Student sues over gay Brokeback

A 12-YEAR-OLD girl and her furious grandparents have sued education bosses in the US, alleging that a teacher showed the R-rated gay cowboy movie Brokeback Mountain in class.

The lawsuit against the Chicago Board of Education claims that Jessica Turner, 12, suffered psychological distress after viewing the movie, which stars Australian Heath Ledger, in her class at Ashburn Community Elementary School last year.

The film, which won three Oscars, depicts two cowboys who conceal their homosexual affair.

Turner and her grandparents, Kenneth and LaVerne Richardson, are seeking around $US500,000 ($A600,000) in damages after the substitute teacher's bungle.

"It is very important to me that my children not be exposed to this," said Kenneth Richardson, Turner's guardian.

"The teacher knew she was not supposed to do this."

According to the lawsuit filed on Friday in Cook County Circuit Court, the video was shown without permission from the students' parents and guardians. Richardson had previously complained to school officials about reading material he said contained curse words.

"This was the last straw," he said. "I feel the lawsuit was necessary because of the warning I had already given them on the literature they were giving out to children to read."

Messages left over the weekend with school district officials were not immediately returned.

This just illustrates everything that is wrong with America, and why it is a nation in crumbling decline. That these nutbags could secure a lawyer to file a piece of shit lawsuit like this, beggars belief. I believe the school should have obtained permission to show this, as the topic is sensitive, but this is just over the top! America - the culture of complaint prevails.

Homophobic nonsense! But i guess its a litigious culture in which nutty religious views are the norm.

Before we judge America however, remember with shame the outcry (at least in the Daily Telegraph and talkback radio-land) we had here over gay-themed school books in primary schools or a gay family covered on Play School etc.

There's still a lot of ignorance and prejudice out there to overcome (Don't get me started on our backward state of laws regarding gay equality!)

If this is an R rated video then it shouldn't be shown to anyone under the age of 18 period.

But still, In the world we live in, all it takes is for someone to slip on a banana peel out the front of someone's house who didnt even put it there and they could get sued for some bullshit reason just to get a big sum of cash.

I mean, how the **** in this case is her pain and torment worth $600,000? I could buy a house and a top of the range car for that!

Poor girl.

How dare the school allow her to be exposed to an element of sociey that very much exists and that she will probably encounter some point in her life.

She should be sheilded from all elements of society that the church doesn't condone.

I think in America R would be M or MA. So it's not terribly bad. Definately not worth $600,000. Maybe 20 bucks? It's ridiculous to sue and I don't know what kind of person would but they still shouldn't have shown the movie wthout permission. And what kind of person becomes distressed. Pleasee.

I think this lawsuit is stupid but the school should have asked for permission to show it, hell i remember when i was in primary school we had to get permission from our parents to watch a bloody PG movie!!! let alone an M,MA,R movie!!!

True that they shouldn't be showing R-rated movies to 12 year olds...but, Brokeback shouldn't have been made R-rated in the first place.
I'd rather my kids watch Brokeback mountain than something like Die Hard.

As it is rated R they shouldnt according to law have been shown it, so they have a right to complain against that.

Whether or not its' appropriate for 12 year olds to see such a film and discuss such issues is another question. As much as i believe that you should teach tolerance against such, i also believe people have the right to disagree with homorelations.

But havn't seen the movie so cant respond to the specific case.

IMO the school should have sought parental permission if a movie rated R in this case was to be shown (not sure for what reason) however the notion that this minor would seek $600,000 in damages (for psychological distress) is pure exploitation of the legal system. What a load of bullshit.

I dont know how they would work out the damages payable in this situation. Usually with this kind of case damages make up the amount necessary to make it as if the wrong had never happened. I dont see how you could do that in this situation unless the parents had to give the kid councilling or failing that brain washing.

Brings other questions out like:
Do parents have to give permission for their kids to be taught evolution
Do parents have to give permission for their kids to be taught about Pythagoras and his therums seeing he was the head of a cult.

True....and what about the stress I endured after years of learning about the Bible at school only to find out later in life that it is a total crock of shit....
That's it...I'm gonna get me some money.
