Carpio: Duterte affirms arbitration award in recent PH-Japan declaration

President Rodrigo Duterte’s declaration of commitment to freedom of navigation in the disputed South China Sea in the joint Philippines-Japan declaration last week is an affirmation of the 2016 arbitration award, Acting Chief Justice Antonio Carpio said Sunday.

The acting chief justice, one of the leading figures in the Philippines’ arbitration victory against China, lauded the President for his support to freedom of navigation and said this was the “most welcome development in resolving the South China Sea dispute.”

“The statement of President Duterte upholding freedom of navigation and overflight in the South China Sea should be the main thrust of our foreign policy in the South China Sea. The Philippines should thus encourage all states to conduct freedom of navigation and overflight exercises in the South China Sea,” Carpio said in a statement.

Safeguards in MOU with China protect PHL sovereignty – Carpio

The Philippines and China's Memorandum of Understanding (MOU) on oil and gas cooperation in the South China Sea had enough safeguards in it to protect Philippine sovereignty, acting Chief Justice Antonio Carpio told GMA News.

“We did not cede any ground... I have no objection to it. I think the [Department of Foreign Affairs] did a good job in protecting our position, and I think it’s just an agreement to explore an agreement,” explained Carpio.

Furthermore, the arrangement was beneficial for the Philippines because it used the service contract as a vehicle for the MOU.

“That means that if it’s a service contractor, China will have to deal with our service contractors. They would have to enter into a subcontracting agreement with our service contractors," Carpio elaborated further.

"The good thing there, since we’re using the service contract as a vehicle, then that recognizes that the area being explored or exploited belongs to the Philippines, either EEZ or within our jurisdiction. Because the service contract acknowledges that area is under the sovereign rights of the Philippines.”

Likewise, maritime law expert and professor Atty. Jay Batongbacal was pleased that included in the MOU was the condition that both parties needed to agree on cooperation arrangements within 12 months.

Batongbacal pointed out that by setting a deadline, the Philippines, which needed the additional energy resources the most, would benefit from the arrangement.

Carpio to accept defeat

Senior Associate Justice and now Acting Chief Justice Antonio Carpio said he is prepared to be bypassed again by the Judicial and Bar Council (JBC) for the country’s highest post in the judiciary.

“If I am not chosen, I cannot complain,” Carpio told the JBC over the weekend during a closed-door interview, according to a well-placed source of The Manila Times inside the council.

He was bypassed several times for the position despite being the most senior magistrate in the Supreme Court (SC).

When Renato Corona was appointed Chief Justice in May 2010, Carpio did not apply for the position since he believed that it was a “midnight appointment” made by then-President Gloria Macapagal-Arroyo.

When Maria Lourdes Sereno was named as the country’s top magistrate in August 2012, he applied for the post but was bypassed by then- President Benigno Aquino 3rd.

When Sereno was ousted by the high court via quo warranto, Carpio also did not apply for the post.

Teresita Leonardo-de Castro was appointed as Chief Justice in September 2018 by President Rodrigo Duterte,

tapos si Carpio pa pala ang merong shortest judiciary experience among CJ candidates, kaya siguro ingay nya to get some support maybe? so balik ba sya ulit sa dati na walang pinagkaiba sa isang keyboard warrior regarding WPS dahil di naman sila responsible for doing the execution, basically isang mema lang? :lol:
