contextual than the Bauhaus proposal.

Looking forward to seeing Juul-Hansen's design. I would love to see a 700-footer in the vein of his 210 W. 77th condo building...



...only perhaps, as a nod to the classic Sutton Place towers, clad in red brick?

Back in June, the city’s Board of Standards and Appeals cleared the path for the contested 844-foot (257-meter) Sutton Place tower that developers Gamma Real Estate are constructing in Midtown East to move forward, however, residents have indicated that they are not satisfied with the planned project’s height.

The East River Fifties Alliance, the community group that was spearheading the rezoning proposal and the opposition to Gamma’s project, is pushing back against the board’s decision and has filed a lawsuit to stop the condo tower from taking shape, reports Crain’s.

The suit, filed on Sunday, is requesting that a judge order construction on the tower to halt once again, and require any future work on the site be in compliance with new zoning laws. The East River Fifties Alliance and similar neighborhood groups have an issue with the height of 3 Sutton Place, with many nearby property owners stating that the massive structure will ruin the views that the low-rise neighborhood offers.

Those opposed to the project have argued in the past that Gamma skirted rules by rushing to complete as much of its foundation as possible before the new zoning rules went into effect in December.

Additionally, they argue that the board should not have given Gamma Real Estate an extra six months to complete its foundation, and wrongfully allowed the development to be grandfathered into old zoning rules.

I still can't believe they rezoned the entire neighborhood in a futile attempt to stop this one tower. Glad to see it moving forward, I thought I read somewhere that the developers were tied up in legal trouble. That must have been resolved. I hope we get to see the new design soon.
