DOJ indicts Rappler, Maria Ressa, reporter for cyber libel

The Department of Justice (DOJ) has indicted news website Rappler, its chief Maria Ressa, and a former Rappler reporter for cyber libel, saying an article it published in 2012 was "clearly defamatory." The complaint was filed by businessman Wilfredo Keng, which stemmed from an article published by Rappler titled “CJ using SUVs of controversial businessman” during the impeachment trial of former Chief Justice Renato Corona. Keng had said he did not lend any vehicle to the late chief magistrate, who was ousted in 2012 over undeclared wealth. In a resolution dated Feb. 4, Senior Assistant State Prosecutor Edwin Dayog said Rappler, Ressa and reporter Reynaldo Santos Jr. committed libel under the Cybercrime Prevention Act of 2012.

How can the Journalists say they are prosecuted or persecuted when they are only publicly humiliated or castigated by the very person they are targeting and trying to put down...

Mass Media used to be only written or printed, broadcasted on television and radio...

Nowadays the need for broad sheets and tabloids are becoming less and less - now confined to the dust bins or as wrapping paper for dried fish... Gone are the days that families are glued on the TV screens waiting for nightly entertainment to start by watching the Evening News (by broadcasted on TV it is already old news or history)...

Advent of Digital Media on the other hand can only be likened to spreading wild fire or worse a conflagration... Instantaneous as it is happening - it’s on the internet, on the iPhone and thru Social Media (Facebook, Instagram, Twitter, etc) one can be The Darling of the Press one minute and a Social Pariah the next... Scatting Comments, Cruel Jokes, Name Calling, Blatant Ridiculing, Threats of every kind - all Libellous but who is monitoring?

Cyber Bullying a new crime but what penalty? How do you prosecute when things can be deleted or constantly updated. How do you differentiate racism (or others) from stereo typing?

Most News are to elicit a reaction, or change an opinion subliminally or gather forces for causes, a propaganda platform for the elite ... Propagation of Public Opinion Polling using sentiments of the common people and using that fact against the pros or the cons or who ever paid for the study...

Thus invention Fake News... Using Alledgedly or Diumano to escape prosecution...

Unfortunately the president (a lawyer) can see thru the News People.. He would not tolerate their crap ...

He might lack the Eloquence, Bearing or Command of a typical Traditional Politician... He is tactless to a fault - but he speak the Truth...

How many Leaders will tell you the truth and not spin webs of lies...

BREAKING: Rappler’s Maria Ressa arrested

MANILA, Philippines — Rappler’s Chief Executive Officer Maria Ressa was arrested inside her news agency’s headquarters in Pasig City on Wednesday.

Agents of the National Bureau of Investigation (NBI) conducted the arrest by virtue of a warrant issued by the Manila Regional Trial Court Branch 46.

Problems with the media they think of themselves as above the law and set's moral standards accordingly.
I've seen media immersed with so much power and attention. Look around in the ASIA region most progressive nations media outlets are working within their limits.

The CyberLibel charge in a nutshell

You want to fact check this arrest of Maria Ressa due to cyberlibel? Consider these:

1. The case stemmed from an article posted by Rappler IN MAY 2012 against a businessman, Wilfredo Keng, whereby the said article alleged that CJ Corona used an SUV owned by Keng during his impeachment trial.

2. Keng sued not because of the SUV angle but because the Rappler story maliciously imputed that he is engaged in human trafficking and illegal drugs.

3. Keng sued for cyberlibel in OCTOBER 2017, or 5 years after the original story was posted. There was no cyberlibel law yet when the story came out IN MAY 2012. The Cyber Libel Law came in effect SEPTEMBER 2012.

4. However, instead of heeding the request of Keng to take down the story, Rappler posted an update on the same story in FEBRUARY 2014, when the cyberlibel law was already in effect.

5. Last January 10, the DOJ found probable cause against Maria Ressa, reporter/researcher Reynaldo Santos Jr. and Rappler for cyberlibel.

6. The DOJ rejected the motion of Ressa’s camp to dismiss the charge based on their argument that the filing was beyond the one year prescription period. The DOJ said that under the cyberlibel law, there is no 1 Year prescription period indicated.

7. Judge Rainelda Estacio-Montesa issued a warrant of arrest dated February 12, 2019, TUESDAY.

8. Ressa had the whole day of Wednesday, Feb 13, 2019 to post bail. But she did not do so, and instead, invited media people to her office prior to the arrival of the NBI personnel who were to serve the WOA.

These are the facts.

Walang drama yan, unlike Maria Ressa and her gang of snowflakes in media like Karen Davila, Inday Varona, and others.

The problem with media, they are always hiding behind PRESS FREEDOM mantra for every legal actions that are doing to them.

I just wonder if RESSA do another thing like jaywalking and authorities charge him, is she will cry again of Press freedom attack?

What they simply mean is Trial by Media Publicity should continue. :bash::bash:

If Media attacked by someone it's suppression of Press Freedom.
If Media Attacked an individual that's Press Freedom.. WTF!!

Wala na silang pinag kaiba sa mga Banal na Aso, walang maling nagawa sa mundo..

People had enough with this so called 'political correctness'. Majority of media around the world, especially in PH are liberal propagandist, spreading information/news that suits their agenda. People globally are fed up already from mainstream media, hence it wasn't able to stop the rise of anti-establishment, from brexit, trump to digong in the case in PH. I always cringed and rolled my eyes hearing these media outlet's claiming as unbiased, bastion of truth, honest, impartial, etc. Let's be honest, at the end of the day, most if not all media outlets are business entities/corporation. They're are after for profits as their highest priority and secondly perhaps fame or their agenda. Thus, it answers to the question why major media outlets practicing clickbaits online or tabloid like headlines because they want it to sell like hotcakes.

Speaking for Rappler's case, I really thought that the case can't be warranted since the Rappler's news was around 2012 and the effects of the new law can't be retroactive. However, Rappler resurrected the 'issue' by producing an update of that news back then lately hence can be warranted as a reference for cyber crime/libel case against rappler. Worse is, there's no prescription stipulated in the cyber crime law.
